which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Agriculture to release a reversionary interest in certain land in the Black River State Forest in Millston, Wisconsin, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HB725AD0AA8CA4DBF9498D94E36715A09"><section section-type="section-one" id="H9255984C10B1421CAFA40573A1185661"><enum>1.</enum><header>Release of reversionary interest, Black River State Forest, Wisconsin</header><subsection commented="no" display-inline="no-display-inline" id="HB9A79301E17E4A99B236C505D5AC0893"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="HE22AEC75916C4DE58E7B745FD1B9723A"><enum>(1)</enum><header>Deli, Inc</header><text>The term <term>Deli, Inc.</term> means Deli, Inc., a sphagnum moss production business located in Millston, Wisconsin.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF1E3B6BE87FE412FA1B85F4D68CDA90F"><enum>(2)</enum><header>Deli land</header><text>The term <term>Deli land</term> means the approximately 37.27 acres of land owned or optioned to acquire, subject to the approval of the land exchange by the Wisconsin Department of Natural Resources, the Wisconsin Natural Resources Board, and the Governor of the State, in 2 separate parcels, by Deli, Inc., located in Millston, Wisconsin, as depicted on the map and more particularly described as follows:</text><subparagraph commented="no" id="H086584F88B744A919B592278F99BB3E7"><enum>(A)</enum><text>The approximately 31.3-acre parcel (including land within the road right-of-way), together with any improvements—</text><clause commented="no" display-inline="no-display-inline" id="HD79EDB370E464E988B63D99B07D54092"><enum>(i)</enum><text display-inline="yes-display-inline">comprising the NE<fraction>1/4</fraction>NE<fraction>1/4</fraction> of sec. 29, T. 20 N., R. 2 W., Town of Millston, Jackson County, Wisconsin;</text></clause><clause commented="no" display-inline="no-display-inline" id="HEC348204F0F44A409EE489C2B27362C8"><enum>(ii)</enum><text display-inline="yes-display-inline">excluding—</text><subclause commented="no" id="H5D8694DC110B43D1924DACC465052C89"><enum>(I)</enum><text>land lying north of the railroad right-of-way; and</text></subclause><subclause commented="no" id="H919350309A7D4AAF8D1CFBE623E78D2A"><enum>(II)</enum><text>a parcel 150 feet wide, with 50 feet lying to the northeast, and 100 feet to the southwest, of a line commencing at a point 5 feet east of the northwest corner of the quarter-quarter section described in clause (i), thence south 56° E. 39′ a distance of 222 feet, thence south 57° E. 31′ a distance of 1359 feet; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HA00E45BF1FDE46D2B4A30DC38F22509B"><enum>(iii)</enum><text display-inline="yes-display-inline">subject to—</text><subclause commented="no" display-inline="no-display-inline" id="H8F69E531A0934A5E9F8E16039265A522"><enum>(I)</enum><text display-inline="yes-display-inline">any public water use or easements on Lee Lake; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HA9BFE8F98B33421F9052874217AD0769"><enum>(II)</enum><text display-inline="yes-display-inline">any easements or restrictions of record, public roadways, zoning and use ordinances, and the railroad right-of-way.</text></subclause></clause></subparagraph><subparagraph commented="no" id="H9DA3E1CCEDE543B581656984D1CA3177"><enum>(B)</enum><text>The approximately 5.97-acre parcel located in the SW<fraction>1/4</fraction>SW<fraction>1/4</fraction> of sec. 20, T. 20 N., R. 4 W., Town of Millston, Jackson County, Wisconsin, comprising lot 7 of Certified Survey Map No. 4483, as recorded in volume 19S of the certified survey maps, page 334, as Document No. 413440 in the Jackson County Register of Deeds.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H478D2DDF493A465681EB948564217888"><enum>(3)</enum><header display-inline="yes-display-inline">Map</header><text>The term <term>map</term> means the map entitled <quote>Black River State Forest – Deli, Inc.</quote> and dated June 26, 2023.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFCA80B84F5174343A63AEBA386DCF90D"><enum>(4)</enum><header>State</header><text>The term <term>State</term> means the State of Wisconsin.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2A329B1EC0A94FB08A2033DD66EE137F"><enum>(5)</enum><header>State forest land</header><text>The term <term>State forest land</term> means the approximately 31.83 acres of land located in the Black River State Forest in Millston, Wisconsin, as depicted on the map and more particularly described as follows:</text><subparagraph id="HA5EDA0905AC749A7B836D9697DE0034E"><enum>(A)</enum><text>The 23.13-acre parcel—</text><clause commented="no" display-inline="no-display-inline" id="H3B195EC8663A4AFDBC38DB854160B4B2"><enum>(i)</enum><text display-inline="yes-display-inline">comprising the portion of the E<fraction>1/2</fraction>SE<fraction>1/4</fraction> of sec. 20, T. 20 N., R. 2. W., Town of Millston, Jackson County, Wisconsin, lying south of the Interstate 94 southern right-of-way; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H454CC6CF868747BB9BD719DE187E9209"><enum>(ii)</enum><text display-inline="yes-display-inline">excluding a triangular parcel in the southwest corner described as commencing at the southwest corner, thence east 260 feet, thence northwesterly to a point on the west boundary thereof 200 feet north of the southwest corner, thence south to the place of beginning.</text></clause></subparagraph><subparagraph id="HFC846E7E2253474F890474CCD7B964A7"><enum>(B)</enum><text>The 8.70-acre parcel comprising the portion of the NE<fraction>1/4</fraction>NE<fraction>1/4</fraction> of sec. 29, T. 20 N., R. 2. W., Town of Millston, Jackson County, Wisconsin, lying north of the railroad right-of-way, forming a triangular piece, and more particularly described as commencing at the northeast corner of that quarter-quarter section, thence west 1010 feet to the north line of the railroad right-of-way, thence southeasterly along the boundary of the railroad to the east line of that quarter-quarter section, thence north on the east line 750 feet to the place of beginning.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD852886AA11B470083F2C76288528BEA"><enum>(b)</enum><header>Conditional release</header><paragraph commented="no" display-inline="no-display-inline" id="H5CD60DEC014E4FCCA28A4843B077C92E"><enum>(1)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text><subparagraph commented="no" display-inline="no-display-inline" id="HCEC4A5655EC84ADC81E82AF192311EF3"><enum>(A)</enum><text display-inline="yes-display-inline">the State forest land is subject to a reversionary interest of the United States pursuant to section 32(c) of The Bankhead-Jones Farm Tenant Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1011">7 U.S.C. 1011(c)</external-xref>), requiring that the State forest land be used for public purposes in perpetuity; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5660426E8EF54949B2529C6DB859B8F8"><enum>(B)</enum><text display-inline="yes-display-inline">the State and Deli, Inc. have agreed that—</text><clause commented="no" display-inline="no-display-inline" id="id1479f4c8dad2456ea693d71ff19236cf"><enum>(i)</enum><text display-inline="yes-display-inline">the State will convey to Deli, Inc. the State forest land in exchange for the Deli land; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idcccbdfd13a9249858293e921dfed8911"><enum>(ii)</enum><text display-inline="yes-display-inline">after that exchange, the Deli land will be added to Black River State Forest in the State.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H675C17E033434DD68DF56A91C32455BA"><enum>(2)</enum><header>Release</header><text display-inline="yes-display-inline">If the State offers, in a written agreement, to convey to Deli, Inc., the State forest land in exchange for the conveyance of the Deli land by Deli, Inc. to the State—</text><subparagraph commented="no" display-inline="no-display-inline" id="HFBDB98CAF335424396221D2225AF85DE"><enum>(A)</enum><text display-inline="yes-display-inline">the reversionary interest of the United States in the State forest land shall be released; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H886B169BB2E84320AF629F5BF9D90587"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of Agriculture shall provide, as expeditiously as practicable, recordable evidence of the release under subparagraph (A) in the form of a quitclaim deed, which shall—</text><clause commented="no" display-inline="no-display-inline" id="HE6A419D435394FCA918BE189E847651B"><enum>(i)</enum><text display-inline="yes-display-inline">convey any interest of the United States in and to the State forest land, without consideration; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HB78DDDB27CF4448E98B7F83D74CDA2AA"><enum>(ii)</enum><text display-inline="yes-display-inline">be provided to the State for recording before the exchange deeds are recorded. </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBB6D76E4366240C298FDD3D69FA6284F"><enum>(3)</enum><header>Corrections</header><text display-inline="yes-display-inline">The Secretary of Agriculture, in consultation with the State, may make any necessary corrections to the legal description of the State forest land for purposes of the quitclaim deed described in paragraph (2)(B).</text></paragraph></subsection></section></legis-body></bill>
