which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Agriculture to submit to Congress a report on residue testing for all imported organic feedstuffs shipped in bulk, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Organic Imports Verification Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id3c48ce7f580944869ef41f14e159d4b6"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="ide9da39c1db694eacbb5fa6f069e597f4"><enum>(1)</enum><header>Covered organic feedstuff</header><text>The term <term>covered organic feedstuff</term> means any organic feedstuff included on the list established under section 4(b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2d0360b27e3b49f6bee6cb4df1219a1d"><enum>(A)</enum><text display-inline="yes-display-inline">that is shipped in bulk; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idacdcc3876d7542e3a17f57736fb314bc"><enum>(B)</enum><text>for which there is a national organic program import certificate.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide568131a48564ace944ba9833d94ea61"><enum>(2)</enum><header>National organic program import certificate</header><text>The term <term>national organic program import certificate</term> has the meaning given the term in section 2103 of the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6502">7 U.S.C. 6502</external-xref>).</text></paragraph><paragraph id="id3a7c678ff3944918989551685b6de2f8"><enum>(3)</enum><header>Organic</header><text>The term <term>organic</term>, with respect to a feedstuff, means that the feedstuff is organically produced (as defined in section 2103 of the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6502">7 U.S.C. 6502</external-xref>)).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8afff322796a4df592c047cc1d136a2f"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Administrator of the Agricultural Marketing Service.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf2bb2cc6add14ea1a7945e03eee68b76"><enum>(5)</enum><header>Shipped in bulk</header><subparagraph commented="no" display-inline="no-display-inline" id="id5d281ce67729475292b3d5c724943f75"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>shipped in bulk</term>, with respect to a feedstuff, means that the feedstuff is shipped loose in a ship hold, railcar, container, or super sack, or by another similar method.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id73fecd989402496c84ca239508606ab4"><enum>(B)</enum><header>Exclusion</header><text>The term <term>shipped in bulk</term>, with respect to a feedstuff, does not include the shipment of that feedstuff as a packaged good. </text></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="id2fbd6a781f054da2a53cf1b6d0ca1157"><enum>3.</enum><header>Annual report on residue testing for covered organic feedstuffs and other imported organic feedstuffs</header><subsection commented="no" display-inline="no-display-inline" id="id95168ff58cb74781b8ae7a3a09b6e962"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, and annually thereafter, the Secretary shall submit to Congress a report on the residue testing described in subsection (b) that was carried out during the year covered by the report for—</text><paragraph commented="no" display-inline="no-display-inline" id="id6e79cc834b68448787ead388ea54af37"><enum>(1)</enum><text display-inline="yes-display-inline">each covered organic feedstuff; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf9016866976e4f03aa99ddc596037a00"><enum>(2)</enum><text display-inline="yes-display-inline">each other imported organic feedstuff—</text><subparagraph commented="no" display-inline="no-display-inline" id="id22aa7a38be274df797bb5547916a9ca2"><enum>(A)</enum><text>that is shipped in bulk; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5f326576850e48e89cbbfdfd6c923364"><enum>(B)</enum><text>for which there is a national organic program import certificate.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id677384b88fa44409a4371a602dab2cd5"><enum>(b)</enum><header>Residue testing described</header><text>The residue testing referred to in subsection (a) is residue testing carried out under any of the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id151fc10294584ab6b507aeab83970314"><enum>(1)</enum><text display-inline="yes-display-inline">Section 4(c).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idec9cf64672b1450cbf0befdb3717545c"><enum>(2)</enum><text display-inline="yes-display-inline">Section 2107(a)(6) of the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6506">7 U.S.C. 6506(a)(6)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd72ef821370241b298364d8d141b084b"><enum>(3)</enum><text display-inline="yes-display-inline">Section 2112(a) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/6511">7 U.S.C. 6511(a)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd3052e6ba2a641fe9b181564e96f1eec"><enum>(4)</enum><text display-inline="yes-display-inline">Section 205.670(c) of title 7, Code of Federal Regulations (or a successor regulation).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfd9d102b0f8347abad7dd092e2c09b52"><enum>(c)</enum><header>Requirements</header><text display-inline="yes-display-inline">Each report under subsection (a) shall include information on—</text><paragraph commented="no" display-inline="no-display-inline" id="id73c41da62bf04f43977ba58d4c700551"><enum>(1)</enum><text display-inline="yes-display-inline">the frequency of the applicable residue testing;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbc5abe45803b46879c4aca44659c2039"><enum>(2)</enum><text display-inline="yes-display-inline">the methods used for that residue testing;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5a0f6ba8411945f1a5e16d10bcdf44b2"><enum>(3)</enum><text display-inline="yes-display-inline">the results of that residue testing;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ideac3b76361c9470099e16a854cbe5397"><enum>(4)</enum><text display-inline="yes-display-inline">the standards used to analyze those results; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0a2394b90e1b46dab89f1891751f6dcb"><enum>(5)</enum><text display-inline="yes-display-inline">any actions taken as a result of that residue testing.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id3a9ceafa2af34843be853acbbcda629f"><enum>4.</enum><header>Annual testing and corrective action</header><subsection commented="no" display-inline="no-display-inline" id="id8c4689357633473e8417d521dc034b22"><enum>(a)</enum><header display-inline="yes-display-inline">Risk-Based protocol</header><text>The Secretary, in consultation with the Secretary of Homeland Security and the organic agricultural product imports interagency working group established under section 2122A of the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6521a">7 U.S.C. 6521a</external-xref>), shall develop and regularly update risk-based protocols for—</text><paragraph commented="no" display-inline="no-display-inline" id="id1fd7692ece1e48e58b21c5ae6d768907"><enum>(1)</enum><text display-inline="yes-display-inline">determining which imported organic feedstuffs shall be included on the list of covered organic feedstuffs described in subsection (b) each year; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5f6a26a32ff6404c92a213f32183ac49"><enum>(2)</enum><text>determining necessary parameters of residue testing for those imported organic feedstuffs, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="idcf437add821c46ab8f5ea57bdda1dd7e"><enum>(A)</enum><text display-inline="yes-display-inline">frequency of testing;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id66f227c3db8043e886d868347214c404"><enum>(B)</enum><text display-inline="yes-display-inline">quantity to be tested;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb8fbca2bdac642d2be4c8f8bdee77973"><enum>(C)</enum><text display-inline="yes-display-inline">type of testing;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id84e3d7dff0b9425fa0103641c6f4e75d"><enum>(D)</enum><text display-inline="yes-display-inline">responsibility for testing; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4be77c8f24ac4f68a51f2ba0b387ab94"><enum>(E)</enum><text display-inline="yes-display-inline">other necessary parameters.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ided9a5b6d9f1b493b9558a232d8a7af4f"><enum>(b)</enum><header>List of covered organic feedstuffs</header><paragraph commented="no" display-inline="no-display-inline" id="id74e161835e65414c905c97584da610e4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, using the risk-based protocol established under subsection (a)(1), shall establish and annually update a list of imported organic feedstuffs for which the Secretary shall carry out residue testing under subsection (c) during that year.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id011c79f647ec4e19a7885a1eaf3d222a"><enum>(2)</enum><header>Confidentiality</header><text>The list established under paragraph (1) shall not be made publicly available.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4a138c2b3be445c6a153a5bd53ca84b5"><enum>(c)</enum><header>Annual testing</header><text>Each year, the Secretary shall carry out residue testing for each covered organic feedstuff.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id5218228d57a54041ba0c2c4442590496"><enum>(d)</enum><header display-inline="yes-display-inline">Corrective action</header><text display-inline="yes-display-inline">Beginning on the date of enactment of this Act, if any residue testing required under subsection (c) indicates any detectable prohibited substance at a level in excess of the level permitted by the national organic program established under the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6501">7 U.S.C. 6501 et seq.</external-xref>) or the relevant, equivalent organic certification program of a State, the applicable shipment of that covered organic feedstuff—</text><paragraph commented="no" display-inline="no-display-inline" id="id6f66933164a34a98bae5a084da56caea"><enum>(1)</enum><text display-inline="yes-display-inline">shall be excluded from organic sale; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1b29c5d20c2a44c68915391287dc48f6"><enum>(2)</enum><text display-inline="yes-display-inline">may not be sold, labeled, or represented as organically produced.</text></paragraph></subsection></section></legis-body></bill>
