which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Homeowner Flood Insurance Affordability Act of 2014 to address ecosystem restoration projects, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Floodplain Enhancement and Recovery Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idc95189b1fbce4132ae791d7662118bb2"><enum>2.</enum><header>Ecosystem restoration projects</header><subsection commented="no" display-inline="no-display-inline" id="id05b515f7989d43ee9a53bb6e1e789fad"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 22 of the Homeowner Flood Insurance Affordability Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/42/4101e">42 U.S.C. 4101e</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="idD9EBBE7C1CFB4F80B07FEC0B8DCA6DCF" act-name=""><section section-type="subsequent-section" id="idC7E8DCA3EBDC45E0A086294A76685A58"><enum>22.</enum><header>Ecosystem restoration projects</header><subsection commented="no" display-inline="no-display-inline" id="idb09fe090de0940a2883c430e6c708aa6"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text>In this section, the term <term>ecosystem restoration project</term> means a project proposed for the primary purpose of manipulating the physical, chemical, or biological characteristics of a site with the goal of—</text><paragraph commented="no" display-inline="no-display-inline" id="id8919504871e1482789c1599bb8994c6e"><enum>(1)</enum><text display-inline="yes-display-inline">recovering natural and beneficial functions to a former or degraded aquatic resource or floodplain; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb75d49e9174b47728ddaaf5d5bfff4a2"><enum>(2)</enum><text display-inline="yes-display-inline">enhancing, accelerating, reclaiming, or improving a specific, natural, and beneficial function of an aquatic resource or floodplain.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id63ecf8c8a5944703b52d5933cb94c071"><enum>(b)</enum><header>Exemption from fees for flood hazard change requests for ecosystem restoration projects</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a requester shall be exempt from submitting a review or processing fee for a request for a flood insurance rate map change based on an ecosystem restoration project.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id4fba0266bf614542b35022a4e44ff360"><enum>(c)</enum><header>Exemption from conditional approval for certain ecosystem restoration projects</header><text display-inline="yes-display-inline">A community may permit an ecosystem restoration project within an adopted regulatory floodway that would result in an increase in base flood elevations, if—</text><paragraph commented="no" display-inline="no-display-inline" id="idee034abd4e0641dea576e600bb552b29"><enum>(1)</enum><text display-inline="yes-display-inline">a professional engineer uses the best judgment of the engineer to determine that the cumulative effect of the proposed ecosystem restoration project, when combined with all other existing development, will not increase the water surface elevation of the base flood by more than 1 foot (or a greater amount or metric determined appropriate by the Administrator); </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8a87c59786d14fe782b440a3b5051e50"><enum>(2)</enum><text display-inline="yes-display-inline">no insurable structure or any critical infrastructure is located in an area that would be adversely impacted by the increased base flood elevation; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb3991e342d3c484e914068ff1f5c0334"><enum>(3)</enum><text display-inline="yes-display-inline">not later than 180 days after the date on which the ecosystem restoration project is completed, the community submits to the Administrator an analysis regarding the changed conditions caused by the ecosystem restoration project.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id65ae46488883476cbc713452d49cec29"><enum>(d)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed to affect the procedure (as in effect on the day before the date of enactment of the <short-title>Floodplain Enhancement and Recovery Act</short-title>) for providing notification to a landowner with respect to development in a regulatory floodway.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idc0c30edecd144ad4a11081459d4a5f6a"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of contents for the Homeowner Flood Insurance Affordability Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/89">Public Law 113–89</external-xref>) is amended by striking the item relating to section 22 and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id88FB918FBEF849A4BB6E883D69059EBB"><toc><toc-entry bold="off" level="section">Sec. 22. Ecosystem restoration projects.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id493091fdd5354ad0b1c3ca9dae17f7d6"><enum>(c)</enum><header>Guidance</header><paragraph commented="no" display-inline="no-display-inline" id="ide2e8212ff2c645de8440dc8e99a4bcbb"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="idefe9a340131d4f87b4b2384afa766b17"><enum>(A)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Federal Emergency Management Agency.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfa5c48ade2084010bb6393f6ed8feff0"><enum>(B)</enum><header>Covered agencies</header><text>The term <term>covered agencies</term> means Federal and State natural resource agencies, as determined by the Administrator.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idead8511503bf47a0a79dc3c775f2025d"><enum>(2)</enum><header display-inline="yes-display-inline">Issuance</header><text>Not later than 180 days after the date of enactment of this Act, and after consultation with the heads of covered agencies, the Administrator shall issue guidance to implement section 22 of the Homeowner Flood Insurance Affordability Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/42/4101e">42 U.S.C. 4101e</external-xref>), as amended by this section.</text></paragraph></subsection></section></legis-body></bill>
