which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Administrator of the Environmental Protection Agency to provide grants to air pollution control agencies to implement a cleaner air space program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HBCBF97A8510B4E9794C64279512E561F"><section section-type="section-one" id="H55B99E5F5AFC4B248FFA8F45E98CEE60"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cleaner Air Spaces Act of 2025</short-title></quote>.</text></section><section id="H6D06E53C1FD247B78E16C42925B45F55"><enum>2.</enum><header>Cleaner air space program grants</header><subsection id="id48C48ABAB15E4D19A12733E8B39D8D14"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="idC9E2E67CCAD1470F9304FC2566FF663F"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="idE46F4EE067E842AA94E596AA1B6285E2"><enum>(2)</enum><header>Air pollution control agency</header><text>The term <term>air pollution control agency</term> has the meaning the term given in section 302 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7602">42 U.S.C. 7602</external-xref>).</text></paragraph><paragraph id="id87AEE888A018407F9F9AC2BBDBB288E3"><enum>(3)</enum><header>Clean air center</header><text display-inline="yes-display-inline">The term <term>clean air center</term> means 1 or more clean air rooms in a publicly accessible building.</text></paragraph><paragraph id="id0C68F61876E14ABCAD86286FC1A37A55"><enum>(4)</enum><header>Clean air room</header><text>The term <term>clean air room</term> means a room that is designed to keep levels of harmful air pollutants as low as possible during wildland fire smoke events.</text></paragraph><paragraph id="idD6F109FBBA7849369B8E59C49A7B52D0"><enum>(5)</enum><header>Covered household</header><text display-inline="yes-display-inline">The term <term>covered household</term> means a household that—</text><subparagraph id="idDF058C7932CE4B8AA3913D5B89C5DE33"><enum>(A)</enum><text>is located in a low-income community; and</text></subparagraph><subparagraph id="idDDC23B0FC95349ABB4CE407DB71313FB"><enum>(B)</enum><text>includes a person who—</text><clause id="id5AB34A3529A44C4CBD1852293A9108C9"><enum>(i)</enum><text>is at high risk of experiencing a wildland fire smoke event; and</text></clause><clause id="idDD8FA05402A8425CA8A4459FDBCB397B"><enum>(ii)</enum><text>is vulnerable to negative health effects caused by wildland fire smoke due to factors such as an underlying health condition, a disability, or age.</text></clause></subparagraph></paragraph><paragraph id="idDF28186C72964674870DC8F8E3D82B32"><enum>(6)</enum><header>Eligible air filtration unit</header><text>The term <term>eligible air filtration unit</term> means an air filtration unit that—</text><subparagraph commented="no" id="id224B80C3E1D845CCA36C7E7169728654"><enum>(A)</enum><text>is certified by the Association of Home Appliance Manufacturers to have a Clean Air Delivery Rate of at least 97 for smoke; </text></subparagraph><subparagraph id="id284AA95F285A44FB9386C438BC479F08"><enum>(B)</enum><text display-inline="yes-display-inline">is certified under the Energy Star program established by section 324A of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6294a">42 U.S.C. 6294a</external-xref>);</text></subparagraph><subparagraph id="idF98AAC800B294CC3AE1C7CB17EA1B6F8"><enum>(C)</enum><text>does not emit ozone; and</text></subparagraph><subparagraph id="id421ABE85E7A14C4CA84BE73CFF910627"><enum>(D)</enum><text>uses a true high-efficiency particulate air filter rated to remove 99.97 percent of particles measuring 0.3 micrometers or greater.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6D1000059CC44FADAD85377351B62681"><enum>(7)</enum><header>Low-income community</header><text>The term <term>low-income community</term> has the meaning given the term in section 45D(e) of the Internal Revenue Code.</text></paragraph></subsection><subsection id="H826CC1E17B45411B824CB0DDECF64FFD"><enum>(b)</enum><header>Grants authorized</header><text>Subject to the availability of appropriations, the Administrator shall provide grants to air pollution control agencies to implement a cleaner air space program in accordance with this section.</text></subsection><subsection id="H3409DDD303D34842B06243A27E32F4BC"><enum>(c)</enum><header>Grant requirements</header><paragraph id="H491D2B6155E94FBFBBB481BA949EC037"><enum>(1)</enum><header>Amounts</header><text display-inline="yes-display-inline">Under this section, the Administrator may not provide a grant to an air pollution control agency in an amount that exceeds $3,000,000.</text></paragraph><paragraph id="HC7389D6C3ACD45199560ACA67B79AD2D"><enum>(2)</enum><header>Grants for Tribes</header><text>The Administrator shall provide at least 1 grant under this section to a Tribal agency that has jurisdiction over air quality.</text></paragraph></subsection><subsection id="HB74FCE34B8944B3F8E66B8EF6A4E06DC"><enum>(d)</enum><header>Application</header><paragraph id="H51FDB1F8FBA54F18898274A01FD38A60"><enum>(1)</enum><header>In general</header><text>To apply for a grant under this section, an air pollution control agency shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator determines appropriate, including a proposal for the implementation of a cleaner air space program.</text></paragraph><paragraph id="H8A71251713D14FDCBD13D19D9A6E00E0"><enum>(2)</enum><header>Proposal for cleaner air space program requirements</header><text>A proposal for the implementation of a cleaner air space program of an air pollution control agency under paragraph (1) shall include the following:</text><subparagraph id="H0ACBBF68B64D481C886ED577138374BF"><enum>(A)</enum><text>Certification of partnering with a community-based organization.</text></subparagraph><subparagraph id="HABC5DC0CBE6749F495DC3C63C0AE6A5B"><enum>(B)</enum><text>Details on the responsibilities of all parties involved with the cleaner air space program, including the responsibilities of—</text><clause id="H522E03F9AFF542C19386BC4693E3255B"><enum>(i)</enum><text>the air pollution control agency; and</text></clause><clause id="H42B6A724A23040B7A0085CDF38D30643"><enum>(ii)</enum><text>any community-based organizations with which the air pollution control agency is partnering under subparagraph (A).</text></clause></subparagraph><subparagraph id="H007A64C0FF7842D49B2AD8A43B819C6A"><enum>(C)</enum><text>Information with respect to which geographic population or community of covered households may be receiving eligible air filtration units under the cleaner air space program.</text></subparagraph><subparagraph commented="no" id="H393DB429FDE448FA9B0FCB1AB9BC969D"><enum>(D)</enum><text display-inline="yes-display-inline">Information on how the air pollution control agency plans—</text><clause id="HFCE0CC3C71064C60821BC56D48946BAD"><enum>(i)</enum><text>to distribute educational materials related to eligible air filtration units; and</text></clause><clause id="HA1433855A6FA43A994BFC9F4EFCDD56B"><enum>(ii)</enum><text>to advertise the availability of clean air centers.</text></clause></subparagraph><subparagraph id="H31EAF20838064BB288546E1244E4062C"><enum>(E)</enum><text>Information on how the air pollution control agency plans to establish a clean air center, including—</text><clause id="HD6FF9A67FA5D4E199A7D2C03F7CE7BE8"><enum>(i)</enum><text>the facility in which a clean air center may be established; and</text></clause><clause id="H33A3FD14CCE7434D9A05EB5AC73107EB"><enum>(ii)</enum><text>the capacity and ventilation characteristics of that facility.</text></clause></subparagraph><subparagraph commented="no" id="H11BF3D13494748548B547B22178FA998"><enum>(F)</enum><text display-inline="yes-display-inline">A description of the costs that may be associated with the cleaner air space program, including any administrative costs.</text></subparagraph></paragraph></subsection><subsection id="H9FBD72009ACA4979B5DD8AA3964FDEF5"><enum>(e)</enum><header>Cleaner air space program requirements</header><text>Subject to satisfaction of the partnership requirement described in subsection (f), an air pollution control agency implementing a cleaner air space program pursuant to a grant provided under subsection (b) shall— </text><paragraph id="HB3E24B6894A54D589C984B99F4513E84"><enum>(1)</enum><text>establish at least 1 clean air center that is—</text><subparagraph id="H1CD468D89E6842C9A44B3119D1145802"><enum>(A)</enum><text>located in an area at risk of being exposed to wildland fire smoke; </text></subparagraph><subparagraph id="H89BC8E1F0B42495681D0A6CBE4443DA8"><enum>(B)</enum><text>accessible to individuals that reside in covered households; </text></subparagraph><subparagraph commented="no" id="HC469D3C66CE14381B0B7488A9295F580"><enum>(C)</enum><text display-inline="yes-display-inline">open, accessible, and staffed during wildland fire smoke events with the option of being open, accessible, and staffed before or after wildland fire smoke events;</text></subparagraph></paragraph><paragraph id="H79ECC90524154963BDB489471E61BE04"><enum>(2)</enum><text>advertise to the public—</text><subparagraph id="H57A80F29AA5444D2A40A3B6B54C68AAE"><enum>(A)</enum><text>during a wildland fire smoke event, the availability of a clean air center; and</text></subparagraph><subparagraph id="H7C21FBDF5CC646D28963C5714311C7B3"><enum>(B)</enum><text>the cleaner air space program that the air pollution control agency is implementing, including information about the cleaner air space program, the availability of free air filtration units (if applicable), eligibility requirements to receive those free air filtration units, and information on who to contact for more information with respect to the cleaner air space program;</text></subparagraph></paragraph><paragraph id="H96596EEDC35F422D9D935D030813B7CF"><enum>(3)</enum><text>at no cost to covered households—</text><subparagraph id="H10B093A25F164B6A96664509287B6C06"><enum>(A)</enum><text>distribute not less than 1,000 eligible air filtration units to those covered households; and</text></subparagraph><subparagraph id="H37EC5D7927CF4980BBC4F53FDDD7431F"><enum>(B)</enum><text>provide 1 air filter replacement for each eligible air filtration unit distributed under subparagraph (A);</text></subparagraph></paragraph><paragraph commented="no" id="H0C13AE732D4A4303B60F7989F92CF29E"><enum>(4)</enum><text>distribute educational materials that include information with respect to how to best utilize an eligible air filtration unit to create a clean air room in a home; </text></paragraph><paragraph commented="no" id="H1D39B39D1890408188C64B8CCA05A8D9"><enum>(5)</enum><text>collect, and provide to the Administrator, information on—</text><subparagraph commented="no" id="HDA3586DB9E1C42C38873BA2AB937A35C"><enum>(A)</enum><text>each type of eligible air filtration unit distributed under the cleaner air space program;</text></subparagraph><subparagraph commented="no" id="HB5EBA606D5424BFABE2DDDD75004043C"><enum>(B)</enum><text>the number of eligible air filtration units so distributed; and</text></subparagraph><subparagraph commented="no" id="H6AA1FD9D7CD44D6C872D50AB53B8247F"><enum>(C)</enum><text>the cost of each type of eligible air filtration unit so distributed; and</text></subparagraph></paragraph><paragraph id="H324D426001A34FFBAF73C5CD59C1160D"><enum>(6)</enum><text>not later than 6 months after providing an eligible air filtration unit to a covered household, conduct an anonymous survey of an individual of the covered household that received the eligible air filtration unit through the cleaner air space program with respect to—</text><subparagraph id="HA9206EABEE51418FAB9901F6589DDAF9"><enum>(A)</enum><text>whether the individual understood how to properly set up a clean air room and how to utilize the air filtration unit;</text></subparagraph><subparagraph id="H68E9B727F6EC4EEB80E418E80D83141A"><enum>(B)</enum><text display-inline="yes-display-inline">how often the individual utilized the air filtration unit;</text></subparagraph><subparagraph id="HE8157C9196D14518B2DC81071E96AE96"><enum>(C)</enum><text>the largest barriers to properly utilizing the air filtration unit or creating a clean air room;</text></subparagraph><subparagraph commented="no" id="H1C5627F2806F43B0AA2844C3917A6EAC"><enum>(D)</enum><text>whether the individual reported better air conditions in the clean air room compared to other parts of the home of that individual; and</text></subparagraph><subparagraph id="HEC35DC3057C0492D96906FF35BAAA02C"><enum>(E)</enum><text>how the implementation of the cleaner air space program could improve.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HBE2DD052D7904166A8640EE62275A204"><enum>(f)</enum><header>Partnership</header><text>In implementing a cleaner air space program pursuant to a grant provided under subsection (b), an air pollution control agency shall partner with at least 1 community-based organization to carry out the requirements of the cleaner air space program described in subsection (e).</text></subsection><subsection id="HC6A244B3316E424DA8BF350AA8C0BA42"><enum>(g)</enum><header>Report</header><text>Not later than 3 years after the date of enactment of this Act, the Administrator shall submit to Congress a report that includes—</text><paragraph id="HF773346C1CC945E28F42A5C8110ED158"><enum>(1)</enum><text>information on each cleaner air space program implemented using a grant provided under subsection (b), including—</text><subparagraph id="HDE4E303E3D9D479CAB926AF9BE2B009B"><enum>(A)</enum><text>the name of the air pollution control agency that received the grant; and</text></subparagraph><subparagraph id="H7B5A679CE214420BAC1B7E59826EA154"><enum>(B)</enum><text>the information described in subsection (e)(5) collected by the air pollution control agency;</text></subparagraph></paragraph><paragraph commented="no" id="H0722CB31739E473882CF7B551D3FFC95"><enum>(2)</enum><text>responses from the surveys described in subsection (e)(6); and</text></paragraph><paragraph id="H2544D758443B4589A47B94BFA55FCF39"><enum>(3)</enum><text>recommendations with respect to—</text><subparagraph id="H65B5AA20377543D6BEEC0A64D79DA4EA"><enum>(A)</enum><text>whether the grant program under this section should be expanded; and</text></subparagraph><subparagraph id="HD8E6A37411ED4F5AA85147903F5807AD"><enum>(B)</enum><text>how the grant program under this section can be improved.</text></subparagraph></paragraph></subsection><subsection id="H28C1384C9CEF48FBBA6399ECDD0CD7B9"><enum>(h)</enum><header>Authorization of appropriations</header><paragraph id="HDC64ECA34A0341DBA20FF7C69CEEC7F1"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Administrator to carry out this section $30,000,000 for the period of fiscal years 2026 through 2028.</text></paragraph><paragraph id="H66EB105AA9814C3EA0B921C5A9AD3FDF"><enum>(2)</enum><header>Administrative expenses</header><text>Of the funds made available under paragraph (1), the Administrator may use not more than 10 percent for expenses relating to administering the grant program under this section.</text></paragraph></subsection></section></legis-body></bill>
