Russell National School Lunch Act to improve the child and adult care food program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HD6EBBADE3900496097A10237615A5130"><section section-type="section-one" id="H4A8040555C0C4F6DB484C5EAF1B91679"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Early Childhood Nutrition Improvement Act</short-title></quote>.</text></section><section id="H908D6F054CEC46879577186C4D28E4DA"><enum>2.</enum><header>Eligibility certification criteria for proprietary child care centers</header><text display-inline="no-display-inline"> Section 17(a)(6) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(a)(6)</external-xref>) is amended—</text><paragraph id="id19d5e621d11b4f5c8c4efcfc39677791"><enum>(1)</enum><text>in subparagraph (B), by inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771 et seq.</external-xref>)</quote> after <quote>1966</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd84b1d0bc3474053bd1f42ed086c6d24"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and indenting the clauses appropriately;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7dcc1485fe2a4f0a9492bae730c300c9"><enum>(3)</enum><text display-inline="yes-display-inline">in subparagraph (C)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6a1b293a40ee49fdb4a273e1d0403d71"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (ii), by striking <quote>(ii) in the case of a sponsoring organization, the organization shall employ</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8072D4525B0E412883D6B585016193C2"><subclause commented="no" display-inline="no-display-inline" id="idc274d95020e347518c18339a6375a8df" indent="up1"><enum>(II)</enum><text>if the institution is a sponsoring organization, employs</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id63b41d2ed55e4c6db14cd885a96e08ec"><enum>(B)</enum><text>by striking <quote>(C)(i) will provide</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA100882EF5D24D70992A6C80E2F1838E"><clause commented="no" display-inline="no-display-inline" id="ida351348a371941709b93760c3ea1e3d3"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="ided44b8e621004131b373ddd25b126be7"><enum>(I)</enum><text>will provide</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H06E110A5EE924DCB93D7869E58B3644B"><enum>(4)</enum><text>in subparagraph (D)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6396b521f4f34f4dbbc4816d995ec6a8"><enum>(A)</enum><text>by striking <quote>one employee, the organization</quote> and inserting <quote>1 employee,</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idad92811a79914cb89fba6ffb75fee6e7"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>(D) in the case of</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF91EB72D0128469A98A5E458598FDB9E"><clause commented="no" display-inline="no-display-inline" id="id69f007b2439144e2a6019c63b4736c69"><enum>(iv)</enum><text display-inline="yes-display-inline">if the institution is</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfade3b1605084030b58ddb08d5582c2c"><enum>(5)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking <quote>(E) in the case of a sponsoring organization, the organization</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF2D0BBB3C8204007ACDB5B110143511B"><clause commented="no" display-inline="no-display-inline" id="id10e753fab00a415f8cc3610e022d04b9"><enum>(v)</enum><text>if the institution is a sponsoring organization,</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H05DC7121EF3B44C3BDC5ABB640C0FFFA"><enum>(6)</enum><text>in subparagraph (F)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id051c3f48c59c4e75aa21cb7f86438195"><enum>(A)</enum><text>by striking <quote>the date of the enactment of this subparagraph</quote> and inserting <quote>June 20, 2000,</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8dfeee9a26bf456faf47ef0d31f977b8"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>the institution is bonded</quote> and inserting <quote>is bonded</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2C54148D364C491898FF901D87D2FAB9"><enum>(C)</enum><text display-inline="yes-display-inline">by striking <quote>in the case of</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6BD72F2A1A184B308136BE2DEA64E11A"><clause commented="no" display-inline="no-display-inline" id="id190a821d5e7447b09a2ee7ad44084e41"><enum>(vi)</enum><text display-inline="yes-display-inline">if the institution is</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HE9E956EBE19743018D1D2B86E664C868"><enum>(7)</enum><text>in the matter preceding clause (i) (as redesignated by paragraph (2))—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida9ee0f164c124e9aa3b3ec2afc897f78"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>it satisfies the following criteria:</quote> and inserting <quote>the institution—</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf49e05906864455cbf37b52707bb5cf8"><enum>(B)</enum><text>by striking <quote>No institution shall be</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC216EA3B1B75468888CDC2E6A1CFADBF"><subparagraph commented="no" display-inline="no-display-inline" id="idf2e8ce6be06941d69ec676e5247b64f3"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), an institution shall not be</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HC3D6CEE36D754D4988D325F0644B2A64"><enum>(8)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7BF7616D21474CBE88C905A1CAE95EEE"><subparagraph commented="no" id="H48AC5D33420E457886716D7535915250"><enum>(B)</enum><header>Annual determination for certain institutions</header><text display-inline="yes-display-inline">The eligibility of an institution described in paragraph (2)(B) shall be determined on an annual basis in accordance with this section.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H9F3C04EB37384177907B2D5A3B39D9BB"><enum>3.</enum><header>Review of serious deficiency process</header><text display-inline="no-display-inline">Section 17(d)(5) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(d)(5)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HFBD6FE568F27442F9243C0F670B35FDC"><subparagraph id="H6F4AE7AA48294795A4773E428ED69F1F"><enum>(F)</enum><header>Serious deficiency process</header><clause id="H797BF0BFFB434586A30E215EEDEED32F"><enum>(i)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this subparagraph, the Secretary shall review and issue guidance and, as appropriate, regulations regarding the serious deficiency process for the program under this section.</text></clause><clause id="HA81A4D532F24482EA401F1BD6FB9B9E9"><enum>(ii)</enum><header>Review</header><text>In carrying out clause (i), the Secretary shall review, at a minimum, the processes for, and the individuals involved in—</text><subclause id="H26624C9B6220482699EAA1BAB41E630F"><enum>(I)</enum><text>determining when there exists a serious deficiency with respect to an institution or a family or group day care home, including—</text><item id="H80E42102C1AD40C295C54CEEA626BC5A"><enum>(aa)</enum><text>the measures that will automatically result in a finding of serious deficiency; and</text></item><item id="H1727DF1B88104E5FA1A51859E14AC546"><enum>(bb)</enum><text>the means of differentiating between—</text><subitem id="H4291A81187B54ECDA5DCC4EA9FEE4C97"><enum>(AA)</enum><text>a reasonable margin of human error and systematic or intentional noncompliance; and</text></subitem><subitem id="H0E75095BA52D455186444A92A578DBA7"><enum>(BB)</enum><text>State-specific requirements and Federal regulations;</text></subitem></item></subclause><subclause id="H397BDECD1A2D4516A14F5E1148498DB8"><enum>(II)</enum><text>appealing and mediating a finding of serious deficiency with respect to an institution or a family or group day care home, including—</text><item id="HDFD50C1FF11945D6A85B1A6E9FDCA27A"><enum>(aa)</enum><text>findings relating to State-specific requirements; and</text></item><item id="H87C6C44C695140FF8D534CD3152A18E3"><enum>(bb)</enum><text>processes for ensuring that the officials involved in appeals and mediation are fair and impartial;</text></item></subclause><subclause id="H62E5D02FAAE2498883D104650FBCF5DF"><enum>(III)</enum><text>determining the circumstances under which a corrective action plan is acceptable;</text></subclause><subclause id="HBB8781A502C3438CA41CD3F0E9F65705"><enum>(IV)</enum><text>the termination and disqualification of institutions, family or group day care homes, and individuals under this paragraph, including maintenance of the list under subparagraph (E); and</text></subclause><subclause id="H83E0F1A5B4F7462AA3E72A3BC6994CF5"><enum>(V)</enum><text display-inline="yes-display-inline">determining opportunities for strengthening the processes intended to reduce the imposition of additional State agency requirements on institutions or family or group day care homes in addition to applicable requirements under Federal law, including—</text><item id="H6121BD1A6A4346E8993AB2BA463C4200"><enum>(aa)</enum><text>State evaluation of practices used at the time of review;</text></item><item id="H63DDD0171E624D03AA047FEBBAE8CAB8"><enum>(bb)</enum><text>regional approval of those additional State agency requirements; and</text></item><item id="HB500BC391C544546830EE4E31EC900A2"><enum>(cc)</enum><text>oversight through the management evaluation process.</text></item></subclause></clause><clause id="H27BB79C3BE6F4D1E84D6221DAF21D2F2"><enum>(iii)</enum><header>State-specific requirements</header><text display-inline="yes-display-inline">The Secretary may not consider State-specific requirements in determining noncompliance or serious deficiency under this paragraph.</text></clause><clause id="H6A0F1256ACC2432FAA37229C81CA25BC"><enum>(iv)</enum><header>Guidance and regulations</header><subclause id="H8053F7AB26B644A88F96DB4B20D22375"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">After conducting the review under clause (i), the Secretary shall—</text><item commented="no" display-inline="no-display-inline" id="id295bffc7b8a94527aaca675516d68990"><enum>(aa)</enum><text display-inline="yes-display-inline">make findings from the information collected;</text></item><item commented="no" display-inline="no-display-inline" id="idad03acedb6f34343997bd78d56beae33"><enum>(bb)</enum><text display-inline="yes-display-inline">issue guidance and, as appropriate, regulations from those findings that will—</text><subitem id="H5615443FDB67478EA47561922D26E1A1"><enum>(AA)</enum><text>streamline and modernize the program under this section; and</text></subitem><subitem id="H53FC33D07B6846A7826F58A9DECD5A50"><enum>(BB)</enum><text>reduce the paperwork burden on parents; and</text></subitem></item><item id="HDE887EA33E8C418DA7D7EE7CA5519C13"><enum>(cc)</enum><text>assist sponsoring organizations, State agencies, and the Food and Nutrition Service in ensuring a fair, uniform, and effective administration of the serious deficiency process under this paragraph, while retaining program integrity.</text></item></subclause><subclause id="H127217BAA2B442D7835757E67447BBA0"><enum>(II)</enum><header>Scope</header><text>The guidance and regulations issued pursuant to subclause (I) shall include—</text><item id="HA1DD4B71D9B04200B7FBEDA7963B5DD0"><enum>(aa)</enum><text display-inline="yes-display-inline">provisions to ensure clarity with respect to required measures for noncompliance, including—</text><subitem id="H8C91C015168442C48DF8DAAB911A8916"><enum>(AA)</enum><text display-inline="yes-display-inline">an allowance for a reasonable margin of human error; and</text></subitem><subitem id="H3FC495F66A52473D89F7EA513EA7D633"><enum>(BB)</enum><text>a distinction between a reasonable margin of human error and systematic or intentional noncompliance;</text></subitem></item><item id="HCE73A37664C04DF2BF8DFB706F7222DF"><enum>(bb)</enum><text display-inline="yes-display-inline">a formal appeals and mediation process that—</text><subitem id="HB29FAE2DECDA4D749761E86744641B71"><enum>(AA)</enum><text>is conducted by a trained official who is independent from, and not affiliated with, any person or agency involved in the determination being appealed or mediated; </text></subitem><subitem id="HC595C84DF37A47A0BE1A70D45BA9706F"><enum>(BB)</enum><text>provides an opportunity for a fair hearing for any institution or family or group day care home determined to have a serious deficiency finding or inadequate corrective action plan; and</text></subitem><subitem id="H028F58C677A94D3D971C7D4CB1A4408E"><enum>(CC)</enum><text>provides for the evaluation and resolution of disputes regarding State agency requirements applicable to institutions or family or group day care homes that are in addition to applicable requirements under Federal law;</text></subitem></item><item id="H65AD288A72FD4C6EBEBE7EA8128C3C3F"><enum>(cc)</enum><text>timeframes for acceptable corrective action plans for group or family day care homes that are consistent with corrective action timeframes for child care centers; and</text></item><item id="H2D21464B785E4B78BE6B7B421C9D623C"><enum>(dd)</enum><text>a process to dismiss a serious deficiency on correction of the deficiency.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HEEC4CFF1ABA44F409FFCFC3082CC640D"><enum>4.</enum><header>Reimbursements for additional meals or snacks</header><text display-inline="no-display-inline">Section 17(f)(2) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(f)(2)</external-xref>) is amended—</text><paragraph id="HC06DD3EE11624CB480511CCF5BB1D0A6"><enum>(1)</enum><text>by striking <quote>(2)(A) Subject to subparagraph (B) of this paragraph</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H285E9AE8F0BC4D989F2D51D6E12CCA01"><paragraph id="HA8A4749443E44C58AE1DC968B0165413"><enum>(2)</enum><header>Disbursements</header><subparagraph id="H6478E0EC580C45F29A6A4447A0033383"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B)</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HA87C0AEBEFE947849AC1535765F928CB"><enum>(2)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H70040D5C1D234294815DCBE99E498EB6"><subparagraph id="H01DCEE429C834C888E6BC9AA2CF0B63A"><enum>(B)</enum><header>Limitation on number of meals</header><text display-inline="yes-display-inline">No reimbursement may be made to an institution under this paragraph, or to a family or group day care home sponsoring organization under paragraph (3), for more than—</text><clause id="H163FF6E9BEA540D2AE4AB4FFAFDE20F3"><enum>(i)</enum><text display-inline="yes-display-inline">2 meals and 1 supplement, or 1 meal and 2 supplements, per day per child; or</text></clause><clause id="H486FEA2D86E94B8C9D6D89F8C07EC7DF"><enum>(ii)</enum><text display-inline="yes-display-inline">3 meals and 1 supplement, or 2 meals and 2 supplements, per day per child, in the case of child care during which there are 8 or more hours between the beginning of the first meal service period and the beginning of the fourth meal service period.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idb59e86bb5b4e4c14ad89f5a997613001"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id399C652487CB44FB905DE0002341A64C"><subparagraph id="H75D7E7BDDC06423C831723D7E6421D26"><enum>(D)</enum><header>Study on third meal</header><text>The Secretary shall—</text><clause id="HCA0B9BDAF958458A83E93783D9AE425E"><enum>(i)</enum><text display-inline="yes-display-inline">not later than 2 years after the date of enactment of this subparagraph, conduct a study regarding—</text><subclause id="H77559F8141894ABCA9409A76DF3197C2"><enum>(I)</enum><text>the prevalence of third-meal reimbursement by program operators; and</text></subclause><subclause id="H51BDBB5CB57B4C6EAFD0E2F66DC2E060"><enum>(II)</enum><text>the contribution of such an additional meal to—</text><item commented="no" display-inline="no-display-inline" id="idc4154d49965a491590dbf9fa5774a2e1"><enum>(aa)</enum><text display-inline="yes-display-inline">effectively supporting working families;</text></item><item id="H97EAFE71ED01406ABE99AC317BB333AA"><enum>(bb)</enum><text>local economies; and</text></item><item id="H022C787B1BD941C8874B41197EBE8A2A"><enum>(cc)</enum><text display-inline="yes-display-inline">the economic viability of child care and afterschool programs, including in rural areas;</text></item></subclause></clause><clause id="H6CADBE079A8B479F8C4149C022843F7E"><enum>(ii)</enum><text display-inline="yes-display-inline">submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Education and Workforce of the House of Representatives a report that includes the findings of the study under clause (i); and</text></clause><clause id="H6F0775BC75F7442DB54CE8556608F6EE"><enum>(iii)</enum><text display-inline="yes-display-inline">based on the findings of the report under clause (ii), provide to program operators guidance—</text><subclause id="HEE38082F791A42BD9C978141AB5FCC53"><enum>(I)</enum><text>to improve implementation of the program under this section;</text></subclause><subclause id="H349416F31BD84F3C9A26F804B7B8380B"><enum>(II)</enum><text>to maximize the utility of an additional meal in supporting working families; and</text></subclause><subclause id="H8F655D44836A4F2D82A3BC377AE1DA1A"><enum>(III)</enum><text>to limit unnecessary costs to program operators and parents of participating children.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H2C09EF2081E74562B20E7A7F05FC7919"><enum>5.</enum><header>Adjustments</header><text display-inline="no-display-inline">Section 17(f)(3)(A) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(f)(3)(A)</external-xref>) is amended by striking <quote>Consumer Price Index for food at home</quote> each place it appears and inserting <quote>Consumer Price Index for food away from home</quote>.</text></section><section id="H95FD7DB0769E432A86E8888516624EA3"><enum>6.</enum><header>Advisory committee on paperwork reduction</header><subsection commented="no" display-inline="no-display-inline" id="idc0058bfd49234a38a71cc1507096cfcb"><enum>(a)</enum><header display-inline="yes-display-inline">Clerical amendments</header><text>Section 17 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id96cc8593b1e64ec891eed77d8d3497ec"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7a6251ba920c4879afd17c3935e6ff75"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2)(F), by striking <quote>subsection (t)</quote> and inserting <quote>subsection (s)</quote>; and</text></subparagraph><subparagraph id="idd7583550e8c24781a30f9e20ae9032b3" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>in paragraph (3), by striking <quote>subsection (r)</quote> and inserting <quote>subsection (q)</quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id634c4f8609fd47f2be9144722d598eea"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c), by moving paragraphs (5) and (6) so as to appear in numerical order;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida5f004d8853b4bd291c9d09d7a03bfbf"><enum>(3)</enum><text>in subsection (t)(1), by striking <quote>Stewart B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref>) (as amended by subsection (a)(4)) is amended by inserting after subsection (m) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF597C6364F3448809A83389E736F69CA"><subsection id="HD17922681AAD4F32A5B3D68553F6752E"><enum>(n)</enum><header>Advisory committee on paperwork reduction</header><paragraph id="HEBD8AEF78EC5475295D2CCA02FFE8679"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of the <short-title>Early Childhood Nutrition Improvement Act</short-title>, the Secretary shall establish an advisory committee (referred to in this subsection as the <term>Advisory Committee</term>) to carry out the duties described in paragraph (2).</text></paragraph><paragraph id="H823D2CCEE8744D5FADED70BDAED376A0"><enum>(2)</enum><header>Duties</header><text>The duties of the Advisory Committee shall be—</text><subparagraph id="H86305E7E1A674BE4805B7057B433786B"><enum>(A)</enum><text display-inline="yes-display-inline">to examine the feasibility of reducing unnecessary or duplicative paperwork resulting from regulations and recordkeeping requirements, including paperwork resulting from additional State requirements, for entities participating, or seeking to participate, in the program under this section, including State agencies, family child care homes, child care centers, and sponsoring organizations; and</text></subparagraph><subparagraph id="H8784EEAE4BE443B18CA5F20F89DDDB15"><enum>(B)</enum><text display-inline="yes-display-inline">to provide to the Secretary recommendations to reduce the paperwork described in subparagraph (A) for participants in the program under this section, while ensuring that proper accountability and program integrity are maintained.</text></subparagraph></paragraph><paragraph id="H09CC9A20383A4F578806022449D49DCC"><enum>(3)</enum><header>Membership</header><text>The Advisory Committee shall be composed of not fewer than 14 members, of whom—</text><subparagraph id="H881F359C789F4E30A6DEC1F3763F29C3"><enum>(A)</enum><text>1 shall be a representative of a public nonprofit center;</text></subparagraph><subparagraph id="H10F2E5F99C3143FDBB8CD8DE2F459061"><enum>(B)</enum><text display-inline="yes-display-inline">1 shall be a representative of a private nonprofit center;</text></subparagraph><subparagraph id="H9674A649656C4E988AA9C9DCE8737949"><enum>(C)</enum><text display-inline="yes-display-inline">1 shall be a representative of a family or group day care home;</text></subparagraph><subparagraph id="H3ED07DAED4D34F63B2FC790C51024271"><enum>(D)</enum><text display-inline="yes-display-inline">1 shall be a representative of a Head Start center;</text></subparagraph><subparagraph id="H82DE7F156A264D0B9DA43A0AC1EB33A3"><enum>(E)</enum><text display-inline="yes-display-inline">1 shall be a representative of a for-profit center;</text></subparagraph><subparagraph id="H3DF9721B6ECE4056B0B2EA93953B7966"><enum>(F)</enum><text display-inline="yes-display-inline">1 shall be a representative of an emergency shelter;</text></subparagraph><subparagraph id="H7D86755B723E4DAF9BC1C676A3C586DA"><enum>(G)</enum><text display-inline="yes-display-inline">1 shall be a representative of an adult day care center;</text></subparagraph><subparagraph id="HCEB61CC5C8694B899507A6BFACA49EC0"><enum>(H)</enum><text display-inline="yes-display-inline">1 shall be a representative of a State agency;</text></subparagraph><subparagraph id="HEFAED27279BF40B2AAFCB1529E5DF3B4"><enum>(I)</enum><text display-inline="yes-display-inline">1 shall be a representative of a sponsoring organization for the entities referred to in subparagraphs (A), (B), (D), (E), (F), and (G);</text></subparagraph><subparagraph id="H2BBD99562F6344BBB27CE624FF1876BC"><enum>(J)</enum><text display-inline="yes-display-inline">1 shall be a representative of a sponsoring organization of family or group day care homes;</text></subparagraph><subparagraph id="HC33912C5CDDC43318C5D5333C8A64B8D"><enum>(K)</enum><text display-inline="yes-display-inline">1 shall be a representative of an anti-hunger advocacy organization;</text></subparagraph><subparagraph id="H49D7E5EE6D994BC8879FFB37D1DED4F6"><enum>(L)</enum><text display-inline="yes-display-inline">1 shall be a representative of an at-risk, afterschool program;</text></subparagraph><subparagraph id="HC584E5A66AD24E91B66E88CBFF3DBC6D"><enum>(M)</enum><text display-inline="yes-display-inline">1 shall be a representative of a child care advocacy organization; and</text></subparagraph><subparagraph id="H9B7111351F0143F08D0DC499867EBA31"><enum>(N)</enum><text display-inline="yes-display-inline">1 shall be a representative of an advocacy organization representing parents with young children.</text></subparagraph></paragraph><paragraph id="H5CFFDEAD19C549C290AD8FB1AEC43DD1"><enum>(4)</enum><header>Considerations</header><text>In developing recommendations under paragraph (2)(B), the Advisory Committee shall take into consideration—</text><subparagraph id="H1972827D254E4B6DAD2D331BCA98C491"><enum>(A)</enum><text>information, recommendations, and reports from the paperwork reduction work group established by the Food and Nutrition Service pursuant to section 119(i) of the Child Nutrition and WIC Reauthorization Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/108/265">Public Law 108–265</external-xref>); </text></subparagraph><subparagraph id="H3908CC46AF9E4FEEA1EFFA64B7F8C62A"><enum>(B)</enum><text>the use of electronic systems and recordkeeping technologies to reduce paperwork for program participants and program operators; and</text></subparagraph><subparagraph id="HBE51AF64B29E4F23ACC6F397174858F0"><enum>(C)</enum><text display-inline="yes-display-inline">duplicative requirements across multiple Federal programs.</text></subparagraph></paragraph><paragraph id="HC7CD8383210F4F5D844CCEA2DFD86E39"><enum>(5)</enum><header>Guidance and regulations</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of the <short-title>Early Childhood Nutrition Improvement Act</short-title>, the Secretary shall issue guidance and, as appropriate, regulations based on the recommendations described in paragraph (2)(B) for streamlined and consolidated paperwork and recordkeeping requirements for the program under this section, including recommendations and actions carried out to reduce paperwork for parents and program operators by streamlining and modernizing—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb4a6b2b502db4e7a98cc15559cbc486c"><enum>(A)</enum><text display-inline="yes-display-inline">applications; and</text></subparagraph><subparagraph id="H40C5C6B782464510ADE53E4B462B9299"><enum>(B)</enum><text>the monitoring and auditing of programmatic documentation and recordkeeping, including—</text><clause id="H5386F062579649C3BED056508587098A"><enum>(i)</enum><text>eliminating the use of the enrollment form for the purpose of claiming meals;</text></clause><clause id="H43A7280189C646A4B4C9528D60240A70"><enum>(ii)</enum><text>allowing the use of direct certification in all States;</text></clause><clause id="H44206F385DE74D32964F14084B0092CC"><enum>(iii)</enum><text>requiring States to accept as documentation digital forms, digitized and electronic signatures, and electronic records;</text></clause><clause id="HC95DE5E6A71942DCAE5C779537D51D64"><enum>(iv)</enum><text>allowing the use of electronic data collection systems containing all required Federal child and adult care food program standards;</text></clause><clause id="HDBB18CB885EB4E018A814C8E0B24A1DD"><enum>(v)</enum><text>addressing nonmandated State-specific requirements; and</text></clause><clause id="HF1F82E6DD6CC4160B55EAD0A73FC16C9"><enum>(vi)</enum><text>requiring the adoption of generally accepted technologies for client-facing technology, virtual visits, and technology used for administrative functions by the program to reduce the burden on participants and program operators and administrators.</text></clause></subparagraph></paragraph><paragraph id="HC9AB48011372463095004BAE6453C51A"><enum>(6)</enum><header>Report</header><text>Not later than 180 days after the date on which guidance or regulations are issued under paragraph (5), the Secretary shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Education and Workforce of the House of Representatives a report containing—</text><subparagraph commented="no" id="H0476381CA8C8441C9FDABAE90A07935C"><enum>(A)</enum><text>for each instance in which the Secretary did not implement a recommendation of the Advisory Committee, an explanation regarding why the recommendation was not implemented; and</text></subparagraph><subparagraph id="H3DA582EEBE9141DD83EA7F89EE81FA3D"><enum>(B)</enum><text>additional recommendations with respect to legislative action that may—</text><clause commented="no" display-inline="no-display-inline" id="idc4aeb555b1524fe69efb911c16e5be6b"><enum>(i)</enum><text display-inline="yes-display-inline">strengthen and streamline the application and monitoring process of the program under this section; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idcd69af09cf584f5da263f691c2ef38bf"><enum>(ii)</enum><text display-inline="yes-display-inline">reduce administrative burdens on grantees, program participants, the Federal Government, and State and local governments.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
