display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph commented="no" display-inline="no-display-inline" id="ide805a8d16b394d2c93aa1001565f4cc1"><enum>(1)</enum><text display-inline="yes-display-inline">if the Government of the Russian Federation is refusing to engage in good faith negotiations for a lasting peace with Ukraine, the Russian Federation should be subject to maximum sanctions as allowed under United States law; and</text></paragraph><paragraph id="idd3944729144b445f834eaa6e914ffd93"><enum>(2)</enum><text>in order to prevent another military invasion or act that undermines the sovereignty of Ukraine following a negotiated peace, it should be the policy of the United States to provide sustainable levels of security assistance to Ukraine to provide a credible defensive and deterrent capability.</text></paragraph></section><section id="idbc23385d2b9b41dbad5d50e04d22f067"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id6e1919593a7147c3a862d0968e673d1e"><enum>(1)</enum><header>Account; correspondent account; payable-through account</header><text>The terms <term>account</term>, <term>correspondent account</term>, and <term>payable-through account</term> have the meanings given those terms in section 5318A of title 31, United States Code.</text></paragraph><paragraph id="id540b30f7df224efa8e7be946d0792593"><enum>(2)</enum><header>Admission; admitted; alien</header><text>The terms <term>admission</term>, <term>admitted</term>, and <term>alien</term> have the meanings given those terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida8e63dd9ef96442a9baaea28921c5094"><enum>(3)</enum><header>Armed Forces of the Russian Federation</header><text>The term <term>Armed Forces of the Russian Federation</term> includes—</text><subparagraph id="idaac62328f3514828a9afb93814159b73"><enum>(A)</enum><text>the Aerospace Forces of the Russian Federation;</text></subparagraph><subparagraph id="idf3b9c26117d8482fa8ea16b88042fc3f"><enum>(B)</enum><text>the Airborne Forces of the Russian Federation;</text></subparagraph><subparagraph id="ideac741572e4e4514a6b5ca3750f659fa"><enum>(C)</enum><text>the Ground Forces of the Russian Federation;</text></subparagraph><subparagraph id="idde17a8da940b4ee786845f5d7154fbdd"><enum>(D)</enum><text>the Navy of the Russian Federation;</text></subparagraph><subparagraph id="idb331913de7404f0d8c5b117f41b50b40"><enum>(E)</enum><text>the Special Operations Command of the Russian Federation;</text></subparagraph><subparagraph id="id0c91912806334940bfff72b77a089cfd"><enum>(F)</enum><text>the Strategic Rocket Forces of the Russian Federation; </text></subparagraph><subparagraph id="id9e9fe89c99504338971a53918f89278d"><enum>(G)</enum><text>the General Staff of the Armed Forces of the Russian Federation;</text></subparagraph><subparagraph id="idf6caa36f781f46b991cbe81b3a7d9068"><enum>(H)</enum><text>the Main Directorate of the General Staff of the Armed Forces of the Russian Federation; and</text></subparagraph><subparagraph id="id20627cf9de2b4343857b85ffff29eff6" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text>any successor entities or proxies of the entities described in subparagraphs (A) through (H). </text></subparagraph></paragraph><paragraph id="id860aa363811840f4a90cf4adfe1a3da4"><enum>(4)</enum><header>Covered determination</header><text>The term <term>covered determination</term> means a determination by the President as described in section 4. </text></paragraph><paragraph id="ida4eaede052a64320a5a26d990c718f7c"><enum>(5)</enum><header>Critical infrastructure</header><subparagraph id="idf11dea60d71848b1b5546afb1d17a034"><enum>(A)</enum><header>In general</header><text>The term <term>critical infrastructure</term>, with respect to Ukraine, means systems and assets, whether physical or virtual, so vital to Ukraine that the incapacity or destruction of such systems and assets would have catastrophic regional or national effects on public health or safety, economic security, or national security.</text></subparagraph><subparagraph id="id05f7215f5a6843f882735e1f02c4f261"><enum>(B)</enum><header>Included sectors</header><text>The term <term>critical infrastructure</term> includes assets in the following sectors:</text><clause id="ide0b5abae65454b2bbe694eaaa0bc681b"><enum>(i)</enum><text>Biotechnology.</text></clause><clause id="id1ba2fbdbfd1a45228068ebc009a6c0b5"><enum>(ii)</enum><text>Chemical.</text></clause><clause id="idc2f3919019e8493ba81454509e1f119d"><enum>(iii)</enum><text>Commercial facilities.</text></clause><clause id="idafc7ba20122843579cf7fa92d66b0f62"><enum>(iv)</enum><text>Communications.</text></clause><clause id="id7194664bf9ac40c09793e9b60603b0e5"><enum>(v)</enum><text>Critical manufacturing.</text></clause><clause id="idcbd7527cc31d448a8528efa96ee783ac"><enum>(vi)</enum><text>Dams.</text></clause><clause id="id05f2340137444af58681cd8a29445430"><enum>(vii)</enum><text>Defense industrial base.</text></clause><clause id="id2e1439cb428d4df1ab47b3a5a876823e"><enum>(viii)</enum><text>Emergency services.</text></clause><clause id="id4e5c424d82714c91aca3452fe911b598"><enum>(ix)</enum><text>Energy.</text></clause><clause id="ide262207dc19242adb52431670d95a38e"><enum>(x)</enum><text>Financial services.</text></clause><clause id="id7a38258152bc4ef5a3c9daabbf808bf1"><enum>(xi)</enum><text>Food and agriculture.</text></clause><clause id="id1c4c6bf298e94097aaa2d186f5f6f466"><enum>(xii)</enum><text>Government facilities.</text></clause><clause id="id1f9839cd774e45b3be434bd4dba7c018"><enum>(xiii)</enum><text>Healthcare and public health.</text></clause><clause id="idf991f2a72c084b4a880df49ba01c7f9b"><enum>(xiv)</enum><text>Information technology.</text></clause><clause id="id558eb52e2b76431299d1614daa53cf74"><enum>(xv)</enum><text>Materials and waste.</text></clause><clause id="ide78826b97eb34548a8986cda2841a520"><enum>(xvi)</enum><text>Nuclear reactors.</text></clause><clause id="ida46a88ea5fb34b47ab995949e9da04b3"><enum>(xvii)</enum><text>Space.</text></clause><clause id="idacce1ec664904bc2bf45f53ee8c54fbb"><enum>(xviii)</enum><text>Transportation systems.</text></clause><clause id="id543ef9078e5f490eb512e33c4ad090b5"><enum>(xix)</enum><text>Water and wastewater systems.</text></clause></subparagraph></paragraph><paragraph id="id256aa25fe74e4cb3a41888838f6a4c62"><enum>(6)</enum><header>Financial institution</header><text>The term <term>financial institution</term> means a financial institution specified in subparagraph (A), (B), (C), (D), (E), (F), (G), (H), (I), (J), (M), or (Y) of section 5312(a)(2) of title 31, United States Code.</text></paragraph><paragraph id="id5babd89626114868af7556e92bb77b27"><enum>(7)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means an individual or entity that is not a United States person.</text></paragraph><paragraph id="id1f5bbcbb60a84a04951c3bd664c1d50d"><enum>(8)</enum><header>Knowingly; knows</header><text>The terms <term>knowingly</term> and <term>knows</term>, with respect to conduct, a circumstance, or a result, means that a person had actual knowledge, or should have known, of the conduct, the circumstance, or the result.</text></paragraph><paragraph id="id0af1cbb10f584c9e8744b68c0a968351"><enum>(9)</enum><header>Military invasion</header><text>The term <term>military invasion </term> includes—</text><subparagraph id="id2dbf58da40ca414dbeb887830bbcc2a5"><enum>(A)</enum><text>a ground operation or assault; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id39ef3da3a89840d0915685e9d5ea42c6"><enum>(B)</enum><text display-inline="yes-display-inline">an amphibious landing or assault; </text></subparagraph><subparagraph id="idd7913e1dd25c4130847da148fd14f65e"><enum>(C)</enum><text>an airborne operation or air assault;</text></subparagraph><subparagraph id="ida93e6e8080ca48e09a66f63a28d05b32"><enum>(D)</enum><text>an aerial bombardment or blockade;</text></subparagraph><subparagraph id="idcbbf42dac31749f888e1e2fb9bbdcfc2"><enum>(E)</enum><text>missile attacks, including rockets, ballistic missiles, cruise missiles, and hypersonic missiles;</text></subparagraph><subparagraph id="idb2337f2c7bfa4d488775cd5c9423b2b8"><enum>(F)</enum><text>a naval bombardment or armed blockade;</text></subparagraph><subparagraph id="idb421eb98b992482bbb46177a683ee001"><enum>(G)</enum><text>a cyber attack; and</text></subparagraph><subparagraph id="id6890e592aa8643eda507f6415a89956d"><enum>(H)</enum><text>an attack by a country on any territory controlled or administered by any other independent, sovereign country, including offshore islands controlled or administered by that country.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9806c4c8b9914193addc5c4b370b4911"><enum>(10)</enum><header>United States person</header><text display-inline="yes-display-inline">The term <term>United States person</term> means—</text><subparagraph id="ide35f77c7b1d440c2917a3ecba6b99d78"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States; or</text></subparagraph><subparagraph id="id1fae5e4a37514aabbefddfac1763dc4d"><enum>(B)</enum><text>an entity organized under the laws of the United States or any jurisdiction within the United States, including a foreign branch of such an entity.</text></subparagraph></paragraph></section><section id="idd03776f6649a45df83aa08c02bd12801"><enum>4.</enum><header>Covered determination</header><subsection id="ida2d7275ccec64233ae90e716cbd71620"><enum>(a)</enum><header>In general</header><text>Not later than 15 days after the date of the enactment of this Act, and every 90 days thereafter, the President shall determine if any of the following actors has engaged, is engaging, or is planning to engage in an act described in subsection (b):</text><paragraph id="id4cc35ff744a449e695181e8ee3dc1b63"><enum>(1)</enum><text>The Government of the Russian Federation.</text></paragraph><paragraph id="id03e472b5e528489ba98418a715d96f15"><enum>(2)</enum><text>Any proxy of the Government of the Russian Federation.</text></paragraph><paragraph id="idf1756e0c62c74dcc8a7c4be47fce6922"><enum>(3)</enum><text>Any individual or entity controlled by or acting at the direction of the Government of the Russian Federation.</text></paragraph><paragraph id="id407cbdf3bcf640ea80575e9adaef3a6f"><enum>(4)</enum><text>Any person described in section 5 or 6.</text></paragraph></subsection><subsection id="idbd6987e4b8394b4a87083c7c084076cb"><enum>(b)</enum><header>Acts described</header><text>An act described in this subsection is any of the following:</text><paragraph id="id6c9c2557c7c2491989a48ae3230c5214"><enum>(1)</enum><text>Refusing to negotiate a peace agreement with Ukraine.</text></paragraph><paragraph id="id3118a801e6b247baa5b398a7f8def3bf"><enum>(2)</enum><text>Violating any negotiated peace agreement.</text></paragraph><paragraph id="id0c03bdfa4a7b41b68e423de5e548c401"><enum>(3)</enum><text>Initiating another military invasion of Ukraine.</text></paragraph><paragraph id="id02f14c9693a44e2daf1f6e88ea681cc7"><enum>(4)</enum><text>Overthrowing, dismantling, or seeking to subvert the Government of Ukraine.</text></paragraph></subsection></section><section id="id384c25fbb707414185ab3141c382982a"><enum>5.</enum><header>Imposition of sanctions on certain persons affiliated with or supporting the Government of the Russian Federation</header><subsection id="idc5a326c960764fb8b7250d228996d837"><enum>(a)</enum><header>In general</header><text>Not later than 15 days after making a covered determination, and every 90 days thereafter, the President shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id9aa5a59281fa472ca11ebb461fcbb9da"><enum>(1)</enum><text display-inline="yes-display-inline">impose the sanctions described in subsection (c) with respect to the persons described in subsection (b); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8c6c4ad74a4f46c2b10e7c94ebf9f067"><enum>(2)</enum><text>prohibit any United States person from engaging in any transaction with a person described in subsection (b).</text></paragraph></subsection><subsection id="id407b7ffcd56a4c79bde61fb3d4a10c66"><enum>(b)</enum><header>Persons described</header><text>The persons described in this subsection are the following:</text><paragraph id="id17c7c279742c4e8c9eca21a4dfb65434"><enum>(1)</enum><text>The following officials of the Government of the Russian Federation:</text><subparagraph id="id1086991a6f684a09a14595a34e8be667"><enum>(A)</enum><text>The President of the Russian Federation.</text></subparagraph><subparagraph id="id2a5cca3fc85742cf85dc9d63063155b9"><enum>(B)</enum><text>The Prime Minister of the Russian Federation.</text></subparagraph><subparagraph id="idbface952c4f74186a7ded6fd4c437768"><enum>(C)</enum><text>The Minister of Defense of the Russian Federation.</text></subparagraph><subparagraph id="idd4a1739f71a24bd381fb2c36ed34e561"><enum>(D)</enum><text>The Chief of the General Staff of the Armed Forces of the Russian Federation.</text></subparagraph><subparagraph id="idc0acaa62e92646268f03c0ed95db136d"><enum>(E)</enum><text>The Deputy Ministers of Defense of the Russian Federation.</text></subparagraph><subparagraph id="id983768a120f24762bf19e39ba1d80ff9"><enum>(F)</enum><text>The Commander-in-Chief of the Land Forces of the Russian Federation.</text></subparagraph><subparagraph id="ida33f621effbc409f938a4fa618fb3ac8"><enum>(G)</enum><text>The Commander-in-Chief of the Aerospace Forces of the Russian Federation.</text></subparagraph><subparagraph id="id6d5e6d90293d48188b1f6e76103cdd53"><enum>(H)</enum><text>The Commander of the Airborne Forces of the Russian Federation.</text></subparagraph><subparagraph id="ide5b5a3080e2745c6b3a8591af237e1f2"><enum>(I)</enum><text>The Commander-in-Chief of the Navy of the Russian Federation.</text></subparagraph><subparagraph id="id44ff03013fb24127aee03bc75bec443e"><enum>(J)</enum><text>The Commander of the Strategic Rocket Forces of the Russian Federation.</text></subparagraph><subparagraph id="id5a5d50cf779a4b06a34ff3bc31e59dc8"><enum>(K)</enum><text>The Commander of the Special Operations Forces of the Russian Federation.</text></subparagraph><subparagraph Federation.</text></subparagraph></paragraph><paragraph id="id51f295e726204e4fa73ad812b4c82cca"><enum>(2)</enum><text>Any foreign person that—</text><subparagraph id="id43ad7bad473e4d88979b90cf1d8c80e8"><enum>(A)</enum><text>knowingly sells, supplies, transfers, markets, or provides defense articles, equipment, goods, services, technology, or materials to the Armed Forces of the Russian Federation;</text></subparagraph><subparagraph id="id1dfc5e9554774106927fe4305f3c8dcd"><enum>(B)</enum><text>knowingly conducts a transaction with the Armed Forces of the Russian Federation;</text></subparagraph><subparagraph id="id223789add26146f5892c721e105e7fcd"><enum>(C)</enum><text>has engaged in or attempted to engage in activities that—</text><clause id="idc85a97a95a154b979e8861f5b3fb0b4a"><enum>(i)</enum><text>materially undermine the military readiness of Ukraine;</text></clause><clause id="id1ecbfd833b914e78bf9236972b4d8781"><enum>(ii)</enum><text>seek to overthrow, dismantle, or subvert the Government of Ukraine;</text></clause><clause id="ida82a706ed01c49558b174ae4f5f29d27"><enum>(iii)</enum><text>debilitate the critical infrastructure of Ukraine;</text></clause><clause id="id9e9b438822144182b2868647ec722aa7"><enum>(iv)</enum><text>debilitate cybersecurity systems through malicious electronic attacks or cyberattacks on Ukraine;</text></clause><clause id="idfafcccbff09140c0ad32e1a2046f0de9"><enum>(v)</enum><text>undermine the democratic processes of Ukraine; or</text></clause><clause id="ida5cfb14bb4604cccb8c2fa81abcc5ef9"><enum>(vi)</enum><text>involve committing serious human rights abuses against citizens of Ukraine, including forceful transfers, enforced disappearances, unjust detainment, or torture;</text></clause></subparagraph><subparagraph id="idc9e2492fffcb410c9de35caaff8107a4"><enum>(D)</enum><text>operates or has operated in the energy, commodities, telecommunications, banking, industrial, transportation, or manufacturing sectors of the economy of the Russian Federation; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd6feb431865242daa34aaa6370b4ad73"><enum>(E)</enum><text display-inline="yes-display-inline">is an oligarch (as defined and identified by the President);</text></subparagraph><subparagraph id="idcb4c21e81b3947fe8df1944656f7be14"><enum>(F)</enum><text>is responsible for or complicit in, or has directly or indirectly engaged or attempted to engage in, for or on behalf of, or for the benefit of, directly or indirectly, the Government of the Russian Federation—</text><clause id="id4113ea36c6df437490e8ff0d3f3b08fd"><enum>(i)</enum><text>transnational corruption, bribery, extortion, or money laundering;</text></clause><clause id="id5ba30e5dff824292b7e07cd071145176"><enum>(ii)</enum><text>assassination, murder, or other unlawful killing of, or infliction of other bodily harm against, a United States person or a citizen or national of an ally or partner of the United States;</text></clause><clause id="id82d29384f102487d9d4d8a96835ab417"><enum>(iii)</enum><text>activities that undermine the peace, security, political stability, or territorial integrity of the United States or an ally or partner of the United States; or</text></clause><clause id="idab59ac93a06944fe8a9e50ed2296bc41"><enum>(iv)</enum><text>deceptive or structured transactions or dealings to circumvent the application of any sanctions imposed by the United States, including through the use of digital currencies or assets or the use of physical assets.</text></clause></subparagraph></paragraph><paragraph id="id01b88254a59e4554aaa98c0951261a37"><enum>(3)</enum><text>Any person or agent of any person described in paragraph (1) or (2) if the sanctioned person transferred property or an interest in property to the person—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd52dc8abe40942839c0da091bd8a18ec"><enum>(A)</enum><text display-inline="yes-display-inline">after the date on which the President imposed sanctions with respect to the sanctioned person; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id37742bd11f1143e5816149b3010934f9"><enum>(B)</enum><text display-inline="yes-display-inline">before that date, if the sanctioned person did so in an attempt to evade the imposition of sanctions.</text></subparagraph></paragraph></subsection><subsection id="id36f40280f391438b81dfe1384d33efde"><enum>(c)</enum><header>Sanctions described</header><text>The sanctions described in this subsection to be imposed with respect to a person described in subsection (b) are the following:</text><paragraph id="id99a22a6506ee4c2f862ab554112e597d"><enum>(1)</enum><header>Blocking of property</header><subparagraph id="id8451c1797e50440f9114527bec2862b5"><enum>(A)</enum><header>In general</header><text>The President shall exercise all of the powers granted by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to block and prohibit all transactions in all property and interests in property of the person if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></subparagraph><subparagraph id="idac491d1ca1924871ac5734f4f7bc6bbf"><enum>(B)</enum><header>Inapplicability of national emergency requirement</header><text>The requirements of section 202 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref>) shall not apply for purposes of this section.</text></subparagraph></paragraph><paragraph id="id9d6ba8171cce4d0c94d65f07a043d140"><enum>(2)</enum><header>Ineligibility for visas, admission, or parole</header><subparagraph id="id17559b09ff254999a8886aa5a5b722ab"><enum>(A)</enum><header>Visas, admission, or parole</header><text>An alien described in subsection (b) shall be—</text><clause id="id066550e90b6c45fdbfc8ad03f25bd5f6"><enum>(i)</enum><text>inadmissible to the United States;</text></clause><clause id="id94e7ffa01d88468288659af1b05f635e"><enum>(ii)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></clause><clause id="id1e9e94414074445aa9f8ddb43059b947"><enum>(iii)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></clause></subparagraph><subparagraph id="idd37da87b4dbc47aea42086c663a60b75"><enum>(B)</enum><header>Current visas revoked</header><clause id="idc26fad1cd4d44d70be479fb753529a5a"><enum>(i)</enum><header>In general</header><text>The visa or other entry documentation of an alien described in subsection (b) shall be revoked, regardless of when such visa or other entry documentation is or was issued.</text></clause><clause id="id10d26bf90b1c4b5c874eb0933464605d"><enum>(ii)</enum><header>Immediate effect</header><text>A revocation under clause (i) shall—</text><subclause id="id710711a927ca47bbb0076d7e4a1db7e8"><enum>(I)</enum><text>take effect immediately; and</text></subclause><subclause id="ida7cdb0fd129e4e8d8e6678d6c0687e18"><enum>(II)</enum><text>automatically cancel any other valid visa or entry documentation that is in the possession of the alien.</text></subclause></clause></subparagraph></paragraph></subsection></section><section id="id9006147f3cc643b0aad3651ee1b7d343"><enum>6.</enum><header>Imposition of sanctions with respect to financial institutions affiliated with the Government of the Russian Federation</header><subsection id="id2cb0c7c282ec43ab8efd6f52ae0e061a"><enum>(a)</enum><header>In general</header><text>Not later than 15 days after making a covered determination, and every 90 days thereafter, the Secretary of the Treasury shall—</text><paragraph id="idaeddffc32f3b4ffab44014760e020a5e"><enum>(1)</enum><text>impose the sanctions described in subsection (b) with respect to—</text><subparagraph id="iddc6dc8ad6a7342c8b8f5bc0ec79a5e2b"><enum>(A)</enum><text>the Central Bank of the Russian Federation (Bank of Russia);</text></subparagraph><subparagraph id="idf0a69905f36b4cf78b7a3e73d6a0213f"><enum>(B)</enum><text>Sberbank;</text></subparagraph><subparagraph id="id5c8194704199429db81e8663d330b634"><enum>(C)</enum><text>VTB Bank;</text></subparagraph><subparagraph id="id7e2b9bd7842040e998d6bf4102ee9f91"><enum>(D)</enum><text>Gazprombank;</text></subparagraph><subparagraph id="id98f0347649ae489f95da274ba46354b4"><enum>(E)</enum><text>any other financial institution organized under the laws of the Russian Federation and owned in whole or part by the Government of the Russian Federation; </text></subparagraph><subparagraph id="id1aa07058c07a4960a5449aecda6d0b63"><enum>(F)</enum><text>any subsidiary of, or successor entity to, any of the financial institutions described in subparagraphs (A) through (E); and</text></subparagraph><subparagraph id="idf70b53b6047e40eba00ec1cd1df8c481"><enum>(G)</enum><text>any financial institution that engages in transactions with any of the financial institutions described in subparagraphs (A) through (F);</text></subparagraph></paragraph><paragraph id="id522347fa6d4e4f08b3ced9b1e14edc20"><enum>(2)</enum><text>impose the sanctions described in section 5(c) with respect to any directors of, officers of, officials of, and shareholders with an interest in, a financial institution described in paragraph (1); and</text></paragraph><paragraph id="id0554acfa060d4b3bafab710fa98efa22"><enum>(3)</enum><text>prohibit any United States person from engaging in any transaction with a financial institution described in paragraph (1).</text></paragraph></subsection><subsection id="id146ca8bb9fb7406aa7f81266f6c93f21"><enum>(b)</enum><header>Sanctions described</header><text>The sanctions described in this subsection to be imposed with respect to a financial institution described in subsection (a)(1) are the following:</text><paragraph id="id4a8fdb0bc11d4941962c3073adc77d14"><enum>(1)</enum><header>Blocking of property</header><subparagraph id="id35c9656ddc2b4ee18fcbb878ab71b2e1"><enum>(A)</enum><header>In general</header><text>The President shall exercise all of the powers granted to the President under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in property and interests in property of the financial institution if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></subparagraph><subparagraph id="idce615fb70702483888ce77c9043f4345"><enum>(B)</enum><header>Inapplicability of national emergency requirement</header><text>The requirements of section 202 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref>) shall not apply for purposes of this section.</text></subparagraph></paragraph><paragraph id="idee9b2ba2eeb34c3faa6ee28a4b45a781"><enum>(2)</enum><header>Restrictions on correspondent and payable-through accounts</header><text>The President shall prohibit the opening, and prohibit or impose strict conditions on the maintaining, in the United States, of a correspondent account or payable-through account by the financial institution.</text></paragraph></subsection></section><section id="id9304b251711b4c3391d0e566c102326f"><enum>7.</enum><header>Imposition of sanctions with respect to other entities owned by or affiliated with the Government of the Russian Federation</header><subsection id="idca2a55ca132844e385c61a611d4bcbad"><enum>(a)</enum><header>In general</header><text>Not later than 15 days after making a covered determination, and every 90 days thereafter, the Secretary of the Treasury shall impose the sanctions described in subsection (b) with respect to any entity that—</text><paragraph id="id8b07313cb14d4d60bc02295764ba001a"><enum>(1)</enum><text>the Government of the Russian Federation has an ownership interest in; or</text></paragraph><paragraph id="id4f26d8133c1d45289722b119bdb906e3"><enum>(2)</enum><text>is otherwise affiliated with the Government of the Russian Federation.</text></paragraph></subsection><subsection id="id22dbeec67b8d40fd9379689c1f4d6128"><enum>(b)</enum><header>Blocking of property</header><paragraph id="ide96aad56e97a4013a77f256a9a9d1470"><enum>(1)</enum><header>In general</header><text>The President shall exercise all of the powers granted to the President under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in property and interests in property of an entity described in subsection (a) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph><paragraph id="idccc3797863644a21a639b891a074db0c"><enum>(2)</enum><header>Inapplicability of national emergency requirement</header><text>The requirements of section 202 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref>) shall not apply for purposes of this section.</text></paragraph></subsection></section><section id="ida5adb9ec1b294d9cbc384291d7693c56"><enum>8.</enum><header>Prohibition on transfers of funds involving the Russian Federation</header><subsection id="id187b1ce9cbf5403b84967af29e08ad7f"><enum>(a)</enum><header>In general</header><text>Except as provided by subsection (b), not later than 15 days after a covered determination is made, a depository institution (as defined in section 19(b)(1)(A) of the Federal Reserve Act (<external-xref legal-doc="usc" parsable-cite="usc/12/461">12 U.S.C. 461(b)(1)(A)</external-xref>)) or a broker or dealer in securities registered with the Securities and Exchange Commission under the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78a">15 U.S.C. 78a et seq.</external-xref>) may not process transfers of funds—</text><paragraph id="id3b85c730ef5143a79aa7ea00bece32d4"><enum>(1)</enum><text>to or from the Russian Federation; or</text></paragraph><paragraph id="idac0dc2c9974f48a5bcc99727ee0e747f"><enum>(2)</enum><text>for the direct or indirect benefit of officials of the Government of the Russian Federation.</text></paragraph></subsection><subsection id="id2f8ae41a77fb47f8ab3a1e493a367238"><enum>(b)</enum><header>Exception</header><text>A depository institution, broker, or dealer described in subsection (a) may process a transfer described in that subsection if the transfer—</text><paragraph id="id5157f1cc61514d7090bd08b24bc58481"><enum>(1)</enum><text>arises from, and is ordinarily incident and necessary to give effect to, an underlying transaction that is authorized by a specific or general license; and</text></paragraph><paragraph id="id4be2df5c359a4781aa2e6f162ac465f4"><enum>(2)</enum><text>does not involve debiting or crediting an account affiliated with the Russian Federation or held by a Russian person.</text></paragraph></subsection><subsection id="id6bb8aa47dd944397bf83bf7909448a39"><enum>(c)</enum><header>Russian person defined</header><text>In this section, the term <term>Russian person</term> means—</text><paragraph id="id683587f234994194914de154da6d2f36"><enum>(1)</enum><text>a citizen or national of the Russian Federation; or</text></paragraph><paragraph id="ida235d44204e34d8480b1becd87e2a9ca" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>an entity organized under the laws of the Russian Federation or otherwise subject to the jurisdiction of the Government of the Russian Federation. </text></paragraph></subsection></section><section id="id0eeceaf606bf46c6a7255dc02d5cfa9c"><enum>9.</enum><header>Prohibition on listing or trading of Russian entities on United States securities exchanges</header><subsection id="id2c9094fb617b4d01918e805a2b54aa41"><enum>(a)</enum><header>In general</header><text>Not later than 15 days after a covered determination is made, the Securities and Exchange Commission shall prohibit the securities of an issuer described in subsection (b) from being traded on a national securities exchange.</text></subsection><subsection id="idd5671934cdf34e96bc76e7a9eef10946"><enum>(b)</enum><header>Issuers</header><text>An issuer described in this subsection is an issuer that is—</text><paragraph id="id16db9813e61f4694a2ff917a19cd8195"><enum>(1)</enum><text>an official of or individual affiliated with the Government of the Russian Federation; or</text></paragraph><paragraph id="id647ccf6a604b4259b70521720927ca6c"><enum>(2)</enum><text>an entity that—</text><subparagraph id="id2be72fd7e5d64d49859c46eaf6d4f8e8"><enum>(A)</enum><text>the Government of the Russian Federation has an ownership interest in; or</text></subparagraph><subparagraph id="id78e1c61063fe4e93916a6d840cfa4aa2"><enum>(B)</enum><text>is otherwise affiliated with the Government of the Russian Federation.</text></subparagraph></paragraph></subsection><subsection id="id2363b003bcaa4f2681a03d16f6f09654"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id6fabf74544f04ef0a509affdcc3308f3"><enum>(1)</enum><header>Issuer; security</header><text>The terms <term>issuer</term> and <term>security</term> have the meanings given those terms in section 3(a) of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78c">15 U.S.C. 78c(a)</external-xref>).</text></paragraph><paragraph id="ida1b3dfbbf25949b0b48888a6ee74b097"><enum>(2)</enum><header>National securities exchange</header><text>The term <term>national securities exchange</term> means an exchange registered as a national securities exchange in accordance with section 6 of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78f">15 U.S.C. 78f</external-xref>).</text></paragraph></subsection></section><section id="id46f95fbda8a940f78c952e808094472a"><enum>10.</enum><header>Prohibition on investments by United States financial institutions that benefit the Government of the Russian Federation</header><subsection id="id8ce1dbd03e4d4754a4e4f19469fef5b5"><enum>(a)</enum><header>In general</header><text>Not later than 15 days after a covered determination is made, the Secretary of the Treasury shall prohibit any United States financial institution from making any investment described in subsection (b).</text></subsection><subsection id="id29d6a589c14e4d8abb5a56454b881aae"><enum>(b)</enum><header>Investments described</header><text>An investment described in this subsection is a monetary investment in or to—</text><paragraph id="ida69d63fed69e4a7dbfdf0f07bbf5493f"><enum>(1)</enum><text>an entity owned or controlled by the Government of the Russian Federation; or</text></paragraph><paragraph id="idfd7425debde94b3cb74f3cccbcf8d5bb"><enum>(2)</enum><text>the Armed Forces of the Russian Federation.</text></paragraph></subsection><subsection id="ida4beda24a0de41c6af770a25ab74c3d0"><enum>(c)</enum><header>United states financial institution defined</header><text>In this section, the term <term>United States financial institution</term>—</text><paragraph id="id07ec7b8e2b3e4118aa4261242e758e40"><enum>(1)</enum><text>means any financial institution that is a United States person; and</text></paragraph><paragraph id="id7c721344cc5a4a7da49bc265b94dbcda"><enum>(2)</enum><text>includes an investment company, private equity company, venture capital company, or hedge fund that is a United States person.</text></paragraph></subsection></section><section id="idfba4ac4b3ece46de8c0a94a520e1a6d5"><enum>11.</enum><header>Prohibition on energy exports to, and investments in energy sector of, the Russian Federation</header><subsection id="id38429948d6cd4cf1ba1f5dc4bb825d84"><enum>(a)</enum><header>Prohibition on exports</header><paragraph id="id63398c95636f4caa84250c0c74a0b395"><enum>(1)</enum><header>In general</header><text>Not later than 15 days after a covered determination is made, the Secretary of Commerce shall prohibit, under the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801 et seq.</external-xref>), the export, reexport, or in-country transfer to or in the Russian Federation of any energy or energy product produced in the United States.</text></paragraph><paragraph id="id43173f1253e240f389b097fbe9bc0bd7"><enum>(2)</enum><header>Definitions</header><text>In this subsection, the terms <term>export</term>, <term>in-country transfer</term>, and <term>reexport</term> have the meanings given those terms in section 1742 of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801</external-xref>).</text></paragraph></subsection><subsection id="ida5ea69c6272d48579172d8947d837f09"><enum>(b)</enum><header>Prohibition on investments</header><text>On and after the date on which a covered determination is made, a United States person may not make an investment in the energy sector of the Russian Federation.</text></subsection><subsection id="iddf2ce89a47a949b69a5127dc3eb31fdf"><enum>(c)</enum><header>Sanctions</header><text>The President shall—</text><paragraph id="idf91c754d51ab4d0d91b241eba5fa26ab"><enum>(1)</enum><text>impose the sanctions described in section 5(c) with respect to any foreign person that the President determines knowingly sells, supplies, transfers, markets, or provides goods, services, technology, information, or other support that facilitates the maintenance or expansion of the production of oil, uranium, natural gas, petroleum, petroleum products, or petrochemical products for use by any person subject to sanctions under section 5 or 6; and</text></paragraph><paragraph id="id9fbc3d8a741f4c7b86f72b99f4a1a7f3"><enum>(2)</enum><text>prohibit any United States person from engaging in any transaction with a person described in paragraph (1).</text></paragraph></subsection></section><section id="idd5f4880831d64308b9dc123b94b503c6"><enum>12.</enum><header>Prohibition on purchases of sovereign debt of the Russian Federation by United States persons</header><text display-inline="no-display-inline">On and after the date that is 15 days after a covered determination is made, the purchase of sovereign debt of the Government of the Russian Federation by any United States person is prohibited.</text></section><section id="id43ac1f3c29474f3d993bf7be539b190a"><enum>13.</enum><header>Prohibition on provision of services to sanctioned financial institutions by international financial messaging systems</header><text display-inline="no-display-inline">Not later than 15 days after making a covered determination, and every 90 days thereafter, the President shall impose sanctions pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) with respect to—</text><paragraph id="id4e7c8b3ebedf4786a8196ba589d8db87"><enum>(1)</enum><text>any global financial communications services provider that does not terminate the provision of financial communications services to, and the enabling and facilitation of access to such services for, any financial institution subject to sanctions under section 6 or any other provision of this Act; and</text></paragraph><paragraph id="id35e2bb5e94184554b6c0d10d1d1f50a1"><enum>(2)</enum><text>the directors of, officers of, and shareholders with a interest in, the provider.</text></paragraph></section><section id="id70376cdc048c4f6b8952ddca35cb8843"><enum>14.</enum><header>Prohibition on importing, and sanctions with respect to, uranium from the Russian Federation</header><subsection id="id1f7197b8191b427ab51d725c6ed9509b"><enum>(a)</enum><header>Prohibition</header><text>Not later than 15 days after making a covered determination, the President shall prohibit the importation of uranium from—</text><paragraph commented="no" display-inline="no-display-inline" id="id6e3ee0efd8b642b1befe714f87c8ebb1"><enum>(1)</enum><text display-inline="yes-display-inline">the Russian Federation, including the importation of any uranium from Rosatom State Corporation or any subsidiary or successor entity; and</text></paragraph><paragraph id="id12efd9a057204badb7d1e0f0d228967e"><enum>(2)</enum><text>any country that has uranium that was originally sourced from the Russian Federation, Rosatom State Corporation, or any subsidiary or successor entity.</text></paragraph></subsection><subsection id="id35badee9d9d8417db95672ddd768afa3"><enum>(b)</enum><header>Sanctions</header><text>Not later than 15 days after making a covered determination, and every 90 days thereafter, the President shall impose sanctions described in section 5(c) with respect to—</text><paragraph commented="no" display-inline="no-display-inline" id="id80822933a95245719d04a373100007f8"><enum>(1)</enum><text display-inline="yes-display-inline">any directors of, officers of, and shareholders with an interest in, Rosatom State Corporation or any subsidiary or successor entity; and</text></paragraph><paragraph id="idf63ce846854e43649c4241ef78a4ab4a"><enum>(2)</enum><text>any foreign government or foreign person that has knowingly sold, supplied, transferred, or purchased uranium originally sourced from the Russian Federation, Rosatom State Corporation, or any subsidiary or successor entity.</text></paragraph></subsection></section><section id="idcfc3380261624c5eb754f34b526fdb20"><enum>15.</enum><header>Increases in duties on goods and services imported from the Russian Federation</header><subsection id="idd7490fda62a04b85950072eeefa6a17b"><enum>(a)</enum><header>In general</header><text>Not later than 15 days after making a covered determination, the President shall, notwithstanding any other provision of law, increase the rate of duty for all goods and services, including oil, natural gas, petroleum, petroleum products, and petrochemical products, imported into the United States from the Russian Federation to a rate of not less than the equivalent of 500 percent ad valorem.</text></subsection><subsection id="id379ab2a4f764420fac147043a389b9c7"><enum>(b)</enum><header>Recommendations for higher rate</header><text>The United States Trade Representative, in consultation with the Secretary of the Treasury, the Secretary of Commerce, and the heads of other relevant Federal agencies, shall provide recommendations to the President with respect to goods and services described in subsection (a) that should be subject to a rate of duty that exceeds the equivalent of 500 percent ad valorem.</text></subsection><subsection id="id97976de8da264cf787efd68e7e834d63"><enum>(c)</enum><header>Duty rate in addition to antidumping and countervailing duties</header><text>The rate of duty required under subsection (a) with respect to a good or service described in that subsection shall be in addition to any antidumping or countervailing duty applicable with respect to the good or service under title VII of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1671">19 U.S.C. 1671 et seq.</external-xref>).</text></subsection></section><section id="id72f82799ea254c2baca995dd52858c07"><enum>16.</enum><header>Imposition of CAATSA sanctions</header><text display-inline="no-display-inline">Not later than 15 days after making a covered determination, and every 90 days thereafter, the President shall impose all sanctions described in section 235 of the Countering America’s Adversaries Through Sanctions Act (<external-xref legal-doc="usc" parsable-cite="usc/22/9529">22 U.S.C. 9529</external-xref>) that are not already applicable with respect to—</text><paragraph id="id2014387fffcd452c80004778ef2f1cc1"><enum>(1)</enum><text>the Russian Federation; and</text></paragraph><paragraph id="id769289d8936943c180cafb3e7acb7c03"><enum>(2)</enum><text>any person described in section 5 or 6.</text></paragraph></section><section id="id7990a938c9e843d897545ea421437b00"><enum>17.</enum><header>Duties on countries that purchase Russian-origin oil, uranium, and petroleum products</header><subsection id="id63a1b3bf92654e16afb08a83dc9c8afc"><enum>(a)</enum><header>In general</header><text>Not later than 15 days after making a covered determination, and every 90 days thereafter, the President shall, notwithstanding any other provision of law, increase the rate of duty for all goods or services imported into the United States from a country described in subsection (b) to a rate of not less than the equivalent of 500 percent ad valorem. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="ida60476d4ee51400bb6ac94af76937fb6"><enum>(b)</enum><header>Countries described</header><text display-inline="yes-display-inline">A country is described in this subsection if the country knowingly sells, supplies, transfers, or purchases oil, uranium, natural gas, petroleum products, or petrochemical products that originated in the Russian Federation.</text></subsection><subsection id="idcff17afc62b44db4a9c1b8caf2d9cd5f"><enum>(c)</enum><header>Duty rate in addition to antidumping and countervailing duties</header><text>The rate of duty required under subsection (a) with respect to a good or service described in that subsection shall be in addition to any antidumping or countervailing duty applicable with respect to the good or service under title VII of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1671">19 U.S.C. 1671 et seq.</external-xref>). </text></subsection><subsection id="id91484331c4204e0099b158ffb19429cb"><enum>(d)</enum><header>Waiver</header><paragraph commented="no" display-inline="no-display-inline" id="idf75450de18394ae19e5b0c6c911720d7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President may waive the application of subsection (a) one time for a period of not more than 180 days with respect to a country, a good, or a service if the President determines that such a waiver is in the national security interests of the United States.</text></paragraph><paragraph id="id4500b7609b4e4e0da3b6252c917496d2"><enum>(2)</enum><header>Prohibition on waivers for certain countries</header><text>The President may not waive the application of subsection (a) with respect to—</text><subparagraph id="id8da3745c222947ec94a7d0d053db1a73"><enum>(A)</enum><text>a country the government of which the Secretary of State has determined has repeatedly provided support for acts of international terrorism (commonly referred to as a <quote>state sponsor of terrorism</quote>), for purposes of—</text><clause id="id64bea8337c804475ae1981b05dc9843a"><enum>(i)</enum><text>section 1754(c)(1)(A)(i) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4813">50 U.S.C. 4813(c)(1)(A)(i)</external-xref>);</text></clause><clause id="id03c22b0962ef46998ce8c981fbad14f1"><enum>(ii)</enum><text>section 620A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>);</text></clause><clause id="idcb6a4ed878ab4105beb6f7dc42dc3a95"><enum>(iii)</enum><text>section 40(d) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780(d)</external-xref>); or</text></clause><clause id="id6e01e941b95a41cfa08a7052bffd2a67"><enum>(iv)</enum><text>any other provision of law; or</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id21e09a7f430147e8bac523669bd381e3"><enum>(B)</enum><text>a country specified in section 4872(f)(2) of title 10, United States Code.</text></subparagraph></paragraph></subsection></section><section id="id84a9ae299458446a81402f8e78b9acaa"><enum>18.</enum><header>Exceptions</header><subsection id="ide7102f738f694bb2929b5ade9443ff36"><enum>(a)</enum><header>Support for people of the Russian Federation</header><text>This Act shall not apply with respect to the provision of humanitarian assistance (including medical assistance) to the people of the Russian Federation.</text></subsection><subsection id="id14275d0b5c05434d9c379490b1288c51"><enum>(b)</enum><header>Exception for intelligence activities</header><text>This Act shall not apply with respect to activities subject to the reporting requirements under title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091 et seq.</external-xref>) or any authorized intelligence activities of the United States.</text></subsection><subsection id="idabd306916edc4e7993ac3081520e5115"><enum>(c)</enum><header>Exception To comply with international obligations</header><text>Sanctions under this Act shall not apply to the admission of an alien if the admission of that alien is necessary to comply with United States obligations under the Agreement between the United Nations and the United States of America regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, under the Convention on Consular Relations, done at Vienna April 24, 1963, and entered into force March 19, 1967, or under other international agreements.</text></subsection></section><section id="id91046ae52b644187b9d2be27e03e7652"><enum>19.</enum><header>Implementation; penalties</header><subsection id="id690ee4543ba2457c804fc967c82eef9c"><enum>(a)</enum><header>Implementation</header><text>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to carry out this Act.</text></subsection><subsection id="id16fbd9fe489042299b947c8f0fa2b8b7"><enum>(b)</enum><header>Penalties</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of this Act or any regulation, license, or order issued to carry out this Act shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</text></subsection></section><section id="id140910407d11431eaabe413b2a4927fe"><enum>20.</enum><header>Termination authority; reimposition of sanctions</header><subsection id="id3733ca26dff241a5bddfcf8b99be2952"><enum>(a)</enum><header>In general</header><text>The President may terminate the application of sanctions, prohibitions, restrictions, duties, and penalties under this Act if the President certifies to Congress that—</text><paragraph id="id69e9bccd579d4a81956f55380e11e593"><enum>(1)</enum><text>all actors described in subsection (a) of section 4 have verifiably ceased engaging in acts described in subsection (b) of that section; and</text></paragraph><paragraph id="id8920e34c4f4e4f21bc99c03a3637c7df"><enum>(2)</enum><text>the Government of the Russian Federation has entered into a peace agreement with Ukraine.</text></paragraph></subsection><subsection id="idd5cb15cac23d421783edad03f000d3b2"><enum>(b)</enum><header>Reimposition</header><text>If, after the submission of a certification described in subsection (a), an actor described in subsection (a) of section 4 engages in an act described in subsection (b) of that section, the President shall immediately reimpose all previously terminated sanctions, prohibitions, restrictions, duties, and penalties imposed under this Act, in addition to new sanctions, prohibitions, restrictions, duties, and penalties under this Act.
