which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to restrict the possession of certain firearms, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Gas-Operated Semi-Automatic Firearms Exclusion Act</short-title></quote> or the <quote><short-title>GOSAFE Act</short-title></quote>.</text></section><section id="id5C08FD6CEA494144A659FD79760939AB"><enum>2.</enum><header>Restrictions</header><subsection id="id6754E9FA27C84E3BAC4797E44D8CF1AF"><enum>(a)</enum><header>Definitions</header><text>Section 921(a) of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idCF42B44DD1934F7AB717EA5E3B1EE83F"><paragraph id="id208BA36678A24B79B757C7FBC12F7903" indent="up1"><enum>(39)</enum><text>The term <term>semi-automatic firearm</term> means any firearm that—</text><subparagraph id="idc55759702f404f0faf7a30310562dfda"><enum>(A)</enum><text>upon initiating the firing sequence, fires the first chambered cartridge and uses a portion of the energy of the firing cartridge to—</text><clause id="id0F8B2066D2794B089B2E79C3495FEBA7"><enum>(i)</enum><text>extract the expended cartridge case;</text></clause><clause id="id35AB40874577415D8405C446825B4270"><enum>(ii)</enum><text>chamber the next round; and</text></clause><clause id="id703B867C614F40C6B6FE6CF135E5D061"><enum>(iii)</enum><text>prepare the firing mechanism to fire again;</text></clause></subparagraph><subparagraph id="id37126c7125b94d30b94e0ddda0deedd1"><enum>(B)</enum><text>requires a separate pull, release, push, or initiation of the trigger to fire each cartridge; and</text></subparagraph><subparagraph id="id5b575d59005245eca1e7d4ef4bb5d198"><enum>(C)</enum><text>is not a machinegun.</text></subparagraph></paragraph><paragraph id="idEEE7A16223E14DA497AAE36F40DDDAEC" indent="up1"><enum>(40)</enum><text>The term <term>cycle the action</term>, with respect to a firearm, means to extract the fired cartridge case, chamber the next cartridge, and prepare the firing mechanism to fire again.</text></paragraph><paragraph id="idF95373D4D2E14B43845E7A365DD1D8F7" indent="up1"><enum>(41)</enum><text>The term <term>gas-operated</term>, with respect to a semi-automatic firearm, means any firearm that harnesses or traps a portion of the high-pressure gas from a fired cartridge to cycle the action using—</text><subparagraph id="idaf065a958bff4d358181be617720e265"><enum>(A)</enum><text>a long stroke piston, where gas is vented from the barrel to a piston that is mechanically fixed to the bolt group and moves to cycle the action;</text></subparagraph><subparagraph id="idf802afb1d56745b2a398a328336d15d6"><enum>(B)</enum><text>a short stroke piston, where gas is vented from the barrel to a piston that moves separately from the bolt group so that the energy is imparted through a gas piston to cycle the action;</text></subparagraph><subparagraph id="idDEC7861305244034A73B37327B15D155"><enum>(C)</enum><text>a system that traps and vents gas from either the barrel or the chamber to directly strike or impinge the bolt, bolt carrier, or slide assembly, to unlock and cycle the action; </text></subparagraph><subparagraph id="id75EA7A3D199141D18F21BEFBC1561A5E"><enum>(D)</enum><text>a hybrid system that combines elements of a system described in subparagraph (C) with a system described in subparagraph (A) or (B) to capture gas vented from the barrel to cycle the action;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7140753a7fc1405f8cc1097130cbfbd2"><enum>(E)</enum><text display-inline="yes-display-inline">a blowback-operated system that directly utilizes the expanding gases of the ignited propellant powder acting on the cartridge case to drive the breechblock or breech bolt rearward; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id06f8c1d82e1b467289311dbad237e1ce"><enum>(F)</enum><text display-inline="yes-display-inline">a recoil-operated system that utilizes the recoil force to unlock the breech bolt and then to complete the cycle of extracting, ejecting, and reloading. </text></subparagraph></paragraph><paragraph id="id47FD235901434BD88F0B4274E44D2719" indent="up1"><enum>(42)</enum><text>The term <term>large capacity ammunition feeding device</term>—</text><subparagraph id="idd1d428aa68474f0db43e20511752e583"><enum>(A)</enum><text>means a magazine, belt, drum, feed strip, helical feeding device, or similar device, including any such device joined or coupled with another in any manner, that— </text><clause commented="no" display-inline="no-display-inline" id="id6bb1118aa0e34797aa507fc4596631ec"><enum>(i)</enum><text display-inline="yes-display-inline">has an overall capacity of, or that can be readily restored, altered, or converted to accept, more than 10 rounds of ammunition; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idc8908ea5abcf45dfaa02ae1c7be88663"><enum>(ii)</enum><text>is not permanently fixed; and</text></clause></subparagraph><subparagraph id="id80f824e0bf9a4b919e3cf2274146fc5d"><enum>(B)</enum><text>does not include any device designed to accept, and capable of operating only with, .22 or less caliber rimfire ammunition.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id9BCD6C0E530E41A5888E8245EC23A290"><enum>(b)</enum><header>Prohibitions</header><text>Section 922 of title 18, United States Code, is amended—</text><paragraph id="idBA4BC706F2D8448B9C10CF511AF1A2C3"><enum>(1)</enum><text>by inserting after subsection (u) the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id19D77774FAD246DE9211A927AB40583C"><subsection id="idFD833E022869453587655D351F05252E"><enum>(v)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idAFF4006B29654BCAB3E6A7076E16C003"><enum>(1)</enum><text>Except as provided in paragraph (2) or (4), it shall be unlawful for any person to import, sell, manufacture, transfer, receive, or possess, in or affecting interstate or foreign commerce, a firearm, device, or combination of parts described in subparagraphs (A) through (H), knowing or having reasonable cause to believe that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfde69780bdfc417b805b94017a068619" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">the firearm is included on the list of prohibited gas-operated semi-automatic firearms described in section 935(a); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id792f2080f3d240a892c1cbc32ea30d62" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the modified non-prohibited firearm, as modified, operates as a firearm included on the list of prohibited gas-operated semi-automatic firearms described in section 935(a); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id86be89951eb84df9aa6487fbfd7d189b" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">the combination of parts is designed and functions to modify an otherwise non-prohibited firearm so that the firearm, as modified, operates as a gas-operated semi-automatic firearm included on the list of prohibited gas-operated semi-automatic firearms described in section 935(a); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id075af99a03394dca8700aaac16c360e5"><enum>(D)</enum><text display-inline="yes-display-inline">the combination of parts is designed to be assembled into a firearm that operates as a firearm included on the list of prohibited gas-operated semi-automatic firearms described in section 935(a);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="idb095922b31a540b18fcbec5b84148275"><enum>(E)</enum><text display-inline="yes-display-inline">the combination of parts functions to produce a gas-operated semi-automatic cycling action that was not lawfully manufactured as part of an approved firearm design described in section 935(c);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="idaf26530ba7b44641958937fed9e2f9e4"><enum>(F)</enum><text display-inline="yes-display-inline">the manual, power-driven, or electronic device is primarily designed, or redesigned, so that if the device is attached to a semi-automatic firearm the device—</text><clause commented="no" display-inline="no-display-inline" id="id295926f6a4cb4170baea9112c83792d2"><enum>(i)</enum><text display-inline="yes-display-inline">materially increases the rate of fire of the firearm; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idb4be8d5ecd8e4eac8c7660954bb246fc"><enum>(ii)</enum><text display-inline="yes-display-inline">approximates the action or rate of fire of a machinegun;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id3039ff5fb9c14b0ba258f7a1456265a1"><enum>(G)</enum><text display-inline="yes-display-inline">the device, part, or combination of parts is designed and functions to materially increase the rate of fire of the semi-automatic firearm by eliminating the need for the operator of the firearm to make a separate movement for each individual function of the trigger; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="idd2ba7eb589ea4324919f1aa115323435"><enum>(H)</enum><text display-inline="yes-display-inline">the semi-automatic firearm has been modified in any way that—</text><clause commented="no" display-inline="no-display-inline" id="idbf7354b8151d4617befd8e162037f12f"><enum>(i)</enum><text display-inline="yes-display-inline">materially increases the rate of fire of the firearm; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id5c93154f02ec47ad88530e02af72c331"><enum>(ii)</enum><text display-inline="yes-display-inline">approximates the action or rate of fire of a machinegun.</text></clause></subparagraph></paragraph><paragraph id="id6C68145665CC4656955C9B6AF0892230" indent="up1"><enum>(2)</enum><text>Paragraph (1) shall not apply to—</text><subparagraph id="idA0D7CAD5AF554B16AA4881CE3CD09FDF"><enum>(A)</enum><text>the importation or manufacture by or for, sale or transfer to, or possession by or under the authority of, the United States or any department or agency thereof or a State or Tribe, or a department, agency, or political subdivision thereof;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5efb963c96044e83b8f85a58ad026e18"><enum>(B)</enum><text display-inline="yes-display-inline">the importation or manufacture for, sale or transfer to, or possession by, a licensee under title I of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011 et seq.</external-xref>) for purposes of establishing and maintaining an on-site physical security protection system and security organization required by Federal law, or the transfer to, or possession by, a contractor of such a licensee on-site for such purposes or off-site for purposes of licensee-authorized training or transportation of nuclear materials; </text></subparagraph><subparagraph id="id7E0537A60FDC4AC089FB04EC0FA29B57"><enum>(C)</enum><text>the possession of a gas-operated semi-automatic firearm that, before the date of enactment of this subsection, was lawfully— </text><clause commented="no" display-inline="no-display-inline" id="id0a194e5edfeb4479878ecd0840d8c175"><enum>(i)</enum><text display-inline="yes-display-inline">manufactured; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idfc1aa60ef6f74445804352b6fcf036c5"><enum>(ii)</enum><text display-inline="yes-display-inline">transferred by the manufacturer to another party; or </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0ed80e83265144b98fd03415c9b27fb3"><enum>(D)</enum><text>the transfer of a gas-operated semi-automatic firearm that is lawfully possessed before the date of enactment of this subsection in accordance with subparagraph (C), in which—</text><clause commented="no" display-inline="no-display-inline" id="id483ed9db279741fbabee81857da8f4e5"><enum>(i)</enum><text>the transferee is an immediate family member of the transferor;</text></clause><clause commented="no" display-inline="no-display-inline" id="id1ece8404c92e4a1c9bc6421db47171e6"><enum>(ii)</enum><text display-inline="yes-display-inline">the transfer occurs after a licensed importer, licensed manufacturer, or licensed dealer has first taken possession of the firearm for the purpose of complying with subsection (t) before such transfer to the immediate family member occurs; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idc2c248469aa84e9da83b5c5259bd7aed"><enum>(iii)</enum><text>upon taking possession of the firearm under clause (ii), the licensee to whom the firearm was transferred under clause (ii) complies with all requirements of this chapter as if the licensee were transferring the firearm from the business inventory of the licensee to the unlicensed transferee.</text></clause></subparagraph></paragraph><paragraph id="idA17CC1AEFDB14968AA850D25FD0D9ED0" indent="up1"><enum>(3)</enum><text>Licensed importers and licensed manufacturers shall mark all gas-operated semi-automatic firearms imported or manufactured under subparagraphs (A) and (B) of paragraph (2) after the date of enactment of this subsection in the manner prescribed by the Attorney General before any transfer under subparagraph (A) or (B) of paragraph (2).</text></paragraph><paragraph id="idABF1794DAE7545688D39CB2EB4F30401" indent="up1"><enum>(4)</enum><text>For purposes of this subsection—</text><subparagraph id="id3FA5DACD349E401FA9FEC65921A9FD43"><enum>(A)</enum><text>the term <term>gas-operated semi-automatic firearm</term> does not include—</text><clause commented="no" display-inline="no-display-inline" id="id38cbaf82af90499caadabc82e2c6235e"><enum>(i)</enum><text display-inline="yes-display-inline">any firearm designed to accept, and capable of operating only with, .22 caliber rimfire ammunition, provided that such firearm does not have a separate upper and lower receiver;</text></clause><clause commented="no" display-inline="no-display-inline" id="id20f2b7d40526404c9a1a1630d4520196"><enum>(ii)</enum><text display-inline="yes-display-inline">a rifle that—</text><subclause commented="no" display-inline="no-display-inline" id="idee7b9548e64f401081e72157d95a5e49"><enum>(I)</enum><text display-inline="yes-display-inline">is a single-shot rifle;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idabd67080e5eb472c9a742d48c2256b56"><enum>(II)</enum><text display-inline="yes-display-inline">is a breech loading rifle with a capacity not to exceed 2 rounds of ammunition;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id6769e19a15524dfca2902d1f4ddc4c50"><enum>(III)</enum><text display-inline="yes-display-inline">is a muzzle-loading rifle or smoothbore shoulder-fired firearm; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide08c4c61ed074bada8387a07202831f9"><enum>(IV)</enum><text display-inline="yes-display-inline">uses a bolt action, lever action, or pump action to cycle the action of the rifle; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id57b9a37ffc3241ddacb573cabc662dd0"><enum>(V)</enum><text display-inline="yes-display-inline">has a permanently fixed magazine with a capacity not to exceed 10 rounds of ammunition that cannot be converted or changed to accept more than 10 rounds of ammunition;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idf6f59944a0c5453699cc68369fca658f"><enum>(iii)</enum><text display-inline="yes-display-inline">a shotgun that—</text><subclause commented="no" display-inline="no-display-inline" id="id0e82aa7380a8458cbca616d0d3f65ce9"><enum>(I)</enum><text display-inline="yes-display-inline">is a single-shot shotgun;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id425b4efd29f541cb878d509dd581b118"><enum>(II)</enum><text display-inline="yes-display-inline">is a breech loading shotgun with a capacity not to exceed 2 rounds of ammunition;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id63cff349e2444d868883f9e75fbfa809"><enum>(III)</enum><text display-inline="yes-display-inline">is a muzzle-loading shotgun;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id335f708011fa40fba7a74e9fbf4033bd"><enum>(IV)</enum><text display-inline="yes-display-inline">uses a bolt action, lever action, or pump action to cycle the action of the shotgun; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id303c61cd5f394047b8bcfbfbc81f109d"><enum>(V)</enum><text display-inline="yes-display-inline">is a semi-automatic or auto-loading shotgun; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb6903329f8d043b3b394b64d6757d162"><enum>(VI)</enum><text display-inline="yes-display-inline">has a permanently fixed magazine with a capacity not to exceed 10 rounds of ammunition that cannot be converted or changed to accept more than 10 rounds of ammunition;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idaabdd275961a4df5b0353b8aa76c2310"><enum>(iv)</enum><text>a breech loading firearm capable of holding a single cartridge and not more than 2 shotgun shells simultaneously and that must be reloaded after firing those rounds of ammunition; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id2543458ab34047428a7eec85dcef48d4"><enum>(v)</enum><text>a handgun that—</text><subclause commented="no" display-inline="no-display-inline" id="idcd00f36a46634987b9ff644e5747be11"><enum>(I)</enum><text display-inline="yes-display-inline">is a single-shot handgun;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idd83afcd645ea4671ba679d318c59f155"><enum>(II)</enum><text>is a breech loading handgun with a capacity not to exceed 2 rounds of ammunition; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id70e486ff41844d83a3cfc4296a0225d9"><enum>(III)</enum><text>is a muzzle-loading or smoothbore handgun;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc37771a01a354f8b9ca7917e90a954f6"><enum>(IV)</enum><text>uses a bolt action to cycle the action of the handgun;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idcdc81d76bbde458ca9971b2d51aa0ff1"><enum>(V)</enum><text>is a single or double action revolver; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0dfc9aa9b8f44fdf8d8f97a14d77ef3d"><enum>(VI)</enum><text>is a single or double action semi-automatic handgun that uses recoil to cycle the action of the handgun; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id03f95ec4687e494bbe2d610f49bd75a1"><enum>(VII)</enum><text>has a permanently fixed magazine with a capacity not to exceed 15 rounds of ammunition that cannot be converted or changed to accept more than 15 rounds of ammunition; and</text></subclause></clause></subparagraph><subparagraph id="idF01E380466C14A1DA4053310F3780CE5"><enum>(B)</enum><text>the term <term>immediate family member</term> means, with respect to a person—</text><clause id="id2A5E8D14D981409AB92A9ECD64F5D596"><enum>(i)</enum><text>a spouse, parent, brother or sister, or child of that person, or an individual to whom that person stands in loco parentis; or</text></clause><clause id="id5AD0B2082E9944A9AC05C365F2BD5ADF"><enum>(ii)</enum><text>any other person living in the household of that person and related to that person by blood or marriage.</text></clause></subparagraph></paragraph></subsection><subsection id="id37E40AF5145D4D9CB5015A808D1A5598"><enum>(w)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id925B338247264B8999F4C93D53FC5914"><enum>(1)</enum><text>Except as provided in paragraph (3), it shall be unlawful, on and after the date of enactment of this subsection, for any person to, in or affecting interstate or foreign commerce—</text><subparagraph id="id16EB0C0E8BCF488DBB9446E1BF70DE77" indent="up1"><enum>(A)</enum><text>import, sell, manufacture, transfer, or receive a large capacity ammunition feeding device; or</text></subparagraph><subparagraph id="id9D76409B546345768F500D3D44E4DBBF" indent="up1"><enum>(B)</enum><text>possess a large capacity ammunition feeding device manufactured after the date of enactment of this subsection.</text></subparagraph></paragraph><paragraph id="id277D0F8ECA9C4E85BDC490BC988324BE" indent="up1"><enum>(2)</enum><text>It shall be unlawful for any person who lawfully owns or possesses a large capacity ammunition feeding device that was manufactured and purchased or transferred before such date of enactment to transfer, in or affecting interstate or foreign commerce, such device after the date of enactment of this subsection.</text></paragraph><paragraph id="id639850B4C56046A0AC19C79E62E12A37" indent="up1"><enum>(3)</enum><text>This subsection shall not apply with respect to— </text><subparagraph commented="no" display-inline="no-display-inline" id="ida1f57fa5b3ee4f6993d41060507f91df"><enum>(A)</enum><text display-inline="yes-display-inline">the importation for, manufacture for, sale to, transfer to, or possession by or under the authority of, the United States or any department or agency thereof or a State or Tribe, or a department, agency, or political subdivision thereof; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id86e7de9563964774831e96de2362d6aa"><enum>(B)</enum><text display-inline="yes-display-inline">the importation or manufacture for, sale or transfer to, or possession by, a licensee under title I of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011 et seq.</external-xref>) for purposes of establishing and maintaining an on-site physical security protection system and security organization required by Federal law, or the transfer to, or possession by, a contractor of such a licensee on-site for such purposes or off-site for purposes of licensee-authorized training or transportation of nuclear materials.</text></subparagraph></paragraph><paragraph id="idC0E18B6A589346A5AC46425746E3BB6A" indent="up1"><enum>(4)</enum><text>Any licensed importer, licensed manufacturer, or other person in possession of a large capacity ammunition feeding device— </text><subparagraph commented="no" display-inline="no-display-inline" id="idb8c07ce61d9a41d788d5c2641a9bbf2a"><enum>(A)</enum><text display-inline="yes-display-inline">shall mark such large capacity ammunition feeding device imported or manufactured under subparagraph (A) or (B) of paragraph (3) after the date of enactment of this subsection in the manner prescribed by the Attorney General before any transfer under subparagraph (A) or (B) of paragraph (3); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id99ee2ebe27934c96b207b11f3ecc93ed"><enum>(B)</enum><text display-inline="yes-display-inline">may not obliterate or otherwise alter the serial number on such large capacity ammunition feeding device.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idf1e92f56990e48d58c6b9da028fc0137"><enum>3.</enum><header>Use of Byrne grants for buy-back programs for gas-operated semi-automatic firearms and large capacity ammunition feeding devices</header><text display-inline="no-display-inline">Section 501(a)(1) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10152">34 U.S.C. 10152(a)(1)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id67535224c277469fac6e8861150c0133"><subparagraph id="ida64fb9ab79cd44ff8786d3ac366dde31"><enum>(J)</enum><text>Compensation for surrendered gas-operated semi-automatic firearms and large capacity ammunition feeding devices, as defined in section 921 of title 18, United States Code, under buy-back programs for gas-operated semi-automatic firearms and large capacity ammunition feeding devices.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idCB9F055B6636469F869027202FFDC5CE"><enum>4.</enum><header>Penalties</header><text display-inline="no-display-inline">Section 924(a) of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idFECFD2565940423BAD0B978280B1044A"><paragraph id="id913B10B6EFD840ECA8FBB1BDEDC4983E" indent="up1"><enum>(9)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id0D44933AB11C4761ADBD65D510BC737D"><enum>(A)</enum><text>Whoever violates subsection (v) or (w) of section 922 shall be fined not more than $5,000, imprisoned not more than 12 months, or both, for each offense.</text></subparagraph><subparagraph id="id4115E7EC2BB74A7F8D39D5C00CD21927" indent="up1"><enum>(B)</enum><text>Whoever, while in possession of a gas-operated semi-automatic firearm in violation of section 922(v), commits, or attempts to commit, any other Federal offense punishable by imprisonment for a term exceeding 1 year, shall, in addition to the punishment provided for such offense, be fined not more than $250,000, imprisoned for a term not less than 2 years and not more than 10 years, or both.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id1A458CFAAE6143A68DEBD9D38C909226"><enum>5.</enum><header>Prohibited firearm determinations</header><subsection id="idCBEEBF4A7660427BB9E3AB417B40D580"><enum>(a)</enum><header>Amendment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idB3B1F51F7EB34126AF7553B32886C457"><section id="id6DC6FBAC63BC4FBD8ABC7EAE459B2D0D"><enum>935.</enum><header>Prohibited firearm determinations</header><subsection id="idF5455DA3FCE341A5842337770647E9DA"><enum>(a)</enum><header>Determination of prohibited firearms</header><text>For purposes of carrying out section 922(v), not later than 180 days after the date of enactment of this section, the Attorney General, acting through the Director of the Bureau of Alcohol, Tobacco, Firearms, and Explosives, shall publish, and update, a list of gas-operated semi-automatic firearms in or affecting interstate or foreign commerce that are subject to the prohibition in section 922(v).</text></subsection><subsection id="id993909C9185F4B8EBCD0AFB5802A98AF"><enum>(b)</enum><header>Responsibilities</header><text>In carrying out this section, the Director of the Bureau of Alcohol, Tobacco, Firearms, and Explosives shall—</text><paragraph id="id49C02E828CD94269A877448151CF2D42"><enum>(1)</enum><text>review applications and appeals from licensed manufacturers submitted under subsections (c) and (d); </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida00b28acf8c14fe3a208e7f47c77042e"><enum>(2)</enum><text>require that each licensed dealer record purchaser acknowledgment of the list published under subsection (a) before any sale of a firearm that is not prohibited under that list; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id638c4316f0514cb5869cab23f55f3037"><enum>(3)</enum><text display-inline="yes-display-inline">before removing any gas-operated semi-automatic firearm from the list required under subsection (a), submit to the Attorney General clear and convincing evidence of whether the firearm should be removed from the list; and</text></paragraph><paragraph id="idA157C4196EA14AEAA0F4724682D6DCC6"><enum>(4)</enum><text>advise the Attorney General on carrying out the authority described in subsection (a).</text></paragraph></subsection><subsection id="id8EADA91706B74778B521EBD342242B0E"><enum>(c)</enum><header>Applications for approval of firearm designs</header><paragraph id="id4AB4E224E0E547CDBFDC6E75E332FA06"><enum>(1)</enum><header>In general</header><text>Any semi-automatic firearm designed on or after the date of enactment of this section shall be required to have an approval under this subsection prior to the manufacture, in or affecting interstate or foreign commerce, of such firearm for sale to civilians.</text></paragraph><paragraph id="id027FB24284214A7599C8A58821C593D2"><enum>(2)</enum><header>Application for approval</header><text>A licensed manufacturer may file with the Attorney General an application, under penalty of perjury, for approval for a semi-automatic firearm as not subject to the prohibition under section 922(v), which shall contain—</text><subparagraph id="id9de897e44522466683b221cc5e6df47d"><enum>(A)</enum><text>a detailed description of the specifications and operation of the firearm;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf24cbe86a5af403fa44992406908811e"><enum>(B)</enum><text>a physical sample of the firearm; </text></subparagraph><subparagraph id="id60D8ADF639654586A7C5D83033CE1084"><enum>(C)</enum><text>any patent application for the firearm;</text></subparagraph><subparagraph id="id044584C03D604B44AE70936E5E648AEA"><enum>(D)</enum><text>marketing materials and plans;</text></subparagraph><subparagraph id="idAE49C7D83F2E4F30B2AEB95A43E7DA23"><enum>(E)</enum><text>an explanation of why the firearm should not be subject to the prohibition under section 922(v);</text></subparagraph><subparagraph id="idBB782F7091F547DDBD74609ECAA132B4"><enum>(F)</enum><text>a description of any features that prevent modification of the firearm; and</text></subparagraph><subparagraph id="idBFC88E7861734918996655BAE709676F"><enum>(G)</enum><text>any other information the Attorney General shall require.</text></subparagraph></paragraph><paragraph id="idFA1167D1FE4D48B3AAD52CED4269A2F1"><enum>(3)</enum><header>Review of application</header><subparagraph id="id0773640021E34C7D8546A26EC3B88824"><enum>(A)</enum><header>In general</header><text>Not later than 240 days after the date on which an application is submitted under paragraph (2), the Attorney General shall review the application and issue a written determination approving or denying the application.</text></subparagraph><subparagraph id="id726A5CE0FB804992B65E8DB1EE486EC3"><enum>(B)</enum><header>Request for information</header><text>The Attorney General may request any additional information from the manufacturer necessary to make the determination under subparagraph (A). </text></subparagraph></paragraph><paragraph id="idB7EDC9D0F0AF487B9DA8DE90DC2FDEF2"><enum>(4)</enum><header>Fees</header><subparagraph id="idbbcf64f7d4fe45e6812d2c13ce6793ae"><enum>(A)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this section, the Attorney General shall determine the appropriate fee structure for application submissions under this subsection by licensed manufacturers.</text></subparagraph><subparagraph id="idC6D7F46A926149058BED0C3DAF7FED8B"><enum>(B)</enum><header>Consideration</header><text>In determining the fee structure required under subparagraph (A), the Attorney General shall ensure that the fees collected are substantial enough to cover the necessary costs associated with carrying out the activities described in subparagraph (A).</text></subparagraph><subparagraph id="id664573541e4e40598f9f2e439bc16a9e"><enum>(C)</enum><header>Firearm Safety Trust Fund</header><clause id="id0F3A74C719624275B0EB849668B64782"><enum>(i)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a fund to be known as the <quote>Firearm Safety Trust Fund</quote>.</text></clause><clause id="idA2E8645C58374A86BD5806A55DF0B71D"><enum>(ii)</enum><header>Deposits</header><text>Notwithstanding section 3302 of title 31, there shall be deposited in the Firearm Safety Trust Fund—</text><subclause id="id30A23321922D475DBBA522DB651C025C"><enum>(I)</enum><text>all taxes collected by the Bureau of Alcohol, Tobacco, Firearms, and Explosives under subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/53">chapter 53</external-xref> of the Internal Revenue Code of 1986; and</text></subclause><subclause id="id549B991A643E4ECC9E9DECE707240A2B"><enum>(II)</enum><text>any fees collected under this paragraph.</text></subclause></clause><clause id="id9BDE63723A694AC39849AAF63B275209"><enum>(iii)</enum><header>Availability of amounts</header><text>All amounts deposited in the Firearm Safety Trust Fund shall—</text><subclause id="id689FB8FFEFDC4EC1BBAC5CCE324586D9"><enum>(I)</enum><text>be deposited as offsetting collections into the Firearm Safety Trust Fund for use by the Attorney General in carrying out the requirements of the <short-title>GOSAFE Act</short-title> and the National Firearms Act (<external-xref legal-doc="usc" parsable-cite="usc/26/5849">26 U.S.C. 5849 et seq.</external-xref>); and</text></subclause><subclause id="id4E424C55627B4FE59327AC483F0C1AB6"><enum>(II)</enum><text>remain available until expended.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="id577F4E069A63440AB374A59CBAAFDED2"><enum>(d)</enum><header>Appeals</header><paragraph id="idFF3D51484A77437687FCF46D1285E2D2"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date on which the Attorney General denies an application under subsection (c)(3), the licensed manufacturer may appeal the determination by filing an appeal with the Attorney General.</text></paragraph><paragraph id="idF90DDF257FE0409EA0A2B87FE993BC0D"><enum>(2)</enum><header>Review by Attorney General</header><text>Not later than 180 days after the date on which an appeal is filed under paragraph (1), the Attorney General shall issue a written determination upholding or revising the denial of the application. </text></paragraph><paragraph id="idC87E73BC7D5C47C8922C62DAF969C339"><enum>(3)</enum><header>Judicial review</header><subparagraph id="idE50C1BCC105D4F45A8AEE2233A200648"><enum>(A)</enum><header>In general</header><text>Upon a determination by the Attorney General to uphold the denial of an application under paragraph (2), the licensed manufacturer may file a petition for review of the determination in the appropriate district court of the United States.</text></subparagraph><subparagraph id="idA0966495B740431B9E465CCE67B51D04"><enum>(B)</enum><header>Standard of proof</header><text>In a review conducted under subparagraph (A), the court may set aside the determination if the determination is found to be arbitrary and capricious.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id90da7790338b437d9c99f0aa010c5707"><enum>(e)</enum><header>Private right of action</header><paragraph commented="no" display-inline="no-display-inline" id="id573b313d76364f3d8a7915b8f9707ed1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If the Attorney General, acting through the Director of the Bureau of Alcohol, Tobacco, Firearms, and Explosives, removes any gas-operated semi-automatic firearm from the list of gas-operated semi-automatic firearms required under subsection (a), any person may file an action in an appropriate district court of the United States for review of such removal. </text></paragraph><paragraph id="idD606D0FD69F441B183E2A958E3105B6A"><enum>(2)</enum><header>Standard of proof</header><text>In a review conducted under paragraph (1), the court may grant the petitioner injunctive relief if the determination is found to be arbitrary and capricious. </text></paragraph></subsection><subsection commented="no" id="ide9a3ef8489814f709248d8f67745e76c"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary to carry out this section, and any amounts so appropriated shall remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id6C4EA87AD9ED4028A9A007B8E5E76B34"><enum>(b)</enum><header>Table of sections</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/934">section 934</external-xref> the following:</text><quoted-block style="USC" id="id47618101-23f0-4364-a3b4-8c6191702ee4"><toc><toc-entry idref="id6DC6FBAC63BC4FBD8ABC7EAE459B2D0D" level="section">935.
