which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the export of liquefied natural gas and petroleum products to certain countries.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="H31898A0952204130A24B8B9F9DF4C9C8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting American Households From Rising Energy Costs Act of 2025</short-title></quote>.</text></section><section id="id9f60927465ed4e3da21f33993a6d3554"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id191b6fcb7d8441d39c493a43154aa66c"><enum>(1)</enum><header>Petroleum product</header><text>The term <term>petroleum product</term> has the meaning given the term in section 3 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6202">42 U.S.C. 6202</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc3ffdaa2162641eda52ffad4e08d33b8"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy. </text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id3e11834ba2264407a9d46e02670a5f18"><enum>3.</enum><header display-inline="yes-display-inline">Prohibition on exports of liquefied natural gas and petroleum products to certain countries</header><subsection commented="no" display-inline="no-display-inline" id="ide316caec26764a2591becc646d7ef5bc"><enum>(a)</enum><header display-inline="yes-display-inline">Prohibitions</header><paragraph commented="no" display-inline="no-display-inline" id="id4231072c61814d09bde613dc474f8fb3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, unless a waiver has been issued under subsection (b), no person or entity may export or resell, either directly or indirectly through 1 or more third parties, liquefied natural gas or petroleum products—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide61f09c79c454c0d8b81271524f82d5e"><enum>(A)</enum><text display-inline="yes-display-inline">to any entity operating in the territory of, or territory owned by, the People’s Republic of China (or the Chinese Communist Party), the Russian Federation, the Democratic People’s Republic of Korea, or the Islamic Republic of Iran; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2f7337f1168449e49e393421c7b6cf80"><enum>(B)</enum><text display-inline="yes-display-inline">to any entity that is under the ownership or control, as determined by the Secretary in consultation with the Secretary of the Treasury and the Secretary of Commerce, of the People’s Republic of China (or the Chinese Communist Party), the Russian Federation, the Democratic People’s Republic of Korea, or the Islamic Republic of Iran.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0a259adc786a41f6936bf77bb74ab67c"><enum>(2)</enum><header>Responsibility</header><text display-inline="yes-display-inline">It is the responsibility of the export authorization holder to ensure compliance with this Act and any other applicable law or policy, including rules, regulations, orders, and other determinations made by—</text><subparagraph commented="no" display-inline="no-display-inline" id="idab3ebca0055a4abd87db2368ddf3ceaf"><enum>(A)</enum><text display-inline="yes-display-inline">the Office of Foreign Assets Control of the Department of the Treasury; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id001863f6dd414dcda224aa8daf2234ec"><enum>(B)</enum><text>the Federal Energy Regulatory Commission.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfcccbc7f0acf490781c4a761b34f2d06"><enum>(b)</enum><header>Waiver</header><paragraph commented="no" display-inline="no-display-inline" id="id0fe5410e68bb457f94d3985159d0845d"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">On application by an exporter, the Secretary may waive, prior to the date of the applicable contract, the prohibitions described in subsection (a) with respect to the sale of liquefied natural gas or petroleum products. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21f667ea8c04415db1e6c7148dead4b6"><enum>(2)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Secretary may issue a waiver under this subsection only if the Secretary determines that an imminent and acute national security emergency to the United States exists and that other means of responding to the emergency would be inadequate. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id02d8ade92c484e078bf4e8385608e1a1"><enum>(3)</enum><header>Applications</header><text display-inline="yes-display-inline">An exporter seeking a waiver under this subsection shall submit to the Secretary an application by such date, in such form, and containing such information as the Secretary may require. </text></paragraph><paragraph id="id77259688864e42b5b47fc0f2c143cd94"><enum>(4)</enum><header>Notice to Congress</header><text>Not later than 15 days after issuing a waiver under this subsection, the Secretary shall provide a copy of the waiver to the Committee on Energy and Natural Resources of the Senate and the Committee on Energy and Commerce of the House of Representatives.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfddfef25e58f402ca52cd131144f0629"><enum>(c)</enum><header>Rulemaking</header><text>The Secretary may promulgate, amend, and rescind rules and regulations, as the Secretary determines to be appropriate, to carry out this Act.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id21fc45bb39e24e269bb05c9488dec677"><enum>4.</enum><header>Enforcement provisions</header><subsection id="idcff27ab5666b4dbf8c104a33bf2cd369"><enum>(a)</enum><header>Unlawful acts</header><text>It shall be unlawful for a person to violate, attempt to violate, conspire to violate, or cause a violation of any prohibition of, or any waiver, license, order, or regulation issued pursuant to this Act.</text></subsection><subsection id="id21039825652d48b6ba62e01558b3e44e"><enum>(b)</enum><header>Civil penalty</header><paragraph commented="no" display-inline="no-display-inline" id="idf53c97ea109a451397dfe77b39939bd3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may impose a civil penalty on any person who commits an unlawful act described in subsection (a) in an amount not to exceed the greater of—</text><subparagraph id="id3fc4485d941b4af8a669c9c022a33794"><enum>(A)</enum><text>$250,000,000; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcb51c2402ecc4114855a6fc021488ad6"><enum>(B)</enum><text>an amount that is twice the amount of the transaction that is the basis of the violation with respect to which the penalty is imposed.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7c142e1cded34e7db5d2d8a6c649a687"><enum>(2)</enum><header>Notice and opportunity for hearing</header><text>A civil penalty under paragraph (1) may be imposed by the Secretary by an order made on the record after providing written notice to the person to be assessed the civil penalty and an opportunity for a hearing in accordance with this section and sections 554 through 557 of title 5, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id02ab476dde3d425fb333e9da142bc7d9"><enum>(3)</enum><header>Civil action</header><text>If a person described in paragraph (1) fails to pay a civil penalty imposed by the Secretary under this subsection after receiving notice and an opportunity for a hearing under paragraph (2), the Secretary may bring a civil action against that person in an appropriate district court of the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf60da5a927924f2b8f525b6d2b9a9a2f"><enum>(4)</enum><header>Relief</header><text>If a civil action brought by the Secretary under paragraph (3) is successful, the applicable court may grant appropriate relief, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb33794cba4664944a725a6358bb77ec3"><enum>(A)</enum><text display-inline="yes-display-inline">a temporary injunction;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9f5f5294f32b412f8e1cc69d44da1a7d"><enum>(B)</enum><text display-inline="yes-display-inline">a permanent injunction; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id25c653d4f26b4371a89465d86f5262af"><enum>(C)</enum><text>enforcing the civil penalties described in paragraph (1).</text></subparagraph></paragraph></subsection><subsection id="id6d9cdb799ed0405297b3efb554b2fed8"><enum>(c)</enum><header>Criminal penalty</header><text>A person who knowingly commits, knowingly attempts to commit, or knowingly conspires to commit, or aids or abets in the commission of, an unlawful act described in subsection (a) shall be fined not more than $100,000,000, imprisoned for not more than 20 years, or both.</text></subsection></section></legis-body></bill>
