<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 1340</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250408">April 8, 2025</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> (for himself, <cosponsor name-id="S153">Mr. Grassley</cosponsor>, and <cosponsor name-id="S439">Mrs. Moody</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish penalties for violating section 104(f) of the Foreign Assistance Act of 1961.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HDDA1FA7FBE744D75B5F3FE5B89B1BBAE"><section section-type="section-one" id="H544A08C4738A4DF6A37091662AA30558"><enum>1. </enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Aid Accountability Act of 2025</short-title></quote>. </text></section><section id="HF546A1E78B784509B0CCB88D6780472B"><enum>2.</enum><header>Penalties for violating section 104(f) of the Foreign Assistance Act of 1961</header><text display-inline="no-display-inline">Section 104(f) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151b">22 U.S.C. 2151b(f)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H56F9F2AD65824F90B7883E4FD5104491"><paragraph id="H9B79935566A044E3BDF594D3DC6C2475" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HA2C35B56FB67454C998340D63E8D630A"><enum>(A)</enum><text display-inline="yes-display-inline">A Federal employee who knowingly violates any requirement under this subsection—</text><clause id="HFB96AF9DA55649F7A4DCAB854C05E682" indent="up1"><enum>(i)</enum><text>shall be terminated from Federal employment;</text></clause><clause indent="up1" commented="no" display-inline="no-display-inline" id="id8a01e0217cf3422c9ef56fba37c870a7"><enum>(ii)</enum><text display-inline="yes-display-inline">may not be employed by the Federal Government after such violation; and</text></clause><clause id="H0B7616938B8A4B6C8B50F8202D39984A" indent="up1"><enum>(iii)</enum><text>shall be fiscally liable for, and shall pay to the Federal Government, an amount equal to the amount of funds illegally allocated to the activity that was in violation of such requirement in order to provide restitution for such violation.</text></clause></subparagraph><subparagraph id="H934D36F74F01484D8601297CA9C17244" indent="up1"><enum>(B)</enum><text>A grantee, subgrantee, contractor or other recipient of Federal funds who violates any of the requirements under this subsection may not receive any Federal funds after such violation.</text></subparagraph><subparagraph id="HFE8CCCA7819047599C4350D04508930A" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary of State—</text><clause id="H7593CCC29DC646E89F75A743A6599A76"><enum>(i)</enum><text>shall make a final determination with respect to any violation of a requirement under this subsection and the penalties to be imposed pursuant to subparagraph (A) or (B), and such final determination shall not be subject to review or reversal except by a Federal court of competent jurisdiction; and</text></clause><clause id="H1E30FD39298A4381B719E25B2678E750"><enum>(ii)</enum><text>not later than 60 days after making a determination pursuant to clause (i), shall submit a report to Congress that includes—</text><subclause id="H63E2DC777E9E4054A79FB9D4F4A38C26"><enum>(I)</enum><text>a description of the nature of the violation;</text></subclause><subclause id="HDD7E49D3214B481DA85B7780AB35CB3E"><enum>(II)</enum><text>who carried out or was involved in the violation; and</text></subclause><subclause id="H2BC85240FD114640B1084E7F148E8E77"><enum>(III)</enum><text>what will be done to ensure such violation is not repeated.</text></subclause></clause></subparagraph><subparagraph id="H959864F6AAAE46248A5CC1E8FE47D05B" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">Each final determination by the Secretary of State pursuant to subparagraph (C)(i) shall be subject to the procedures set forth in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/8">chapter 8</external-xref> of title 5, United States Code (commonly referred to as the <quote>Congressional Review Act</quote>).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
