<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 133</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250116">January 16, 2025</action-date><action-desc><sponsor name-id="S413">Mr. Padilla</sponsor> (for himself, <cosponsor name-id="S383">Mr. Sullivan</cosponsor>, and <cosponsor name-id="S435">Mr. Sheehy</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To modify the fire management assistance cost share, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="HF0BCFDD24DBA4BE88FB89F0924845922"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fire Suppression and Response Funding Assurance Act</short-title></quote>. </text></section><section id="HAE9B0E83B0FE43368E549F73D3940950"><enum>2.</enum><header>Fire management assistance cost share</header><subsection id="id05730C05CCA342AEBA9C39BAE0C3D7F6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 420 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5187">42 U.S.C. 5187</external-xref>) is amended—</text><paragraph id="H186AA2C67BB249B7B03939A5718EB78B"><enum>(1)</enum><text>by redesignating subsection (e) as subsection (f); and</text></paragraph><paragraph id="HAE9BB25BA9E74CA6B3FB924161601A49"><enum>(2)</enum><text>by inserting after subsection (d) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id67A70736AA5E42029B6233EB0A5EE722"><subsection id="H6339432AF9B74060A84D358EF0F56231"><enum>(e)</enum><header>Federal share</header><text display-inline="yes-display-inline">The Federal share of assistance under this section shall be not less than 75 percent of the eligible cost of such assistance.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idbe2ea39126b8482ea75300ee69bfc286"><enum>(b)</enum><header>Applicability</header><text>The amendments made by subsection (a) shall only apply to amounts appropriated on or after the date of enactment of this Act.</text></subsection></section><section id="H0449B294B078411CA9A28501BF8A255F"><enum>3.</enum><header>Rulemaking</header><text display-inline="no-display-inline">Not later than 3 years after the date of enactment of this Act, the President, acting through the Administrator of the Federal Emergency Management Agency, shall conduct and complete a rulemaking to provide criteria for the circumstances under which the Administrator may recommend the President increase the Federal cost share for section 420 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5187">42 U.S.C. 5187</external-xref>). </text></section><section id="idef0705a5852e476fa9064059f2036131" changed="not-changed"><enum>4.</enum><header>Policy update</header><text display-inline="no-display-inline">The Administrator of the Federal Emergency Management Agency shall update the policy for grants made under section 420 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5187">42 U.S.C. 5187</external-xref>), consistent with assistance provided under a major disaster and emergency declaration under that Act, to provide that predeployment of domestic assets by States, local, and Tribal governments may be eligible for reimbursement under such section 420. </text></section></legis-body></bill>
