which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure the maintenance of a herd of horses in Theodore Roosevelt National Park, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Theodore Roosevelt National Park Wild Horses Protection Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id42d6e0c919024342824e2b01d224fb11"><enum>2.</enum><header>Maintenance of horses in Theodore Roosevelt National Park</header><text display-inline="no-display-inline">Section 5 of the Act of April 25, 1947 (61 Stat. 54, chapter 41; <external-xref legal-doc="usc" parsable-cite="usc/16/245">16 U.S.C. 245</external-xref>), is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id62c670bc95ee4dd998c930c97d6548e6"><enum>(1)</enum><text>by striking the section designation and all that follows through <quote>The Administration</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC85F9ED8006A42C9861B3758C7B29DB8"><section commented="no" display-inline="no-display-inline" id="id390ff7f58feb4d97a0adaf43a048c6a1"><enum>5.</enum><header>Administration, protection, and development</header><subsection commented="no" display-inline="no-display-inline" id="iddcf9b34c831248439a1fdec0f51b3109"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The administration</text></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3a1016911b2148049e35605aa7954ab9"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id760209C3549E4B34932524A2512739D2"><subsection commented="no" display-inline="no-display-inline" id="id382de6836b1d4d77a8aebf90da0ab5b9"><enum>(b)</enum><header>Maintenance of horses</header><paragraph commented="no" display-inline="no-display-inline" id="id322e33c7e075483c8399bbc3b89f33ff"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of the Interior (referred to in this subsection as the <quote>Secretary</quote>) shall maintain a genetically diverse herd of horses in the South Unit of Theodore Roosevelt National Park (referred to in this subsection as the <quote>Park</quote>), with a population of not fewer than 150 horses.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5a8591e16828476680ef1bcfb54a9c80"><enum>(2)</enum><header>Management plan</header><subparagraph commented="no" display-inline="no-display-inline" id="id5205b1f4a31d4fbbbf86bd2fc93f5664"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this subsection, the Secretary shall develop a plan to provide for the management of horses in the Park. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddcab988e578a4cfea964c3f148e8b2dc"><enum>(B)</enum><header>Requirements</header><text display-inline="yes-display-inline">The plan developed under subparagraph (A) shall provide for the cost-effective management of the horses in the Park while ensuring that natural resources within the Park are not adversely impacted.</text></subparagraph></paragraph><paragraph id="id0046af83b97748bc9c00c6d62ef5f244"><enum>(3)</enum><header>Removal</header><text>The Secretary shall not remove, or assist in or permit the removal of, any horses from Federal land within the boundaries of the Park—</text><subparagraph id="idb793b759579645a18940654c3dc222e6"><enum>(A)</enum><text>unless the removal is carried out as part of a plan to maintain a genetically diverse herd of horses; or</text></subparagraph><subparagraph id="ide6e2cdc1a23d4ec2b0de47b95af78fad"><enum>(B)</enum><text>except—</text><clause commented="no" display-inline="no-display-inline" id="id9c9b618038ba45e48f3ebff5f6b42eaf"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of emergency; or </text></clause><clause commented="no" display-inline="no-display-inline" id="id704397abb10b4303992086b7d57bf037"><enum>(ii)</enum><text display-inline="yes-display-inline">to protect public health and safety.</text></clause></subparagraph></paragraph><paragraph id="idd385a351e31f45b88f3ce77982b1df10"><enum>(4)</enum><header>Monitoring and assessment</header><text> The Secretary shall annually monitor, assess, and make available to the public findings regarding the population, structure, and health of the horses in the Park.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
