which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to revise certain physician self-referral exemptions relating to physician-owned hospitals.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HA20F2155A427454787AB9A6780DA3D4F"><section section-type="section-one" id="H11F036FCB83D4439872F88BFA143F292"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Physician Led and Rural Access to Quality Care Act</short-title></quote>.</text></section><section id="H12D3637B3AA34286AB55ADEAA8FA72D1"><enum>2.</enum><header>Revising certain physician self-referral exemptions relating to physician-owned hospitals</header><subsection id="H45D33EA0F60B41DDA08E8B8A7D73CDF0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1877 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395nn">42 U.S.C. 1395nn</external-xref>) is amended—</text><paragraph id="HB74BD2ACB62348C49A6440E5C807C163"><enum>(1)</enum><text>in subsection (d)—</text><subparagraph id="H345CCB6552344CE1A4CE34F76D57C81F"><enum>(A)</enum><text>in paragraph (2)(C), by inserting <quote>(other than a covered rural hospital (as defined in subsection (h)))</quote> after <quote>a hospital</quote>; and</text></subparagraph><subparagraph id="H2970FBF7A4B04392A287C81CA26BE540"><enum>(B)</enum><text>in paragraph (3)(D), by inserting <quote>in the case of a hospital other than a covered rural hospital (as defined in subsection (h)),</quote> before <quote>the hospital</quote>; and</text></subparagraph></paragraph><paragraph id="H59A5E9711D2B4328966504B01F8E1261"><enum>(2)</enum><text>in subsection (h), by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD6075E9D00E24F0FB7D4E38E297CB646"><paragraph id="H3460D60541014057B95E77F40A5E3933"><enum>(8)</enum><header>Covered rural hospital</header><subparagraph commented="no" display-inline="no-display-inline" id="id961a46700a334d18aa408f315eb020c4"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>covered rural hospital</quote> means a hospital that—</text><clause id="H548DFD2C42BF4839B3D4941AF6279B3A"><enum>(i)</enum><text display-inline="yes-display-inline">is located in a rural area (as defined in section 1886(d)(2)(D)); and</text></clause><clause id="H06A57D05BE6B4A7FB6FE980198413718"><enum>(ii)</enum><text display-inline="yes-display-inline">as of the date that such hospital enrolls under this title, meets the criteria described in clause (i)(I) of section 1820(c)(2)(B).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide3d65bb30e0d4ecb8d6a76fbaa58df3d"><enum>(B)</enum><header>Clarification</header><text display-inline="yes-display-inline">Nothing in this paragraph shall be interpreted as requiring a covered rural hospital to meet any other criteria under section 1820(c)(2)(B).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H60EB6573A0034B188CF7638F8197D824"><enum>(b)</enum><header>Allowing for expansion of existing physician-Owned hospitals</header><text>Section 1877(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395nn">42 U.S.C. 1395nn(i)</external-xref>) is amended—</text><paragraph id="H47815A6E25D14D7CA4723356C1E6A7C3"><enum>(1)</enum><text>in paragraph (1)(B), by striking <quote>in paragraph (3)</quote> and inserting <quote>in paragraph (3) or (7)</quote>; and</text></paragraph><paragraph id="H660E6F4CEF78437AA1058B95C9DE1C29"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA1B7BC784C4C4C63A42F43FDDBA8CB52"><paragraph id="HFD630F609FD84211BC27AC149AA989DD"><enum>(7)</enum><header>Sunset of expansion prohibition</header><text display-inline="yes-display-inline">The requirement described in paragraph (1)(B) shall not apply beginning on the date of the enactment of this paragraph.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
