<section id="id9CF827A4979B46079C94A51BD9D8E680" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Revising and Enhancing Project Authorizations Impacted by Review Act of 2025</short-title></quote> or the <quote><short-title>REPAIR Act of 2025</short-title></quote>.</text></section> <section id="iddec6d55284094e9cae2cc0dcfb4df050"><enum>2.</enum><header>Definitions</header> <subsection id="id378178F40B834BE2B5ECB97DA9084CD5"><enum/><text>In this Act:</text>
<paragraph commented="no" display-inline="no-display-inline" id="idca69662822f84eb5a64f6681f72f91be"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given the term in section 551 of title 5, United States Code.</text></paragraph> <paragraph id="idB0E1BA943FBB47F49464526E7835F3B0"><enum>(2)</enum><header>Agency of jurisdiction</header><text>The term <term>agency of jurisdiction</term> means any agency that is responsible for approving an authorization under authorizing legislation.</text></paragraph>
<paragraph id="idAADD148C48CB45F7933EC73101288A86"><enum>(3)</enum><header>Authorization</header><text>The term <term>authorization</term> means any license, permit, authorization, approval, variance, consultation, finding, or other administrative decision (or any extension to or of any license, permit, authorization, approval, variance, consultation, finding, or other administrative decision) that is required or authorized under Federal law (including regulations) to design, plan, site, construct, reconstruct, commence operations of, modify, or operate a project.</text></paragraph> <paragraph id="id142DE561A16A4D0A9086F3029E2478DF"><enum>(4)</enum><header>Authorizing legislation</header><text>The term <term>authorizing legislation</term> means any of—</text>
<subparagraph id="id0F4686388F0D4955903A0FA492F39917"><enum>(A)</enum><text>the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>);</text></subparagraph> <subparagraph id="id7F3129F1FECF4AB199EC7C06D0192DD6"><enum>(B)</enum><text>the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>);</text></subparagraph>
<subparagraph id="idCABDE86936314158B904D9FD09196791"><enum>(C)</enum><text>the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717">15 U.S.C. 717 et seq.</external-xref>);</text></subparagraph> <subparagraph id="id7F987229C00B4524B1161BD6808EBB72"><enum>(D)</enum><text>the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/791a">16 U.S.C. 791a et seq.</external-xref>);</text></subparagraph>
<subparagraph id="idDFB7716E522648A898A50B2B0E2C1432"><enum>(E)</enum><text>division A of subtitle III of title 54, United States Code (formerly known as the <quote>National Historic Preservation Act</quote> (<external-xref legal-doc="usc" parsable-cite="usc/16/470">16 U.S.C. 470 et seq.</external-xref>));</text></subparagraph> <subparagraph id="id4BB427F62B334D0ABDADCF1FB81EEAEF"><enum>(F)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></subparagraph>
<subparagraph id="idD22C244888BC45B88A13B9B87F905CB5"><enum>(G)</enum><text>the Migratory Bird Treaty Act (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703 et seq.</external-xref>);</text></subparagraph> <subparagraph id="idA46E61B3AE584543B5343E7403A75715"><enum>(H)</enum><text>the Act of June 8, 1940 (<external-xref legal-doc="usc" parsable-cite="usc/16/668">16 U.S.C. 668 et seq.</external-xref>) (commonly known as the <quote>Bald and Golden Eagle Protection Act</quote>); </text></subparagraph>
<subparagraph id="id16EB82DD26704D48985CD7FF20A2BD3C"><enum>(I)</enum><text>the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1361">16 U.S.C. 1361 et seq.</external-xref>);</text></subparagraph> <subparagraph id="idB06D284EC38349E7ABE4F8EF8D67385C"><enum>(J)</enum><text>the <act-name parsable-cite="CAMA72">Coastal Zone Management Act of 1972</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1451">16 U.S.C. 1451 et seq.</external-xref>);</text></subparagraph>
<subparagraph id="idBA90BDF480E5435789E1ACEDF3817962"><enum>(K)</enum><text>the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331 et seq.</external-xref>);</text></subparagraph> <subparagraph id="id3B96FEE0D89347B597A78B081A2BBDE6"><enum>(L)</enum><text>the <act-name parsable-cite="MLA">Mineral Leasing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>);</text></subparagraph>
<subparagraph id="idFA69EDEF310A4A27A95AE8D98A87F214"><enum>(M)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>), as it relates to any State seeking to obtain primary enforcement authority for—</text> <clause commented="no" display-inline="no-display-inline" id="id6211c3f3a363402e8ff3c95422f92321"><enum>(i)</enum><text display-inline="yes-display-inline">that Act pursuant to section 1413 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-2">42 U.S.C. 300g–2</external-xref>); or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="id83c8022c9f214a318bc6697bb4a62251"><enum>(ii)</enum><text>an underground injection control program pursuant to section 1422 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300h-1">42 U.S.C. 300h–1</external-xref>);</text></clause></subparagraph> <subparagraph id="id8C9BBBDFBA1747D1B34DD1074211B3DB"><enum>(N)</enum><text>the Deepwater Port Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/33/1501">33 U.S.C. 1501 et seq.</external-xref>);</text></subparagraph>
<subparagraph id="id5E37A832A9B340C69F692AE18CFF9771"><enum>(O)</enum><text>the <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011 et seq.</external-xref>);</text></subparagraph> <subparagraph id="id26F22BFA4FF240978D5FDA2D549F162D"><enum>(P)</enum><text>the Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001 et seq.</external-xref>);</text></subparagraph>
<subparagraph id="id96b369aba89d440197cdf32c2adeb1c8" commented="no"><enum>(Q)</enum><text>the National Forest Management Act of 1976 (<external-xref legal-doc="public-law" parsable-cite="pl/94/588">Public Law 94–588</external-xref>; 90 Stat. 2949);</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id495bef6e4b514261adb46e8caf59a989"><enum>(R)</enum><text display-inline="yes-display-inline">the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600 et seq.</external-xref>);</text></subparagraph>
<subparagraph id="id3e82f0e3d5274a1eb36f62529999df44"><enum>(S)</enum><text>the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>);</text></subparagraph> <subparagraph id="idd47679b3b51b46b294014ae347ea7008"><enum>(T)</enum><text>the <act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>);</text></subparagraph>
<subparagraph id="idcce799eb916648b4824773f26d8f2ae5"><enum>(U)</enum><text><act-name parsable-cite="CERCL">the Comprehensive Environmental Response, Compensation, and Liability Act of 1980</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>);</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id7d5ec7e035834438a14351d14b45af5d"><enum>(V)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/54/2005">chapter 2005</external-xref> of title 54, United States Code (formerly known as the <quote>Urban Park and Recreation Recovery Act of 1978</quote> (<external-xref legal-doc="usc" parsable-cite="usc/16/2501">16 U.S.C. 2501 et seq.</external-xref>)); and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id417cc1405ff343cf9d5831e52da2f00b"><enum>(W)</enum><text>any other Federal law requiring an environmental review pursuant to the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id16522cad835d4b538a12682fa338ca4d"><enum>(5)</enum><header>Council</header><text>The term <term>Council</term> means the Federal Permitting Improvement Steering Council established by section 41002(a) of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m-1">42 U.S.C. 4370m–1(a)</external-xref>).</text></paragraph>
<paragraph id="iddbe0a56fa7034dedbf360869132dfebf"><enum>(6)</enum><header>Direct and tangible harm</header><text>The term <term>direct and tangible harm</term> means a harm with a causal connection to a project that causes—</text> <subparagraph id="id63066e3a35914e5ea1013bac399eae6a"><enum>(A)</enum><text>physical illness or bodily injury; or</text></subparagraph>
<subparagraph id="id59b9783463f149f5b91ca8e4285fa4e2"><enum>(B)</enum><text>uncompensated economic loss. </text></subparagraph></paragraph> <paragraph id="idAF5EF7A05E6C4F98A554E73C92D184DE"><enum>(7)</enum><header>Environmental review</header><text>The term <term>environmental review</term> means an assessment of environmental impact, prepared pursuant to the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), leading to the preparation of—</text>
<subparagraph id="id1B6D730AA15E4611A0383EA3B05610F9"><enum>(A)</enum><text>an environmental assessment;</text></subparagraph> <subparagraph id="idDA82D63D430B4F4681CBAF4DCECC1B7B"><enum>(B)</enum><text>a finding of no significant impact;</text></subparagraph>
<subparagraph id="id45AA8E9EF61B490B9416E936FA225864"><enum>(C)</enum><text>an environmental impact statement;</text></subparagraph> <subparagraph id="id41F0B7AB0B0544B99CEAD8202D24C833"><enum>(D)</enum><text>a record of decision; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idffd87f6ebf66450fa4bab445adb28400"><enum>(E)</enum><text>any other review prepared to fulfill the requirements of that Act.</text></subparagraph></paragraph> <paragraph id="id179941e08ffc43c292ed8a6ac26543bc"><enum>(8)</enum><header>Project</header><text>The term <term>project</term> means an activity required to receive an authorization under authorizing legislation.</text></paragraph>
<paragraph id="idc9c5a799e06348c59aeb830a47d4912d"><enum>(9)</enum><header>Project sponsor</header><text>The term <term>project sponsor</term> means the agency or other entity, including any private or public-private entity, that seeks approval from the agency of jurisdiction for a project.</text></paragraph></subsection></section> <section id="id17b353b95ac540a38dd874bbea5accd8"><enum>3.</enum><header>Judicial review</header> <subsection id="ide4f811e1310247f9a3a9deccd847cff8"><enum>(a)</enum><header>Statute of limitations</header> <paragraph id="id02A95C06777B492A8B1050D2693F0ED9"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id8f3a8bb364ef49ec86de1dbb4e9fcaac"><enum>(A)</enum><header display-inline="yes-display-inline">Initial authorization</header>
<clause id="idEBC78C60C22C4C6FAB69C89F718B5097"><enum>(i)</enum><header>In general</header><text>The term <term>initial authorization</term> means an authorization issued by an agency of jurisdiction for a project following a request for the authorization from a project sponsor.</text></clause> <clause id="idE0B50755403F4944A3ADC9FF549863FF"><enum>(ii)</enum><header>Exclusion</header><text>The term <term>initial authorization</term> does not include any authorization issued by an agency of jurisdiction following an alteration made by a project sponsor pursuant to a mediation process described in subsection (d).</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id6b7711ec232646699dceb115cd0d04de"><enum>(B)</enum><header>Initial claim</header><text>The term <term>initial claim</term> means a claim described in paragraph (2)(A).</text></subparagraph></paragraph> <paragraph id="id8C84ABADDFD34380BE4FE979C55FDDB1"><enum>(2)</enum><header>Claiming relating to initial authorizations</header> <subparagraph commented="no" display-inline="no-display-inline" id="id96343b13986c4d388f0d99b0f45dd478"><enum>(A)</enum><header>Initial claims</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a claim seeking judicial review of any portion of the initial authorization process carried out for a project pursuant to authorizing legislation or an initial authorization issued by an agency of jurisdiction for a project shall be filed by the date that is 120 days after the date on which the final agency action with respect to the project has been taken, unless a shorter time is specified in the Federal law pursuant to which judicial review is sought.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id79fcd77d8bac43ff85236a37dec1dec1"><enum>(B)</enum><header>Subsequent action</header>
<clause id="id98119a56ddcf4adea4c5cbdf65ea9385"><enum>(i)</enum><header>In general</header><text>Any additional action relating to an initial claim, including an action seeking a preliminary injunction based on the initial claim, shall be filed not later than 120 days after the date on which the initial claim was filed.</text></clause> <clause id="id87dd5ce7be8b4c6cbc5df2b29f1b7834"><enum>(ii)</enum><header>Failure to submit subsequent claim</header><text>An individual that fails to submit an additional action described in clause (i) relating to the filed initial claim by the deadline described in that clause shall—</text>
<subclause id="id432a7352511e4c64b821fdca5759e4e7"><enum>(I)</enum><text>invalidate the initial claim;</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="id1f2b5d717b42415dbd412be487a9331c"><enum>(II)</enum><text display-inline="yes-display-inline">be barred from bringing that additional claim; and</text></subclause>
<subclause id="id58b6af0ea51845fb80002f2eda2a6070"><enum>(III)</enum><text>remove any such right of action relating to that initial claim.</text></subclause></clause></subparagraph></paragraph> <paragraph id="id1E96A5365479481EB8DE283BA87B0CAC"><enum>(3)</enum><header>Other claims</header><text>Any other claim relating to the issuance of an authorization by an agency of jurisdiction for a project shall be subject to subsection (d).</text></paragraph></subsection>
<subsection id="id8fb4c92bdcf645408115b545ada61b6a"><enum>(b)</enum><header>Default remedy</header>
<paragraph id="id619a1dd804ef4ccdb46d87a24a27255d"><enum>(1)</enum><header>In general</header><text>If a court of law determines that an agency did not comply with the requirements of authorizing legislation when granting an authorization for a project, the default remedy shall be to remand that authorization to the applicable agency.</text></paragraph> <paragraph id="id45b0830b02f4420e8b6cae5069a23c68"><enum>(2)</enum><header>Limitation</header><text>A court of law shall not vacate, enjoin, or otherwise limit an authorization granted for a project unless the issuance of the authorization would present an imminent and substantial danger to human health or the environment for which there is no other equitable remedy available under law.</text></paragraph></subsection>
<subsection id="id6bdc6248ffa44167b8e13a8bf5b6cbaf"><enum>(c)</enum><header>Right of action</header><text>Notwithstanding any other provision of law, an individual seeking to bring a claim for judicial review of the approval of an authorization for a project may only bring the claim if the individual will suffer a direct and tangible harm because of the authorization for which the individual is seeking judicial review if the harm was not analyzed in the approval of the initial authorization (as defined in subsection (a)(1)).</text></subsection> <subsection id="ide1f65febf83f4c7aaa591257d0edb3cf"><enum>(d)</enum><header>Right of alteration</header> <paragraph id="ide52d5f37e5d84d93855162a5114685d4"><enum>(1)</enum><header>In general</header><text>If an authorization for a project is enjoined, remanded, or vacated by a court of law, the project sponsor and the agency of jurisdiction shall participate in a mediation process overseen by the Council—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id864454c91ccb4ccdadb70cc104d80af8"><enum>(A)</enum><text display-inline="yes-display-inline">to address the reasons for the injunction, remand, or vacatur; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idbb5b46c81f8a4952ba376a2d51d1d3d2"><enum>(B)</enum><text>to reauthorize the project for development.</text></subparagraph></paragraph>
<paragraph id="idb38b900bc0294713be13786db24bd562"><enum>(2)</enum><header>Process</header>
<subparagraph commented="no" display-inline="no-display-inline" id="id1e22f1223af04d65a1778e253259f623"><enum>(A)</enum><header>Remediation proposals</header><text display-inline="yes-display-inline">Subject to subparagraph (B)(i), not later than 60 days after the date on which an authorization for a project is enjoined, remanded, or vacated by a court of law, the project sponsor and the agency of jurisdiction shall each submit to the Council remediation proposals—</text> <clause commented="no" display-inline="no-display-inline" id="id45e0e949c2014084a387969b98515e6a"><enum>(i)</enum><text display-inline="yes-display-inline">to address any identified issues that can be fully resolved; or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="id27bd74ddcbc4442595c404c47d5e0b8c"><enum>(ii)</enum><text>to attempt to mitigate the identified issues if the issues cannot be fully resolved.</text></clause></subparagraph> <subparagraph id="id1c2b7359eace4b90a6ef555704c9bf3d"><enum>(B)</enum><header>Extension</header> <clause id="id1249271801514ea39750bc5eb7d16cc3"><enum>(i)</enum><header>In general</header><text>A project sponsor may request from the Council an extension of not more than 120 days to complete a remediation proposal described in subparagraph (A).</text></clause>
<clause commented="no" display-inline="no-display-inline" id="id18b7927dbd6f47fc8b6b7927428da134"><enum>(ii)</enum><header>Approval required</header><text>If the Council receives a request from a project sponsor for an extension under clause (i), the Council shall approve that request.</text></clause> <clause id="idadeb2f99bb4a43b2aa21a3f8631af455"><enum>(iii)</enum><header>Treatment of the agency of jurisdiction</header><text>If an extension is requested and approved under clauses (i) and (ii), respectively, an agency of jurisdiction may, notwithstanding subparagraph (A), submit the remediation proposal required under that subparagraph (A) within the extension period described in clause (i).</text></clause></subparagraph>
<subparagraph id="ide83dbc52a3044d01aa3ef73dd7890af5"><enum>(C)</enum><header>Agency compliance</header><text>If an agency of jurisdiction fails to submit a remediation proposal in the time period described in subparagraph (A) or (B)(i), as applicable, the Council shall—</text> <clause id="idd49863d0ebff4c1f9d27674ada4b8647"><enum>(i)</enum><text>approve the remediation proposal submitted by the project sponsor; and</text></clause>
<clause id="id5c7ff4ee1b274e468782c589692a1d31"><enum>(ii)</enum><text>direct the agency of jurisdiction to reauthorize all applicable authorizations for the project.</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id2e544eeabe264f8a83e14b43bcb9d4a5"><enum>(D)</enum><header>Council review</header> <clause id="id1943cf7f8c774496b30ea6ddb2e82c45"><enum>(i)</enum><header>In general</header><text>Not later than 60 days after the date on which a project sponsor and an agency of jurisdiction submit a remediation proposal in accordance with subparagraph (A) or (B)(i), as applicable, the Council shall—</text>
<subclause id="ide3fd6306de854e40bd40b557d9d2568f"><enum>(I)</enum><text>hold any necessary joint meetings between the project sponsor and the agency of jurisdiction to assist in reaching a final remediation plan described in clause (ii);</text></subclause> <subclause id="ide220aa18d6df4244a07a9a657ad46390"><enum>(II)</enum><text>complete a final remediation plan; and</text></subclause>
<subclause id="idb702bc327a0e494bb79116f89b400209"><enum>(III)</enum><text>direct the agency of jurisdiction to reauthorize the project based on that final remediation plan.</text></subclause></clause> <clause id="id670741eb68444bcea680333e93614764"><enum>(ii)</enum><header>Final remediation plan</header> <subclause id="idd31dc26aeb3d490fb69c8ceaff55bf31"><enum>(I)</enum><header>In general</header><text>A final remediation plan described in clause (i) shall contain any alterations to a project necessary to address the reasons for which a court of law enjoined, remanded, vacated, or otherwise limited an authorization for the applicable project.</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="idee66010fd8de4a3aa12c8807361b2bcb"><enum>(II)</enum><header>Form</header><text display-inline="yes-display-inline">A final remediation plan described in clause (i) shall—</text> <item id="idf80349c3d6a6456fbc4649be2b2cbb70"><enum>(aa)</enum><text>accept the remediation proposal of the project sponsor; or</text></item>
<item id="iddeaf16dc7a2044e8967290db8a81177e"><enum>(bb)</enum><text>alter the remediation proposal of the project sponsor based on the remediation proposal of the agency of jurisdiction.</text></item></subclause> <subclause id="id19ebf11486864096b8f1e7e527b2f99a"><enum>(III)</enum><header>Alterations</header><text>To the maximum extent practicable, alterations described in subclause (II)(bb) shall represent an intermediate position between the remediation proposal of the project sponsor and the remediation proposal of the agency of jurisdiction.</text></subclause>
<subclause id="idf4b907709a8343c3a59c0c8096b9fe08"><enum>(IV)</enum><header>Length of final remediation plan</header><text>The text of a final remediation plan shall not exceed 50 pages.</text></subclause></clause> <clause id="iddc8605a87ee34259a64fd122bd5bec83"><enum>(iii)</enum><header>Right of acceptance</header> <subclause id="id4835fd5d165745158a997f1fc1030974"><enum>(I)</enum><header>In general</header><text>At any point in the 60-day period described in clause (i), a project sponsor or an agency of jurisdiction may submit to the Council in writing an acceptance of the remediation proposal of the other party.</text></subclause>
<subclause id="id17742029b4c74509a6a451cea3a0b7a3"><enum>(II)</enum><header>Reauthorization</header><text>If the Council receives an acceptance under subclause (I), the Council shall—</text> <item id="idf7d80523954d4b438640ef9310093a8c"><enum>(aa)</enum><text>consider the accepted remediation proposal to be the final remediation plan; and</text></item>
<item id="idce62670889cb4fffb07deac88eaf6051"><enum>(bb)</enum><text>direct the agency of jurisdiction to reauthorize all authorizations for the project.</text></item></subclause></clause> <clause id="idb2165ec69ee145f5ba0107d4e2bd52a5"><enum>(iv)</enum><header>Meetings</header><text>The Council shall hold not less than 1 meeting between a project sponsor and an agency of jurisdiction to address any necessary areas of dispute between the applicable remediation plans.</text></clause>
<clause id="id103d8f2f08cf4401b40cd91a9fda90a6"><enum>(v)</enum><header>Completion</header><text>On completion of a final remediation plan under clause (ii), the Council shall—</text> <subclause id="idc0667a42164b4c6aa266a224e8a6e212"><enum>(I)</enum><text>make public the final remediation plan in a manner consistent with the authorization approval process of the agency of jurisdiction; and</text></subclause>
<subclause id="id3209a78a72d24d01bc64adc3cd710636"><enum>(II)</enum><text>direct the agency of jurisdiction to reauthorize all authorizations for the project.</text></subclause></clause> <clause id="id83d3ad5a197240e09a12092b749f1cfd"><enum>(vi)</enum><header>Compliance</header><text>If the Council fails to direct the agency of jurisdiction to reauthorize all authorizations for the project within the 60-day period described in clause (i), the agency of jurisdiction shall—</text>
<subclause id="id8c653f1e371b457894abc7368d5371ef"><enum>(I)</enum><text>consider the remediation proposal of the project sponsor to be the final remediation plan; and</text></subclause> <subclause id="idc8b817a340614f5dac40ca3423539b55"><enum>(II)</enum><text>reauthorize all authorizations for the project in accordance with the final remediation plan.</text></subclause></clause></subparagraph>
<subparagraph id="idecd24b178abb4898940154292cd2fe89"><enum>(E)</enum><header>Additional meetings</header><text>At the request of a project sponsor, following the date on which an authorization for a project is enjoined, remanded, or vacated by a court of law, but before the date on which a project sponsor and an agency of jurisdiction submit a remediation proposal under subparagraph (A) or (B)(i), as applicable, the Council may hold meetings between the agency of jurisdiction and the project sponsor in an attempt to align the parties on remediation proposals.</text></subparagraph> <subparagraph id="idca49c47bde60439e8cf60963956f2ffd"><enum>(F)</enum><header>Treatment of additional analyses</header> <clause id="id53944dbc539f4d998bae5faf47386491"><enum>(i)</enum><header>In general</header><text>To the maximum extent practicable, and except as provided in clause (ii), all remediation proposals and final remediation plans described in subparagraph (D)(ii) shall only use existing information, data, and analyses used in the initial authorization (as defined in subsection (a)(1)) or presented as a part of the initial claim (as defined in that subsection) and subsequent judicial process.</text></clause>
<clause id="idb0c9fa1208744bf4aa8394975ad22d39"><enum>(ii)</enum><header>Additional analyses</header><text>If additional analysis is required to fulfill a court order, all final remediation plans described in subparagraph (D)(ii) shall—</text> <subclause id="id984d811287ed4fcf89ffc9535d602328"><enum>(I)</enum><text>designate a singular agency of jurisdiction to perform the analysis;</text></subclause>
<subclause id="idde1bf9760a184fd9802f57d979bee0da"><enum>(II)</enum><text>allow for not more than 90 days to perform the analysis;</text></subclause> <subclause id="id5592d2df3f41414181372ac6b790a423"><enum>(III)</enum><text>designate the court order as fulfilled and the project authorization re-approved if the designated agency does not complete the analysis in the 90-day period described in subclause (II); and</text></subclause>
<subclause id="ide02b4aa072634181afba90a1abf6c306"><enum>(IV)</enum><text>establish clear actions to be taken in relation to the final remediation plan and the authorization dependent on the potential outcomes of the additional analysis. </text></subclause></clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id11f67fd0f9b94e2085af798d70062464"><enum>(3)</enum><header>Right of additional review</header><text display-inline="yes-display-inline">A final remediation plan described in paragraph (2)(D)(ii) shall not be subject to judicial review or further right of action by an individual or entity other than the project sponsor.</text></paragraph>
<paragraph id="id72ea9bc381d64e60a090d714b2134931"><enum>(4)</enum><header>Reauthorization</header>
<subparagraph id="id6e1210a203624ad686d636b6157f02f3"><enum>(A)</enum><header>In general</header><text>An agency of jurisdiction shall reauthorize all authorizations for a project not later than 15 days after the date on which a final remediation plan described in paragraph (2)(D)(ii) is completed.</text></subparagraph> <subparagraph id="id0d68fdd6d2ed48fcab5b1f79863734d9"><enum>(B)</enum><header>Failure to reauthorize a project</header><text>If an agency of jurisdiction fails to reauthorize a project and submit to the project sponsor any necessary authorization paperwork within the 15-day period described in subparagraph (A), the project sponsor may begin any necessary actions reliant on the authorization to complete the project.</text></subparagraph></paragraph></subsection>
<subsection id="ida00c2eae1cb1491e8bf5a1fda4ca1b17"><enum>(e)</enum><header>Venue</header><text>A claim seeking judicial review of an authorization issued by an agency of jurisdiction for a project shall be filed—</text> <paragraph id="idd76cb3081740487a956360818260428d"><enum>(1)</enum><text>in the court the jurisdiction of which contains the location of the project that the authorization applies to; or</text></paragraph>
<paragraph id="id7be9cabca7664bdbaeb107ca66b17045"><enum>(2)</enum><text>if the location of the project transverses the jurisdiction of multiple courts, in the court the jurisdiction of which contains the location in which the largest financial investment will be made with respect to the project.</text></paragraph></subsection> <subsection id="id23cdbe81026b4ce99417fce28cb61030"><enum>(f)</enum><header>Random assignment of cases</header><text>To the maximum extent practicable, district courts of the United States and courts of appeals of the United States shall randomly assign cases seeking judicial review of any authorization issued by an agency of jurisdiction for a project to judges appointed, designated, or assigned to sit as judges of the court in a manner to avoid the appearance of favoritism or bias.</text></subsection>
<subsection id="idee44fc2a1cea420b8085cfaa2ee4f2e6"><enum>(g)</enum><header>Publication of judicial review time periods</header>
<paragraph id="id0dbc2a6df5ef40d9bf8e1edb1e55ded9"><enum>(1)</enum><header>In general</header><text>The Council shall maintain a public database (referred to in this subsection as the <term>database</term>) of any claim relating to the issuance of an authorization by an agency of jurisdiction that—</text> <subparagraph id="id017D15021B1F42D2A3CE5D19F7AFC6D1"><enum>(A)</enum><text>is subject to judicial review; and</text></subparagraph>
<subparagraph id="idA96F62B1588848B288FB8B77B5B05E47"><enum>(B)</enum><text>has not been adjudicated within 90 days after the date on which the claim was assigned to a judge.</text></subparagraph></paragraph> <paragraph id="id76822b0a4086404eaed59abe790708b9"><enum>(2)</enum><header>Reporting requirements</header> <subparagraph id="id01cb20656e634b54ad4271c36e352f24" commented="no"><enum>(A)</enum><header>In general</header><text>In the case of a claim described in paragraph (1) that has not been adjudicated within 90 days after the date on which the claim is assigned to a judge, the Director of the Administrative Office of the United States Courts shall submit to the Council a report, which shall include— </text>
<clause id="ida48bdb1e15b346cc979a964b025fc413" commented="no"><enum>(i)</enum><text>the name of the claim;</text></clause> <clause commented="no" id="id7259C1C0E1154D0E84A99C2001E14992"><enum>(ii)</enum><text>the authorizing legislation pursuant to which the initial authorization (as defined in subsection (a)(1)) was issued;</text></clause>
<clause id="idbb531682f6694c5498562a11af98f098" commented="no"><enum>(iii)</enum><text>the name of the plaintiff;</text></clause> <clause id="ide44fc639b7404b009bcf1041dfb8e5c1" commented="no"><enum>(iv)</enum><text>the name of the defendant;</text></clause>
<clause id="idf6470bbeb98446199d072df71e842e33" commented="no"><enum>(v)</enum><text>the date on which the claim was filed;</text></clause> <clause id="idee46bf90f9ad447798f1daf68f96007a" commented="no"><enum>(vi)</enum><text>the name of the court; and</text></clause>
<clause id="id153170eca1634014b1f71901da08b924" commented="no"><enum>(vii)</enum><text>the name of the judge to which the claim was assigned.</text></clause></subparagraph> <subparagraph id="id6facf55c82334f8592adcc8d4411540c"><enum>(B)</enum><header>Alternate reporting methods</header> <clause id="idBDE06B35FC4E4F60A4872F278396CAA7"><enum>(i)</enum><header>In general</header><text>A plaintiff or defendant involved in a claim may self-report the information described in clauses (i) through (vii) of subparagraph (A).</text></clause>
<clause id="idDBE505211F08438DBA8E48E2189302AB"><enum>(ii)</enum><header>Publication</header><text>The Council shall ensure that the availability to self-report as described in clause (i) is publicized—</text> <subclause id="id46C192FBF49044FA886679DCC63BBBA5"><enum>(I)</enum><text>on the home page of the website of the Council; and</text></subclause>
<subclause id="idC58992BBFE644A49B931986691D06210"><enum>(II)</enum><text>in any other manner determined to be appropriate by the Council.</text></subclause></clause> <clause id="idDA88C1A31B984D1E9EC3146050041781"><enum>(iii)</enum><header>Notification to applicable court</header><text>For each matter self-reported to the Council under clause (i), the Council shall notify the applicable court to confirm that the information described in clauses (i) through (vii) of subparagraph (A) received by the Council is accurate.</text></clause></subparagraph></paragraph>
<paragraph id="id0d7c74a2f6314c3295c4b162b6b8d710"><enum>(3)</enum><header>Maintenance of judicial review timelines</header><text>With respect to each claim in the database, the Council shall update the database not less frequently than daily to reflect the number of days the claim has been under judicial review.</text></paragraph> <paragraph id="id630217b2440e46dcb95687bf72d45d6b"><enum>(4)</enum><header>Publication</header><text>Not later than 5 business days after the date on which the Council receives a report from the Director of the Administrative Office of the United States Courts under subparagraph (A) of paragraph (2) or from a plaintiff or defendant under subparagraph (B) of that paragraph, as applicable, the Council shall update the database to include the information contained in the report.</text></paragraph>
<paragraph id="id1390d349a98b46c884ebd775f14887dd"><enum>(5)</enum><header>Council reporting</header>
<subparagraph id="ide2a66d0fb32149a3a428e327ae9b3760"><enum>(A)</enum><header>In general</header><text>Not less frequently than once per calendar year, the Council shall publish and submit to the committees described in subparagraph (D) a report containing—</text> <clause id="id6fb902d769da44f4948d040d6ec74184"><enum>(i)</enum><text>a list of all cases with claims that were reported to the Council under paragraph (2);</text></clause>
<clause id="id9c958c7a92534ed9a6697939dc251484"><enum>(ii)</enum><text>a list of all courts with multiple cases with claims reported under paragraph (2), which shall be—</text> <subclause id="id6AC18226731F4D87B42BAFBD3D5EE3C8"><enum>(I)</enum><text>listed by name with the total number of applicable cases on file with each court—</text>
<item id="id8855A85644F64F6B90CC5A1509D52E6B"><enum>(aa)</enum><text>in the year preceding the date on which the applicable report is submitted; and</text></item> <item id="id3C4B196C1CB943F9BE392AF7EA3F19FC"><enum>(bb)</enum><text>in total since the date of enactment of this Act; and </text></item></subclause>
<subclause id="idF61A1A7600ED4E7F8B65A6FF967FE6AF"><enum>(II)</enum><text>ordered according to the largest number, from largest to smallest, of late cases per court in the year preceding the date on which the applicable report is submitted;</text></subclause></clause> <clause id="idb9a8981cb2104a3d9473aa8696c84337"><enum>(iii)</enum><text>a list of all judges with multiple cases with claims reported under paragraph (2), which shall be—</text>
<subclause id="id00DAE43E269C48D7B0370E362D12FE86"><enum>(I)</enum><text>listed by name with the total number of late cases assigned to each judge—</text> <item id="idCB5C5FD1E092444E8DF737937E0486CE"><enum>(aa)</enum><text>in the year preceding the date on which the applicable report is submitted; and</text></item>
<item id="id6BF80405F3FD4247A0BC32B17A72A48D"><enum>(bb)</enum><text>in total since the date of enactment of this Act; and</text></item></subclause> <subclause id="idA3CBB1C01B5A42C0A39F145D0AF0E9B7"><enum>(II)</enum><text>ordered according to the largest number, from largest to smallest, of late cases per judge since the date of enactment of this Act;</text></subclause></clause>
<clause id="id654dbf79d687484689215d86f236e3ea"><enum>(iv)</enum><text>the name of any judge that has failed to report a claim in accordance with paragraph (2)(A); and</text></clause> <clause id="idbf1eabb10c1b4f6398f1b84c86c7ac61"><enum>(v)</enum><text>any other information that the Council determines to be necessary to ensure timely review of claims relating to the issuance of an authorization.</text></clause></subparagraph>
<subparagraph id="ida30e5236e32d475c821230e561d4651e"><enum>(B)</enum><header>More frequent reporting</header><text>The Council may publish the report required under subparagraph (A) more frequently than once per calendar year, subject to the condition that the Council shall not publish the report more frequently than once per quarter.</text></subparagraph> <subparagraph id="id28080baa0a434084958b273b63c07227"><enum>(C)</enum><header>Publication</header><text>Any report prepared by the Council under subparagraph (A) shall be—</text>
<clause id="id5e7e46233a4c4d40a0f9bba8e42d38e9"><enum>(i)</enum><text>published in the Federal Register; and</text></clause> <clause id="idb5b8f0c4ddb5406a8d95d0ce149a67b5"><enum>(ii)</enum><text>made available on the website of the Council.</text></clause></subparagraph>
<subparagraph id="idbffb09b457584a6bb4f043c07b92cf47"><enum>(D)</enum><header>Committees described</header><text>The committees referred to in subparagraph (A) are—</text> <clause id="id876b8bbcb1224bf58b5f9539fec55b80"><enum>(i)</enum><text>the Committee on Environment and Public Works of the Senate;</text></clause>
<clause id="id58373b5c3cd6492eadb75494f6a26d73"><enum>(ii)</enum><text>the Committee on the Judiciary of the Senate;</text></clause> <clause id="idc73759e7c25148a3a1864000d7b6acd7"><enum>(iii)</enum><text>the Committee on Energy and Natural Resources of the Senate;</text></clause>
<clause id="id5457b53d504a44aaa2af514e9f8b4a84"><enum>(iv)</enum><text>the Committee on Natural Resources of the House of Representatives;</text></clause> <clause id="id1c1b8314542c496a95eb81e729632fff"><enum>(v)</enum><text>the Committee on the Judiciary of the House of Representatives; and</text></clause>
<clause id="id9d45a9c3dc234ed68b5519a226f4f184"><enum>(vi)</enum><text>the Committee on Energy and Commerce of the House of Representatives.</text></clause></subparagraph></paragraph></subsection> <subsection id="id44c997d027fd499e940a36b00e4b109d"><enum>(h)</enum><header>Treatment of existing authorization requests</header><text>For a project sponsor that has submitted a project to an agency of jurisdiction for approval of an authorization on or before the date of enactment of this Act, the judicial review requirements described in this section shall apply to any authorization granted for the project.</text></subsection>
<subsection id="id117f7361f5cc4243aff2bface9ffe296"><enum>(i)</enum><header>Treatment of existing judicial reviews</header><text>For any authorization subject to judicial review as of the date of enactment of this Act, the judicial review processes described in this section shall apply to such judicial review.</text></subsection> <subsection id="idd0ac908953b84d62acbd3ecaa1f8d912"><enum>(j)</enum><header>Savings provision</header><text>Nothing in this section—</text>
<paragraph id="id4BE7AF99FC964D4BBBDFF8842A5E697F"><enum>(1)</enum><text>establishes a right of action under any authorizing legislation relating to an environmental review that does not already provide for a right of action relating to that environmental review; or</text></paragraph> <paragraph id="id4EA1023A06AE4A3D99AEEC1D8A50F812"><enum>(2)</enum><text>prohibits any lawful action taken by a project sponsor that has been denied the ability—</text>
<subparagraph id="id644717d4fca04e419a5b71c3331f525b"><enum>(A)</enum><text>to appeal an initial rejection of a project by the agency of jurisdiction;</text></subparagraph> <subparagraph id="id8d8b070a9c3344f5a65a86021a5bdd1f"><enum>(B)</enum><text>to appeal a rejection by the agency of jurisdiction relating to 1 or more attempts to address the issues identified as a result of a previous injunction, remand, or vacatur of an authorization decision; or</text></subparagraph>
<subparagraph id="idf86dbccfaab948e6bde6a5b58fbc0b0e"><enum>(C)</enum><text>to resubmit a project in a manner that addresses the reasons for the rejection of that project by the agency of jurisdiction.</text></subparagraph></paragraph></subsection></section> <section commented="no" display-inline="no-display-inline" id="id7f3de67cf7f440c69ad47844a061fe45"><enum>4.</enum><header>Judicial standing under NEPA</header> <subsection commented="no" display-inline="no-display-inline" id="idef4640b977984a718a50fa56fe18692e"><enum/><text>Title I of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4331">42 U.S.C. 4331 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="idEE9A27F796E84AA6A0DABFE35595116A"><enum>112.</enum><header>Judicial standing</header><text display-inline="no-display-inline">Nothing in this title, or any environmental review (as defined in section 2 of the <short-title>REPAIR Act of 2025</short-title>) carried out pursuant to this title, provides a judicial right of action under this title or subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>), relating to the approval of an authorization (as defined in that section) for a project (as defined in that section)<italic></italic> that uses an applicable environmental review (as so defined).</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> </legis-body> </bill>
