<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 1434</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250410">April 10, 2025</action-date><action-desc><sponsor name-id="S376">Ms. Ernst</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To track taxpayer dollars sent to adversarial countries and foreign entities of concern, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tracking Receipts to Adversarial Countries for Knowledge of Spending Act</short-title></quote> or the <quote><short-title>TRACKS Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idd5c488ba55044825a3cbfc6371c2da2e"><enum>2.</enum><header>Foreign subawards</header><text display-inline="no-display-inline">Section 2 of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/282">Public Law 109–282</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idf659b8534a224ce081f18a163cf92c85"><enum>(1)</enum><text>in subsection (a), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5BE9B52129BF4BB292A16BF8D3D8E789"><paragraph commented="no" display-inline="no-display-inline" id="id829615d0b9ca4305aefffc6979c4f97e"><enum>(9)</enum><header>Subaward</header><text>The term <term>subaward</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5e7cc139393b4785b9321ab7d9ab1209"><enum>(A)</enum><text display-inline="yes-display-inline">means an award, including a grant, contract, cooperative agreement, other transaction agreement, or other financial transaction, provided by a pass-through entity to a subrecipient for the subrecipient to carry out part of a Federal award received by the pass-through entity;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id45c552da6de5407aa378f8d98ac7aeb1"><enum>(B)</enum><text display-inline="yes-display-inline">includes an award described in subparagraph (A) that is passed from a subrecipient to another subrecipient; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1fd3dc12893847539f39d0596fff072a"><enum>(C)</enum><text display-inline="yes-display-inline">does not include payments to a beneficiary of a Federal program.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idb8e43150162e4da3bcf0326ee6985c8e"><enum>(2)</enum><text>in subsection (d), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1AA0DA72EF3D4A4DB03F85454A197D89"><paragraph id="id4add06b6aab34344ae45a1716e1f1f20"><enum>(3)</enum><header>Reporting of foreign subawards</header><subparagraph commented="no" display-inline="no-display-inline" id="id575cc23704494fb6a42cde3b4da34506"><enum>(A)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph:</text><clause commented="no" display-inline="no-display-inline" id="id7bd101e6e7884a169a35c3c70ebf3321"><enum>(i)</enum><header>Covered subaward</header><text>The term <term>covered subaward</term>—</text><subclause commented="no" display-inline="no-display-inline" id="id359f272566cb4a54977f858eafba0349"><enum>(I)</enum><text display-inline="yes-display-inline">means a subaward awarded to—</text><item commented="no" display-inline="no-display-inline" id="id7d7e97deece14df8a45a69dce799bb9a"><enum>(aa)</enum><text display-inline="yes-display-inline">an entity located in a foreign country of concern (as defined in section 9901 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/4651">15 U.S.C. 4651</external-xref>)); or</text></item><item commented="no" display-inline="no-display-inline" id="ide0d9367bf8c442b9b3dc509badf60156"><enum>(bb)</enum><text>a foreign entity of concern (as defined in section 9901 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/4651">15 U.S.C. 4651</external-xref>)); and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id57bf2005ed09480fa1b6cdaaf289d55b"><enum>(II)</enum><text>includes a subaward described in subclause (I) of any amount.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id0f71d962851a477c85a2d739982b5b91"><enum>(ii)</enum><header>Prime award recipient</header><text>The term <term>prime award recipient</term>, with respect to a covered subaward, means the entity that directly receives the Federal award from which the covered subaward originates.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfd457b8e76f046dba86703189de66741"><enum>(B)</enum><header>Reporting</header><text display-inline="yes-display-inline">The recipient of a covered subaward shall disclose data with respect to the covered subaward in the same manner as subawards are disclosed in accordance with paragraph (2).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2d908195b097497599c5606a17e2847a"><enum>(C)</enum><header>Guidance</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of the <short-title>Tracking Receipts to Adversarial Countries for Knowledge of Spending Act</short-title>, the Director shall issue guidance that establishes consistency for complying with this paragraph for agencies, prime award recipients, and covered subaward recipients, including establishing standards for disclosed data.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
