<official-title>To authorize the continuation of lawful nonimmigrant status for certain religious workers affected by the backlog for religious worker immigrant visas.</official-title>

<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Religious Workforce Protection Act</short-title></quote>.</text></section> <section id="id4d2fa6c27a97425782ed0c0b775b8628"><enum>2.</enum><header>Extension of nonimmigrant status for religious workers caught in long backlogs for lawful permanent residence</header> <subsection commented="no" display-inline="no-display-inline" id="id98df63582bab4e0cb34b3a27632d75bd"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 214(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(a)(2)</external-xref>) is amended by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="id0619CC46B86E4157B1EA50DED46992CF">
<subparagraph id="id9db27e96f68d438095a16498623cf109" indent="up2"><enum>(C)</enum><text>Notwithstanding section 101(a)(15)(R)(ii), an alien may apply for, and the Secretary of Homeland Security may grant, an extension of nonimmigrant status under section 101(a)(15)(R) until such alien’s application for adjustment of status or an immigrant visa has been processed and a decision has been made on such application if the alien—</text> <clause commented="no" display-inline="no-display-inline" id="id4cfe98d207ab4bbebc38a8974966f0c6"><enum>(i)</enum><text display-inline="yes-display-inline">is the principal or derivative beneficiary of an immigrant petition filed pursuant to section 204(a) for a preference status under section 203(b)(4); and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="id58fcb55ec0de451b8ead93c6b153b63a"><enum>(ii)</enum><text display-inline="yes-display-inline">is eligible to be granted such immigrant status absent the application of the numerical limitations under sections 201, 202, and 203.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection commented="no" display-inline="no-display-inline" id="idab1eddcc15e1431181ae968a9808f8bc"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 101(a)(15)(R)(ii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(R)(ii)</external-xref>) is amended by inserting <quote>, except as provided in section 214(a)(2)(C),</quote> after <quote>5 years</quote>.</text></subsection></section>
<section id="id006d899256dc441496071dce4feab724"><enum>3.</enum><header>Limited job flexibility for certain religious workers with long-delayed applications for lawful permanent residence</header><text display-inline="no-display-inline">Section 204(j) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(j)</external-xref>) is amended by striking <quote>subsection (a)(1)(D)</quote> and inserting <quote>subsection (a)(1)(F) or subsection (a)(1)(G)(i) (with respect to special immigrants described in section 101(a)(27)(C))</quote>.</text></section> <section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ide9ed036bd56e4d7b8e0db53b4cd5a69c"><enum>4.</enum><header>Exemption to 1-year foreign residence requirement for certain nonimmigrant religious workers</header><text display-inline="no-display-inline">An alien described in section 214(a)(2)(C) of the Immigration and Nationality Act, as added by section 2(a), who departed from the United States due to the 5-year limitation on nonimmigrant status under section 101(a)(15)(R) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(R)</external-xref>) shall be exempt from the 1-year foreign residence requirement set forth in section 214.2(r)(6) of title 8, Code of Federal Regulations.</text></section>
