which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a new nonimmigrant visa for mobile entertainment workers.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring Industry Development in Entertainment Act</short-title></quote> or the <quote><short-title>RIDE Act</short-title></quote>.</text></section><section id="id751359409f6e4be09b787830521d306e"><enum>2.</enum><header>Authorization of new P–4 nonimmigrant visa</header><text display-inline="no-display-inline">Section 101(a)(15)(P) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(P)</external-xref>) is amended—</text><paragraph id="idd783618f1fe94bebaa9a3c706c240c5c"><enum>(1)</enum><text>in clause (iii)(II) by striking <quote>or</quote> at the end; and</text></paragraph><paragraph id="id613733d7f43d4993b845cc57a5155d87"><enum>(2)</enum><text>by striking clause (iv) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide9f21e22ada84b5f86a18be43a3ae231"><clause id="id46e45d5ab8b043b39da1550e51164457"><enum>(iv)</enum><text>is a mobile entertainment worker described in section 214(c)(4)(I) and for which mobile entertainment position the Department of Labor has certified that if—</text><subclause id="idD44C557554DD440C86DB220D1E183804"><enum>(I)</enum><text>there are not sufficient workers who are able, willing, and qualified, and who will be available at the time and place needed, to perform the labor or services required; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idABBDE4AAF0FF4325AB80EC78733AD8FD"><enum>(II)</enum><text display-inline="yes-display-inline">the employment of the alien in such labor or services will not adversely affect the wages and working conditions of workers in the United States similarly employed; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id9ec7ac64da044b31a546648dd5c411d1"><enum>(v)</enum><text display-inline="yes-display-inline">is the spouse or child of an alien described in clause (i), (ii), (iii), or (iv) and is accompanying, or following to join, such alien.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="ida4a9eaf7e55f4de7aa47308f51a454a8"><enum>3.</enum><header>Mobile entertainment workers</header><text display-inline="no-display-inline">Section 214(c)(4) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)(4)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7a00996174d44b539ac71a12070f901e"><subparagraph id="id38a2e66418784f1c997f277e50ad0112" indent="up2"><enum>(I)</enum><clause commented="no" display-inline="yes-display-inline" id="id12db78d0f52e4f9e8c19b2292fc7992f"><enum>(i)</enum><text>For purposes of section 101(a)(15)(P)(iv), an alien is a mobile entertainment worker described in this subparagraph if the alien seeks to enter the United States temporarily and solely for the purpose of performing functions that are integral and essential to the operation of a mobile entertainment provider, including—</text><subclause commented="no" display-inline="no-display-inline" indent="up1" id="id2519dc937b6c4e75a5ed5acd6ba105fb"><enum>(I)</enum><text display-inline="yes-display-inline">transporting, assembly, operation, disassembly, and maintenance of mobile entertainment attractions, structures, and equipment, including rides, games, novelties, and food or beverage concessions; and</text></subclause><subclause commented="no" display-inline="no-display-inline" indent="up1" id="id95fc9f74e0964be1a119877db5f8d894"><enum>(II)</enum><text display-inline="yes-display-inline">other functions that are common in the mobile entertainment industry and are necessary for the safe and efficient operation of the mobile entertainment provider.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="ide76b403f94e84980896a7e05dada5449"><enum>(ii)</enum><text display-inline="yes-display-inline">In this subparagraph, the term <term>mobile entertainment provider</term> means—</text><subclause commented="no" display-inline="no-display-inline" id="id74974fd21c334dbea5413729b3c239c5"><enum>(I)</enum><text display-inline="yes-display-inline">a carnival or circus that travels around the United States on a temporary or seasonal basis; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1b922a087c3d4ddc9c04f4b5df3783d3"><enum>(II)</enum><text display-inline="yes-display-inline">a provider of services normally affiliated with a carnival or circus, such as food and game concessions, that travels around the United States on a seasonal or temporary basis to provide services to—</text><item commented="no" display-inline="no-display-inline" id="id4d651275eb8b43d68d4d05c85546229e"><enum>(aa)</enum><text display-inline="yes-display-inline">State, county, and local fairs and festivals; or </text></item><item commented="no" display-inline="no-display-inline" id="id1881de4879934bbbacb06ddaa11e334d"><enum>(bb)</enum><text display-inline="yes-display-inline">support events sponsored by not-for-profit organizations for fundraising.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idb3dcd352e2b84a8f8d60b2097837b260"><enum>4.</enum><header>Rulemaking</header><text display-inline="no-display-inline">The Secretary of Homeland Security and the Secretary of Labor shall each publish in the Federal Register—</text><paragraph commented="no" display-inline="no-display-inline" id="idb8036bdb42ea474d8ffb29789f713098"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 180 days after the date of the enactment of this Act, proposed rules implementing the amendments made by sections 2 and 3; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1bcf9ffc9a354385b7ff334f3d4c0504"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 1 year after such date of enactment, final rules implementing the amendments made by sections 2 and 3.</text></paragraph></section></legis-body></bill>
