<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 1464</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250410">April 10, 2025</action-date><action-desc><sponsor name-id="S359">Mr. Heinrich</sponsor> (for himself and <cosponsor name-id="S409">Mr. Luján</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To withdraw certain Bureau of Land Management land from mineral development.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" changed="not-changed" id="id6aa706c2ce2a4ac2ab7b4668e3af05a8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Buffalo Tract Protection Act</short-title></quote>.</text></section><section changed="not-changed" id="ida69e6b337710413199add5b9f3c0f43e"><enum>2.</enum><header>Withdrawal</header><subsection id="id57d811f852024253a8a62fa0bcb619db" changed="not-changed"><enum>(a)</enum><header>In general</header><text>Subject to valid existing rights, the Federal land described in subsection (b) is withdrawn from all forms of—</text><paragraph id="id8432d0d3df9a4ee5b71c1dbcf302594a" changed="not-changed"><enum>(1)</enum><text>location, entry, and patent under the mining laws; and</text></paragraph><paragraph id="id41ba8f197f71490e9545a958292cd991" changed="not-changed"><enum>(2)</enum><text>disposition under the mineral leasing, mineral materials, and geothermal leasing laws.</text></paragraph></subsection><subsection id="id48abfc5b0c8a45609d8640ea20e63e10" changed="not-changed"><enum>(b)</enum><header>Description</header><text>The Federal land referred to in subsections (a) and (c) is the approximately 4,288 acres of land administered by the Director of the Bureau of Land Management and generally depicted as <quote>Tract A</quote>, <quote>Tract B</quote>, <quote>Tract C</quote>, and <quote>Tract D</quote> on the map entitled <quote>Placitas, New Mexico Area Map</quote> and dated November 13, 2019.</text></subsection><subsection id="idb0d2edcc1a3d4cf29bb1201f708d3606" changed="not-changed"><enum>(c)</enum><header>Surface estate</header><paragraph id="id175aab5eb01344338ffd81a6c3e19fe4" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Subject to the reservation of the mineral estate under paragraph (2), nothing in this Act prohibits the Secretary of the Interior from conveying the surface estate of the Federal land described in subsection (b) in accordance with—</text><subparagraph id="id161ae187a5c6463e9ed1363e73d61499" changed="not-changed"><enum>(A)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); or</text></subparagraph><subparagraph id="ideb417a7a3544486488d0a4d197bc3b31" changed="not-changed"><enum>(B)</enum><text>the Act of June 14, 1926 (commonly known as the <quote>Recreation and Public Purposes Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/43/869">43 U.S.C. 869 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="id4498147a8df640328836173e4c5f1677" changed="not-changed"><enum>(2)</enum><header>Mineral estate</header><text>Any conveyance of the surface estate of the Federal land described in subsection (b) shall require a reservation of the mineral estate to the United States.</text></paragraph></subsection></section></legis-body></bill>
