which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Export Control Reform Act of 2018 to establish a whistleblower incentive program and provide protections to whistleblowers. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Stealing our Chips Act</short-title></quote>.</text></section><section id="ida6cbaf2e274943689f8cfa8263e3c4e6"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="idac17919c94734b1e8cf52fa84cde264c"><enum>(1)</enum><text>Violations of the export control laws of the United States, especially the diversion of leading-edge artificial intelligence chips into countries that are adversaries of the United States, threaten the national security of the United States.</text></paragraph><paragraph id="id1c88b26c424945918b7997a7d40b9d77"><enum>(2)</enum><text>Individuals who accurately report violations of United States export control laws play a significant role in helping authorities identify and mitigate such threats.</text></paragraph><paragraph id="id0bd89a9c0e9445078ef81011ac38bf5d"><enum>(3)</enum><text>An incentive program that rewards whistleblowers can significantly enhance enforcement efforts by encouraging individuals to provide high-value information on potential violations.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id970d41d8e3bf4883929590c7aa344d70"><enum>3.</enum><header>Establishment of Whistleblower Incentive Program and Whistleblower Protections</header><subsection commented="no" display-inline="no-display-inline" id="idf531fef5da9746a6b0557a081f17e1e4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801 et seq.</external-xref>) is amended by inserting after section 1761 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id22575EF63F354AE5A6282F02F3214714"><section section-type="subsequent-section" id="idD7DB685DC595494E8E3FA28AC3A13E80"><enum>1761A.</enum><header>Whistleblower Incentives and Protections</header><subsection commented="no" display-inline="no-display-inline" id="idd0e9132f613543059777d186acea8a06"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" id="idae8deff5c2c046828ce0f3a5693d9a6a"><enum>(1)</enum><header>Original information</header><text>The term <term>original information</term> means information that is—</text><subparagraph commented="no" id="id46e5b1597df04cccbef469f31a4d732e"><enum>(A)</enum><text>derived from the independent knowledge or analysis of a whistleblower;</text></subparagraph><subparagraph commented="no" id="id45bbb55ddf474bfc9f9599ea5fec4e16"><enum>(B)</enum><text>not known to the Secretary from any other source;</text></subparagraph><subparagraph commented="no" id="id1e322bed5aa24d5f816924b14e73e03d"><enum>(C)</enum><text>not exclusively derived from an allegation made in a judicial or administrative hearing, a governmental report, hearing, audit, or investigation, or from news media, unless the whistleblower is the source of such allegation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id960f449977fe4b9f9aefc85a10ccdad2"><enum>(D)</enum><text>provided to the Secretary voluntarily, without any request from the Secretary or any other government official. </text></subparagraph></paragraph><paragraph commented="no" id="idf9ca46cf77bc4b88b220cb03fe4debf2"><enum>(2)</enum><header>Whistleblower</header><subparagraph commented="no" display-inline="no-display-inline" id="id7f23e235f9514d32938041bead3c59c8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>whistleblower</term> means, except as provided by subparagraph (B), any individual (including an individual who is not a United States citizen) who provides, or 2 or more such individuals acting jointly who provide, to the Secretary information relating to a possible violation of this part or of any regulation, order, license, or other authorization issued under this part.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide3c6fa580aa242399c41aef18cd1de32"><enum>(B)</enum><header>Exclusions</header><text display-inline="yes-display-inline">The term <term>whistleblower</term> does not include—</text><clause commented="no" display-inline="no-display-inline" id="id4f656d33f392463ca422acf2c1877935"><enum>(i)</enum><text display-inline="yes-display-inline">a Federal employee acting within the scope of the duties of the employee; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id9276053f967a4b939071f82443ee2c0d"><enum>(ii)</enum><text>an individual on the list of specially designated nationals and blocked persons maintained by the Office of Foreign Assets Control of the Department of the Treasury. </text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf6e3945219e7487cb691ddf57094f8bd"><enum>(b)</enum><header>Whistleblower Incentive Program</header><paragraph commented="no" display-inline="no-display-inline" id="id185b3b6f21e4480cbebb285a8cd53e9f"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text>Not later than 120 days after the date of the enactment of this section, the Secretary shall establish a whistleblower incentive program to reward individuals who provide original information that leads to the imposition of fines under this part on persons that violate, attempt to violate, conspire to violate, or cause a violation of this part or any regulation, order, license, or other authorization issued under this part.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcbd9eb30958d4e68ae3aaf5ba9f7e954"><enum>(2)</enum><header>Whistleblower reports</header><subparagraph commented="no" display-inline="no-display-inline" id="idb9cb6c8dbf034da592b8cad58ef96032"><enum>(A)</enum><header display-inline="yes-display-inline">Online portal</header><text>Not later than 120 days after the date of the enactment of this section, the Secretary shall develop, implement, and maintain a secure portal, on a website accessible to the public, for the reporting of original information relating to persons that violate, attempt to violate, conspire to violate, or cause a violation of this part or any regulation, order, license, or other authorization issued under this part.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3f947791fd0741ca90a3fb4db959f3cb"><enum>(B)</enum><header>Anonymity</header><text><?xm-replace_text text?></text><clause commented="no" display-inline="no-display-inline" id="id369107ac537a46bf88ef9db5b56321d0"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">As an alternative to submission through the portal required by subparagraph (A), an individual may submit a report of original information under this subsection anonymously, including through an attorney. </text></clause><clause commented="no" display-inline="no-display-inline" id="id360e9da76b934d6293ce7482bf1468a7"><enum>(ii)</enum><header>Exception</header><text>The Secretary may require that the identity of an individual be disclosed for the individual to receive an award under paragraph (3). </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide3379516487a492a93d3db958c35dc15"><enum>(C)</enum><header display-inline="yes-display-inline">Expedited review</header><clause commented="no" display-inline="no-display-inline" id="id70332dab1e794c47b29de453f4e1f6cc"><enum>(i)</enum><header display-inline="yes-display-inline">Initial review</header><text>Not later than 60 days after the date of receipt of a report from a whistleblower, the Secretary shall—</text><subclause commented="no" display-inline="no-display-inline" id="idb7e581a250d84398903d4bdc5450b628"><enum>(I)</enum><text display-inline="yes-display-inline">determine whether the report is credible; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id357a0dbe2bae41a689c848ccf1b4e4b0"><enum>(II)</enum><text display-inline="yes-display-inline">if credible, initiate a formal investigation of the allegations contained in the report.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id6e084b01e5c44ed69870425a371951bc"><enum>(ii)</enum><header>Investigation</header><text display-inline="yes-display-inline">Unless the Secretary determines that the investigation is particularly complex, the Secretary shall conclude the investigation not later than 180 days after the date on which a formal investigation has been initiated under clause (i).</text></clause><clause commented="no" display-inline="no-display-inline" id="id8ecbc3f0e59c4bb1af9f01ba322fbde5"><enum>(iii)</enum><header>Notification</header><text display-inline="yes-display-inline"><?xm-replace_text text?></text><subclause commented="no" display-inline="no-display-inline" id="idd6611de6aca4474fb534ef30ad89b4ac"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall update the whistleblower on the status of a report and, if applicable, the related investigation not later than 30 days after the date on which the whistleblower submitted the report and not less frequently than every 30 days thereafter.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id48d047b29f6445e684b8e1311e2da872"><enum>(II)</enum><header>Sensitive information</header><text>The Secretary may omit from the updates required by subclause (I) any information that could compromise an ongoing investigation. </text></subclause></clause></subparagraph><subparagraph id="idea074c2d6748492eb89364eb786ea76e"><enum>(D)</enum><header>Avoidance of frivolous reports</header><text>The Secretary may prohibit an individual from making reports under this subsection if the individual has previously submitted multiple reports under this subsection that the Secretary determined under subparagraph (C)(i) were not credible.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida87b74e6a8e442b98cea4750c0ee4fd4"><enum>(3)</enum><header display-inline="yes-display-inline">Awards</header><subparagraph commented="no" display-inline="no-display-inline" id="ida326e9e87fe4412c844153ae292a3881"><enum>(A)</enum><header display-inline="yes-display-inline">Eligibility</header><text>Subject to subparagraph (B), the Secretary may pay an award or awards to any whistleblower who provided original information that led to the imposition of a fine under this part on a person or persons that violated, attempted to violate, conspired to violate, or caused a violation of this part or any regulation, order, license, or other authorization issued under this part.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id21c9161f92f24d2d8cfe8e5c257a8fb9"><enum>(B)</enum><header>Disqualification</header><text><?xm-replace_text text?></text><clause commented="no" display-inline="no-display-inline" id="idaa3a43f7fac94d20a5e9e63e5ef1a136"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to clause (ii), the Secretary may not pay an award or awards to any whistleblower who provides original information with respect to a person or persons that violated, attempted to violate, conspired to violate, or caused a violation of this part or any regulation, order, license, or other authorization issued under this part, if such information was obtained through—</text><subclause id="idcdb7b1e9ac114833aca15624a314f4dd"><enum>(I)</enum><text>the role of the whistleblower as—</text><item commented="no" display-inline="no-display-inline" id="id400fe578001b4aca9b4ffea07d7aecb2"><enum>(aa)</enum><text display-inline="yes-display-inline">an officer, director, trustee, or partner of an entity that handles internal processes for legal violations for the person or persons; </text></item><item commented="no" display-inline="no-display-inline" id="id02b6ca2c95624543a1d6cf81f6984e89"><enum>(bb)</enum><text display-inline="yes-display-inline">an employee of an entity that conducts compliance or internal audits for the person or persons; </text></item><item commented="no" display-inline="no-display-inline" id="id04e6249bdaf84e05a6594669fc326b49"><enum>(cc)</enum><text display-inline="yes-display-inline">an employee of a public accounting firm if the information was obtained while working on an engagement required by Federal securities laws, other than specific audits; or</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id2f9b7e884f2a416395a66b53f9799531"><enum>(II)</enum><text display-inline="yes-display-inline">any means that violates Federal or State criminal law.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idf9924dba0be8499988995cf9b916f4e5"><enum>(ii)</enum><header>Exceptions</header><text>Clause (i) shall not apply if—</text><subclause commented="no" display-inline="no-display-inline" id="id99f465bcc9b0444da86238bda4a0b02a"><enum>(I)</enum><text display-inline="yes-display-inline">the whistleblower had a reasonable basis to believe that disclosing the original information to the Secretary was necessary to stop conduct likely to cause significant financial harm;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idfe1c4272c1e44b08af5bacc31485c66b"><enum>(II)</enum><text display-inline="yes-display-inline">the whistleblower had a reasonable basis to believe that the relevant entity was obstructing an investigation into the misconduct; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1051b350df2f4a60aef2fbe7cd5cb524"><enum>(III)</enum><text>not less than 120 days have elapsed since the whistleblower provided the information to the audit committee, chief legal officer, chief compliance officer (or their equivalent) of the relevant entity or the supervisor of the whistleblower.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaed7c9ae1fd54d399c98e1835262efbd"><enum>(C)</enum><header display-inline="yes-display-inline">Amount</header><text><?xm-replace_text text?></text><clause commented="no" display-inline="no-display-inline" id="idc4956200ffc74cb786cfbdd27f893f7f"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">An award issued under subparagraph (A) shall be—</text><subclause commented="no" display-inline="no-display-inline" id="idaab654621b72459ab99b9826dee55336"><enum>(I)</enum><text display-inline="yes-display-inline">not less than 10 percent, in total, of the amount collected of the fine imposed under this part; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5c10ff49d5234caca0282edef0130170"><enum>(II)</enum><text>not more than 30 percent, in total, of the amount collected of that fine.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idc512745c6fb44924bb6ba6e91e4919c4"><enum>(ii)</enum><header>Jointly submitted report</header><text>In the case of a report that was submitted jointly by 2 or more individuals, any award issued under subparagraph (A) shall be split equally among the individuals.</text></clause></subparagraph><subparagraph id="idb5a621e287dd4b83a212ac22556afac7"><enum>(D)</enum><header>Determination</header><text>The Secretary shall determine the amount of an award made under subparagraph (A) taking into account, with respect to the information provided—</text><clause commented="no" display-inline="no-display-inline" id="id2529dc0545ee43f7a65651e308df5378"><enum>(i)</enum><text display-inline="yes-display-inline">accuracy;</text></clause><clause commented="no" display-inline="no-display-inline" id="id1c8e5633daeb4b34b7058fc017e59516"><enum>(ii)</enum><text display-inline="yes-display-inline">relevance;</text></clause><clause commented="no" display-inline="no-display-inline" id="idcd65ce405fbf4de4b337f1ed9580d7ea"><enum>(iii)</enum><text display-inline="yes-display-inline">timeliness; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id4dfad59216d74a3a981cb8d60c8cd7eb"><enum>(iv)</enum><text display-inline="yes-display-inline">usefulness.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5765281c05ef47a191c8cb009dc2de5c"><enum>(4)</enum><header display-inline="yes-display-inline">Publication</header><subparagraph commented="no" display-inline="no-display-inline" id="id1db33b7e9df442769824c499a43eb2af"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than the date on which the online portal required by paragraph (2)(A) is complete, the Secretary shall develop and implement a plan to publicize the whistleblower incentive program established by paragraph (1).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7ac5a1b17a9f4143a045456d1e902212"><enum>(B)</enum><header>Funding</header><text>The Secretary shall pay any expenses incurred under subparagraph (A) from amounts authorized to be appropriated to the Bureau of Industry and Security.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id06bd55f5ec5d4da297c47e4e53b842a2"><enum>(c)</enum><header>Protection of whistleblowers</header><paragraph commented="no" display-inline="no-display-inline" id="id66ed9d6ac69646fa965eebf9382f03dd"><enum>(1)</enum><header display-inline="yes-display-inline">Prohibition against retaliation</header><subparagraph commented="no" display-inline="no-display-inline" id="idb0d89c35cd984b63943e75c45747a7cd"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Except as provided in subparagraph (B), no employer may discharge, demote, suspend, threaten, harass, directly or indirectly, or in any other manner discriminate against a whistleblower in the terms and conditions of employment because of a lawful act done by the whistleblower—</text><clause commented="no" display-inline="no-display-inline" id="id5e523614e5ed4259943c0c0a847dd0a4"><enum>(i)</enum><text display-inline="yes-display-inline">in reporting violations to the employer or to a law enforcement agency;</text></clause><clause commented="no" display-inline="no-display-inline" id="ide18e3dd449b54ff0bf58192104dd0b4a"><enum>(ii)</enum><text display-inline="yes-display-inline">in providing information to the Secretary in accordance with this section; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id6633fb3ca3b349e1b0f3ca42074587e7"><enum>(iii)</enum><text>in initiating, testifying in, or assisting in any investigation or judicial or administrative action based upon or related to such information.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id78b4431840cb47ea8dc5b03910c9f2f2"><enum>(B)</enum><header>Exception</header><text>The protection against retaliation established by subparagraph (A) shall not apply to any individual who reports information under this section knowing that such information is false. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0b9e493ab2b6447584371ee2054b2fdd"><enum>(C)</enum><header>Enforcement</header><clause commented="no" display-inline="no-display-inline" id="idec3ac39c2196429c9de12c65d856f97b"><enum>(i)</enum><header>Cause of action</header><text display-inline="yes-display-inline">An individual who alleges discharge or other discrimination in violation of subparagraph (A) may bring an action under this paragraph in the appropriate district court of the United States for the relief provided in subparagraph (D). </text></clause><clause commented="no" display-inline="no-display-inline" id="id2b9cdaf7a4204d2296acf22855552da7"><enum>(ii)</enum><header>Subpoenas</header><text>A subpoena requiring the attendance of a witness at a trial or hearing conducted under this subparagraph may be served at any place in the United States.</text></clause><clause commented="no" display-inline="no-display-inline" id="id42a282dcf9c8492a8259ffd1e3402934"><enum>(iii)</enum><header>Statute of limitations</header><subclause commented="no" display-inline="no-display-inline" id="id965724ce2693464c8292d9d0e3e0c208"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text>An action under this subparagraph shall not be entertained if commenced more than—</text><item commented="no" display-inline="no-display-inline" id="id61537fb634ba433d861a95df709796b2"><enum>(aa)</enum><text display-inline="yes-display-inline">6 years after the date of the violation of subparagraph (A) occurred; or </text></item><item commented="no" display-inline="no-display-inline" id="id701a3cf51f834f319c00ff783b7972f4"><enum>(bb)</enum><text display-inline="yes-display-inline">3 years after the date when facts material to the right of action are known or reasonably should have been known by the employee alleging a violation of subparagraph (A).</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id3c5fa681cdeb46929d88314afe491962"><enum>(II)</enum><header>Required action within 10 years</header><text>Notwithstanding subclause (I), an action under this subparagraph may not in any circumstance be brought more than 10 years after the date on which the violation occurs. </text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7055ec9293154a65a79c35cc1364b84c"><enum>(D)</enum><header>Relief</header><text>Relief for an individual prevailing in an action brought under subparagraph (C) shall include—</text><clause commented="no" display-inline="no-display-inline" id="idf998ffd0404d4561b62c11009978dd66"><enum>(i)</enum><text display-inline="yes-display-inline">reinstatement with the same seniority status that the individual would have had, but for the discrimination;</text></clause><clause commented="no" display-inline="no-display-inline" id="id219dfc37875840f7b75279ae079b0aad"><enum>(ii)</enum><text>2 times the amount of back pay otherwise owed to the individual, with interest; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idc0013549e5a847aa84b4e9a7f5a3044a"><enum>(iii)</enum><text>compensation for litigation costs, expert witness fees, and reasonable attorneys' fees.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID19713F3B041644A88DE2BC0326BF55FC"><enum>(2)</enum><header display-inline="yes-display-inline">Confidentiality</header><subparagraph commented="no" display-inline="no-display-inline" id="IDF34494D0FFD343799D9CEE6570403916"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraphs (B) and (C), the Secretary and any officer or employee of the Department of Commerce shall not disclose any information, including information provided by a whistleblower to the Secretary, that could reasonably be expected to reveal the identity of the whistleblower, except in accordance with the provisions of section 552a of title 5, United States Code, unless and until required to be disclosed to a defendant or respondent in connection with a public proceeding instituted by the Secretary or any entity described in subparagraph (D). </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6D43C788A4124B3C93A0104D42196B8F"><enum>(B)</enum><header>Exempted statute</header><text>For purposes of section 552 of title 5, United States Code, this paragraph shall be considered a statute described in subsection (b)(3)(B) of such section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID82358858F8E643048B268980DC6D6532"><enum>(C)</enum><header>Rule of construction</header><text>Nothing in this section is intended to limit, or shall be construed to limit, the ability of the Attorney General to present such evidence to a grand jury or to share such evidence with potential witnesses or defendants in the course of an ongoing criminal investigation.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID572FC7BD2BBA488BA5C7F8E55D224A24"><enum>(D)</enum><header>Availability to government agencies</header><clause id="ID1ECB8A67972E47A28D8A56321EFD8C2C"><enum>(i)</enum><header>In general</header><text>Without the loss of its status as confidential in the hands of the Secretary, all information referred to in subparagraph (A) may, in the discretion of the Secretary, when determined by the Secretary to be necessary to accomplish the purposes of this part or any regulation, order, license, or other authorization issued under this part, be made available to—</text><subclause id="ID604E37B5301546FFA35DBDB58939C164"><enum>(I)</enum><text>a Federal law enforcement agency;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id7f9876cb64034b218468a959a7e728ed"><enum>(II)</enum><text display-inline="yes-display-inline">a national security agency;</text></subclause><subclause id="ID8B244DA4317E4DCC808259323C460575"><enum>(III)</enum><text>an appropriate regulatory authority;</text></subclause><subclause id="ID0286B17D2BC8498CB0A53D5DB52390C8"><enum>(IV)</enum><text>a self-regulatory organization; and</text></subclause><subclause id="ID60A81ED4CDAC4B408B498ECDD1BAADC5"><enum>(V)</enum><text>a foreign law enforcement authority.</text></subclause></clause><clause id="IDDD961784FDB14ECEBEB3D3B83F9205C6"><enum>(ii)</enum><header>Confidentiality</header><subclause id="IDB414B3867A874E929A76A8D943059D28"><enum>(I)</enum><header>In general</header><text>Each of the entities described in subclauses (I) through (IV) of clause (i) shall maintain such information as confidential in accordance with the requirements established under subparagraph (A).</text></subclause><subclause id="ID246DEDE82C5741C8BE0BDA2397E8A687"><enum>(II)</enum><header>Foreign authorities</header><text>Each of the entities described in clause (i)(V) shall maintain such information in accordance with such assurances of confidentiality as the Secretary determines appropriate.</text></subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida280b11598c34dd78a7b3a57b9149345"><enum>(d)</enum><header>Export Compliance Accountability Fund</header><paragraph commented="no" display-inline="no-display-inline" id="id1ad739fbb1da434e8821b2cc2cad1aca"><enum>(1)</enum><header>Establishment</header><text>Not later than 90 days after the date of the enactment of this section, there shall be established in the Treasury of the United States a fund to be known as the <quote>Export Compliance Accountability Fund</quote> (in this subsection referred to as the <quote>Fund</quote>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idce08cddfed42498ca9247fc92efbbbc0"><enum>(2)</enum><header>Availability</header><text>At the end of each fiscal year, any amounts deposited into the Fund under paragraph (3) that remain in the Fund after the payment, for that fiscal year, of all expenses under paragraph (3) shall be transferred to the general fund of the Treasury. </text></paragraph><paragraph id="id889fe754f5ea423eb76c0c33f931b350"><enum>(3)</enum><header>Use of Fund</header><text>The Fund shall be available to the Secretary, without further appropriation or fiscal year limitation, for—</text><subparagraph id="id20eceabb4e4549bb92145938d1e78411"><enum>(A)</enum><text>paying awards to whistleblowers as provided in subsection (b)(3); </text></subparagraph><subparagraph id="id9c156760223148df8e73c2a14c7161ef"><enum>(B)</enum><text>funding activities that support the whistleblower incentive program and whistleblower protections, including—</text><clause commented="no" display-inline="no-display-inline" id="id6c44c1f2bc304e00832001ef0de3a328"><enum>(i)</enum><text display-inline="yes-display-inline">reviewing and investigating whistleblower reports;</text></clause><clause commented="no" display-inline="no-display-inline" id="id93dababc0a1d4cea93f83dddd09af989"><enum>(ii)</enum><text display-inline="yes-display-inline">providing training and education on compliance with the confidentiality requirement under subsection (c)(2); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id2dfd482130974b0ab36eadee6bf6eddc"><enum>(iii)</enum><text display-inline="yes-display-inline">record keeping, as considered necessary by the Secretary; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1130f5623dee4596ae8951e8469ccc4e"><enum>(C)</enum><text>if all outstanding awards under subsection (b)(3) have been paid, expenses related to enforcement of this part or any regulation, order, license, or other authorization issued under this part.</text></subparagraph></paragraph><paragraph id="id08dc81ad8c454c7083909e6d9e2d1265"><enum>(4)</enum><header>Deposits and credits</header><text>There shall be deposited into or credited to the Fund an amount equal to any fine collected by the Secretary on or after the date of the enactment of this section in any judicial or administrative action brought by the Secretary that depends on or was initiated because of original information submitted by a whistleblower.</text></paragraph></subsection><subsection id="id8589c8c271d04a0eb4e960422f455ede"><enum>(e)</enum><header>Initial funding</header><text>The Secretary shall pay, from amounts otherwise available to the Bureau of Industry and Security, any expenses incurred under this section before the Export Compliance Accountability Fund is established under subsection (d) and has received deposits under paragraph (3) of that subsection.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id7379aaf4c484484fbe39a0236ff9def3"><enum>(b)</enum><header>Conforming amendment</header><text>Section 1402(b)(1)(B) of the Victims of Crime Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/34/20101">34 U.S.C. 20101(b)(1)(B)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id009e477255f745b88b2abf8b5faccf33"><enum>(1)</enum><text>in clause (iii), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1bd952f5748845578e5ab1045b64e844"><enum>(2)</enum><text>in clause (iv), by striking the semicolon and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8a09d58b72ec469bb3b5229c434eeabb"><enum>(3)</enum><text>by adding at the end the following;</text><quoted-block style="USC" id="id685A66CD0E96491180D5133F13DADA11" act-name=""><clause id="id4A93E277D4F243FDAA8BCBCD8CFE4B2F"><enum>(v)</enum><text>the Export Compliance Accountability Fund pursuant to section 1761A(e) of the Export Control Reform Act of 2018.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
