Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Adult Education and Family Literacy Act and the Workforce Innovation and Opportunity Act to strengthen adult education.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Adult Education Workforce Opportunity and Reskilling for Knowledge and Success Act</short-title></quote> or the <quote><short-title>Adult Education WORKS Act</short-title></quote>.</text></section><title id="id89d5f6bb857b469d9a1b941c2dd94394"><enum>I</enum><header>Workforce Development Activities</header><section id="ideb521507ca8f40c79b72378d74816d7a"><enum>101.</enum><header>Workforce development activities</header><subsection id="idde347ae94f234eafbc5259823344657e"><enum>(a)</enum><header>Amendment to WIOA</header><text>Except as otherwise expressly provided, whenever in this section an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3101">29 U.S.C. 3101 et seq.</external-xref>).</text></subsection><subsection id="idd4b68ba1c32e408497c27fd324de11fd"><enum>(b)</enum><header>Definitions</header><paragraph id="id965689fafa434b84b58c7b4d58dd7d5f"><enum>(1)</enum><header>In general</header><text>Section 3 (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>) is amended—</text><subparagraph id="id77747f4350974dfb9228621d25c9264c"><enum>(A)</enum><text>by striking paragraph (5);</text></subparagraph><subparagraph id="id9177cc5e654644db92563e92585390eb"><enum>(B)</enum><text>by redesignating paragraphs (6) through (9) as paragraphs (5) through (8), respectively;</text></subparagraph><subparagraph id="id0090cdef5c24401d942db60056c0d33e"><enum>(C)</enum><text>by inserting after paragraph (8), as redesignated by subparagraph (B), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2922ba57471e46a0a3c58ee1207af9ce"><paragraph id="idfdfae201fed14a9487136dbb97211f0c"><enum>(9)</enum><header>College and career navigator</header><text>The term <term>college and career navigator</term> means an individual who—</text><subparagraph id="iddf40c92d812b48d995db071c445f3b68"><enum>(A)</enum><text>has extensive knowledge of workforce development programs and services, postsecondary programs and services, Federal and other student financial aid for postsecondary education, and case management techniques;</text></subparagraph><subparagraph id="id695e151bd9fe4270a82f265863a1d8f1"><enum>(B)</enum><text>supports persons who are accessing services under this Act, by gathering work history and skills information, providing tailored college and career guidance and labor market information, helping jobseekers identify training and educational options to best fit their needs, including Federal student aid and other assistance available to pay the costs of attendance at an institution of higher education or for participation in training, facilitating access to services, and facilitating co-enrollment of individuals in programs carried out under title I and title II;</text></subparagraph><subparagraph id="id4a6bfb41e0bd4125a71fe490355bd3d2"><enum>(C)</enum><text>provides or organizes provision of services to promote job readiness, digital literacy skills, information literacy skills, and the skills needed for success in postsecondary education, facilitates the successful transition of individuals to postsecondary education, coordinates activities with employers and with entities and individuals involved in the one-stop delivery system in the local area, and conducts community outreach; and</text></subparagraph><subparagraph id="id0682d29d214143ca83b60d016f452a3e"><enum>(D)</enum><text>as determined appropriate by the one-stop operator or eligible provider of adult education and literacy activities involved, is responsible for recruitment of students in adult education and literacy activities and participants in workforce investment activities, provision of intensive case management, provision of career exploration services, and data collection associated with an activity specified in this subparagraph.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="iddd6bcd151826414a8aacfb4548dc5be7"><enum>(D)</enum><text>by redesignating paragraphs (12) through (14), (15) through (21), (22) through (26), and (27) through (71), as paragraphs (13) through (15), (17) through (23), (25) through (29), and (31) through (75), respectively;</text></subparagraph><subparagraph id="id2741d4261c2048e38363440ec1599233"><enum>(E)</enum><text>by inserting after paragraph (11) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id06071fa227434fbc891113ec65736cd7"><paragraph id="id012dc82423d44a42894b7c86a6614ee0"><enum>(12)</enum><header>Concurrent enrollment</header><text>The term <term>concurrent enrollment</term> has the meaning given the term in section 203.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="idf353fbf41afc4e838a65c436927795a0"><enum>(F)</enum><text>by inserting after paragraph (15), as redesignated by subparagraph (D), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfd37fe30d0224f4795222cedd7318fde"><paragraph id="id5ba797a306c642a4877cb0b0e881eaae"><enum>(16)</enum><header>Digital literacy skills</header><text>The term <term>digital literacy skills</term> has the meaning given the term in section 203.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="idada558e9492b416594eb6379897fa78b"><enum>(G)</enum><text>by inserting after paragraph (23), as redesignated by subparagraph (D), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf4ba4d15cde64e339808182aebb38e7b"><paragraph id="idc878c6d8a8de42e28666a7ba0f32eb9d"><enum>(24)</enum><header>Foundational skill needs</header><text>The term <term>foundational skill needs</term>, used with respect to an individual, means—</text><subparagraph id="iddec17590a20a490fbc701ed106c2577d"><enum>(A)</enum><text>in the case of an individual who is a youth, an individual who has English reading, writing, or computing skills at or below the 8th grade level on a generally accepted standardized test; or</text></subparagraph><subparagraph id="id6d919c9cf95147d6934bd7aa0af7ddfd"><enum>(B)</enum><text>in the case of an individual who is a youth or adult, an individual who is unable to compute or solve problems, or read, write, or speak English, at a level necessary to function on the job, in the individual’s family, or in society.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idda44790b656a46d5a8b2e097398a089c"><enum>(H)</enum><text>by inserting after paragraph (29), as redesignated by subparagraph (D), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9a93ac5bebf44b44bc76292f96daffbc"><paragraph id="id85d541f5164149cf849985c9f2b3d36d"><enum>(30)</enum><header>Information literacy skills</header><text>The term <term>information literacy skills</term> has the meaning given the term in section 203.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id30d2a887f1824de0be4878bd144a5705"><enum>(2)</enum><header>Conforming amendments</header><subparagraph id="idc19329ce7dc64325874314d0cd49402e"><enum>(A)</enum><text>Section 121(h)(2)(C)(ii) (<external-xref legal-doc="usc" parsable-cite="usc/29/3151">29 U.S.C. 3151(h)(2)(C)(ii)</external-xref>) is amended by striking <quote>section 3(13)(D)</quote> and inserting <quote>section 3(14)(D)</quote>.</text></subparagraph><subparagraph id="idb8acf5c9bf0347b091c230954ad862c8"><enum>(B)</enum><text>Section 134(c)(3)(H)(i) (<external-xref legal-doc="usc" parsable-cite="usc/29/3174">29 U.S.C. 3174(c)(3)(H)(i)</external-xref>) is amended by striking <quote>section 3(44)</quote> and inserting <quote>section 3(48)</quote>.</text></subparagraph><subparagraph id="id22f179e706b74168b6f0e62fe596c708"><enum>(C)</enum><text>Section 170(b)(1)(D)(i) (<external-xref legal-doc="usc" parsable-cite="usc/29/3225">29 U.S.C. 3225(b)(1)(D)(i)</external-xref>) is amended by striking <quote>section 3(15)(E)</quote> and inserting <quote>section 3(17)(E)</quote>.</text></subparagraph><subparagraph id="idf5364ae41bbd48c8afb796f963717843"><enum>(D)</enum><text>Section 211(e)(3) (<external-xref legal-doc="usc" parsable-cite="usc/29/3291">29 U.S.C. 3291(e)(3)</external-xref>) is amended by striking <quote>section 3(45)</quote> and inserting <quote>section 3(49)</quote>.</text></subparagraph></paragraph></subsection><subsection id="id317965659e92413c95ea21bf215e72df"><enum>(c)</enum><header>State workforce development boards</header><text>Section 101 (<external-xref legal-doc="usc" parsable-cite="usc/29/3111">29 U.S.C. 3111</external-xref>) is amended—</text><paragraph id="id12b2ae9df92c46e7a88b2811139c1973"><enum>(1)</enum><text>in subsection (b)(1)(C)(ii)(IV), by inserting <quote>, and representatives of organizations that provide adult education</quote> after <quote>out-of-school youth</quote>; and</text></paragraph><paragraph id="id15d46ae6c94e4347a4d3c1ff5b378454"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph id="ida135425ae075490c9b49196fb88161af"><enum>(A)</enum><text>in paragraph (7)(A), by striking <quote>(as defined in section 202 of the Museum and Library Services Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9101">20 U.S.C. 9101</external-xref>); referred to in this Act as <quote>digital literacy skills</quote>)</quote>;</text></subparagraph><subparagraph id="idac88f701c7ba4d7d9d9162c84be45c90"><enum>(B)</enum><text>in paragraph (11), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id6f2986282c14433d9c9eb9514eb1a51d"><enum>(C)</enum><text>by redesignating paragraph (12) as paragraph (13); and</text></subparagraph><subparagraph id="ida059b6405fd0409983f60ef759efe355"><enum>(D)</enum><text>by inserting after paragraph (11) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc5a52d66f08f44e1a72092b4f26daaef"><paragraph id="id15023664e01b4a7bbff6a252bc42e2ba"><enum>(12)</enum><text>in collaboration with providers of adult education and literacy activities, the promotion of the employment of college and career navigators by the one-stop centers in the State; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="ide710e2ac8e7f47ffbff7e29eec2a4172"><enum>(d)</enum><header>Program specifics for State plans</header><text>Section 102(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/29/3112">29 U.S.C. 3112(b)(2)</external-xref>) is amended—</text><paragraph id="idfd3f6f880c294cb5beb65fa80529a4bb"><enum>(1)</enum><text>in subparagraph (D)(ii)—</text><subparagraph id="ida2ad82f4f98245f19fde4be34b100247"><enum>(A)</enum><text>in subclause (II), by striking item (dd) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ideff8fcc56eb04504b0f04bc29e636b7a"><item id="idc4fc29978d134740ad73411c92162340"><enum>(dd)</enum><text>integrated education and training, including how costs for such activities will be shared among relevant core programs;</text></item><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="idf2e5b45b9a1b4f59823f472829ef403e"><enum>(B)</enum><text>in subclause (V), by adding <quote>and</quote> at the end; and</text></subparagraph><subparagraph id="id1a893a8a3a8f4692924faac80ae612bf"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfde121d567954f24bb320c1ca4edebf9"><subclause id="id12f10a3b50ab46e69c68ffedcaabadc0"><enum>(VI)</enum><text>how the eligible agency will promote, through funding priority or other means, professionalization of adult education and literacy activities through the adoption of staffing models that include requirements and support for teacher credentialing, standards, and support for ongoing in-service professional development, and career ladders for professional growth, which may include more opportunities for full-time teaching positions;</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id10459396817048258ce3d2fb56bb7952"><enum>(2)</enum><text>in subparagraph (E)(iii)(II), by inserting <quote>providers of adult education and literacy activities,</quote> after <quote>institutions of higher education,</quote>.</text></paragraph></subsection><subsection id="id62932c4f742344a59d5dc2f910f73051"><enum>(e)</enum><header>Local boards</header><text>Section 107 (<external-xref legal-doc="usc" parsable-cite="usc/29/3122">29 U.S.C. 3122</external-xref>) is amended—</text><paragraph id="id50165655fd0846c48d336d6423e2dca1"><enum>(1)</enum><text>in subsection (c)(1), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf200b291b1634ca59116acfe3bae1369"><subparagraph id="id595d004ca91d4b6b82246577973d0cfc"><enum>(D)</enum><header>Information on membership</header><text>The chief elected officials appointing the local board for a local area shall make publicly available information on the membership of the board (including information identifying how the membership composition requirements of subsection (b) have been met), including by posting that information on the website of each unit of general local government included in the local area.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id2f335b35e0c74ec68938eafb5429f04f"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph id="id37da1291274a4f7da471087778a59be5"><enum>(A)</enum><text>in paragraph (5), by striking <quote>secondary and postsecondary education</quote> and inserting <quote>secondary, postsecondary, and adult education</quote>;</text></subparagraph><subparagraph id="id73243c2dbe514ddcbbc3b7ed5185e230"><enum>(B)</enum><text>in paragraph (7)(C)—</text><clause id="id27d9c1802f2840078a353a98973a79bb"><enum>(i)</enum><text>by inserting <quote>, in consultation with providers of public access to technology,</quote> after <quote>identifying strategies</quote>;</text></clause><clause id="id447ba2c66a66498d828cded8106d3013"><enum>(ii)</enum><text>by inserting <quote>, including deliveries through public libraries,</quote> after <quote>traditional service delivery</quote>; and</text></clause><clause id="idd82574c4e2954e469c9e1e85c336f645"><enum>(iii)</enum><text>by inserting <quote>and information literacy skills</quote> after <quote>digital literacy skills</quote>; and</text></clause></subparagraph><subparagraph id="id1a590b1ff9e5462496b85bdd087271ae"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id994ad6b2c3504379a9aabfa3d604db97"><paragraph id="ida440ee6b3fb846b4910d53f9e651d1d1"><enum>(14)</enum><header>College and career navigators</header><text>The local board, in collaboration with providers of adult education and literacy activities in the local area, shall promote the employment of college and career navigators by the one-stop centers and eligible providers (as defined in section 203) in the local area.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id7306608eeec34beba30c3d912f6b2f7b"><enum>(f)</enum><header>Local plans</header><text>Section 108 (<external-xref legal-doc="usc" parsable-cite="usc/29/3123">29 U.S.C. 3123</external-xref>) is amended—</text><paragraph id="id71f9d6b3e51f48b19fd052da2c3cb069"><enum>(1)</enum><text>in subsection (b)(13), by inserting <quote>, including, in all local plans after the first such plan, a description of how the local board carried out such coordination and completed such review during the previous 4-year period</quote> after <quote>submitted under title II</quote>; and</text></paragraph><paragraph id="id21b67fc2b3c54795a5f3dc8d779f98ed"><enum>(2)</enum><text>in subsection (d)(3), by inserting <quote>, along with a description of the actions the local board took in response to such comments</quote> after <quote>disagreement with the plan</quote>.</text></paragraph></subsection><subsection id="id174c05da14274bf8bae0f6f069337f00"><enum>(g)</enum><header>Indicators of performance</header><text>Section 116(b)(2)(A) (<external-xref legal-doc="usc" parsable-cite="usc/29/3141">29 U.S.C. 3141(b)(2)(A)</external-xref>) is amended—</text><paragraph id="idbbeb1cd9cde547e7a7728ea5550fd40d"><enum>(1)</enum><text>in clause (i), by striking subclauses (IV) and (V) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id860ec38668714e26adaaf87fb1ca6a0b"><subclause id="idce3b9ad1d1314e42bd285caa5aa71266"><enum>(IV)</enum><text>the percentages of program participants who, during participation in the program—</text><item id="iddc210c7c67504fb59ab2a64f3579dc55"><enum>(aa)</enum><text>obtain a recognized postsecondary credential or a secondary school diploma or its recognized equivalent; and</text></item><item id="ide298d75e5237409fbcc3dfb270292bfa"><enum>(bb)</enum><text>are in an education or training program that leads to a recognized postsecondary credential or employment and who are achieving measurable skill gains toward such a credential or employment;</text></item></subclause><subclause id="id97c8533259134582a0e8f1c716f3e853"><enum>(V)</enum><text>the percentages of program participants who, within 1 year after exit from the program—</text><item id="id9d29700ff03b4e82976622719b32ca66"><enum>(aa)</enum><text>obtain a secondary school diploma or its recognized equivalent;</text></item><item id="id3452e8ceac054e4d96ddb5c01964267a"><enum>(bb)</enum><text>have obtained or retained employment; and</text></item><item id="ida94b02324e8b472584f03460facdfd18"><enum>(cc)</enum><text>are in an education or training program leading to a recognized postsecondary credential; and</text></item></subclause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="ideb7114ea6ba04ca0949473f024575155"><enum>(2)</enum><text>by striking clause (iii) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6560dd156e394c57b46dae28270b6f4d"><clause id="idc94f061912c548b8b6b8bf8655a009d2"><enum>(iii)</enum><header>Interim indicators for adult education</header><text>A State may develop interim indicators for measuring the percentage of program participants on track to meet the indicators described in subclauses (IV) and (V) of clause (i) for adult education and literacy activities authorized under title II.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id94ef9c358a8844f9a80d1a755ee49e2e"><enum>(3)</enum><text>in clause (iv), by striking <quote>clauses (i)(VI)</quote> and inserting <quote>clause (i)(VI)</quote>.</text></paragraph></subsection><subsection id="id3dd7108d527341b8a8761d4362dc60d7"><enum>(h)</enum><header>Common participant individual record layout</header><text>Section 116 (<external-xref legal-doc="usc" parsable-cite="usc/29/3141">29 U.S.C. 3141</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id218257fbc1aa4c33bbba4f5e77e5451e"><subsection id="idf67c79a6bf3243699c594a3d1d181a96"><enum>(j)</enum><header>Common participant individual record layout</header><text>The Secretary of Labor and the Secretary of Education shall establish a common reporting system that covers, and that accommodates, the core programs, relating to participant records and the performance accountability measures described in subsection (b).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idf5ba1ef51bc5442c94c05ae8c0eb5a24"><enum>(i)</enum><header>One-Stop delivery systems</header><text>Section 121 (<external-xref legal-doc="usc" parsable-cite="usc/29/3151">29 U.S.C. 3151</external-xref>) is amended—</text><paragraph id="id95af5d917f2242b1b5e45e596ac0803b"><enum>(1)</enum><text>in subsection (d)(2)(B)—</text><subparagraph id="ida089e45acb6942dbb0bdd4658e995fe8"><enum>(A)</enum><text>by redesignating clauses (ii) through (vi) as clauses (iii) through (vii), respectively; and</text></subparagraph><subparagraph id="idb4fc582d376e4f7aadb1eead4da5dfc5"><enum>(B)</enum><text>by inserting after clause (i) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2c5975ce61ca45658831c0ee92095f1a"><clause id="idd1c5095fab58430ba7382618fe18abab"><enum>(ii)</enum><text>a public library;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id90ed69f12fda4681858898dd9f9e4765"><enum>(2)</enum><text>in subsection (e)—</text><subparagraph id="ide651634f3c3f442b93063917ba05dadf"><enum>(A)</enum><text>in paragraph (2)(B)—</text><clause id="id23274b934a1b4adea65209dea32033eb"><enum>(i)</enum><text>in clause (i), by striking <quote>and</quote> at the end;</text></clause><clause id="id019034c9c73944949efe24001135f88a"><enum>(ii)</enum><text>in clause (ii), by striking the semicolon and inserting <quote>; and</quote>; and</text></clause><clause id="id61c1ea1390564efbbab59ca9ed45cfa9"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idcd92c5ff9ab743c581407fc0fa20b4e4"><clause id="id03883ee708b14d94be9994568b285ddd"><enum>(iii)</enum><text>through one or more public libraries in accordance with paragraph (5);</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id8e402d2da3ae43ebb676d5988ec1cfaf"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6ba097ce663f4e5193c89ae06e36d1e8"><paragraph id="id8ae8dd988366496eb0a3938f9a1eb8d2"><enum>(5)</enum><header>Information and services provided through public libraries</header><text>A local board may use funds made available under subsection (h) to make programs, activities, and services available through a public library to the extent such library demonstrates to the local board—</text><subparagraph id="id550954619dd44f5e9a4544f81ac451ad"><enum>(A)</enum><text>that the library provides or will provide career services or other workforce development activities to address unmet need for such services or activities, such as by providing career services and other workforce development activities to individuals at days or times, and locations, at which the services or activities are not otherwise made available through the corresponding one-stop partners;</text></subparagraph><subparagraph id="iddc64b3bd982d4fc0b24a83cb95d52eaf"><enum>(B)</enum><text>that the library will provide a physical location within the library, which may include a mobile library site, in which to serve individuals seeking services provided by a college and career navigator; and</text></subparagraph><subparagraph id="id3a7d3fda4a074e809d67af55238c5c28"><enum>(C)</enum><text>the library's ability to leverage additional resources, such as staff, facilities, computer access, or learning materials, in order to extend the level of services otherwise provided through the local one-stop delivery system, particularly to geographically distant communities, communities for which physical one-stop centers are not easily accessible through public transportation, or communities in which there is inadequate access for the level of services needed.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="ide096a838759c4b389edbe9df22bc11c0"><enum>(j)</enum><header>Digital literacy skills; information literacy skills</header><text>Section 134(c) (<external-xref legal-doc="usc" parsable-cite="usc/29/3174">29 U.S.C. 3174(c)</external-xref>) is amended—</text><paragraph id="idd54bd5a957a44e378c187612256f0e2f"><enum>(1)</enum><text>in paragraph (2)(A)—</text><subparagraph id="id3462530d3c894c9ba321e7a72d02fc8f"><enum>(A)</enum><text>in clause (iii), by inserting <quote>digital literacy, information literacy,</quote> after <quote>(including literacy,</quote>; section 171 (<external-xref legal-doc="usc" parsable-cite="usc/29/3226">29 U.S.C. 3226</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5552d2a41f03460f8c0f2bb184fd04d9"><section id="id72b185adaf87438f87f7f90a7c0c8634"><enum>171A.</enum><header>Library-based and community-based college and career navigators</header><subsection id="id7a8fe1c6f8f04b779fc6be1dac533720"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to expand the capacity of State and local workforce development systems by leveraging the facilities and staff of libraries and community-based organizations to provide career navigation services to individuals through library-based and community-based college and career navigators.</text></subsection><subsection id="id7056551b1f35423a9904b3054b478361"><enum>(b)</enum><header>Eligible entity</header><text>In this section, the term <term>eligible entity</term> means a partnership between a State board or local board and 1 or more of the following:</text><paragraph id="id1aff709ae954454b9afe0649026e3925"><enum>(1)</enum><text>A community-based organization.</text></paragraph><paragraph id="id83a1b683c0e84f3a9c3ac5ac5678bf4b"><enum>(2)</enum><text>A library (as defined in section 213 of the Library Services and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9122">20 U.S.C. 9122</external-xref>)) that offers workforce development activities at no cost to individuals.</text></paragraph></subsection><subsection id="idd9765f1f0321431284a29f68e0738a7d"><enum>(c)</enum><header>Grants authorized</header><text>From funds made available under section 172(g), the Secretary is authorized to make grants to eligible entities to carry out the purpose of this section.</text></subsection><subsection id="id3a380d88153141daad2b541712b95a4a"><enum>(d)</enum><header>Application</header><text>To be eligible to receive a grant under this section, an eligible entity shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></subsection><subsection id="idbba28e3e77034b5faff0d622e90a7f35"><enum>(e)</enum><header>Uses of funds</header><paragraph id="idead6e416dda74877b3645f21bfa05a95"><enum>(1)</enum><header>In general</header><text>An eligible entity that receives a grant under this section shall use funds made available through the grant to establish a college and career navigator program within the library, community-based organization, or agency that is a partner of such eligible entity.</text></paragraph><paragraph id="id8d6db6de2b5647a188b653d91921e64a"><enum>(2)</enum><header>Activities of program</header><text>A college and career navigator program established under paragraph (1) may hire, train, support, or retain 1 or more college and career navigators to provide career navigation services in coordination with a State or local workforce development system.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id299b6f2ae4784a018e87c2b6409a07a8"><enum>(l)</enum><header>Authorization of appropriations</header><text>Section 172 (<external-xref legal-doc="usc" parsable-cite="usc/20/3227">20 U.S.C. 3227</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide7ef45dc64944856b6d838c2c1c2fd0f"><subsection id="ida9f37f48e2bd4130aeb64e970955f3e8"><enum>(g)</enum><header>Library-Based and community-Based navigators</header><text>There are authorized to be appropriated to carry out section 171A, $135,000,000 for fiscal year 2026 and each of the 4 succeeding fiscal years.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title><title id="id4aa2368939aa4880826195ec3d4507e9"><enum>II</enum><header>Adult Education and Literacy</header><section id="id5a4ac69ea8bd4ae78e17544f44f52f81"><enum>201.</enum><header>Purpose</header><text display-inline="no-display-inline">Section 202(1) of the Adult Education and Family Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3271">29 U.S.C. 3271(1)</external-xref>) is amended—</text><paragraph id="id880D0427D79242CCA456C55B593679B5"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(including digital literacy skills and information id="id2281b4966ee94f4d83ffe60b2b457b81"><enum>202.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 203 of the Adult Education and Family Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3272">29 U.S.C. 3272</external-xref>) is amended—</text><paragraph id="id182c9ad0299e40e6887feff33319a5cf"><enum>(1)</enum><text>in paragraph means intentional, simultaneous enrollment in more than 1 one-stop partner program, as a strategy for leveraging resources and eliminating duplication of services while achieving the best possible outcomes.</text></paragraph><paragraph id="id53a77c3d380948a9bac043f38d2083aa"><enum>(5)</enum><header>Digital literacy skills</header><text>The term <term>digital literacy skills</term> means the skills associated with—</text><subparagraph id="id11bb3b2cc37549d58062c8be1b4b7b13"><enum>(A)</enum><text>using technology to enable users to find, evaluate, organize, create, and communicate information; and</text></subparagraph><subparagraph id="ide0309dfe5cdd450096633bda226aa456"><enum>(B)</enum><text>developing digital citizenship and the responsible use of technology.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id3b3c11313a104ad08ba667965d5f1a1e"><enum>(4)</enum><text>in paragraph (7), as redesignated by paragraph (2), in subparagraph (C)(i), by striking <quote>is basic skills deficient</quote> and inserting <quote>has foundational skills of the Adult Education and Family Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3291">29 U.S.C. 3291</external-xref>) is amended in subsection (a)(1), by striking <quote>$15,000,000</quote> and inserting <quote>$25,000,000</quote>.</text></section><section id="id69334ac1716142c7b86c5642ba0b20ce"><enum>205.</enum><header>Performance and accountability system</header><text display-inline="no-display-inline">Section 212 of the Adult Education and Family Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3292">29 U.S.C. 3292</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idda3d358ed4814208ba3923b25b1dfcdf"><section id="ida6f1d4f5831f4ad2a4c29058b15f15ab"><enum>212.</enum><header>Performance and accountability system</header><subsection id="id53f1c1b24e7f44488e4b1ea122433be3"><enum>(a)</enum><header>In general</header><paragraph id="id9A3F25222C104FE9A4AD695BB62CB37C"><enum>(1)</enum><header>In general</header><text>Except as provided in subsection (b), programs and activities authorized under this title are subject to all of the performance accountability provisions described in section 116.</text></paragraph><paragraph id="id66A26EB176AA44878FE753A6DA277F18"><enum>(2)</enum><header>Additional measurable skill gains</header><text>With respect to the application to programs and activities authorized under this title of the indicator of measurable skill gains under section 116(b)(2)(A)(i)(IV), such measurable skill gains may include those relating to the purpose described in section 202. </text></paragraph></subsection><subsection id="idc81a4a6f272a4539894f527b8d5ee7ee"><enum>(b)</enum><header>Pilot for innovative performance accountability systems</header><paragraph id="ide7d846f0d36344ca94afa533855bba34"><enum>(1)</enum><header>In general</header><text>The Secretary shall approve an application from an eligible agency to pilot, for a subset of eligible providers within its State and as an alternative to the performance accountability system described in section 116, an innovative performance accountability system that uses alternative indicators of performance that have the potential to more accurately reflect the objectives and adult education and literacy activities of the eligible providers’ programs if the Secretary determines that an application from such an eligible agency meets the requirements of this subsection.</text></paragraph><paragraph id="id982a4041bf504ba3b78f73a881c8d642"><enum>(2)</enum><header>Pilot period</header><text>An eligible agency applying to pilot an innovative performance accountability system under this subsection shall propose in its application the period of time that the agency desires to implement such system, except that the period shall not exceed 5 years.</text></paragraph><paragraph id="id3bb58b25f96e486dab379aa59ac06b79"><enum>(3)</enum><header>Extension of a pilot period</header><text>The Secretary shall approve an eligible agency’s request to extend the period of a pilot under this subsection if the Secretary determines that the innovative performance system is meeting the objectives of this subsection.</text></paragraph><paragraph id="idf6c69eedcd81419faab02cd29af22cf0"><enum>(4)</enum><header>Application</header><subparagraph id="idda3af38774574e41967104b0eba5ab72"><enum>(A)</enum><header>In general</header><text>An eligible agency desiring to undertake a pilot under this subsection shall submit an application at such time and in such manner as the Secretary may require.</text></subparagraph><subparagraph id="id6a194ab7002343c2a79d9e351f98a7c7"><enum>(B)</enum><header>Contents</header><text>An application described in subparagraph (A) shall include—</text><clause id="id3d625ac23790443cabcb45ed9dce4a54"><enum>(i)</enum><text>a description of how the eligible agency engaged in an outreach process with eligible providers within its State to—</text><subclause id="idc8ea7e05a8a84b97bae967ad250fe51d"><enum>(I)</enum><text>inform the eligible providers of the opportunity to implement a pilot under this subsection; and</text></subclause><subclause id="idd41bfe1545934147af4ebc2051ec34fc"><enum>(II)</enum><text>engage with the eligible providers in the development of alternative indicators of performance;</text></subclause></clause><clause id="id07d31fbaa0a54da5a868051d7fa0709c"><enum>(ii)</enum><text>an explanation of whether and how the eligible agency established any standards or criteria for the alternative measures of performance that participating eligible providers could elect to use;</text></clause><clause id="id236642f2dfdb4a4f9991788e8c601898"><enum>(iii)</enum><text>a listing of the eligible providers that will participate in the proposed pilot and a description of the indicators of performance that each such provider will make use of through the pilot;</text></clause><clause id="id6d3219ea57a546b19f401a8cef5bb257"><enum>(iv)</enum><text>a description of why the eligible agency and the participating eligible providers believe the proposed indicators of performance would more accurately measure the attainment of the objectives of such providers’ adult education and literacy activities than would the indicators of performance described in section 116(b)(2);</text></clause><clause id="idf8fe65ac04424801bb58d1c9996b67de"><enum>(v)</enum><text>an explanation of how the proposed indicators of performance will be valid and reliable measures of education and employment consistent with purposes of this title;</text></clause><clause id="idec459d7b94004263a1e351b20e3ace21"><enum>(vi)</enum><text>a description of how the eligible agency will collect, report to the Secretary, and make publicly available the proposed indicators of performance from each participating eligible provider on a timely basis; and</text></clause><clause id="id7d5a192a4c6a456f942338d6585be04f"><enum>(vii)</enum><text>an assurance that the eligible agency will, at the end of the pilot period, report to the Secretary on the outcomes of the pilot, including on whether the eligible agency met the objectives of the pilot.</text></clause></subparagraph><subparagraph id="idf24f77ebc268471a81a978b436fb33ad"><enum>(C)</enum><header>Secretarial review and approval</header><text>The Secretary shall determine whether to approve an application under this subsection by not later than 90 days of receiving the application.</text></subparagraph><subparagraph id="iddb94d4fb48494f8083e0a71942e0bcc0"><enum>(D)</enum><header>Disapproval</header><text>The Secretary shall not disapprove an application under this subsection without giving the applicant the opportunity to revise and resubmit the application.</text></subparagraph></paragraph><paragraph id="id8b071137a3f34fdc8aa2f5d145b66314"><enum>(5)</enum><header>Additional secretarial responsibilities</header><text>The Secretary shall—</text><subparagraph id="id2495c642fc4a432099878eadf3a0839b"><enum>(A)</enum><text>through the Director of the Institute of Education Sciences, carry out national evaluations of the implementation and outcomes of the pilots authorized under this subsection, with the first such evaluation to be completed not later than 5 years after the Secretary approves the first application from an eligible entity;</text></subparagraph><subparagraph id="id855530418bc34954aa56322382e0d14d"><enum>(B)</enum><text>in consultation with the Director of the Institute of Education Sciences, identify best practices in the development and implementation of innovative performance accountability systems under this subsection;</text></subparagraph><subparagraph id="idbbf13a873ec446cb83623e3eee6c259e"><enum>(C)</enum><text>disseminate information on those practices, including by making the information available on the website of the Department of Education; and</text></subparagraph><subparagraph id="ide418256225164cd997f3898e93bd7ebd"><enum>(D)</enum><text>provide a report to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and Workforce of the House of Representatives on the results of the pilot program, including a comparison of the outcomes as measured by the innovative performance accountability systems implemented under this subsection and the performance measures described in section 116.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idd9e4b12404b9474f935922a9e628f206"><enum>206.</enum><header>Matching requirement</header><text display-inline="no-display-inline">Section 222(b) of the Adult Education and Family Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3302">29 U.S.C. 3302(b)</external-xref>) is amended by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf47f90ce95e54ba1a01a1f287b178370"><paragraph id="id96820e991eed44deb7706474f0549256"><enum>(3)</enum><header>Public availability of information on matching funds</header><text>Each eligible agency shall maintain, on the website of such agency and in an easily accessible format, information documenting the non-Federal contributions made available to adult education and literacy programs pursuant to this subsection, including the sources of such contributions and, in the case of funds made available by the State, the distribution of such funds to eligible providers.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id52362d4bff4543189d3fe4926f50bc21"><enum>207.</enum><header>State leadership activities</header><text display-inline="no-display-inline">Section 223(a) of the Adult Education and Family Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3303">29 U.S.C. 3303(a)</external-xref>) is amended—</text><paragraph id="id9e9955aa51154fdfbd48be3a6852823b"><enum>(1)</enum><text>in paragraph (1)(C)—</text><subparagraph id="id164742d57ae649b49d3cb331f8c4cad4"><enum>(A)</enum><text>in clause (i), by striking <quote>programs,</quote> and inserting <quote>, family literacy,</quote>; Family Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3321">29 U.S.C. 3321</external-xref>) is amended—</text><paragraph id="id24d308bdf8834df2918c9657640c07d2"><enum>(1)</enum><text>in subsection (d), by striking <quote>subparagraphs (A) and (B) of section 203(4)</quote> and inserting <quote>subparagraphs (A) and (B) of section 203(8)</quote>; and</text></paragraph><paragraph id="idc80f8542c5dc4f7788f53793630d793e"><enum>(2)</enum><text>in subsection (e)(2), by striking <quote>learning disabilities</quote> and inserting <quote>learning differences</quote>.</text></paragraph></section><section id="id0a6669b69f32450ba113e245fdda2a69"><enum>209.</enum><header>Local administrative cost limits</header><text display-inline="no-display-inline">Section 233(a) of the Adult Education and Family Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3323">29 U.S.C. 3323(a)</external-xref>) is amended—</text><paragraph id="id3ddafcbfdbc14356b09f6d53064a2979"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>and for professional development</quote> after <quote>literacy activities</quote>; and</text></paragraph><paragraph id="id4b1a7847539c4745a5ed34f3b3961bdc"><enum>(2)</enum><text>in paragraph (2), by striking <quote>professional development,</quote>.</text></paragraph></section><section id="id6cd03fc4d5e64f239f4028a33ffb3b78"><enum>210.</enum><header>National leadership activities</header><text display-inline="no-display-inline">Section 242 of the Adult Education and Family Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3332">29 U.S.C. 3332</external-xref>) is amended—</text><paragraph id="idae145608d4c6415a9fd69b3a565d6469"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="idd9f1eac8b32946ada737da604f5a7e63"><enum>(A)</enum><text>by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0346d72ba000479494a1a072b2f210fb"><paragraph id="id862367ab62d74ce9867d74f9a45d3396"><enum>(1)</enum><text>assistance to help States meet the requirements of section 116 in order to ensure—</text><subparagraph id="id2dd9e12f26c64ba686f3474d1004be19"><enum>(A)</enum><text>that the outcomes and other data required pursuant to section 116 are collected and reported in a timely and accessible manner; and</text></subparagraph><subparagraph id="id155600a41b434784993c628bc8e66cdd"><enum>(B)</enum><text>that such data are reported consistently across States and eligible providers and are reviewed for quality and consistency at the Federal level.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id88b843e841ba406b8449df0106051147"><enum>(B)</enum><text>by redesignating paragraphs (2) through (4) as paragraphs (5) through (7), respectively; and</text></subparagraph><subparagraph id="id75b0576736ac4faf9c6904cfa05c88ea"><enum>(C)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc45c58c2317646f29e393a0369552785"><paragraph id="id60634066bd2e4820a1cabb8e68b23ff2"><enum>(2)</enum><text>technical assistance to participating eligible agencies and eligible providers in implementing innovative performance accountability systems under section 212(b)(1);</text></paragraph><paragraph id="id9a5f8a7b65304ed6bba7c0946af6e632"><enum>(3)</enum><text>grants to such agencies and providers to assist them in implementing such systems;</text></paragraph><paragraph id="ide3edd164ae534d8fbf0cba5453420fa7"><enum>(4)</enum><text>carrying out the national evaluations required under section 212(b)(5)(A);</text></paragraph><after-quoted-block> and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id54859ce6a5d44cf9b9ec112bfdd41cf8"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="idf2484e9504584aad95f42646027943c9"><enum>(A)</enum><text>in paragraph (1)(C), by inserting <quote>skills and information literacy skills</quote> after <quote>digital literacy</quote>; and</text></subparagraph><subparagraph id="ida08cf480e6c44c5c8f2d1713f8a72c67"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="id03c99cddfe5447df945c25cd8bb31dbf"><enum>(i)</enum><text>in subparagraph (C)(vii)—</text><subclause id="id48748351ba9540f4b81e3223fe570ce5"><enum>(I)</enum><text>in the matter preceding subclause (I), by striking <quote>best practices</quote> and inserting <quote>effective practices</quote>;</text></subclause><subclause id="id93dcdfb2ca6240339c2abbdf212d4043"><enum>(II)</enum><text>in subclause (I), by striking <quote>adults with learning disabilities and with</quote> and inserting <quote>specific populations, such as adults with learning differences, adults with the lowest levels of literacy or numeracy, adults who are supporting the education of their children, and</quote>;</text></subclause><subclause id="ide3a840f2605549f4bf3715ff6e9b1589"><enum>(III)</enum><text>by redesignating subclauses (III) and (IV) as subclauses (IV) and (V), respectively;</text></subclause><subclause id="idd47264062fcc40db93228aadfaf2a464"><enum>(IV)</enum><text>by inserting after subclause (II) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9da806ce0c04479ab9533a0f7b308622"><subclause id="iddf6f69b3ae1642109efbd68746e1e7d5"><enum>(III)</enum><text>family literacy programs;</text></subclause><after-quoted-block>; education through the creation and implementation of full-time staffing models;</text></subparagraph><subparagraph id="id625a8f2d2aa14d2da309036fe9ee2784"><enum>(I)</enum><text>providing professional development and technical assistance to adult educators that is designed to help ensure that adult education and family literacy programs build pathways to future success for all adult learners; and</text></subparagraph><subparagraph id="id4eecfe5c4c474776b55b722330e69b0c"><enum>(J)</enum><text>strengthening the quality of adult education and literacy programs through support for improved credentials, program quality standards, and certification and accreditation requirements that States may adopt on a voluntary basis; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></section><section id="id10ba7e235e6e4e7eb0d4de0f493b27ce"><enum>211.</enum><header>Integrated English literacy and civics education</header><text display-inline="no-display-inline">Section 243 of the Adult Education and Family Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3333">29 U.S.C. 3333</external-xref>) is amended—</text><paragraph id="id3be535b4d4e748168ef5a292ddd4666b"><enum>(1)</enum><text>in subsection (a), by striking <quote>, in combination with integrated education and training activities</quote>; and</text></paragraph><paragraph id="id9d81a0f03f5146cbb6a863215d9d847d"><enum>(2)</enum><text>in subsection (c), by striking <quote>designed</quote> and all that follows through the period at the end and inserting the following: <quote>designed to prepare adults who are English learners for full participation in the economic, educational, and civic life of the community, which may include
