which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Ocean Acidification Research And Monitoring Act of 2009 to require the Secretary of Commerce, acting through the Administrator of the National Oceanic and Atmospheric Administration, to collaborate with State and local governments and Indian Tribes on vulnerability assessments related to ocean acidification, research planning, and similar activities, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Coastal Communities Ocean Acidification Act of 2025</short-title></quote>.</text></section><section id="id1e0581d1222f459abf118fc20b709f72"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 12403 of the Federal Ocean Acidification Research And Monitoring Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/33/3702">33 U.S.C. 3702</external-xref>) is amended—</text><paragraph id="idc52b2802d9984f30b3891933ddc4f730"><enum>(1)</enum><text>by striking paragraph (4); </text></paragraph><paragraph id="idDD4B580F08CF4DF3B8EDF5045CB06374"><enum>(2)</enum><text>by redesignating paragraphs (2), (3), and (5) as paragraphs (4), (5), and (6) respectively;</text></paragraph><paragraph id="id8EED5ACF94E14F579FA594E70CF3B49E"><enum>(3)</enum><text>by inserting after paragraph (1) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id33164C04B42945B09807B2A9C6AF2A38"><paragraph commented="no" id="idED92506AD1C64B7AB6C68C409BE0FB53"><enum>(2)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="id091786b1b8d248ae8538e2ff40cdb053"><enum>(3)</enum><header>Native Hawaiian organization</header><text>The term <term>Native Hawaiian organization</term> has the meaning given that term in section 3 of the NATIVE Act (<external-xref legal-doc="usc" parsable-cite="usc/25/4352">25 U.S.C. 4352</external-xref>).</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="idE8F49A6C695849ADACCE1851A101ABCB"><enum>(4)</enum><text>in paragraph (4), as redesignated by paragraph (2), by inserting <quote>an increase of</quote> before <quote>carbon dioxide</quote>; and</text></paragraph><paragraph id="id2b2ff820d6b84744a99e1977391a7cf2"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id087d2a3b96594027960f588fd6b20425"><paragraph id="id1a17dc33de3a4256b89239431f18b74e"><enum>(7)</enum><header>Subcommittee</header><text>The term <term>Subcommittee</term> means the National Science and Technology Council Subcommittee on Ocean Science and Technology.</text></paragraph><paragraph id="idF78FCB39F77E4B8EB1167C4F3DA5A67E"><enum>(8)</enum><header>United States</header><text>The term <term>United States</term> means the States, collectively.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idbe06af9d3ace4cb9aaf287b1f64d3da8"><enum>3.</enum><header>Improvement of collaboration on ocean acidification</header><subsection id="idDEC58ED35BB546E587CBBE09F3F46A5F"><enum>(a)</enum><header>Ongoing input mechanism</header><text>Section 12404(c)(2) of the Federal Ocean Acidification Research And Monitoring Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/33/3703">33 U.S.C. 3703(c)(2)</external-xref>) is amended—</text><paragraph id="id87972C85F90B4287B119EC7B7D04ED84"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>; and</quote> and inserting a semicolon; </text></paragraph><paragraph id="id9E674B406D184B16AD99696129AA18D9"><enum>(2)</enum><text>in subparagraph (C), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id7B1B8BE994264705B9F9A375903C0D25"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="id0B6A20E1A16B49B89D386F782C62F7DA" act-name=""><subparagraph id="id32B0C3FF3A0F41BC9432B01BDC8861B8"><enum>(D)</enum><text>maintain or establish an ongoing mechanism (such as a liaison or other contact of the National Oceanic and Atmospheric Administration, standing meetings, or an online platform) to engage affected industry members, coastal stakeholders, community acidification networks, fishery management councils and commissions, Indigenous knowledge groups, non-Federal resource managers, and scientific experts not employed by the Federal Government to provide input on research, data, and monitoring that is necessary to support on-the-ground management, decision making, and adaptation related to ocean acidification and coastal acidification and the impacts of ocean acidification and coastal acidification.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idC4D9F99011EE4E2CA4F41F1DC842152F"><enum>(b)</enum><header>Advisory Board membership</header><text>Section 12404(c)(3) of the Federal Ocean Acidification Research And Monitoring Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/33/3703">33 U.S.C. 3703(c)(3)</external-xref>) is amended—</text><paragraph id="id037484CB07E741EF9A2ECA169027F677"><enum>(1)</enum><text>by redesignating subparagraphs (G) through (Q) as subparagraphs (H) through (R), respectively; </text></paragraph><paragraph id="id524B5AFBA9E64CBD965C6EB660BF2710"><enum>(2)</enum><text>by inserting after subparagraph (F) the following: </text><quoted-block style="OLC" id="id48840F69F02141CDB57C9BAB4C7E678E" act-name=""><subparagraph id="id21BA33479B954CAB8548F19D4073D98E"><enum>(G)</enum><text>Two representatives from Indian Tribes, Native Hawaiian organizations, Tribal organizations, and Tribal consortia affected by ocean acidification and coastal acidification.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idB33DED04D1064AFA8D1596543344EE07"><enum>(3)</enum><text>in subparagraph (H), as redesignated by paragraph (1), by striking <quote>Six</quote> and inserting <quote>Four</quote>. </text></paragraph></subsection><subsection id="id97E1B2B5067748E1A1ED5A1C7E729131"><enum>(c)</enum><header>Appointment of Advisory Board members</header><text>Section 12404(c)(4)(C) of the Federal Ocean Acidification Research And Monitoring Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/33/3703">33 U.S.C. 3703(c)(4)(C)</external-xref>) is amended by striking <quote>State and local</quote> and inserting <quote>State, local, and Indigenous</quote>.</text></subsection><subsection id="id47F80C3008AE4A259511DF2D23CDEFE3"><enum>(d)</enum><header>Engagement and coordination with Indian Tribes</header><text>Paragraph (9) of section 12404(c) of the Federal Ocean Acidification Research And Monitoring Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/33/3703">33 U.S.C. 3703(c)</external-xref>) is amended to read as follows: </text><quoted-block style="OLC" id="id486913081FA4409891E51AD236FF2583" act-name=""><paragraph id="id55588F6E649E451FAE9211B7D9AF0CB0"><enum>(9)</enum><header>Engagement and coordination with Indian Tribes</header><subparagraph id="id55AF718C60AF45EA8CD653AE227FF4A5"><enum>(A)</enum><header>Policy required</header><text>Not later than one year after the date on which the Advisory Board is established, the Advisory Board shall develop and commence maintaining a policy for engagement and coordination with Indian Tribes affected by ocean acidification and coastal acidification.</text></subparagraph><subparagraph id="id66A668BE8DC649C5BF1821D90A97EC58"><enum>(B)</enum><header>Consultation</header><text>In developing the policy under subparagraph (A), the Advisory Board shall consult with Indian Tribes affected by ocean acidification and coastal acidification.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idAB8960A1252244908650B2E8E1B6F843"><enum>(e)</enum><header>Collaboration on vulnerability assessments, research planning, and similar activities</header><text>Section 12404(e)(4)(A) of the Federal Ocean Acidification Research And Monitoring Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/33/3703">33 U.S.C. 3703(e)(4)(A)</external-xref>) is amended—</text><paragraph id="id4350C5CEBE0C4FEEA981D9DB937BC9CE"><enum>(1)</enum><text>by redesignating clauses (ix) and (x) as clauses (x) and (xi), respectively; and</text></paragraph><paragraph id="idBC8A4CA4C07D40409999640093A373A1"><enum>(2)</enum><text>by inserting after clause (viii) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC5DF44367D5D464297D80295F9E685CD"><clause id="idC910CEDB13014256AD0688B47AC5D2F1"><enum>(ix)</enum><text>identifies the efforts of the Secretary to collaborate with State and local governments, Indian Tribes, and Native Hawaiian organizations on community vulnerability assessments, research planning, and similar activities, pursuant to section 12406(e);</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idC1133AF710F746CE94A01CD2D10844D0"><enum>(f)</enum><header>Contents of strategic research plan</header><text>Section 12405(b) of the Federal Ocean Acidification Research And Monitoring Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/33/3704">33 U.S.C. 3704(b)</external-xref>) is amended—</text><paragraph id="idFABBE1AD0F1D44D4BDA8470C7DDD18F8"><enum>(1)</enum><text>in paragraph (10), by striking <quote>section 12404(c)(4)</quote> and inserting <quote>section 12404(e)(4)</quote>; and </text></paragraph><paragraph id="id6E59D4758ACC4E8894AAB724B1D4A48E"><enum>(2)</enum><text>in paragraph (11), by striking <quote>potentially affected industry members, coastal stakeholders, fishery management councils and commissions, Tribal governments, non-Federal resource managers, and scientific experts</quote> and inserting <quote>affected industry members, coastal stakeholders, community acidification networks, fishery management councils and commissions, Indigenous knowledge groups, non-Federal resource managers, and scientific experts not employed by the Federal Government</quote>. </text></paragraph></subsection><subsection id="id24F5D7CC00494960B773A0B7D9847915"><enum>(g)</enum><header>Improving collaboration on NOAA ocean acidification activities</header><text>Section 12406 of the Federal Ocean Acidification Research And Monitoring Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/33/3705">33 U.S.C. 3705</external-xref>) is amended—</text><paragraph id="idF60010462C0A4337AEE6EE5442CD371B"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id27892E8006F3419E837339EA0027E23F"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="idB0F19BA6CFC849BD9C83F4359DE12F1F"><enum>(i)</enum><text>in subparagraph (C), by striking <quote>maximize</quote> and inserting <quote>take into consideration</quote>; </text></clause><clause id="idDB87949BFB6C4A84AB6BC8D1B551C350"><enum>(ii)</enum><text>in subparagraph (D), by adding a semicolon at the end; and</text></clause><clause id="id9CC1C3224AE14C70ACEA2A0847C9BE60"><enum>(iii)</enum><text>in subparagraph (F), by striking <quote>Tribal governments</quote> and inserting <quote>Indian Tribes, Native Hawaiian organizations</quote>; and</text></clause></subparagraph><subparagraph id="id5AAB2D49FAB5404CA59553480507C316"><enum>(B)</enum><text>in paragraph (4), by striking <quote>industry members, coastal stakeholders, fishery management councils and commissions, non-Federal resource managers, community acidification networks, indigenous knowledge groups, and scientific experts</quote> and inserting <quote>affected industry members, coastal stakeholders, community acidification networks, fishery management councils and commissions, Indigenous knowledge groups, non-Federal resource managers, and scientific experts not employed by the Federal Government</quote>; </text></subparagraph></paragraph><paragraph id="id0E3D4CFC1A494D9C8AEBE64BD704F0EC"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="id1F5BE79FC63F4CB79E0928CB0BBE0548"><enum>(A)</enum><text>in paragraph (1), by striking <quote>State, local, and Tribal governments</quote> and inserting <quote>State and local governments, Indian Tribes,</quote>; or</text></subparagraph><after-quoted-block>; and </after-quoted-block></quoted-block></clause><clause id="id65AE8345F47749C280AAA89B72947881"><enum>(iv)</enum><text>in subparagraph (C), as redesignated by clause (ii), by striking <quote>State governments, local governments, Tribal governments</quote> and inserting <quote>State and local governments, Indian Tribes</quote>;</text></clause></subparagraph></paragraph><paragraph id="idBFF1C064F2DE430696B8DC4BB5730B0F"><enum>(3)</enum><text>in subsection (d)(1)(C), by striking <quote>Tribes or Tribal governments</quote> and inserting <quote>Indian Tribes, Native Hawaiian organizations, Tribal organizations, and Tribal consortia</quote>; and </text></paragraph><paragraph id="id1EAB8C344E4043B4AACFF6222E6545E3"><enum>(4)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id0070C5CD27DB4CA7A44ADDE84C9FCDDD"><subsection id="id3395D37B64B24C4E8CFDF4BD814C716B"><enum>(e)</enum><header>Better collaboration on vulnerability assessments, research planning, and similar activities</header><paragraph id="id5621A61109754891991E786B19B6D9A2"><enum>(1)</enum><header>In general</header><text>In carrying out the program under subsection (a), and in support of vulnerability assessments transmitted under section 12404(e)(4) and recommendations included in the strategic research plan described in section 12405(b)(10), the Secretary shall build upon existing activities and collaborate with State and local governments and Indian Tribes that are conducting or have completed vulnerability assessments, research planning, climate action plans, or other similar activities related to ocean acidification and coastal acidification and the impacts of ocean acidification and coastal acidification on coastal communities, for the purpose of—</text><subparagraph id="idB6A7EF4D363B495982D6918BE30F2B69"><enum>(A)</enum><text>supporting collaborative interagency relationships and information sharing at the State, local, and Tribal levels; and </text></subparagraph><subparagraph id="idB94EDEBA70514498BE41FE3AE9BD320D"><enum>(B)</enum><text>assisting State and local governments and Indian Tribes in—</text><clause id="idB00D2F7CD33D44C89DEDABDDAA794B8F"><enum>(i)</enum><text>improving existing systems and programs to better address ocean acidification and coastal acidification; and </text></clause><clause id="id6116EE157CBF4632BD60D80B2FA1C198"><enum>(ii)</enum><text>identifying whether such activities can be used as a model for other communities.</text></clause></subparagraph></paragraph><paragraph id="id964ca42a73eb4ca4ac4fa44683b1ae45"><enum>(2)</enum><header>Native Hawaiian organizations, Tribal organizations, and Tribal consortia</header><text>In carrying out the program under subsection (a), and in support of vulnerability assessments transmitted under section 12404(e)(4) and recommendations included in the strategic research plan described in section 12405(b)(10), the Secretary may build upon existing activities and collaborate with Native Hawaiian organizations, Tribal organizations, and Tribal consortia that are conducting or have completed vulnerability assessments, research planning, climate action plans, or other similar activities related to ocean acidification and coastal acidification and the impacts of ocean acidification and coastal acidification on coastal communities. </text></paragraph><paragraph id="idE1E15E047C3C48EA84CC1E7E1FD10184"><enum>(3)</enum><header>Priority</header><text>In carrying out paragraphs (1) and (2), the Secretary shall prioritize underserved populations and entities in the use of resources of the National Oceanic and Atmospheric Administration.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id700466F2319D49E0ADFBDF6DE6D975CF"><enum>4.</enum><header>Technical corrections</header><text display-inline="no-display-inline">The Federal Ocean Acidification Research And Monitoring Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/33/3701">33 U.S.C. 3701 et seq.</external-xref>) is amended—</text><paragraph id="id7DE44F7084494A64B73DF3C9FD36DBF9"><enum>(1)</enum><text>in section 12402 (<external-xref legal-doc="usc" parsable-cite="usc/33/3701">33 U.S.C. 3701</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide084b2719b1d46d5b1665a15b68db3c0"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>development coordination and implementation</quote> and inserting <quote>development, coordination, and implementation</quote>; and</text></subparagraph><subparagraph id="idad2ccd1e80f44cf69f3307eea9c31331"><enum>(B)</enum><text>in paragraph (4), by striking <quote>research adaptation strategies and mitigating the impacts</quote> and inserting <quote>research on adaptation strategies and mitigation of the impacts</quote>; </text></subparagraph></paragraph><paragraph id="idDFBD9E07B7494F2BB47548DAE70F3C5F"><enum>(2)</enum><text>in section 12404 (<external-xref legal-doc="usc" parsable-cite="usc/33/3703">33 U.S.C. 3703</external-xref>)—</text><subparagraph id="idFA0ABFB7DA5A4BFB82B67F347198E307"><enum>(A)</enum><text>in subsection (b)(5), by striking <quote>; and</quote> and inserting a period; </text></subparagraph><subparagraph id="idA081BE195059436190883F22A48D467D"><enum>(B)</enum><text>in subsection (c)(2)(A)—</text><clause id="id62A43E6400D846738B87BEDEECC4C8B4"><enum>(i)</enum><text>in clause (i), by striking <quote>subsection (d)(2)</quote> and inserting <quote>subsection (e)(2)</quote>;
