which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to prohibit machinegun conversion devices and illegal modifications of semiautomatic firearms, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Banning Unlawful Machinegun Parts Act</short-title></quote> or the <quote><short-title>BUMP Act</short-title></quote>.</text></section><section id="idA671A26742D7413491BD450F0E23342F"><enum>2.</enum><header>Prohibition</header><subsection id="id2695D9B3924248939E4657F370CE9159"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, is amended—</text><paragraph id="idD74D5ED4319041B7AF05B60EE4AFCD1C"><enum>(1)</enum><text>in section 921(a), by inserting after paragraph (30) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4840EEAD58BE4B13992DB34DAE92C0C0"><paragraph id="id2B2737FC27E84DE193B260E2BCFB9860" indent="up1"><enum>(31)</enum><text>The term <term>semiautomatic firearm</term> means any firearm that—</text><subparagraph id="id1f273e3a79f04520a0b77d9f8876dc13"><enum>(A)</enum><text>upon initiating the firing sequence, fires the first chambered cartridge and uses a portion of the energy of the firing cartridge to—</text><clause id="idfae41c407b724385a553a8723b38f7d1"><enum>(i)</enum><text>extract the expended cartridge case;</text></clause><clause id="id676c62e7809f4ca3869d008e916f61c0"><enum>(ii)</enum><text>chamber the next round; and</text></clause><clause id="id7963d9cea25b40a9913e2d9c63c60d6b"><enum>(iii)</enum><text>prepare the firing mechanism to fire again;</text></clause></subparagraph><subparagraph id="idd80fc809552145d690ff4193a1f189f4"><enum>(B)</enum><text>requires a separate pull, release, push, or initiation of the trigger to fire each cartridge; and</text></subparagraph><subparagraph id="id5f058da95ac843f4852d5de1ecc11c01"><enum>(C)</enum><text>is not a machinegun.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id142439C69D5D4140A339BCC1D7B2FD22"><enum>(2)</enum><text>in section 922, by inserting after subsection (u) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDDC947F462804258AFA253655A08879F"><subsection id="idDA497E065E4C43FB944AB0BAB690736B"><enum>(v)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id63CD64890B1D44F181ED3D445F4DDF46"><enum>(1)</enum><text>Except as provided in paragraphs (3) and (4), on and after the date that is 120 days after the date of enactment of this subsection, it shall be unlawful for any person to import, sell, manufacture, transfer, receive, or possess, in or affecting interstate or foreign commerce—</text><subparagraph id="id0B864537147745B182127FA004922A83" indent="up1"><enum>(A)</enum><text>any manual, power-driven, or electronic device primarily designed, or redesigned, so that when the device is attached to a semiautomatic firearm the device—</text><clause id="id8328E898FD394FE38DAE59FA0C84500B"><enum>(i)</enum><text>materially increases the rate of fire of the firearm; or</text></clause><clause id="id8830958BE44D42988271886D46808834"><enum>(ii)</enum><text>approximates the action or rate of fire of a machinegun;</text></clause></subparagraph><subparagraph id="idB563B8AD913A44789956D5C20AA2C0B8" indent="up1"><enum>(B)</enum><text>any device, part, or combination of parts, that is designed or functions to materially increase the rate of fire of a firearm, by eliminating the need for the operator of the firearm to make a separate movement for each individual function of the trigger; or</text></subparagraph><subparagraph id="idF28CD3B0BCC74217B74621F10E6A1B3F" indent="up1"><enum>(C)</enum><text>a semiautomatic firearm that has been modified in any way that—</text><clause id="id6F5E6078AFA248539CADAA74D53191F4"><enum>(i)</enum><text>materially increases the rate of fire of the firearm; or</text></clause><clause id="idD4915DDA621149168915BB4622FD05D7"><enum>(ii)</enum><text>approximates the action or rate of fire of a machinegun.</text></clause></subparagraph></paragraph><paragraph id="idE65B3B779B7843E19459C0709D4F9DB6" indent="up1"><enum>(2)</enum><text>Except as provided in paragraph (3), not later than 120 days after the date of enactment of this subsection, any person who lawfully owns or possesses a semiautomatic firearm that was modified as described in paragraph (1)(C) before such date of enactment shall register the semiautomatic firearm in accordance with <external-xref legal-doc="usc" parsable-cite="usc/26/5841">section 5841</external-xref> of the Internal Revenue Code of 1986.</text></paragraph><paragraph id="id5BDE04CD107F4D3FB5C955C8474F8707" indent="up1"><enum>(3)</enum><text>This subsection does not apply with respect to the importation for, manufacture for, sale to, transfer to, or possession by or under the authority of, the United States or any department or agency thereof or a State or Tribe, or a department, agency, or political subdivision thereof.</text></paragraph><paragraph id="idCD9506E4B41345E2A2C4B32F4112CC82" indent="up1"><enum>(4)</enum><text>Paragraph (1) shall not apply to any lawful transfer or possession of a semiautomatic firearm described in paragraph (1)(C) that—</text><subparagraph id="id7434DA8D8C3D43AF90F3AED0C4219E3F"><enum>(A)</enum><text>was lawfully modified and possessed before the date of enactment of this subsection; and</text></subparagraph><subparagraph id="id8219ACB5FA614D25BC220AC12E3D0604"><enum>(B)</enum><text>is registered in accordance with paragraph (2).</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id95DEE4F2A4CE4D858BF0679A205C9230"><enum>(3)</enum><text>in section 924(a)(2), by striking <quote>, or (o)</quote> and inserting <quote>(o), or (v)</quote>.</text></paragraph></subsection><subsection id="id535DEF93309041A5A461C6353DF46B96"><enum>(b)</enum><header>Amendment to the National Firearms Act</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/5845">Section 5845(a)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>and (8) a destructive device</quote> and inserting <quote>(8) a destructive device; and (9) a semiautomatic firearm, as defined in section 921 of title 18, United States Code, that is modified as described in section 922(v)(1)(C) of such title</quote>.</text></subsection></section></legis-body></bill>
