which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require reforms to programs of the Natural Resources Conservation Service, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>NRCS Wetland Compliance and Appeals Reform Act</short-title></quote>.</text></section><section id="id519E9B2B3D7E438BB4EDCEBEE83202F5"><enum>2.</enum><header>Natural Resources Conservation Service reforms</header><subsection id="id6820DB5FEBD647038ECF665F22065786"><enum>(a)</enum><header>Permissibility of the removal of woody vegetation</header><text>Section 1221(d) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3821">16 U.S.C. 3821(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id80096D0729784EBD9D7AD13CDB24832C"><paragraph id="id9E1265C5D5AE4A209488986B430A08F4"><enum>(3)</enum><header>Permissibility of the removal of woody vegetation</header><text>The removal of woody vegetation, including stumps, shall not be considered to be an activity that is for the purpose, or that has the effect, of making the production of an agricultural commodity possible under paragraph (1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id6C00AD570D3F4BCEBDBB327431FEA4F8"><enum>(b)</enum><header>Prohibition on retroactive penalties</header><text>Section 1221 of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3821">16 U.S.C. 3821</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2EEFEC3573BD41D59FD0DE3080F49835"><subsection id="id572118C9AB3B4663B8070BB73C234D23"><enum>(g)</enum><header>Prohibition on retroactive penalties</header><text>The Secretary may not determine a person to be in violation of this section for the production of an agricultural commodity on, or the conversion of, a wetland that, at the time of that production or conversion, as applicable, the Secretary had not delineated, determined, and certified to be a wetland in accordance with section 1222.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id1546ECEA54544C94ADD311034BC27248"><enum>(c)</enum><header>Burden of proof</header><text>Section 1221 of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3821">16 U.S.C. 3821</external-xref>) (as amended by subsection (b)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC1804BDAC1EA4E91BF8FBE4ED0299905"><subsection id="id3FF4A2C341344EFF83E467F2388095BB"><enum>(h)</enum><header>Burden of proof</header><text>The Secretary shall bear the burden of proving, by clear and convincing evidence, that a person is in violation of this section, including—</text><paragraph id="idECC92418758F448486E5BC116C9B64F0"><enum>(1)</enum><text>in a case in which there is a lack of evidence to determine such a violation; and</text></paragraph><paragraph id="id82EC96D2EFA5486EB646EAB68C7BF6FD"><enum>(2)</enum><text>the burden of proving, by clear and convincing evidence, that evidence offered to prove that a person is not in violation of this section is unreliable.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idCCAC2ECF34E141909E64C78FE104EA73"><enum>(d)</enum><header>Prohibition on using new rationale for wetland determinations previously refuted</header><text>Section 1222(a) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3822">16 U.S.C. 3822(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4B707167FC4F40C8ACE091D870FE3C03"><paragraph id="id76E55E8E8ADD4B7798AA8F3E837A1249"><enum>(7)</enum><header>Prohibition on using new rationale for wetland determinations previously refuted</header><text>If a person successfully appeals a final wetland determination at the National Appeals Division, the Secretary may not subsequently make a determination that the wetland exists based on a rationale that was not used for the determination that was successfully appealed at the National Appeals Division.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id3D4576D6F2CC4ABE929B29344CA5535F"><enum>(e)</enum><header>Appeal process for nonaccepted review of wetland certification requests</header><text>Section 1222(a) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3822">16 U.S.C. 3822(a)</external-xref>) (as amended by subsection (d)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEA736B448B3D40EF898A84A346D1231E"><paragraph id="id1387FED6BF4F413DBB6B4FE5F6B1B605"><enum>(8)</enum><header>Appeal process for nonaccepted review of wetland certification requests</header><text>The Secretary shall develop an appeal process for requests for the review of wetland certifications that are not accepted by a State office of the Natural Resources Conservation Service, which shall include a right for the person bringing the appeal to demand that the Secretary conduct an on-site visit in accordance with subsection (c).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id6B709B27E6474879A2281D3DB9EADF1C"><enum>(f)</enum><header>Requirement relating to preliminary wetland determinations</header><text>Section 1222(c) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3822">16 U.S.C. 3822(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6B4BA164D88C4CD0BA3BE4E71148801F"><paragraph id="id96E6F8472FA14542BC23590BA38C7E40"><enum>(3)</enum><header>Requirement relating to preliminary wetland determinations</header><text>The Secretary may not rely solely on 1 on-site visit described in paragraph (1) to determine that the hydrologic criteria for the determination that a wetland exists are satisfied.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id5C261BA2D4A44010B1A1DB070666598F"><enum>(g)</enum><header>Customer satisfaction survey</header><text>Subtitle C of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3821">16 U.S.C. 3821 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE43FB7A93124418EA0446AAFE7EC7B72"><section id="id9E5C4F4D94994348B577399FBDF7A4A7"><enum>1225.</enum><header>Customer satisfaction survey</header><subsection commented="no" display-inline="no-display-inline" id="idC61F9616EDCC4544935B62D213D57B48"><enum>(a)</enum><header>Purposes</header><text>The purposes of this section are—</text><paragraph commented="no" display-inline="no-display-inline" id="id46615A26C63B4D9AB110B705085F0196"><enum>(1)</enum><text>to improve customer service at the Natural Resources Conservation Service relating to the administration of this subtitle;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC7E946C1CD5C45C380FA8722D825C110"><enum>(2)</enum><text>to identify areas of satisfaction of customers in interacting with the Natural Resources Conservation Service in the administration of this subtitle;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id45014E1A5DD54968BAAE2EBBC261B4AB"><enum>(3)</enum><text>to identify areas of customer service at the Natural Resources Conservation Service in need of improvement due to dissatisfaction of customers in interacting with the Natural Resources Conservation Service in the administration of this subtitle; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id04E2C16B559E4A5E82ECFDE83AA9CDC1"><enum>(4)</enum><text>to address corrective measures and initiate positive change in customer service at the Natural Resources Conservation Service relating to the administration of this subtitle.</text></paragraph></subsection><subsection id="idA8305946A2F541C1A65D3FC31EBBD75C"><enum>(b)</enum><header>Option To participate in survey</header><text>The Secretary shall offer to each individual who interacts with the Natural Resources Conservation Service in the administration of this subtitle the option to participate in a survey described in subsection (c).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id462D8427E5FA44DCA6676CDDC4365B3B"><enum>(c)</enum><header>Surveys</header><text>The Secretary shall enter into an agreement with an independent survey company, under which the independent survey company shall provide the following services:</text><paragraph commented="no" display-inline="no-display-inline" id="id23E2026C1E174F8ABBD4EEEA33CFAF55"><enum>(1)</enum><text>Send, by email or mail, a customer satisfaction survey to each individual who interacts with the Natural Resources Conservation Service in the administration of this subtitle and indicates to the Secretary a desire to participate in the survey on being offered the option to participate under subsection (b) after any of the following occurs:</text><subparagraph id="id087d126540284a40917507a35da320b1"><enum>(A)</enum><text>The Secretary completes a final wetland determination, including a final technical determination, relating to land of the individual.</text></subparagraph><subparagraph id="id826a42f600304373bc4e41b784fc573a"><enum>(B)</enum><text>Appeals to the Farm Service Agency with respect to a wetland determination are exhausted.</text></subparagraph><subparagraph id="id6b1fbaa3f916490d8ddfbe4f4a030243"><enum>(C)</enum><text>An appeal is made with respect to a wetland determination to a National Appeals Division officer.</text></subparagraph><subparagraph id="idff07b194d57b44ebae71e848018fa994"><enum>(D)</enum><text>An appeal is made with respect to a wetland determination to the Director of the National Appeals Division.</text></subparagraph><subparagraph id="idb7619da7f50d436c8be0f6bf9d347127"><enum>(E)</enum><text>The Secretary completes a review of a prior certification of a wetland determination.</text></subparagraph><subparagraph id="id47482275C31A47C09E5A70807983E164"><enum>(F)</enum><text>The individual has any other interaction with the Natural Resources Conservation Service, as the Secretary determines to be appropriate.</text></subparagraph></paragraph><paragraph id="id56B15A57D4964ED592E2C08E6A4381F2"><enum>(2)</enum><text>Receive responses to the surveys from the individuals to which the surveys are sent under paragraph (1).</text></paragraph><paragraph id="idE6B6B4FD97CF496B9B9745ADEFA79959"><enum>(3)</enum><text>Each month—</text><subparagraph id="id6C6AF823DA3B4B2FAC91B3F0339CF952"><enum>(A)</enum><text>compile the responses to the surveys received under paragraph (2); and</text></subparagraph><subparagraph id="idF392DCFF50514264AA877318561D5F95"><enum>(B)</enum><text>submit a report describing the compiled responses to—</text><clause id="id379E3BA61AF94AFEA0446470A437775D"><enum>(i)</enum><text>the applicable State Conservationist;</text></clause><clause id="id952D52A1E0744D7A81A845B6B14090E8"><enum>(ii)</enum><text>the congressional delegation of each applicable State;</text></clause><clause id="idD437C0D97CF543079ACD605032CDBB40"><enum>(iii)</enum><text>the Committee on Agriculture, Nutrition, and Forestry of the Senate;</text></clause><clause id="id507ACEF9A08A41E58EBEFB9B8BDFB046"><enum>(iv)</enum><text>the Committee on Agriculture of the House of Representatives;</text></clause><clause id="id5A4AD49DCA4C49E5ADF17B43D08BE607"><enum>(v)</enum><text>the applicable State department of agriculture; and</text></clause><clause id="idC9BF597802C9450195200ABA249FDE61"><enum>(vi)</enum><text>the Secretary.</text></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idEE11FC9FE62A4356B0715FFDDA969864"><enum>(h)</enum><header>State oversight committees</header><text>Subtitle C of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3821">16 U.S.C. 3821 et seq.</external-xref>) (as amended by subsection (g)) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idDF74F5A48C764584B8DF3C7F2B0523A0"><section id="idD2B2AFAFB155411AA6D1A9820544A6A7"><enum>1226.</enum><header>State oversight committees</header><subsection id="idFA0D43A2F4784F80BA777267294AF144"><enum>(a)</enum><header>In general</header><text>The Secretary shall establish an oversight committee for each State in which appeals of wetland determinations under this subtitle are made.</text></subsection><subsection id="idB089B99CDA0E4852A190CF7E80125ECE"><enum>(b)</enum><header>Composition</header><text>Each State oversight committee shall be composed of—</text><paragraph id="id2B3D16CACCB74153AE3F051996F58BF5"><enum>(1)</enum><text>2 private, active farmers or ranchers appointed by the Secretary; and</text></paragraph><paragraph id="id290165D03F0745EBA0FFB2D4D025F2B5"><enum>(2)</enum><text>1 private, active farmer or rancher appointed by the State department of agriculture.</text></paragraph></subsection><subsection id="idA255E091966C4BF6B5D04EB73073F5AE"><enum>(c)</enum><header>Terms</header><text>A member of a State oversight committee—</text><paragraph commented="no" id="id010ED5D0B3624C2080A2227019CBA15D"><enum>(1)</enum><text>shall be appointed for a term of 5 years; and</text></paragraph><paragraph id="idC4C788464E1245E9BB5ECE1BE0B2A22D"><enum>(2)</enum><text>may serve for not more than 2 terms.</text></paragraph></subsection><subsection id="idB8911881F6EC43C2BB61FADE44E74A9D"><enum>(d)</enum><header>Duties</header><text>Each State oversight committee shall have the following duties:</text><paragraph id="idB373026E1E2B4FE7BFA53C0311C32CCB"><enum>(1)</enum><text>Review the following appeals of wetland determinations under this subtitle in the applicable State:</text><subparagraph id="id5e1d4aa1adaf4cd8aecfb9e74208ded4"><enum>(A)</enum><text>Appeals of preliminary wetland determinations.</text></subparagraph><subparagraph id="idb6feed3d86514d12beca170650d1a672"><enum>(B)</enum><text>Appeals of final wetland determinations.</text></subparagraph><subparagraph id="id5009ebc6746e444ebbd96ab0d2830233"><enum>(C)</enum><text>Wetland determination appeals to the county Farm Service Agency committee.</text></subparagraph><subparagraph id="idad7b210e3ef1423cb7c14d3862200031"><enum>(D)</enum><text>Wetland determination appeals for State Conservationist review.</text></subparagraph><subparagraph id="id18b26f2449714eb2865a01f23851a717"><enum>(E)</enum><text>Requests for wetland determination mediation.</text></subparagraph><subparagraph id="id098d07a0b4574121a76ce4e8b36f01c3"><enum>(F)</enum><text>Wetland determination appeals to the National Appeals Division.</text></subparagraph><subparagraph id="id46e9e0f5400a4567aa17c917a14780c8"><enum>(G)</enum><text>Wetland determination appeals to the Director of the National Appeals Division.</text></subparagraph></paragraph><paragraph id="id662C36420C254E76A9531C1BCBC42951"><enum>(2)</enum><text>Review all requests for a review of a prior certification of a wetland determination under this subtitle.</text></paragraph><paragraph id="idEB0FBD7B137C485A917B97EE43951F3E"><enum>(3)</enum><text>Submit a report describing findings of fact and recommendations for change and improvement with respect to each review under paragraphs (1) and (2) to—</text><subparagraph id="idF78A59F4CA2C4502A81E2EEE5FA452A4"><enum>(A)</enum><text>the State Conservationist;</text></subparagraph><subparagraph id="idA166C1DE3293493B8305C891B892592C"><enum>(B)</enum><text>the Chief of the Natural Resources Conservation Service;</text></subparagraph><subparagraph id="idE0ED5A8669E74AA692BDE303E61531E9"><enum>(C)</enum><text>the Committee on Agriculture, Nutrition, and Forestry of the Senate; and</text></subparagraph><subparagraph id="idF2F1931A6B714CE69F4E0D12386EF598"><enum>(D)</enum><text>the Committee on Agriculture of the House of Representatives.</text></subparagraph></paragraph></subsection><subsection id="id3C920C92F605413092FF102FFD111F8C"><enum>(e)</enum><header>Assistance</header><text>A State oversight committee may procure assistance in carrying out the duties under subsection (d) from—</text><paragraph id="id03E6D50233C44387AAE7C15D250AF2B9"><enum>(1)</enum><text>a consultant; and</text></paragraph><paragraph id="id9B50E6F599B1416183E220ADEAD6553A"><enum>(2)</enum><text>a legal services provider.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id01D407DAFEA3463A98E786C22AA4EED8"><enum>(i)</enum><header>Reforms to appeals processes</header><text>The Secretary of Agriculture shall—</text><paragraph id="idD3D7B802B45C46128D3064E6E12027B1"><enum>(1)</enum><text>require National Appeals Division judges and agency heads of the Department of Agriculture to receive retraining on providing a fair and balanced hearing;</text></paragraph><paragraph id="id3391DB45829D49FA9ACB26FF5FBF3161"><enum>(2)</enum><text>provide to a person the entire record or decisional documentation relating to an allegation of the Secretary that the person is in violation of section 1221 of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3821">16 U.S.C. 3821</external-xref>) at the time the Secretary makes the allegation;</text></paragraph><paragraph id="idC6C1A68E3B07485BA65FCEC222C74D04"><enum>(3)</enum><text>allow a person (or counsel of the person) to call technical staff of the Natural Resources Conservation Service as a witness in an appeal brought by the person relating to a delineation, determination, or certification of a wetland under section 1222 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3822">16 U.S.C. 3822</external-xref>);</text></paragraph><paragraph id="id66BC426ED6D44BA7B6F466135AB04C03"><enum>(4)</enum><text>in an appeal described in paragraph (3), accept evidence provided by the person bringing the appeal as reliable absent substantial evidence that the evidence provided by the person is not reliable; and</text></paragraph><paragraph id="id66bc59d90e694d6a8c3b1f2d7a1bfd3f"><enum>(5)</enum><text>compensate a person for fees and expenses, including legal fees, when the person successfully appeals a delineation, determination, or certification described in paragraph (3) and has incurred legal costs as a result of the overturned delineation, determination, or certification, as applicable.</text></paragraph></subsection><subsection id="id9E929BB3C2DB44658ECB38271EDBC630"><enum>(j)</enum><header>Regulations</header><text>Section 1246(b)(2) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3846">16 U.S.C. 3846(b)(2)</external-xref>) is amended—</text><paragraph id="id5DDAC46A3C0D4F069305910E1053DEC8"><enum>(1)</enum><text>by striking <quote>(2) shall</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE2D1BD91AA6942A08E5FBB232A9A8DAA"><paragraph id="id6916800A085D432094AFF3C84526F4C1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id07703EDC970E4E478B32C0B3800ABCB0"><enum>(A)</enum><text>except as provided in subparagraph (B), shall</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id8E370A83211B49438AA8EDE6965923FC"><enum>(2)</enum><text>in subparagraph (A) (as so designated), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="id8596AEEEF4D24C00B10A16939B69D6F7"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5182CA05DE3E4F409DF00906C3C841D4"><subparagraph id="idDF1E5FB99B9D470198A80C80910DA3BD" indent="up1"><enum>(B)</enum><text>shall be promulgated in accordance with section 553 of title 5, United States Code, in the case of— </text><clause id="idEDA4BC8AD71A4C14982A59636023A703"><enum>(i)</enum><text>subtitles B and C;</text></clause><clause id="id83676E5B13464F2CB6AD93A9DB25B2D2"><enum>(ii)</enum><text>section 1201, to the extent that section defines a term that appears in, or otherwise relates to, subtitle B or C; and</text></clause><clause commented="no" id="id97C91E447A8C4449925315C72B9178D7"><enum>(iii)</enum><text>subtitle E, to the extent that subtitle relates to subtitle B or C.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id6783CB12B41D4ABE943FC525337B2AA7"><enum>(k)</enum><header>Prohibition of permanent easements</header><text>Notwithstanding any other provision of law, the Secretary of Agriculture, acting through the Chief of the Natural Resources Conservation Service, may not acquire any permanent easement.</text></subsection></section></legis-body></bill>
