<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 1348</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250408">April 8, 2025</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Family and Medical Leave Act of 1993 to prohibit an employer from recovering any health care premium paid by the employer for an employee if the employee fails to return to work due to the birth of a child, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fairness for Stay-at-Home Parents Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idb3df8e16b7b54a82af2ec76768f3d143"><enum>2.</enum><header>Amendments to the Family and Medical Leave Act of 1993</header><subsection commented="no" display-inline="no-display-inline" id="idd6eed56634d047e1839c14291606846f"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 104(c)(2)(B) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2614">29 U.S.C. 2614(c)(2)(B)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id1b4058e2fac74ab495e792388f87bb78"><enum>(1)</enum><text>in clause (i), by striking the <quote>or</quote> at the end;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id241bb6172b23440999e2d398e0c1afcb"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating clause (ii) as clause (iii); and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id41925ad56eb445f2b10656959c62a515"><enum>(3)</enum><text>by inserting after clause (i) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id54003D9201E34B8BB22BCDD934BA3CD5"><clause commented="no" display-inline="no-display-inline" id="id05a413b2e8bc4961b0fa0350a4ba1eb0"><enum>(ii)</enum><text>the birth of a son or daughter of the employee; or</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idcb4a55d0d64641d0a702a60dd70ea36a"><enum>(b)</enum><header>Notice</header><text>Section 104(c) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2614">29 U.S.C. 2614(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idABEAC2B8A0FF4D039E49723E897DEF58"><paragraph commented="no" display-inline="no-display-inline" id="id479b67af39ac42c5b95a22d84236be20"><enum>(4)</enum><header>Notice regarding option to not return from leave</header><text>An employer shall notify any eligible employee that takes leave for the birth of a son or daughter of the employee that the employer may not recover any premium described in paragraph (2) that the employer paid for maintaining coverage for the employee if the employee fails to return due to such birth.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
