section or other provision of the Social Security Act.</text></section><section id="HDD8E6D8B6E06419A8F35CCBBE2D5DEBA"><enum>4.</enum><header>Helping more Americans enter and remain in the workforce</header><subsection id="H1BAAFC1AE6834E328B53A4192D228DE5"><enum>(a)</enum><header>Family assistance grants</header><text>Section 403(a)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/603">42 U.S.C. 603(a)(1)</external-xref>) is amended in each of subparagraphs (A) and (C) by striking <quote>2017 and 2018</quote> and inserting <quote>2026 through 2030</quote>.</text></subsection><subsection id="H423B20C787E8445C88001727F6D70424"><enum>(b)</enum><header>Healthy marriage promotion and responsible fatherhood grants</header><text display-inline="yes-display-inline">Section 403(a)(2)(D) (<external-xref legal-doc="usc" parsable-cite="usc/42/603">42 U.S.C. 603(a)(2)(D)</external-xref>) is amended—</text><paragraph id="H4EAEC8CEC433446FA20D1DFF81EACFE3"><enum>(1)</enum><text>by striking <quote>2017 and 2018</quote> and inserting <quote>2026 through 2030</quote>; and</text></paragraph><paragraph id="H8AA48FF212FE45389690B218B0D0729E"><enum>(2)</enum><text>by striking <quote>for fiscal year 2017 or 2018</quote>.</text></paragraph></subsection><subsection id="HB6F2312A5714496E83688E4AC2C44694"><enum>(c)</enum><header>Tribal grants</header><text display-inline="yes-display-inline">Section 412(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/612">42 U.S.C. 612(a)</external-xref>) is amended in each of paragraphs (1)(A) and (2)(A) by striking <quote>2017 and 2018</quote> and inserting <quote>2026 through 2030</quote>.</text></subsection><subsection id="H851E0EFD5DAA49EB9E4AC2447E3CDC61"><enum>(d)</enum><header>Grants to the territories</header><text display-inline="yes-display-inline">Section 1108(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/42/1308">42 U.S.C. 1308(b)(2)</external-xref>) is amended by striking <quote>2017 and 2018</quote> and inserting <quote>2026 through 2030</quote>.</text></subsection></section><section id="HF7A1703FFD87429C8559673F791A4992"><enum>5.</enum><header>Expecting universal engagement and case management</header><text display-inline="no-display-inline">Section 408(b) (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(b)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4FBAA202EED148788D3DB737E5E38EED"><subsection id="HB6AEC426BEFD4DACBE41511D6A71F043"><enum>(b)</enum><header>Individual opportunity plans</header><paragraph id="HCAE355C2D1DA43F3B8D01EAE144A60CA"><enum>(1)</enum><header>Assessment</header><text display-inline="yes-display-inline">The State agency responsible for administering the State program funded under this part shall make an initial assessment of the following for each work-eligible individual (as defined in the regulations promulgated pursuant to section 407(i)(1)(A)(i)):</text><subparagraph id="H7735512E6D29448689BFECE5CAF1CA5F"><enum>(A)</enum><text>The education obtained, skills, prior work experience, work readiness, and barriers to work of the individual.</text></subparagraph><subparagraph id="H2DBC1E27813D41B3BA4E40EF1F682EBF"><enum>(B)</enum><text display-inline="yes-display-inline">The well-being of the children in the family of the individual and, where appropriate, activities or services (such as services offered by a program funded under section 511) to improve the well-being of the children.</text></subparagraph></paragraph><paragraph id="HE69DE8FA300A45D8BA8206DDC5FE5A3D"><enum>(2)</enum><header>Contents of plans</header><text>On the basis of the assessment required by paragraph (1) of this subsection, the State agency, in consultation with the individual, shall develop an individual opportunity plan that—</text><subparagraph id="H955A24FD4EF347F0886F62060A9051E2"><enum>(A)</enum><text display-inline="yes-display-inline">includes a personal responsibility agreement in which the individual acknowledges receipt of publicly funded benefits and responsibility to comply with program requirements in order to receive the benefits;</text></subparagraph><subparagraph id="HDA0B07BF065048A79FB366F564E57EF5"><enum>(B)</enum><text>sets forth the obligations of the individual to participate in work activities (as defined in section 407(d)), and the number of hours per month for which the individual will so participate pursuant to section 407;</text></subparagraph><subparagraph id="H126F936671634CB18A6C5ED36DE97646"><enum>(C)</enum><text display-inline="yes-display-inline">sets forth an employment goal and planned short-, intermediate-, and long-term actions to achieve the goal, and, in the case of an individual who has not attained 24 years of age and is in secondary school or the equivalent, the intermediate action may be completion of secondary school or the equivalent;</text></subparagraph><subparagraph id="HC1C24E8007DC41249331D005C6269B28"><enum>(D)</enum><text>describes the job counseling and other services the State will provide to the individual to enable the individual to obtain and keep unsubsidized employment;</text></subparagraph><subparagraph id="H3DD5DD407EC34DA9886E42553137F0E8"><enum>(E)</enum><text>may include referral to appropriate substance abuse or mental health treatment; and</text></subparagraph><subparagraph id="H5B4FDDE455C94B63B56BEF4B3974FC2A"><enum>(F)</enum><text>is signed by the individual.</text></subparagraph></paragraph><paragraph id="H2FF679B1312747D4943C603AAD2A8FBB"><enum>(3)</enum><header>Timing</header><text display-inline="yes-display-inline">The State agency shall comply with paragraphs (1) and (2) with respect to a work-eligible individual—</text><subparagraph id="H6D4473998063475480C2D3FA2BB46F7D"><enum>(A)</enum><text display-inline="yes-display-inline">within 1 year after the effective date of this subsection, in the case of an individual who, as of such effective date, is a recipient of assistance under the State program funded under this part (as in effect immediately before such effective date); or</text></subparagraph><subparagraph id="H27E0BAE24B754EE5991D9FB9BF610BEA"><enum>(B)</enum><text>within 60 days after the individual is determined to be eligible for the assistance, in the case of any other individual.</text></subparagraph></paragraph><paragraph id="H4924BA743CD54ECBBA69B0D810E7899B"><enum>(4)</enum><header>Universal engagement</header><text display-inline="yes-display-inline">Subject to paragraph (3) of this subsection, each State shall require all work-eligible recipients receiving funds under the State program funded under this part to engage in work in accordance with the provisions of sections 407(c), 407(d), and 407(e).</text></paragraph><paragraph id="HB0BD07BCB82F45E1B8E4A4B937EE183B"><enum>(5)</enum><header>Penalty for noncompliance by individual</header><text display-inline="yes-display-inline">In addition to any other penalties required under the State program funded under this part, the State shall reduce, pursuant to section 407(e)(3), the amount of assistance otherwise payable under the State program to a family that includes an individual who fails without good cause to comply with an individual opportunity plan developed pursuant to this subsection, that is signed by the individual.</text></paragraph><paragraph id="HA036DF69D41C4E36B23AFAA461492B86"><enum>(6)</enum><header>Periodic review</header><text display-inline="yes-display-inline">The State shall meet with each work-eligible individual assessed by the State under paragraph (1), not less frequently than every 90 days, to—</text><subparagraph id="H53EC98A2C67742239CC116B7F841DF45"><enum>(A)</enum><text display-inline="yes-display-inline">review the individual opportunity plan developed for the individual, including the eligibility of the individual for benefits;</text></subparagraph><subparagraph id="H188C0CD16B97457FBB08D3BBDE908348"><enum>(B)</enum><text>discuss with the individual the progress made by the individual in achieving the goals specified in the plan; and</text></subparagraph><subparagraph id="HF3F727C3461C4731956252038444D5E3"><enum>(C)</enum><text>update the plan, as necessary, to reflect any changes in the circumstances of the individual since the plan was last reviewed.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H8B824B2AFF8F41FE92536DB93065C470"><enum>6.</enum><header>Promoting accountability by measuring work outcomes</header><subsection display-inline="no-display-inline" id="H77AE0B2D1FD9457E89C772AB4227E7C3"><enum>(a)</enum><header>In general</header><text>Section 407(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/607">42 U.S.C. 607(a)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H290570DC03EE40B09E86C3113EDD88A3"><subsection id="HDF2D9D6D080D486FADCB7CB6E19B3110"><enum>(a)</enum><header>Performance accountability and work outcomes</header><paragraph id="HBD341C29F5544DD98C05775A19990BF8"><enum>(1)</enum><header>Work outcomes</header><subparagraph id="H239530DFDC63476FADC680D140D2CA61"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A State to which a grant is made under section 403 shall achieve the requisite minimum level of performance for a fiscal year described in this paragraph with respect to the percentage of employment exits for families receiving assistance under the State program funded under this part, or be subject to penalty as described in section 409(a)(3).</text></subparagraph><subparagraph id="H67D51C8593524FC090A0D82380072BD4"><enum>(B)</enum><header>Calculation of percentage of employment exits</header><text>For purposes of this paragraph, the percentage of employment exits with respect to a State equals the ratio of the number of work-eligible individuals who are in unsubsidized employment 6 months after their exit to the average monthly number of families receiving assistance under the State program funded under this part.</text></subparagraph><subparagraph id="H44EC70D8E3464EA2A39288C685EE4B9F"><enum>(C)</enum><header>Agreement on requisite level of performance</header><text>The Secretary and the State shall negotiate the requisite level of performance for the State with respect to employment exits for each fiscal year beginning with fiscal year 2028.</text></subparagraph></paragraph><paragraph id="H150AEA218CFF4B0498AD0EB78BD47A46"><enum>(2)</enum><header>Performance accountability</header><subparagraph id="H4AA08EB0195748DE80C074478D502FC6"><enum>(A)</enum><header>Purpose</header><text>The purpose of this paragraph is to provide for the establishment of performance accountability measures to assess the effectiveness of States in increasing employment, retention, and advancement among families receiving assistance under the State program funded under this part.</text></subparagraph><subparagraph id="HA07EBA461CFC4221A2CEDB15D363CF98"><enum>(B)</enum><header>In general</header><text>A State to which a grant is made under section 403 for a fiscal year shall achieve the requisite level of performance on an indicator described in subparagraph (D) of this paragraph for the fiscal year.</text></subparagraph><subparagraph id="H18FF77907F45451DA6C9EDE6B93F5819"><enum>(C)</enum><header>Measuring state performance</header><text display-inline="yes-display-inline">Each State, in consultation with the Secretary, shall collect and submit to the Secretary the information necessary to measure the level of performance of the State for each indicator described in subparagraph (D), for fiscal year 2027 and each fiscal year thereafter, and the Secretary shall use the information collected for fiscal year 2027 to establish the baseline level of performance for each State for each such indicator.</text></subparagraph><subparagraph id="H607284F5ACA94E968CDCD1218A0B42E4"><enum>(D)</enum><header>Indicators of performance</header><text>The indicators described in this subparagraph, for a fiscal year, are the following:</text><clause id="H159B7785597C4F49B46D814223420E79"><enum>(i)</enum><text>The percentage of individuals who were work-eligible individuals as of the time of exit from the program, who are in unsubsidized employment during the 2nd quarter after the exit.</text></clause><clause id="H2BBC36302841477E868ED9A4E456E661"><enum>(ii)</enum><text display-inline="yes-display-inline">The percentage of individuals who were work-eligible individuals who were in unsubsidized employment in the 2nd quarter after the exit, who are also in unsubsidized employment during the 4th quarter after the exit.</text></clause><clause id="H5C9950C788814353A811457231DD8882"><enum>(iii)</enum><text display-inline="yes-display-inline">The median earnings of individuals who were work-eligible individuals as of the time of exit from the program, who are in unsubsidized employment during the 2nd quarter after the exit.</text></clause><clause id="HEB14AD04CE5240D098834DC3F3191381"><enum>(iv)</enum><text display-inline="yes-display-inline">The percentage of individuals who have not attained 24 years of age, are attending high school or enrolled in an equivalency program, and are work-eligible individuals or were work-eligible individuals as of the time of exit from the program, who obtain a high school degree or its recognized equivalent while receiving assistance under the State program funded under this part or within 1 year after the exit.</text></clause></subparagraph><subparagraph id="H9BE634376826406BA9EAAE83A563DEA8"><enum>(E)</enum><header>Levels of performance</header><clause id="H757500B861A94649AE927E86AB96F4DD"><enum>(i)</enum><header>In general</header><text>For each State submitting a State plan pursuant to section 402(a), there shall be established, in accordance with this subparagraph, levels of performance for each of the indicators described in subparagraph (D).</text></clause><clause id="HCA7036C7062C43D7A98ABDF662EF42FB"><enum>(ii)</enum><header>Weight</header><text>The weight assigned to such an indicator shall be the following:</text><subclause id="H60AAE8455C7F4204AFE51981796D7F34"><enum>(I)</enum><text>Forty percent, in the case of the indicator described in subparagraph (D)(i).</text></subclause><subclause id="H457B64B6D9154301B42678FC44E3BDDC"><enum>(II)</enum><text>Twenty-five percent, in the case of the indicator described in subparagraph (D)(ii).</text></subclause><subclause id="H35C9FE0AEEDD4B74A9ABC98BCF37BFEE"><enum>(III)</enum><text>Twenty-five percent, in the case of the indicator described in subparagraph (D)(iii).</text></subclause><subclause id="H3CEFAE7CB43F4FE9BE47737DBB00EACA"><enum>(IV)</enum><text>Ten percent, in the case of the indicator described in subparagraph (D)(iv).</text></subclause></clause><clause id="HF8AB2C6F3A034FD99A7A384C431717C8"><enum>(iii)</enum><header>Agreement on requisite performance level for each
 indicator</header><subclause id="HA56BC96F99A84E029B9B476D7472FD3F"><enum>(I)</enum><header>In general</header><text>The Secretary and the State shall negotiate the requisite level of performance for the State with respect to each indicator described in clause (ii), for each fiscal year beginning with fiscal year 2028, and shall do so before the beginning of the fiscal year involved.</text></subclause><subclause id="H2C85683E8D584100A0EA6FC25DE39271"><enum>(II)</enum><header>Requirements in establishing performance
 levels</header><text>In establishing the requisite levels of performance, the State and the Secretary shall—</text><item id="HDD84FDEF2D3742108B568185B0342E34"><enum>(aa)</enum><text>take into account how the levels involved compare with the levels established for other States; and</text></item><item id="HD625F5F0DCF0470CB7EF94D46FB1B26A"><enum>(bb)</enum><text>ensure the levels involved are adjusted, using the objective statistical model referred to in clause (v), based on—</text><subitem id="HA23777F05A2149848407D96EEF2A5372"><enum>(AA)</enum><text>the differences among States in economic conditions, including differences in unemployment rates or employment losses or gains in particular industries;</text></subitem><subitem id="HE2DF5EBACB6D4F929C365122A9E3A7D7"><enum>(BB)</enum><text>the characteristics of participants on entry into the program, including indicators of prior work history, lack of educational or occupational skills attainment, or other factors that may affect employment and earnings; and</text></subitem><subitem id="HE220366E096240778C797273877E2BD0"><enum>(CC)</enum><text>take into account the extent to which the levels involved promote continuous improvement in performance by each State.</text></subitem></item></subclause></clause><clause id="HFBAD8E62B78749B983726B9F482FA8DA"><enum>(iv)</enum><header>Revisions based on economic conditions and individuals
 receiving assistance during the fiscal year</header><text>The Secretary shall, in accordance with the objective statistical model referred to in clause (v), revise the requisite levels of performance for a State and a fiscal year to reflect the economic conditions and characteristics of the relevant individuals in the State during the fiscal year.</text></clause><clause id="H5309A5E5989A42A68C65430B59219EFF"><enum>(v)</enum><header>Statistical adjustment model</header><text>The Secretary shall use an objective statistical model to make adjustments to the requisite levels of performance for the economic conditions and characteristics of the relevant individuals, and shall consult with the Secretary of Labor to develop a model that is the same as or similar to the model described in section 116(b)(3)(A)(viii) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3141">29 U.S.C. 3141(b)(3)(A)(viii)</external-xref>).</text></clause><clause id="H4A60F2528FA5429EB779A9D35F359117"><enum>(vi)</enum><header>Definition of exit</header><text display-inline="yes-display-inline">In this paragraph, the term <term>exit</term> means, with respect to a State program funded under this part, ceases to a receive a benefit under the program.</text></clause></subparagraph><subparagraph display-inline="no-display-inline" id="H2E7827F20A3B4489B04CB3670E1555B1"><enum>(F)</enum><header>State option to establish common exit measures</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (E)(vi) of this paragraph, a State that has not provided the notification under section 121(b)(1)(C)(ii) of the Workforce Innovation and Opportunity Act to exclude the State program funded under this part as a mandatory one-stop partner may adopt an alternative definition of <quote>exit</quote> for the purpose of creating common exit measures to improve alignment with workforce programs operated under title I of such Act.</text></subparagraph><subparagraph id="H4E5EDEA132E84771ADBD2F1BA988235B"><enum>(G)</enum><header>Regulations</header><text display-inline="yes-display-inline">In order to ensure nationwide comparability of data, the Secretary, after consultation with the Secretary of Labor and with States, shall issue regulations governing the establishment of the performance accountability system under this paragraph and a template for performance reports to be used by all States consistent with subsection (b).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HDF4AD310D4524A67909E11615C7A1AA8"><enum>(b)</enum><header>Reports on state performance on HHS online dashboard</header><text display-inline="yes-display-inline">Section 407(b) (<external-xref legal-doc="usc" parsable-cite="usc/42/607">42 U.S.C. 607(b)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF298330D92394B8DB0E7AD0131DC4C3E"><subsection id="HCC0AF6D4B7294E7A8AC2E31E489D0994"><enum>(b)</enum><header>Publication of State performance</header><text>The Secretary shall, directly or through the use of grants or contracts, and in collaboration with each State, establish and operate an internet website that is accessible to the public, with a dashboard that is regularly updated and provides easy-to-understand information on the performance of each State program funded under this part, including a profile for each such program, expressed by use of a template, which shall include—</text><paragraph id="H983BF6786AB84ABE9BD6B91F5E933335"><enum>(1)</enum><text>information on the indicators and requisite performance levels established for the State under subsection (a), including, with respect to each such level, whether the State achieves, exceeds, or fails to achieve the level on an ongoing basis, including—</text><subparagraph id="HA3748B2816CF459188665D0BFE90A220"><enum>(A)</enum><text>information on any adjustments made to the requisite levels using the statistical adjustment model described in subsection (a)(2)(E)(v); and</text></subparagraph><subparagraph id="H11C1DA0166934901A12490C72A5E6DD2"><enum>(B)</enum><text display-inline="yes-display-inline">a grade based on the overall performance of the State, as determined by the Secretary and in consultation with the State, and the overall performance shall be graded based on the performance indicators and weights for each such indicator as described in subsection (a);</text></subparagraph></paragraph><paragraph id="HFF559F91EE1E44D4B1E1121076840A9D"><enum>(2)</enum><text>information reported under section 411 on the characteristics and demographics of individuals receiving assistance under the State program, including—</text><subparagraph id="HC13939C033A94E7F808D9FF66C33B493"><enum>(A)</enum><text>the number and percentage of child-only cases and reason why the cases are child-only; and</text></subparagraph><subparagraph id="H6CA1E7941D454E099EF4F9A6E7E756C7"><enum>(B)</enum><text>the average weekly number of hours that each work-eligible individual in the State program participates in work activities, including a separate section showing the number and percentage of the work-eligible individuals with zero hours of the participation and the reason for non-participation;</text></subparagraph></paragraph><paragraph id="H427D8122A6274961AFF0B2C6CBAB31CD"><enum>(3)</enum><text>information on the results of improper payments reviews;</text></paragraph><paragraph id="H08764026B01D45298D5E49FEFB6AB181"><enum>(4)</enum><text>a link to the State plan approved under section 402; and</text></paragraph><paragraph id="H80EBB82D31CB4D94AB9479D05313BBF1"><enum>(5)</enum><text>information regarding any penalty imposed, or other corrective action taken, by the Secretary against a State for failing to achieve a requisite performance level or any other requirement imposed by or under this part.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0938D0AE6F0B40FBB26CA61E024975F8"><enum>(c)</enum><header>Modification of rules for determining whether an individual is engaged in
 work</header><text>Section 407(c) (<external-xref legal-doc="usc" parsable-cite="usc/42/607">42 U.S.C. 607(c)</external-xref>) is amended—</text><paragraph id="H391F296C3892471C912F3475A2931F3F"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="H0C2D432EA44643EA89EF4094894A4DE9"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="HF7842F1F26DA413CBD6BB2C9C5D82DA1"><enum>(i)</enum><text>by striking <quote>For purposes of subsection (b)(1)(B)(i), a</quote> and inserting <quote>A</quote>; and</text></subparagraph><subparagraph id="H39FD6E48B11047A8A80AFB3447F7BE24"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H99206AB955C047DF9E9CE937F33452A9"><subparagraph id="H10E82F20D6FB4E61BF699975B09B8269"><enum>(C)</enum><header>State option for participation requirement exemptions</header><text display-inline="yes-display-inline">For any fiscal year, a State may, at its option, not require an individual who is a single custodial parent caring for a child who has not attained 12 months of age to engage in work, for not more than 12 months.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H7A41E5A3AB7944E2BA22709FF141BC23"><enum>(d)</enum><header>Modifications to allowable work activities</header><text>Section 407(d) (<external-xref legal-doc="usc" parsable-cite="usc/42/607">42 U.S.C. 607(d)</external-xref>) is amended—</text><paragraph id="HABECC958F8114F8888515C390FE43558"><enum>(1)</enum><text>in paragraph (5), by inserting <quote>, including apprenticeships</quote> before the semicolon;</text></paragraph><paragraph id="H5DA863F8C2724F00B7B73E2D3E6F9FB3"><enum>(2)</enum><text>in paragraph (6), by inserting <quote>supervised</quote> before <quote>job search</quote>; and</text></paragraph><paragraph id="H2CEF17D3AAB141A2BBE7205CE2D2FD9B"><enum>(3)</enum><text>in paragraph (8), by striking <quote>(not to exceed 12 months with respect to any individual)</quote> and inserting <quote>, including career technical education</quote>.</text></paragraph></subsection><subsection display-inline="no-display-inline" id="H8127F74907814138ABF7DA2FD5A2769D"><enum>(e)</enum><header>Penalty against States</header><paragraph id="H6D794659A1414845B332F23C39DD36D0"><enum>(1)</enum><header>In general</header><text>Section 409(a)(3) (<external-xref legal-doc="usc" parsable-cite="usc/42/609">42 U.S.C. 609(a)(3)</external-xref>) is amended by striking all that precedes subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDA850324CCB84425AD4E5B9311F6723F"><paragraph id="H35066A7F5E8049F990E80E32156FFE55"><enum>(3)</enum><header>Failure to satisfy work outcomes and work engagement</header><subparagraph id="HBBA96E24806342AFB045CE2CA265F7AD"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If the Secretary determines that a State to which a grant is made under section 403 for a fiscal year has failed to comply with any of section 407(a)(1), section 408(b)(3), or section 408(b)(4) for the fiscal year, the Secretary shall reduce the grant payable to the State under section 403(a)(1) for the immediately succeeding fiscal year by an amount equal to the applicable percentage of the State family assistance grant.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H63C14CD0999B4D2FAAA157D6D97B2C0A"><enum>(2)</enum><header>Transition rule</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services may not impose a penalty under section 409(a)(3) of the Social Security Act by reason of the failure of a State to comply with section 407(a) of such Act for any fiscal year before fiscal year 2027.</text></paragraph></subsection><subsection id="H95B54457A977475084E6B3E62F3622FD"><enum>(f)</enum><header>Pro rata reduction of assistance for individual noncompliance</header><text>Section 407(e) (<external-xref legal-doc="usc" parsable-cite="usc/42/607">42 U.S.C. 607(e)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB601250F8E6549DCAF11A1F5F4DF1143"><paragraph id="H585D4A96F7AB4C7F9A3F483D7A3CB7A3"><enum>(3)</enum><header>Pro rata reduction</header><text display-inline="yes-display-inline">For purposes of paragraph (1)(A), the amount of a pro rata reduction in assistance shall be determined by multiplying the total amount of monthly assistance that would, in the absence of the application of this paragraph, be paid to the entire family, by the ratio of—</text><subparagraph id="H9D671A5E2F6344FFA40E7F2C54DA968C"><enum>(A)</enum><text>the number of hours of required work activities as designated in subsection (d) actually performed by the individual during the month; to</text></subparagraph><subparagraph id="HDA150A1233884F0A9990B63FD1C6BB62"><enum>(B)</enum><text>the number of hours of work activities that the individual was required to perform during the month in accordance with subsection (c).</text></subparagraph></paragraph><paragraph id="H32526D1C3D0043779DF8196AC8F44BA8"><enum>(4)</enum><header>Penalties and engagement</header><subparagraph id="HC4A8A4C9A3574BC28DC23AAE71C5574B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to the limitation in (B), if in a given month an individual who received assistance under this part was required to engage in work under section 408(b)(4), failed to fulfill those obligations and was subsequently sanctioned in accordance with section 407(e)(2) and (3), that individual shall be judged to be engaged in work for that month for purposes of section 408(b)(4).</text></subparagraph><subparagraph id="H302A46CE2BC94818A7999C2B94E5FE02"><enum>(B)</enum><header>Limitation</header><text>If an individual receives no benefits for two consecutive months due to sanctioning under section 407(e)(2) and (3), that individual shall not be counted as engaged in work in subsequent months for purposes of section 408(b)(4) unless actual work in accordance with section 407(d) was resumed.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7BAB894795924A849FEDBEE885244A0B"><enum>(g)</enum><header>Conforming amendment</header><text>The heading of section 412(c) (<external-xref legal-doc="usc" parsable-cite="usc/42/612">42 U.S.C. 612(c)</external-xref>) is amended by striking <quote><header-in-text level="subsection" style="OLC">Minimum Work Participation Requirements</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Requirements for work outcome measures</header-in-text></quote>.</text></subsection></section><section id="H06ED61D504C64C1EA56B7E28F757E047"><enum>7.</enum><header>Targeting funds to truly needy families</header><subsection id="H11CE5C5139A342AB842D073BAE2B5A4F"><enum>(a)</enum><header>Prohibition on use of funds for families with income greater than twice the
 poverty line</header><text display-inline="yes-display-inline">Section 404(k) (<external-xref legal-doc="usc" parsable-cite="usc/42/604">42 U.S.C. 604(k)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB5E1782BA67244CC81BBE697F3D84371"><subsection id="H2E0A7E07F9224B3089AAF784EB50B543"><enum>(k)</enum><header>Prohibitions</header><paragraph id="H104F17481C7C4F289FEBCEAA210A212B"><enum>(1)</enum><header>Use of funds for persons with income greater than twice the
 poverty line</header><text display-inline="yes-display-inline">A State to which a grant is made under this part shall not use the grant to provide any assistance or services to a family whose monthly income exceeds twice the poverty line (as defined by the Office of Management and Budget, and revised annually in accordance with section 673(2) of the Omnibus Budget Reconciliation Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902(2)</external-xref>)).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF03BF6EF2A8F4A1A9F71AFC2EB986527"><enum>(b)</enum><header>Reduction of limitation of use funds for administrative activities</header><paragraph id="HB7FCA37C9BDE45EE9CCF0BA8EB57BF8C"><enum>(1)</enum><header>Use of grants</header><text>Section 404(b) (<external-xref legal-doc="usc" parsable-cite="usc/42/604">42 U.S.C. 604(b)</external-xref>) is amended—</text><subparagraph id="H36CD653C38264E8CAD9D5F8A94FDD4C8"><enum>(A)</enum><text>in paragraph (1), by striking <quote>15</quote> and inserting <quote>10</quote>; and</text></subparagraph><subparagraph id="HA84F4E6C0DE946FE95ED2EA7A9D5F3B9"><enum>(B)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4D17FB0D9DBF4D1881E9FF044EDAC5D1"><paragraph id="HBE205E9B03D64BC2AC113133C5EBEEAE"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply to the use of a grant for—</text><subparagraph id="H9153A738CC0E4ED99A6A16B77288DE66"><enum>(A)</enum><text>information technology and computerization needed for tracking or monitoring required by or under this part; or</text></subparagraph><subparagraph id="HCB26AD2E7AC44068A588F7752BFDACA8"><enum>(B)</enum><text>case management necessary to assist an individual in developing an individual opportunity plan under section 408(b).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HE2FCAAF5F14044AAAFD7A71D1427F6EA"><enum>(2)</enum><header>Penalties</header><text>Section 409(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/609">42 U.S.C. 609(a)</external-xref>) is amended—</text><subparagraph id="H231F799F41A54C2B9BE15490DFB8C727"><enum>(A)</enum><text>in paragraph (7)(B)(i)(I)(dd), by striking <quote>15</quote> and inserting <quote>10</quote>; and</text></subparagraph><subparagraph id="H2DF9C2BD63B248BDAD824F54A55FC46F"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9B26FADB5EEF423086A0B82F8D676CC6"><paragraph id="H4891DDF481984BBCB8ACE7288428251C"><enum>(17)</enum><header>Penalty for failure to comply with administrative limitation</header><text display-inline="yes-display-inline">If the Secretary determines that a State to which a grant is made under section 403 for a fiscal year has failed to comply with section 404(b) for the fiscal year, the Secretary shall reduce the grant payable to the State under section 403(a)(1) for the immediately succeeding fiscal year by an amount equal to not more than 5 percent of the State family assistance grant.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H4006939BA5CE4744ABECE44D1764853A"><enum>(c)</enum><header>Prohibition on use of funds for direct spending on child care services or
 activities</header><text display-inline="yes-display-inline">Section 404(k) (<external-xref legal-doc="usc" parsable-cite="usc/42/604">42 U.S.C. 604(k)</external-xref>), as amended by subsection (a) of this section, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4A43FEC114CF45D0BDB9472BED59B270"><paragraph id="HD8A18C03428E4789B6AC4C7E495F909B"><enum>(2)</enum><header>Direct spending on child care services or activities</header><text display-inline="yes-display-inline">A State to which a grant is made under this part shall not use the grant for direct spending on child care and other early childhood education programs, services, or activities.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HBE5404FFB8CA4A769438EA8D822254B2"><enum>(d)</enum><header>Expansion of authority To transfer funds</header><text>Section 404(d) (<external-xref legal-doc="usc" parsable-cite="usc/42/604">42 U.S.C. 604(d)</external-xref>) is amended by striking paragraphs (1) through (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE336473187444635B746B1B5CF1EAB44"><paragraph id="HFACDE5C4E3894821851237152C963444"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A State may transfer not more than 50 percent of the grant made to the State under section 403(a)(1) to a State program pursuant to any or all of the following provisions of law:</text><subparagraph id="H17A41E2941C54DACB712C8B3BB5F27AE"><enum>(A)</enum><text>The Child Care and Development Block Grant Act of 1990.</text></subparagraph><subparagraph id="H5A29225E2D2A464187F6278161135123"><enum>(B)</enum><text display-inline="yes-display-inline">Title I of the Workforce Innovation and Opportunity Act.</text></subparagraph></paragraph><paragraph id="H49576E8CD4B54A9EA353F05D0FDCC10C"><enum>(2)</enum><header>Applicable rules</header><subparagraph id="H850F0405C3BD4294A7C7E44E2A811559"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B) of this paragraph, any amount paid to a State under this part that is used to carry out a State program pursuant to a provision of law specified in paragraph (1) shall not be subject to the requirements of this part, but shall be subject to the requirements that apply to Federal funds provided directly under the provision of law to carry out the program, and the expenditure of any amount so used shall not be considered to be an expenditure under this part.</text></subparagraph><subparagraph id="H4ED03053A67C49828CBBE9732F2F6A5A"><enum>(B)</enum><header>Funds transferred to the WIOA</header><text display-inline="yes-display-inline">In the case of funds transferred under paragraph (1)(B) of this subsection—</text><clause id="H508DE9E22632452E8950495C1C4B45C1"><enum>(i)</enum><text display-inline="yes-display-inline">the State shall provide an assurance that the funds will be used to support individuals eligible for assistance or services under this part pursuant to subsection (k)(1); and</text></clause><clause id="H044778BEFA2842DFBC51F372A516770B"><enum>(ii)</enum><text>not more than 15 percent of the funds will be reserved for statewide workforce investment activities referred to in section 128(a)(1) of the Workforce Innovation and Opportunity Act.</text></clause></subparagraph></paragraph><paragraph id="H062DD499FEB441D6826CDAF649EDEB4C"><enum>(3)</enum><header>WIOA transfer authority not available to States excluding the State
 TANF program as a mandatory one-stop partner under the WIOA</header><text display-inline="yes-display-inline">The authority provided by paragraph (1)(B) of this subsection may not be exercised by a State that has provided the notification referred to in section 407(a)(2)(F).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H203DFC0E881243649FFCE85EC165F0A0"><enum>8.</enum><header>Targeting funds to core purposes</header><subsection id="H9436D932D23E42209DF97368CDB891F5"><enum>(a)</enum><header>Requirement that States reserve <enum-in-header>25</enum-in-header> percent
 of grant for spending on core activities</header><text display-inline="yes-display-inline">Section 408(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H408E50E890704F3694965347CB8710C1"><paragraph id="H2ECAAAA042694735BA9689BE03FBCA4D"><enum>(13)</enum><header>Requirement that States reserve <enum-in-header>25</enum-in-header>
 percent of grant for spending on core activities</header><text display-inline="yes-display-inline">A State to which a grant is made under section 403(a)(1) for a fiscal year shall expend not less than 25 percent of the grant on work supports, education and training, apprenticeships, non-recurring short-term benefits, work activities (as defined in section 407(d)), and case management necessary to assist an individual in developing an individual opportunity plan under section 408(b).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HFD8423D99BF645F1A066785B41F329D7"><enum>(b)</enum><header>Requirement that at least <enum-in-header>25</enum-in-header> percent of
 qualified State expenditures be for core activities</header><text>Section 408(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)</external-xref>), as amended by subsection (a) of this section, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H61EC292BE44A4925AF5D91EE764D1179"><paragraph id="H6F4FC38B9BA94D6EB2701558A6025BB3"><enum>(14)</enum><header>Requirement that at least <enum-in-header>25</enum-in-header>
 percent of qualified State expenditures be for core activities</header><text display-inline="yes-display-inline">Not less than 25 percent of the qualified State expenditures (as defined in section 409(a)(7)(B)(ii)) of a State during the fiscal year shall be for work supports, education and training, apprenticeships, non-recurring short-term benefits, work activities (as defined in section 407(d)), and case management necessary to assist an individual in developing an individual opportunity plan under section 408(b).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section display-inline="no-display-inline" id="H3EC8CCA590DF4FE88CE8D85F7C8C8F10"><enum>9.</enum><header>Strengthening program integrity by measuring improper payments</header><subsection id="H0848D675BD62497292C76C5A278390F7"><enum>(a)</enum><header>Applicability of improper payments laws</header><text display-inline="yes-display-inline">Section 404 (<external-xref legal-doc="usc" parsable-cite="usc/42/604">42 U.S.C. 604</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H269D1C58623C4A9A960D96D9503DEAA7"><subsection id="HE3EEEC286530485EABD28969206A565C"><enum>(l)</enum><header>Applicability of improper payments laws</header><paragraph id="H15117B151E3345D29C90D8CA3B9FDE06"><enum>(1)</enum><header>In general</header><text>The Improper Payments Information Act of 2002 and the Improper Payments Elimination and Recovery Act of 2010 shall apply to a State in respect of the State program funded under this part in the same manner in which such Acts apply to a Federal agency.</text></paragraph><paragraph id="HEB664ABB77144172A5C38612A82CA41A"><enum>(2)</enum><header>Regulations</header><text>Within 2 years after the date of the enactment of this subsection, the Secretary shall prescribe regulations governing how a State reviews and reports improper payments under the State program funded under this part.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCC4887AE5F2C4044B38BF6FAA5EA9559"><enum>(b)</enum><header>Report to Congress</header><text>Within 1 year after the date of the enactment of this Act, the Secretary of Health and Human Services shall submit to the Congress a written report that contains a plan to reduce or eliminate improper payments made by States under part A of title IV of the Social Security Act within 10 years.</text></subsection></section><section id="H47A847B994DA406896B2FC7454AE7AA8"><enum>10.</enum><header>Prohibition on State diversion of Federal funds to replace State
 spending</header><text display-inline="no-display-inline">Section 408(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)</external-xref>), as amended by section 8 of this Act, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HEACE9109382A4073A1CA5B74219D437A"><paragraph id="H717C0CE1DB17433E81100BDFE75F3C70"><enum>(15)</enum><header>Non-supplantation requirement</header><text display-inline="yes-display-inline">Funds made available to a State under this part shall be used to supplement, not supplant, State general revenue spending on activities described in section 404.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H9E0CDB62F98647CAA17913EA4DA74604"><enum>11.</enum><header>Inclusion of poverty reduction as a program purpose</header><text display-inline="no-display-inline">Section 401(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601(a)</external-xref>) is amended—</text><paragraph id="H01A6954F9DD54E63A6C58FF71E984C02"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (3);</text></paragraph><paragraph id="HB80067384E334ADB98D15C74BB56ED19"><enum>(2)</enum><text>by striking the period at the end of paragraph (4) and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H8345FFBC9A9F40D5B94AF4E849624CF3"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3D2392E41D2E4A8F8B9A503635069894"><paragraph id="H1A5DFB5329B64035A41C9086F3EDC176"><enum>(5)</enum><text display-inline="yes-display-inline">reduce child poverty by increasing employment entry, retention, and advancement of needy parents.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section display-inline="no-display-inline" section-type="subsequent-section" id="H5953F122727745609612BAF56601207B"><enum>12.</enum><header>Strengthening accountability through HHS approval of State plans</header><subsection id="H8CE376BE0CBD497E8C4CF66D925A2946"><enum>(a)</enum><header>In general</header><text>Section 402 (<external-xref legal-doc="usc" parsable-cite="usc/42/602">42 U.S.C. 602</external-xref>) is amended—</text><paragraph id="H6C571A5F0CD44E20800D20CAEDEC3924"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H9235CC34852A4762BB97240900292499"><enum>(A)</enum><text>in the matter preceding paragraph (1)—</text><clause id="H73C425D9700741CDADD3E3CAA30BD7E4"><enum>(i)</enum><text>by striking <quote>27-month</quote> and inserting <quote>24-month</quote>; and</text></subclause><subclause id="HF0434A2A2CF545338438DC8A03387C7F"><enum>(III)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB41F0B2F4C524C6E844E6EB170C121BA"><clause id="H4BF6444F53EC4D149D108349D60006CD"><enum>(viii)</enum><text display-inline="yes-display-inline">Describe the case management practices of the State with respect to the requirements of section 408(b), provide a copy of the form or forms that will be used to assess a work-eligible individual (as so defined) and prepare an individual opportunity plan for the individual, describe how the State will ensure that such a plan is reviewed in accordance with section 408(b)(6), and describe how the State will measure progress under the plan.</text></clause><clause id="H07B0A96610B24407B5D4357808FA047A"><enum>(ix)</enum><text>Propose the requisite levels of performance for the State for purposes of section 407(a) for each year in the 2-year period referred to in subsection (d) of this section, and provide an explanation with supporting data of why each such level is appropriate.</text></clause><clause id="H767B2AE3E2EE45A48B245618B5DCA44D"><enum>(x)</enum><text>Describe how the State will engage low-income noncustodial parents who owe child support and how such a parent will be provided with access to work support and other services under the program to which the parent is referred to support their employment and advancement.</text></clause><clause id="H16B72CCE12164D63BCAD8F253D9839E5"><enum>(xi)</enum><text>Describe how the State will comply with improper payments provisions in section 404(l).</text></clause><clause id="HA3DEBBFE0F6B4D1ABB65B619DAFD7043"><enum>(xii)</enum><text>Describe coordination with other programs, including whether the State intends to exercise authority provided by section 404(d) of this Act to transfer any funds paid to the State under this part, provide assurance that, in the case of a transfer to carry out a program under title I of the Workforce Innovation and Opportunity Act, the State will comply with section 404(d)(3)(B) of this Act and coordinate with the one-stop delivery system under the Workforce Innovation and Opportunity Act, and describe how the State will coordinate with the programs involved to provide services to families receiving assistance under the program referred to in paragraph (1) of this subsection.</text></clause><clause id="H451B0C49F54144999850BE00732A7A91"><enum>(xiii)</enum><text>Describe how the State will promote marriage, such as through temporary disregard of the income of a new spouse when an individual receiving assistance under the State program marries so that the couple doesn’t automatically lose benefits due to marriage.</text></clause><clause id="H1871C8371B704B69B89B7A835A4E4FD5"><enum>(xiv)</enum><text display-inline="yes-display-inline">Describe how the State will allow for a transitional period of benefits, such as through temporary earned income disregards or a gradual reduction in the monthly benefit amount, for an individual receiving assistance who obtains employment and becomes ineligible due to an increase in income obtained through employment or through an increase in wages.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause><clause id="H37C45A782AFC4690986468EC5688A92F"><enum>(ii)</enum><text>in subparagraph (B), by striking clauses (iv) and (v);</text></clause></subparagraph></paragraph><paragraph id="HCC336A3C39CB45308C82313E8C3B48C8"><enum>(2)</enum><text>by striking subsection (c) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA92FAE5E4DFA487199FAC9F386615C55"><subsection id="H68244BB9B7174A84A26232590D348C60"><enum>(c)</enum><header>Public availability of State plans</header><text display-inline="yes-display-inline">The Secretary shall make available to the public, on the website described in section 407(b), a link to any plan or plan amendment submitted by a State under this subsection.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H4C7CBD1787F94AB9A6AA057B2D1370A0"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H77151F7ABF7E43BA9FF3BC592ED154AB"><subsection display-inline="no-display-inline" id="HE565B5F6C05E4156B57B380FA9C6B5CF"><enum>(d)</enum><header>2-Year plan</header><text>A plan submitted pursuant to this section shall be designed to be implemented during a 2-year period.</text></subsection><subsection id="H685523BC9CAF4AF89DC94AA2B67D8CB3"><enum>(e)</enum><header>Combined plan allowed</header><text>A State may submit to the Secretary and the Secretary of Labor a combined State plan that—</text><paragraph id="HA5D37020885842499B02D90736D002E8"><enum>(1)</enum><text>meets the requirements of subsections (a) and (d); and</text></paragraph><paragraph id="HEF416276A8E2445E850A5929A5A7D24D"><enum>(2)</enum><text>is for programs and activities under the Workforce Innovation and Opportunity Act.</text></paragraph></subsection><subsection id="HBDDDA35516074341BE7DD2EB185BBBCE"><enum>(f)</enum><header>Approval of plans</header><text>The Secretary shall approve any plan submitted pursuant to this section that meets the requirements of subsections (a) through (d).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7CF6CD6C9788476AB5C922DB946E71CF"><enum>(b)</enum><header>Duties of the Secretary</header><paragraph id="H9E87DBA4AE9447DA9905D99B44634DF6"><enum>(1)</enum><header>Coordination of activities; dissemination of information</header><text display-inline="yes-display-inline">Section 416 (<external-xref legal-doc="usc" parsable-cite="usc/42/616">42 U.S.C. 616</external-xref>) is amended—</text><subparagraph id="H8A6963E42B164DBEB545F33FCF0D7120"><enum>(A)</enum><text>by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general.—</header-in-text></quote> before <quote>The programs</quote>; and</text></subparagraph><subparagraph id="H0650D0F7989749C5829C06143F8A5B6F"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4AC0932DB3304C949EDA1C717E1FF6F9"><subsection id="HD2D49419C5E14D49BE0DE0C123074B86"><enum>(b)</enum><header>Coordination of activities</header><text display-inline="yes-display-inline">The Secretary shall coordinate all activities of the Department of Health and Human Services relating to work activities (as defined in section 407(d)) and requirements and measurement of employment outcomes, and, to the maximum extent practicable, coordinate the activities of the Department in this regard with similar activities of other Federal entities.</text></subsection><subsection id="H2E1F086BA27D46ADA17B2651CABA7D53"><enum>(c)</enum><header>Dissemination of information</header><text display-inline="yes-display-inline">The Secretary shall disseminate, for voluntary informational purposes, information on practices that scientifically valid research indicates are most successful in improving the quality of State and tribal programs funded under this part.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H43E7CFADA78A4552AB2CA8E158B1F00F"><enum>(c)</enum><header>Technical assistance</header><paragraph id="H1EFEFC9E61C54473825E15F88070AC48"><enum>(1)</enum><header>In general</header><text>Section 406 (<external-xref legal-doc="usc" parsable-cite="usc/42/606">42 U.S.C. 606</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE9184DAD9C414989BA73EBC431D635E4"><section id="H0A45C843D8074476949A7EFE50F68FA0"><enum>406.</enum><header>Technical assistance</header><subsection id="H6209ED280C744C63AFDB36F941E6A5DF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall provide technical assistance to States and Indian tribes (which may include providing technical assistance on a reimbursable basis), which shall be provided by qualified experts on practices grounded in scientifically valid research, where appropriate, to support activities related to the publication of State performance under section 407(b) and to carry out State and tribal programs funded under this part.</text></subsection><subsection id="HFF01A4AD23E345BC8511121EC3AC65EA"><enum>(b)</enum><header>Publication of State performance</header><text>The Secretary may use funds reserved under this section to carry out section 407(b).</text></subsection><subsection id="H7AB54EDC929C42D09968245A0C373276"><enum>(c)</enum><header>Reservation of funds</header><text display-inline="yes-display-inline">The Secretary shall reserve not more than $25,000,000 of the amount appropriated by section 403(a)(1)(C) for a fiscal year to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H8545FF284E264438BA24861AAFFA94CE"><enum>(2)</enum><header>Conforming amendment</header><text>Section 403(a)(1)(B) (<external-xref legal-doc="usc" parsable-cite="usc/42/603">42 U.S.C. 603(a)(1)(B)</external-xref>) is amended by inserting <quote>and the amount specified in section 406(b)</quote> after <quote>section 413(h)(1)</quote>.</text></paragraph></subsection></section><section id="HF6273E470B7B45A2848659F5B1006717"><enum>13.</enum><header>Aligning and improving data reporting</header><subsection id="H9988B9BAE412444B92FEA97CF4FBE2AD"><enum>(a)</enum><header>Requirement that States report full-Population data</header><text display-inline="yes-display-inline">Section 411(a)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/611">42 U.S.C. 611(a)(1)</external-xref>) is amended—</text><paragraph id="H43F979A5D53347FE9AFB80EA65D57549"><enum>(1)</enum><text>by striking subparagraph (B);</text></paragraph><paragraph id="H03AFFCAC16F448BC93A2706A4ABDED18"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>(1) <header-in-text level="paragraph" style="OLC">General reporting requirement.—</header-in-text></quote>; and</text></clause><clause id="HDF7653AE9ED34DC88EE6BC5BEAB9828B"><enum>(ii)</enum><text>in the case of each individual in the family who is not a work-eligible individual (as so defined), the reason for that status.</text></clause></subparagraph><subparagraph id="H30C8892499004E198C1003147C3D6CF8"><enum>(L)</enum><text>For each work-eligible individual (as so defined) and each adult in the family who did not participate in work activities (as so defined) during a month, the reason for the lack of participation.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2EF01BA1ECA44C999DAEEF2F80143D04"><enum>(c)</enum><header>Reporting of information on employment and earnings outcomes</header><text>Section 411(c) (<external-xref legal-doc="usc" parsable-cite="usc/42/611">42 U.S.C. 611(c)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5B005A18D1EA469CB49831AED57E322D"><subsection id="H418C1E98816A4E619BCD8E3A96D333D0"><enum>(c)</enum><header>Reporting of information on employment and earnings outcomes</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of Labor, shall determine the information that is necessary to compute the employment and earnings outcomes and the statistical adjustment model for the employment and earnings outcomes required under section 407, and each eligible State shall collect and report that information to the Secretary.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section display-inline="no-display-inline" section-type="subsequent-section" id="HC7C4CB9D921F4013BA4408A1B518EB44"><enum>14.</enum><header>Technical corrections to data exchange standards to improve program
 coordination</header><subsection id="H8037EF6296314553B2BC9D7A8BE345CB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 411(d) (<external-xref legal-doc="usc" parsable-cite="usc/42/611">42 U.S.C. 611(d)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6073086E84A94E388B41FF8FA598E41C"><subsection id="H82B06218A307466396FDCA563E78A306"><enum>(d)</enum><header>Data exchange standards for improved interoperability</header><paragraph id="H5E691C5B4304464DB7DB64A3468CD46C"><enum>(1)</enum><header>Designation</header><text display-inline="yes-display-inline">The Secretary shall, in consultation with an interagency work group established by the Office of Management and Budget and considering State government perspectives, by rule, designate data exchange standards to govern, under this part—</text><subparagraph id="H66ADCA1554B0471D856ADE3DC0CBCA25"><enum>(A)</enum><text display-inline="yes-display-inline">necessary categories of information that State agencies operating programs under State plans approved under this part are required under applicable Federal law to electronically exchange with another State agency; and</text></subparagraph><subparagraph id="HF23FD607294548BCA964643C5B3BE560"><enum>(B)</enum><text>Federal reporting and data exchange required under applicable Federal law.</text></subparagraph></paragraph><paragraph id="HD64EFE0ACED14B559E57AC39BB517D23"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">The data exchange standards required by paragraph (1) shall, to the extent practicable—</text><subparagraph id="HF17C84991F144290BEBF190F00296914"><enum>(A)</enum><text display-inline="yes-display-inline">incorporate a widely accepted, non-proprietary, searchable, computer-readable format, such as the eXtensible Markup Language;</text></subparagraph><subparagraph id="H5DB52068079C4FCD80948ABE8CC346A1"><enum>(B)</enum><text>contain interoperable standards developed and maintained by intergovernmental partnerships, such as the National Information Exchange Model;</text></subparagraph><subparagraph id="H3828BB09CB6542328862E51F9E9A3BC8"><enum>(C)</enum><text>incorporate interoperable standards developed and maintained by Federal entities with authority over contracting and financial assistance;</text></subparagraph><subparagraph id="HF30B08AFE6984A27A5242E37328699F0"><enum>(D)</enum><text>be consistent with and implement applicable accounting principles;</text></subparagraph><subparagraph id="H9C7EAB50202448A0BB1AF39E9FFD563D"><enum>(E)</enum><text>be implemented in a manner that is cost-effective and improves program efficiency and effectiveness; and</text></subparagraph><subparagraph id="HB9716176063845258C12E66E59338265"><enum>(F)</enum><text>be capable of being continually upgraded as necessary.</text></subparagraph></paragraph><paragraph id="H338C4DDD5C4F4C97ABB9ACB644FE0138"><enum>(3)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to require a change to existing data exchange standards found to be effective and efficient.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H12C86C6A2D4F436F85F5F0C06AC62C24"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">Not later than the date that is 24 months after the date of the enactment of this section, the Secretary of Health and Human Services shall issue a proposed rule that—</text><paragraph id="HB01CE33686474FB9B61E9A6BEEE26900"><enum>(1)</enum><text>identifies federally required data exchanges, include specification and timing of exchanges to be standardized, and address the factors used in determining whether and when to standardize data exchanges; and</text></paragraph><paragraph id="H8C156C2AE1E440B99CF39AE326CA6EEC"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HFC23293A662E4279B0B83AB2D45AFD8D"><clause id="H4390C3D0270B45F78CF1A7456863840B"><enum>(iv)</enum><text display-inline="yes-display-inline">any establishment that offers marihuana (as defined in section 102 of the Controlled Substances Act) for sale.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HB0CCD53ACB68467DAAEB179BCC4398AA"><enum>17.</enum><header>Definitions related to use of funds</header><text display-inline="no-display-inline">Section 419 (<external-xref legal-doc="usc" parsable-cite="usc/42/619">42 U.S.C. 619</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAC0359BCACE842AE99F0683E3FCBF147"><paragraph id="H4B59C50FD9994646A529A647EBB1F48A"><enum>(6)</enum><header>Assistance</header><text display-inline="yes-display-inline">The term <term>assistance</term> means cash, payments, vouchers, and other forms of benefits designed to meet a family's ongoing basic needs (such as for food, clothing, shelter, utilities, household goods, personal care items, and general incidental expenses).</text></paragraph><paragraph id="H260797F1777F42988CB2D64A278C2C42"><enum>(7)</enum><header>Work supports</header><text display-inline="yes-display-inline">The term <term>work supports</term> means assistance and non-assistance transportation benefits (such as the value of allowances, bus tokens, car payments, auto repair, auto insurance reimbursement, and van services) provided in order to help families obtain, retain, or advance in employment, participate in work activities (as defined in section 407(d)), or as a non-recurrent, short-term benefit, including goods provided to individuals in order to help them obtain or maintain employment (such as tools, uniforms, fees to obtain special licenses, bonuses, incentives, and work support allowances and expenditures for job access).</text></paragraph><paragraph id="HB11B1C7ECE764275A863EE9BF0E25640"><enum>(8)</enum><header>Supportive services</header><text>The term <term>supportive services</term> means services such as domestic violence services, and mental health, substance abuse and disability services, housing counseling services, and other family supports, except to the extent that the provision of the service would violate section 408(a)(6).</text></paragraph><paragraph commented="no" id="H8BB0D9037E17440087363AA0F54502A5"><enum>(9)</enum><header>TANF benefit</header><text>The term <term>TANF benefit</term> means—</text><subparagraph commented="no" id="H6230182FB6F34A4C9FE54E278786AA89"><enum>(A)</enum><text display-inline="yes-display-inline">assistance; or</text></subparagraph><subparagraph commented="no" id="H7B0FE214D0474A48885D46C4E53E2EA8"><enum>(B)</enum><text display-inline="yes-display-inline">wage subsidies that are paid, with funds provided under section 403(a) or with qualified State expenditures, with respect to a person who—</text><clause commented="no" id="H90DF1520257F4C09813E1B75CF82BAFD"><enum>(i)</enum><text display-inline="yes-display-inline">was a work-eligible individual (as defined in the regulations promulgated pursuant to section 407(i)(1)(A)(i)) at the time of entry into subsidized employment, such as on-the-job training or apprenticeship;
