which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 31, United States Code, to prohibit the Secretary of the Treasury from minting or issuing 1-cent coins.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Make Sense Not Cents Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id60ecb0e7c4b1489babceb847d5e78c00"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that Congress has the sole authority to coin money and regulate currency. </text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idfe2b7081136c4d5cab7c185e32ec919a"><enum>3.</enum><header>Discontinuation of 1-cent coins</header><subsection commented="no" display-inline="no-display-inline" id="idc5d4365e60684d809b94230a01bd6747"><enum>(a)</enum><header>In general</header><text>The Secretary of the Treasury may not mint or issue a 1-cent coin.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idf30ac62403514c728ec42ec798677241"><enum>(b)</enum><header>Technical and conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="id3043a45b0f59492da675f31e603ba4da"><enum>(1)</enum><text display-inline="yes-display-inline">Title 31, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id42f9992da9ed49cf98296d48b480ff0f"><enum>(A)</enum><text display-inline="yes-display-inline">in section 5112—</text><clause commented="no" display-inline="no-display-inline" id="idd16c9e20c8824ea8b5a3d8f0cc20b5a2"><enum>(i)</enum><text>in subsection (a)—</text><subclause commented="no" display-inline="no-display-inline" id="id6f56d940c04b4114b1d855fe9b48a928"><enum>(I)</enum><text>by striking paragraph (6); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9a4557ccb1ff4dffbfc2c74f21d1a677"><enum>(II)</enum><text>by redesignating paragraphs (7) through (12) as paragraphs (6) through (11), respectively;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id3b25665a776947e49ccba0be5031ca3a"><enum>(ii)</enum><text>in subsection (b), by striking the eighth sentence;</text></clause><clause commented="no" display-inline="no-display-inline" id="id7c37753e23df47a2952253146d3f09ce"><enum>(iii)</enum><text>by striking subsection (c);</text></clause><clause commented="no" display-inline="no-display-inline" id="id9ca97b90139b4b8ca2dc4eaabfe252bb"><enum>(iv)</enum><text display-inline="yes-display-inline">in subsection (i), by striking <quote>(7), (8), (9), and (10)</quote> each place the term appears and inserting <quote>(6), (7), (8), and (9)</quote>; </text></clause><clause commented="no" display-inline="no-display-inline" id="id2064973d5c4f4f0ba553eb256f0d6b54"><enum>(v)</enum><text display-inline="yes-display-inline">in subsection (j), by striking <quote>(7), (8), (9), or (10)</quote> and inserting <quote>(6), (7), (8), or (9)</quote>; and</text></clause><clause id="id1171b3188fea442591eb2f9ceba21337"><enum>(vi)</enum><text>in subsection (v), by striking <quote>paragraph (12)</quote> each place the term appears and inserting <quote>paragraph (11)</quote>;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3fe4f1f493b747e7b70e3bd22e264dd5"><enum>(B)</enum><text>in section 5113(a), by striking the third sentence; and</text></subparagraph><subparagraph id="id96a535523af44178a0f8b9ff84cee29c"><enum>(C)</enum><text>in section 5132(a), by striking <quote>through (6)</quote> each place the term appears and inserting <quote>through (5)</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id595c7e6329de44be82e22ced82a2e8d0"><enum>(2)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/26/408">Section 408(m)(3)(A)(i)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>paragraph (7), (8), (9), or (10)</quote> and inserting <quote>paragraph (6), (7), (8), or (9)</quote>. </text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id1b196ee6e01d49eb8f7d80d96d8aff1d"><enum>4.</enum><header>No effect on legal tender</header><text display-inline="no-display-inline">Notwithstanding any other provision of this Act, or any amendment made by this Act, one-cent coins are legal tender in the United States for all debts, public and private, public charges, taxes, and duties, regardless of the date of minting or issue.</text></section></legis-body></bill>
