which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Civil Rights Cold Case Records Collection Act of 2018 to strengthen the powers of the Civil Rights Cold Case Records Review Board, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H724B3FBC194A4E40B35D426B15CEFEBA"><section section-type="section-one" id="HFE3B3E2745CA46749D6C059DF46431EC"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Civil Rights Cold Case Records Collection Reauthorization Act</short-title></quote>.</text></section><section id="HED3B1B1644A74671A38AB2EB0E6830DB"><enum>2.</enum><header>Clarifying the Authorities of the Civil Rights Cold Case Review Board</header><subsection id="H79D12BE6A86D49F0B5D666C93E4A0F42"><enum>(a)</enum><header>Civil Rights Cold Case Records Review Board presumption of release</header><text display-inline="yes-display-inline">It is the sense of Congress that all records of the Federal Government and State and local governments concerning civil rights cold cases should—</text><paragraph id="H577994C33BB0474DA760ABF99AACD9D8"><enum>(1)</enum><text>carry a presumption of immediate disclosure; and</text></paragraph><paragraph id="HFB38B1ECE0C14966A155D5FF4C049689"><enum>(2)</enum><text>eventually be disclosed to enable the public to become fully informed about the history surrounding the cases.</text></paragraph></subsection><subsection commented="no" id="HA147F980F78244A9A4AFEE38A1D59CFC"><enum>(b)</enum><header>Reimbursement for expenses incurred by State or local governments</header><text display-inline="yes-display-inline">Section 3 of the Civil Rights Cold Case Records Collection Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/44/2107">44 U.S.C. 2107</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/426">Public Law 115–426</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H49F253A59D2C40C99F14B6CD07735DCA"><subsection id="H7825EF0E109A42CBA8AAA3DC6A74BE62"><enum>(i)</enum><header>Reimbursement for expenses incurred by State or local governments</header><text>Upon request of a State or local government to the Review Board, the Review Board may reimburse the State or local government in full for any expense incurred by the State or local government for digitizing, photocopying, or mailing a civil rights cold case record for the purpose of transmitting such record to the Archivist for inclusion in the Collection.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection display-inline="no-display-inline" id="H6DAAE7C66E054B33BDF1E0B0E444CD7D"><enum>(c)</enum><header>Transmission to Collection of civil rights cold case records in possession of State or local government</header><text>Section 3(a)(2)(A)(i) of the Civil Rights Cold Case Records Collection Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/44/2107">44 U.S.C. 2107</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/426">Public Law 115–426</external-xref>) is amended by striking <quote>, except in the case of a State or local government</quote>. </text></subsection><subsection commented="no" id="HB885D709A1BF48889B5127BA01995E5E"><enum>(d)</enum><header>No application of section 552(b)(6) to civil rights cold case records on or before January 1, 1990</header><text display-inline="yes-display-inline">Section 9(a)(2) of the Civil Rights Cold Case Records Collection Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/44/2107">44 U.S.C. 2107</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/426">Public Law 115–426</external-xref>) is amended by striking the period at the end and inserting <quote>, except in the case of information contained in a civil rights cold case record created on or before January 1, 1990.</quote>.</text></subsection></section><section commented="no" id="H01F11E41AA6147B480DC04DD933E8D81"><enum>3.</enum><header>Civil Rights Cold Case Records Review Board Extension of Tenure</header><text display-inline="no-display-inline">Section 5(n)(1) of Civil Rights Cold Case Records Collection Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/44/2107">44 U.S.C. 2107</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/426">Public Law 115–426</external-xref>) is amended—</text><paragraph commented="no" id="H79ED78D540F34BB4A0A3686CB76F41E1"><enum>(1)</enum><text>by striking <quote>7 years</quote> and inserting <quote>11 years</quote>; and</text></paragraph><paragraph commented="no" id="HA3090D3DDB184869A4C0153B69B9E2CE"><enum>(2)</enum><text>by striking <quote>7-year period</quote> and inserting <quote>11-year period</quote>.</text></paragraph></section></legis-body></bill>
