<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 1491</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250410">April 10, 2025</action-date><action-desc><sponsor name-id="S366">Ms. Warren</sponsor> (for herself, <cosponsor name-id="S270">Mr. Schumer</cosponsor>, <cosponsor name-id="S380">Mr. Peters</cosponsor>, <cosponsor name-id="S409">Mr. Luján</cosponsor>, <cosponsor name-id="S322">Mr. Merkley</cosponsor>, <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>, <cosponsor name-id="S390">Mr. Van Hollen</cosponsor>, <cosponsor name-id="S361">Ms. Hirono</cosponsor>, <cosponsor name-id="S413">Mr. Padilla</cosponsor>, <cosponsor name-id="S427">Mr. Schiff</cosponsor>, <cosponsor name-id="S422">Mr. Welch</cosponsor>, and <cosponsor name-id="S406">Mr. Kelly</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to modify the definition of special Government employee, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="id2820792a0c67402a8f9cd0d38331fcd8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>SGE Ethics Enforcement Reform Act of 2025</short-title></quote> or the <quote><short-title>SEER Act 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idc8cfb894b845414a8058d289ffac22e0" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="idf0c35d47f7b44592992fa6bd65ba1379"><enum>(1)</enum><text>Some special Government employees have substantial financial conflicts of interest due to their other business activities while in Federal service.</text></paragraph><paragraph id="id1cbc055b46f243b8893cccc678b2cdf3"><enum>(2)</enum><text>Special Government employees are subject to the criminal conflict-of-interest statute applicable to full-time Government employees, section 208 of title 18, United States Code. However, Federal employees, including special Government employees, do not have to resolve conflicts under that provision if the relevant work does not constitute a particular matter.</text></paragraph><paragraph id="id747e1cd2d4394580b5b1d653120015ef"><enum>(3)</enum><text>Unlike senior executive branch employees under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/131">chapter 131</external-xref> of title 5, United States Code, the vast majority of special Government employees are not required to make their financial disclosure reports public, thus concealing from the public their potential financial conflicts of interest.</text></paragraph><paragraph id="id54c907b93d5d48559931c6fc60708508"><enum>(4)</enum><text>The vast majority of special Government employees in the Federal Government serve on advisory committees and have a limited role in Government decision-making. But a select number of special Government employees have assumed authority within the Federal Government commensurate with a senior or very senior full-time Federal employee.</text></paragraph><paragraph id="idfb699542b9324cce9861819a22b3d493"><enum>(5)</enum><text>The executive branch has not notified the public or Congress when it uses special Government employees to perform high-level responsibilities.</text></paragraph><paragraph id="id5f48f7362a114a789e061c867e4eda8d"><enum>(6)</enum><text>The executive branch has permitted employees to retain special Government employee status beyond the statutory limit of 130 days during any period of 365 consecutive days.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id95ee8fad1d204b05959666ee86d79bed"><enum>3.</enum><header>Conflicts of interest</header><text display-inline="no-display-inline">Title 18, United States Code, is amended—</text><paragraph id="id25bd65660cd14a86a80adc5e477ccee7"><enum>(1)</enum><text>in section 202(a), in the first sentence, by inserting <quote>and who has been designated as a special Government employee on a Notification of Personnel Action (Standard Form 50 or equivalent) of the officer or employee,</quote> after <quote>basis,</quote>; and</text></paragraph><paragraph id="idb48c80b7fd7e495090a37805065eaeed"><enum>(2)</enum><text>in section 208—</text><subparagraph commented="no" display-inline="no-display-inline" id="id295ebd26795b43c5ab4b86d6d95ef0df"><enum>(A)</enum><text>in subsection (a)—</text><clause commented="no" display-inline="no-display-inline" id="id3b79d826345644b9bba9c418e2219a81"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>(a) Except</quote> and inserting <quote>(a)(1) Except</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id89844df5c8af42ffb6333ef46dc2a972"><enum>(ii)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id34B4FED3FDDF466D847AD6A150A2832E"><paragraph id="id4f1d73b5b4e64774a017097c67ea6d25" indent="up1"><enum>(2)</enum><text>In the case of a special Government employee who is not on an advisory committee or who serves as the chair or vice chair of an advisory committee, paragraph (1) shall apply to a discrete and identifiable component of a matter that on its own would constitute a particular matter in which, to the knowledge of the special Government employee, the organization in which the special Government employee is serving as officer, director, trustee, general partner, or employee has a financial interest.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id0a1c6d5ced1940cc9e687681900a17b4"><enum>(B)</enum><text>in subsection (b)—</text><clause id="id2f2de7b84f444b21bb11a2b4cd5c877e"><enum>(i)</enum><text>in paragraph (1), by inserting <quote>, with the concurrence of a designated official at the Office of Government Ethics if the officer or employee is a special Government employee,</quote> after <quote>such official</quote>; and</text></clause><clause id="id7c8683d7fb4c4ceda3daf70e65b4159a"><enum>(ii)</enum><text>in paragraph (3), by inserting <quote>, other than the chair or vice chair of the committee,</quote> after <quote>committee</quote>;</text></clause></subparagraph><subparagraph id="id5dc7306dc7a84ee9a5a46dbeb631550d"><enum>(C)</enum><text>in subsection (d)—</text><clause commented="no" display-inline="no-display-inline" id="id38d189573b0243639862e761c85d6e48"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (1), in the first sentence, by striking <quote>Upon</quote> and inserting <quote>Except as provided in paragraph (2), upon</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="id4acbc4c3faec4593a3eeb6959d2bb381"><enum>(ii)</enum><text display-inline="yes-display-inline">by redesignating paragraph (2) as paragraph (3); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idfa2f96abdbce429f921ab3093235dd0c"><enum>(iii)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5A8A7D95E6A64432BC3D2B434B22B8E7"><paragraph commented="no" display-inline="no-display-inline" id="id82c5ce13d75449859b691d9e67ece23c" indent="up1"><enum>(2)</enum><text>In the case of a special Government employee who is not serving on an advisory committee within the meaning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">chapter 10</external-xref> of title 5 or a special Government employee who is serving as chair or vice chair on such an advisory committee, any waiver or exemption granted under subsection (b)(1) shall be proactively made publicly available via a searchable online database not later than 14 days after the date on which the waiver is issued.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></section><section id="id986a352e697f414bbe2e727f13d2e21e"><enum>4.</enum><header>Restriction on communications with agencies</header><subsection commented="no" display-inline="no-display-inline" id="idedb0f2151a2e46ff8f5cd751fab77335"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text>In this section, the term <term>large company</term> means—</text><paragraph commented="no" display-inline="no-display-inline" id="id76869003c268423aab7b4704cb28b98f"><enum>(1)</enum><text display-inline="yes-display-inline">any for-profit company that has greater than an average of $1,000,000,000 in market capitalization or revenue for the previous 3-year period;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8d0c5febfd4245a4a2f849baeeb6562b"><enum>(2)</enum><text>any Federal contractor that received greater than $100,000,000 in annual revenue from the Federal Government during the previous 3-year period; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id33f6bb442bdf4c14bb39ba7f16af826b"><enum>(3)</enum><text display-inline="yes-display-inline">any for-profit company that exerts monopolistic or monopsonistic control over a significant share of the market in its particular industry, as defined by regulation by the Director of the Office of Government Ethics, in consultation with the Attorney General.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id744b6f1d52824af5b9887deddd8a1d37"><enum>(b)</enum><header display-inline="yes-display-inline">Restriction</header><text display-inline="yes-display-inline">No special Government employee, as defined in section 202 of title 18, United States Code, who is not on an advisory committee or a chair or vice chair on an advisory committee may have direct or indirect communications in their official capacity with an agency or office that contracts with, regulates, or has a pending enforcement action against a large company—</text><paragraph commented="no" display-inline="no-display-inline" id="id2ac24bfb7f134fb7abe91b544a62850e"><enum>(1)</enum><text display-inline="yes-display-inline">that the special Government employee owns; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaf74520607064a67a51a5a55d930bada"><enum>(2)</enum><text display-inline="yes-display-inline">for which the special Government employee serves as a senior executive or director.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5b0927e3cb064a8b8bdc6588441d9bfc"><enum>(c)</enum><header>Regulations</header><text>The Office of Government Ethics shall promulgate regulations carrying out this section, including to define ownership of a large company.</text></subsection></section><section id="id8c1d54f5c2744b93ba27fe0d8e4419a5"><enum>5.</enum><header>Database of special Government employees</header><text display-inline="no-display-inline">Section 1103 of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idED3DB9C321234CE19357522B6A4CF8A4"><subsection id="id431b4c3bcb7d4b1db9e14102513b8479"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="ida167d3e1859a41febb120d19ccc72e8e"><enum>(1)</enum><text>In this subsection, the term <term>covered individual</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida9ab6ba4c0e04df1987c7aa59f0091d5" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">means an individual who is a special Government employee who is not serving on an advisory committee; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id26b39f2854254e969255a15df387fca6" indent="up1"><enum>(B)</enum><text>does not include an individual described in paragraph (1) or (2) of section 13107(a). </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc4b4e15225e742eba02fd91cb9c221fa" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Director, in coordination with the Office of Government Ethics, shall maintain to the extent technically practicable, keep current, and make available to the public over the internet, without a fee or other access charge, in a searchable, sortable, and downloadable manner, an electronic database that contains the name of each covered individual, a rolling tally of the number of days the person has served as a special Government employee, and a description of why the individual was designated as a special Government employee rather than a regular employee.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id4253bccd4fd241a484fd73b9e5fd3a02"><enum>6.</enum><header>Financial disclosure requirements of special Government employees</header><text display-inline="no-display-inline">Title 5, United States Code, is amended—</text><paragraph id="id3e38738d3ef04e12b6a216fd2dce348d"><enum>(1)</enum><text>in section 13103(f)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6dc3f9c6f2ea4bffaf9343d544f5041d"><enum>(A)</enum><text>in paragraph (8), by striking <quote>(other than a special Government employee)</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc5a9a47581c9469780b4654f3ffa7a85"><enum>(B)</enum><text>in paragraph (11), by striking <quote>and at the end</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8fb65cde562843d3aa3a37dbf269313b"><enum>(C)</enum><text>in paragraph (12), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id14c3de92e7e64d999d93572d2a0a6f33"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id87055afdbdf94775a2be016897b8cefd"><paragraph id="id81c09503120543029addcb1d95b64f7b"><enum>(13)</enum><text>A special Government employee who—</text><subparagraph id="ide2306a6d90ec4ad38717d0c6d9ba0ce0"><enum>(A)</enum><text>is not serving on an advisory committee or is serving as a chair or vice chair on an advisory committee; and</text></subparagraph><subparagraph id="id739c73953dfa4692b75200bef02a7e8c"><enum>(B)</enum><text>is not serving in a position classified as a general schedule position at the GS–9 level or below, with limited responsibilities, closely supervised by a career Federal employee.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfb26c3f9a2b648669308b767a0c5f390"><enum>(14)</enum><text display-inline="yes-display-inline">For any special Government employee claiming an exemption from filing a public report this subsection, the relevant agency ethics officer shall review to ensure the exemption may be properly applied to that special Government employee.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id931841ccc2b84f698c594a2f3faa0c45"><enum>(2)</enum><text>in section 13109(a)(1), by inserting <quote>, except as provided in section 13103(f)(13),</quote> after <quote>title 18)</quote>.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="idd0c33cbcf6f245048f4e3a8fcd2151a8"><enum>7.</enum><header>Modifications of online access to certain financial disclosure statements and related forms</header><text display-inline="no-display-inline">Section 1(a)(2) of the Act entitled <quote>An Act to modify the requirements under the STOCK Act regarding online access to certain financial disclosure statements and related forms</quote>, approved April 15, 2013 (<external-xref legal-doc="usc" parsable-cite="usc/5/13107">5 U.S.C. 13107</external-xref> note) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBA714004AFFC4CC1989212FB33BA25BB"><subparagraph commented="no" display-inline="no-display-inline" id="idfa8d95dbfe6348ab828b847f74ee3ecb"><enum>(F)</enum><text>Any special Government employee of the executive branch who—</text><clause commented="no" display-inline="no-display-inline" id="iddf5b059d1d8f4994b537f038ca4bee0d"><enum>(i)</enum><text display-inline="yes-display-inline">is not serving on an advisory committee or is serving as a chair or vice chair on an advisory committee; or</text></clause><clause commented="no" display-inline="no-display-inline" id="ida63c671a74d64baf9b1e8182c05db504"><enum>(ii)</enum><text display-inline="yes-display-inline">is not serving in a position classified as a general schedule position at the GS–9 level or below, with limited responsibilities, closely supervised by a career Federal employee.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id4681ccb294d0434c9faf0096f1ad0ccf"><enum>8.</enum><header>Special Government employee rule</header><subsection id="idd7070134ad514399a3bd6b1e769da3a9"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (b), in the case of a special Government employee, as defined in section 202 of title 18, United States Code, who has served in their department or agency for more than 60 days during the immediately preceding period of 365 consecutive days, all Federal ethics rules shall apply to such special Government employee to the same extent that such rules apply to regular Government employees.</text></subsection><subsection id="idf8f41ca6f87d44599a1721daf6c1f537"><enum>(b)</enum><header>Exception</header><text>In the case of a special Government employee, as defined in section 202 of title 18, United States Code, who has served in their department or agency for more than 130 during the immediately preceding period of 365 consecutive days, section 209 of title 18, United States Code, and subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/131">chapter 131</external-xref> of title 5, United States Code, shall apply to such special Government employee to the same extent that the section applies to regular Government employees, except that such section 209 shall apply whether the special Government employee serves with or without pay. </text></subsection></section></legis-body></bill>
