which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Animal Welfare Act to provide for greater protection of roosters, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HB2E724E4E378445CA24A506B5CB19A7E"><section section-type="section-one" id="id9f79b34c909a455c98517b8e0f56773c"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fighting Inhumane Gambling and High-risk Trafficking Act of 2025</short-title></quote> or the <quote><short-title>FIGHT Act of 2025</short-title></quote>.</text></section><section section-type="subsequent-section" id="H2664EDC8E15F4E7094F3E1120EEACA32"><enum>2.</enum><header>Animal fighting</header><subsection commented="no" display-inline="no-display-inline" id="id672716234d5e4e3dac78db2160fda48c"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of rooster</header><text>Section 2 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2132">7 U.S.C. 2132</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idBCDB9560B2044826AA6D2002B75134E7"><subsection id="HDA45FBDACE474F04A439311898AD6C4E"><enum>(p)</enum><text display-inline="yes-display-inline">The term <quote>rooster</quote> means any male member of Gallus Domesticus species that is older than 6 months. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id9ffabf34c4db4d7e8364ce559c1db9a4"><enum>(b)</enum><header display-inline="yes-display-inline">Gambling on animal fighting ventures prohibited</header><text display-inline="yes-display-inline">Section 26 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2156">7 U.S.C. 2156</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idd737082129c74489b399c7b4639180d7"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the section designation and header and all that follows through <quote>It shall be unlawful</quote> in subsection (a)(2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7A8FF81B9AAE4EAB86D0F601C6E7AB85"><section commented="no" display-inline="no-display-inline" id="id95317f55249448d580cba559fae36c04"><enum>26.</enum><header>Sponsoring or exhibiting an animal in, attending, causing an individual who has not attained the age of 16 to attend, or gambling on, an animal fighting venture</header><subsection commented="no" display-inline="no-display-inline" id="ide2d00ab6cfa54622ac577173b2336983"><enum>(a)</enum><header display-inline="yes-display-inline">Sponsoring or exhibiting</header><paragraph commented="no" display-inline="no-display-inline" id="id605592424ed5476db0978b386bf2a3db"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">It shall be unlawful for any person to knowingly sponsor or exhibit an animal in an animal fighting venture.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5bcce773d1b34886aed9be6f5d1150be"><enum>(2)</enum><header>Attending or causing an individual who has not attained the age of 16 to attend</header><text display-inline="yes-display-inline">It shall be unlawful</text></paragraph></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7a36be23c47840d581ce16fcfcabef87"><enum>(2)</enum><text>in subsection (a), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD7A4ABA488E24EE59EB05CB2508BCB40"><paragraph id="HD80C295831894E328DDCACB03DCBC9A3"><enum>(3)</enum><header>Animal venture gambling</header><text display-inline="yes-display-inline">It shall be unlawful for any person to gamble on an animal fighting venture, including an in-person or broadcast event.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H04501815FA284FD187DB399AB24127FF"><enum>(c)</enum><header>Use of Postal Service or other interstate instrumentality To transport roosters</header><text display-inline="yes-display-inline">Section 26(c) of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2156">7 U.S.C. 2156(c)</external-xref>) is amended—</text><paragraph id="HDD3A10E9D9904B269023C33A2B314919"><enum>(1)</enum><text>in the subsection heading, by inserting <quote><header-in-text level="subsection" style="OLC">or to transport roosters</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">venture</header-in-text></quote>;</text></paragraph><paragraph id="H980E5D216B014BCBB0DFC709C2FF84D3"><enum>(2)</enum><text>by striking <quote>speech for purposes of advertising</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="H01B8433988A44E27B1A333B72A453FE6"><text>speech—</text><paragraph id="HB10B23B055FD490C84556E81C003FF8C"><enum>(1)</enum><text display-inline="yes-display-inline">for purposes of advertising</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="H03D9B83F74044FF8989F08A08092EFFA"><enum>(3)</enum><text>in paragraph (1) (as so designated), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="HBEACB6FC230144E69C719FA69E431E19"><enum>(4)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HCE4E7B0D97EA449385DEA7F7CFBBF895"><paragraph id="HC5041B7D9D5544688555583E2B5AEE3F"><enum>(2)</enum><text display-inline="yes-display-inline">to transport a rooster.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H67F17E4D53CB40168EC0FF102D25E2D0"><enum>(d)</enum><header>Civil citizen suits; seizure</header><text display-inline="yes-display-inline">Section 26(e) of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2156">7 U.S.C. 2156(e)</external-xref>) is amended—</text><paragraph id="HCCE7FBDF0BFD41C396E5BB16E3B74DAC"><enum>(1)</enum><text>by striking the subsection designation and heading and all that follows through <quote>The Secretary or any other person authorized by him</quote> in the first sentence and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H5912D616FCE44C458F6E759A86481429"><subsection id="H746A17C099B64B00AC6763875D120E0E"><enum>(e)</enum><header>Investigations; civil citizen suits</header><paragraph id="HB4A57E227D584B8C8CF5688BD0F63A71"><enum>(1)</enum><header>Investigation of violations by Secretary; assistance by other federal agencies; issuance of search warrant; forfeiture; cost recoverable in forfeiture or civil action</header><text display-inline="yes-display-inline">The Secretary, or any other person authorized by the Secretary,</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HD4375E386BFA482E872348FC6FF4ABA2"><enum>(2)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HC19766F3700747C2B6B150D6FF06C6B9"><paragraph id="H7C2EF072114E4677BE1D618B73828997"><enum>(2)</enum><header>Civil citizen suits</header><subparagraph id="H7B6D184AEA13495891A2F559A553B279"><enum>(A)</enum><header>In general</header><text>Any person may commence a civil suit in a district court of the United States on their own behalf to enjoin any person who is alleged to be in violation of any provision of this section. </text></subparagraph><subparagraph id="H0D4525C0CBC44215BB04934421C894C9"><enum>(B)</enum><header>Amount of fine</header><text>For any person found to have violated a provision of this section in any suit brought under subparagraph (A), the district court may issue a fine in an amount not greater than $5,000 for each violation. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7db7f4ddfb5e4c729501e165e8138782"><enum>(C)</enum><header>Requirement</header><text>A person seeking to commence a civil suit under subparagraph (A) shall, at least 60 days before commencing the suit, submit to the Secretary and local law enforcement notice of the alleged violation of a provision of this section.</text></subparagraph><subparagraph id="H9E55DA22693D47B6BC62F97BC9814FF1"><enum>(D)</enum><header>Limitation</header><text>No action may be commenced under subparagraph (A)—</text><clause id="H088E0A48AB2044A283613E025C2FF530"><enum>(i)</enum><text>if the Secretary has commenced an action against the same person to impose a penalty pursuant to paragraph (1) for the same alleged violation; or</text></clause><clause id="H050D2860822F4BB395CCB1CE641B442B"><enum>(ii)</enum><text>if the United States has commenced, and is diligently prosecuting, a criminal action against the same person in a State or Federal court to redress the same alleged violation.</text></clause></subparagraph><subparagraph id="H92718726B4314134BF8C8BA9257C7F1B"><enum>(E)</enum><header>Jurisdiction</header><text>A suit under this paragraph may be brought in the judicial district in which the alleged violation occurred. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id84fb18c3c89a4424a16a0a9de1e98517"><enum>(F)</enum><header>Intervention</header><text display-inline="yes-display-inline">The Attorney General, at the request of the Secretary, may intervene on behalf of the United States as a matter of right in any civil suit brought under subparagraph (A).</text></subparagraph><subparagraph id="HB2EE7A75A1D844B19586FD54BC5C4A06"><enum>(G)</enum><header>Attorney’s fees</header><text>The court, in issuing any final order in any suit brought under subparagraph (A), may award costs of litigation (including reasonable attorney and expert witness fees) to any party, whenever the court determines such an award is appropriate.</text></subparagraph></paragraph><paragraph id="HAEE470EEB1794ECD96507EF6839DCDAE"><enum>(3)</enum><header>Seizure</header><text display-inline="yes-display-inline">Whoever is found, pursuant to an investigation under paragraph (1), to have violated subsection (a)(1) shall, in addition to the penalties applicable under paragraph (1), be subject to seizure of all real property, including any right, title, and interest (including any leasehold interest) in the whole of any lot or tract of land and any appurtenances or improvements, that is used, or intended to be used, in any manner or part, to commit, or to facilitate the commission of, a violation of subsection (a)(1). </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H13CCD48579A143EC840456276DCEF11F"><enum>(e)</enum><header>Technical corrections</header><paragraph commented="no" display-inline="no-display-inline" id="idcc889f870d83499ba3b7426c050c029e"><enum>(1)</enum><text>Section 26(h) of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2156">7 U.S.C. 2156(h)</external-xref>) is amended to read as follows: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HC0A3FE5FB04847E78304843CA4C06E2B"><subsection id="H831858D05CF4449C80CB77BB1AE09A18"><enum>(h)</enum><header>Conflict with State law</header><text display-inline="yes-display-inline">The provisions of this Act shall not supersede or otherwise invalidate any such State, local, or municipal legislation or ordinance relating to animal fighting ventures except in case of a direct and irreconcilable conflict between any requirements thereunder and this Act or any rule, regulation, or standard hereunder.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HF21E72025BE64772AEF0EC013B4EA30B"><enum>(2)</enum><text>Section 3001(a) of title 39, United States Code, is amended by inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/7/2156">7 U.S.C. 2156</external-xref>),</quote> before <quote>is nonmailable</quote>.</text></paragraph></subsection></section></legis-body></bill>
