<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 1311</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250405" legis-day="20250404">April 5 (legislative day, April 4), 2025</action-date><action-desc><sponsor name-id="S429">Mr. Banks</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Veterans Affairs to seek to enter into an agreement with a federally funded research and development center for an assessment of notice letters that the Secretary sends to claimants for benefits under laws administered by the Secretary, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H7E79F8689B81422B828C1BD6CF0FA5A9"><section section-type="section-one" id="HF8C5643D30FC453E8D0B1E10E8FB5901"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clear Communication for Veterans Claims Act of 2025</short-title></quote>.</text></section><section section-type="subsequent-section" id="H5F23945F8D8C493CAE7D54F3D1476DB5"><enum>2.</enum><header>Independent assessment of notices that the Secretary of Veterans Affairs sends to claimants</header><subsection id="HA82FAC6F0E4043DEA6CBEDEFC9DCD144"><enum>(a)</enum><header>Agreement</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall seek to enter into an agreement with a federally funded research and development center (FFRDC) for an assessment of notices that the Secretary sends to claimants.</text></subsection><subsection id="H539B74F75CA142EC8086B6D2C8360BC0"><enum>(b)</enum><header>Assessment</header><text display-inline="yes-display-inline">A federally funded research and development center that enters to an agreement under subsection (a) shall submit to the Secretary a written assessment of such notices. The assessment shall include the following:</text><paragraph id="HE2CC9D9F1C7B460E9DEA072F1CBB021B"><enum>(1)</enum><text>The determination of the federally funded research and development center, made in consultation with covered entities, whether each such notice may be feasibly altered to reduce paper consumption by, and costs to, the Federal Government.</text></paragraph><paragraph id="H310C773094E4426E8C810E9E72A88544"><enum>(2)</enum><text display-inline="yes-display-inline">The recommendations of the federally funded research and development center regarding how the Secretary may make such notices clearer to claimants, better organized, and more concise.</text></paragraph></subsection><subsection id="H583671CE9FD945AB8FFEA93CBEB8E2F6"><enum>(c)</enum><header>Report; implementation</header><text>Not later than 90 days after the Secretary receives the assessment under subsection (b), the Secretary shall—</text><paragraph id="H7C72555652EA4E02BECEC2C733A157ED"><enum>(1)</enum><text>submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a copy of such assessment; and</text></paragraph><paragraph id="H8FC6A926906C461AB10687624B97D065"><enum>(2)</enum><text display-inline="yes-display-inline">commence implementing the recommendations in the assessment that are in compliance with the laws administered by the Secretary.</text></paragraph></subsection><subsection id="H8A91A34C2A9E43389BF6B8136D0A85C1"><enum>(d)</enum><header>Deadline for implementation</header><text>The Secretary shall complete the implementation required by subsection (c)(2) by not later than one year after the date on which the Secretary commences such implementation.</text></subsection><subsection id="H167B2BEE6BDE49B2B8BEB1D1E5C9A3A6"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="HB17348431E7145B3BD3995D3BEEED8CE"><enum>(1)</enum><header>Covered entities</header><text display-inline="yes-display-inline">The term <term>covered entities</term> includes—</text><subparagraph commented="no" id="H9065BB002C104D6FAEB62BE95D121463"><enum>(A)</enum><text>the Secretary of Veterans Affairs;</text></subparagraph><subparagraph commented="no" id="HB029C969F9344BE49819B568CCB67F49"><enum>(B)</enum><text display-inline="yes-display-inline">an expert in laws administered by the Secretary of Veterans Affairs;</text></subparagraph><subparagraph commented="no" id="H33893A8752A04B77812E2C8432171F9A"><enum>(C)</enum><text display-inline="yes-display-inline">a veterans service organization recognized under section 5902 of title 38, United States Code;</text></subparagraph><subparagraph commented="no" id="H86345B45E6FA4F67949713CABB3FE31C"><enum>(D)</enum><text>an entity that advocates for veterans; and</text></subparagraph><subparagraph id="H080074D6C6994107936F44FF649CD359"><enum>(E)</enum><text display-inline="yes-display-inline">an entity that advocates for the survivors of veterans.</text></subparagraph></paragraph><paragraph id="H059F2F385C7445E2850D6110E8D432C8"><enum>(2)</enum><header>Claimant and notice</header><text>The terms <term>claimant</term> and <term>notice</term> have the meanings given such terms in section 5100 of title 38, United States Code.</text></paragraph></subsection></section></legis-body></bill>
