which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To take certain Federal land in the State of Washington into trust for the Lower Elwha Klallam Tribe, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H7007685E4E1248779C9439708BC67AA4"><section section-type="section-one" id="HAFEA993760A646E69D675D6BE7FB9166"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lower Elwha Klallam Tribe Project Lands Restoration Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H98BE69AF46084A7AAE79A9B8FA6A59D4"><enum>2.</enum><header>Land taken into trust for the Lower Elwha Klallam Tribe</header><subsection id="H51E7AE67C77C4CFCB97230ED55DF3CBE"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HA97B02B2049B4E9F9A52D2B5F277B3A1"><enum>(1)</enum><header>Reservation</header><text display-inline="yes-display-inline">The term <term>Reservation</term> means the Lower Elwha Indian Reservation, also known as the Lower Elwha Reservation, located in the State of Washington.</text></paragraph><paragraph id="HF7F54A78523D4629B0B2ADBEDA859DA7"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="H01EB5B315AA841239B7AACBD75CB248A"><enum>(3)</enum><header>Tribe</header><text display-inline="yes-display-inline">The term <term>Tribe</term> means the Lower Elwha Tribal Community, also known as the Lower Elwha Klallam Tribe, located in the State of Washington.</text></paragraph></subsection><subsection id="H0382DBE014644ECB8F8BD58BFB702A54"><enum>(b)</enum><header>Land held in trust</header><paragraph id="H60847A16AC6842C599EF3D9419B8AEC3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to all valid existing rights of the United States, the approximately 1,082.63 acres of Federal land generally depicted as <quote>NPS Parcels to be Transferred to Tribe</quote> on the map entitled <quote>Olympic National Park Proposed Transfer of Elwha Lands</quote>, numbered 149/178020, and dated December 2021 is hereby taken into and held in trust by the United States for the benefit of the Tribe.</text></paragraph><paragraph id="H86D96BB7646F40D6B90425E694CC975D"><enum>(2)</enum><header>Inclusion in reservation</header><text>The land taken into trust under paragraph (1) shall be part of the Reservation.</text></paragraph><paragraph id="HBCD5935B3B2248ED81448BE7C236B82C"><enum>(3)</enum><header>Law applicable to certain land</header><text>The land taken into trust under paragraph (1) shall not be subject to any requirements for valuation, appraisal, or equalization under any Federal law.</text></paragraph></subsection><subsection id="H8385CFEEB21C403CA38B65D81D7473E1"><enum>(c)</enum><header>Land management</header><text display-inline="yes-display-inline">Of the land taken into and held in trust under subsection (b)(1), the portion of the Elwha River subject to section 3(c)(3) of the Elwha River Ecosystem and Fisheries Restoration Act (<external-xref legal-doc="public-law" parsable-cite="pl/102/495">Public Law 102–495</external-xref>; 106 Stat. 3175) shall be managed in accordance with subsection (b) of the first section of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1271">16 U.S.C. 1271</external-xref>), except for necessary modifications under section 3(c)(3) of the Elwha River Ecosystem and Fisheries Restoration Act (<external-xref legal-doc="public-law" parsable-cite="pl/102/495">Public Law 102–495</external-xref>; 106 Stat. 3175).</text></subsection><subsection id="H449707B010F24947AF5B4BD2DB052FA0"><enum>(d)</enum><header>Map and survey</header><paragraph id="H39B4A38C4117427CA979701EF9FF19AC"><enum>(1)</enum><header>Boundary adjustment; survey</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall conduct a survey to define the boundaries of the land taken into and held in trust under subsection (b)(1).</text></paragraph><paragraph id="H240F0B0B5F3A45CBAB2CC38E2210575A"><enum>(2)</enum><header>Adjustments</header><text display-inline="yes-display-inline">The Secretary may—</text><subparagraph commented="no" display-inline="no-display-inline" id="id90aef8d7f7d342ea887e804224ab2bf8"><enum>(A)</enum><text display-inline="yes-display-inline">make minor boundary adjustments to the land taken into and held in trust under subsection (b)(1); and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id73bbc8175f944162bb82d890e8992203"><enum>(B)</enum><text display-inline="yes-display-inline">correct any minor errors in any map, acreage estimate, or description of that land.</text></subparagraph></paragraph></subsection><subsection id="H18E5BC1CFB16451E8DF18A28EA7D2A84"><enum>(e)</enum><header>Gaming prohibition</header><text>No land taken into and held in trust for the benefit of the Tribe under this section shall be considered Indian lands for the purpose of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2701">25 U.S.C. 2701 et seq.</external-xref>).</text></subsection></section><section id="HAE179A78F8794E54A37CF19D88CE5726"><enum>3.</enum><header>No impact on treaty rights</header><text display-inline="no-display-inline">Nothing in this Act affects treaty rights under the Treaty between the United States of America and the S'Klallams Indians, concluded at Point no Point, Washington Territory, January 26, 1855 (12 Stat. 933) (commonly known as the <quote>Treaty of Point No Point</quote>).</text></section></legis-body></bill>
