title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>SBA Fraud Enforcement Extension Act</short-title></quote>.</text></section><section id="idf0ae01e6708145e993561aaf0b4e06c5" changed="deleted" reported-display-style="strikethrough" committee-id="SSSB00"><enum>2.</enum><header>Statute of limitations for certain programs</header><subsection commented="no" display-inline="no-display-inline" id="id0a6fc7411c5843859d78132b11db2107"><enum>(a)</enum><header>Shuttered venue operators</header><text>Section 324 of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5f68ea884ae74024afc0eb24eadf9a71" changed="deleted" reported-display-style="strikethrough" committee-id="SSSB00"><subsection id="idbca7238dc78d457289ed1cbaa115a486"><enum>(g)</enum><header>Statute of limitations</header><text>Notwithstanding any other provision of law, any criminal prosecution or civil enforcement action for a violation of, or conspiracy to violate, section 371, 641, 1028A, 1029, 1341, 1343, 1344, 1349, 1956, or 1957 of title 18, United States Code, or section 3729 or 3801 of title 31, United States Code, with respect to any grant for shuttered venue operators received under this section shall be brought not later than 10 years after the date of the violation or conspiracy.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idfed3d392d08a4f03bdf4f59e3b14c051"><enum>(b)</enum><header>Restaurant revitalization</header><text>Section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idffd8ea222bbe4fcba85e58c6f6564881" changed="deleted" reported-display-style="strikethrough" committee-id="SSSB00"><subsection id="id91cbb3b072bd4f469ffc0ad28b234c55"><enum>(d)</enum><header>Statute of limitations</header><text>Notwithstanding any other provision of law, any criminal prosecution or civil enforcement action for a violation of, or conspiracy to violate, section 371, 641, 1028A, 1029, 1341, 1343, 1344, 1349, 1956, or 1957 of title 18, United States Code, or section 3729 or 3801 of title 31, United States Code, with respect to any restaurant revitalization grant received under this section shall be brought not later than 10 years after the date of the violation or conspiracy.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="iddea8c057-2d2b-42b6-89f4-6366adddeae3" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSSB00"><enum>1.</enum><header>Short title</header><text States Code, with respect to any grant received or applied for under this section shall be filed not later than 10 years after the date of the violation or id="id47d511a9-3242-4670-9bd3-9a982ee1467c"><enum>(d)</enum><header>Statute of limitations</header><text>Notwithstanding any other provision of law, any criminal prosecution or civil enforcement action for a violation of, or conspiracy to violate, section 371, 641, 1001, 1028A, 1029, 1341, 1343, 1349, 1956, or 1957 of title 18, United States Code, or section 3729 or 3802 of title 31, United States Code, with respect to any grant received or applied for under this section shall be filed not later than 10 years after the date of the violation or conspiracy.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8cfd176ffb914abe99bba19630807a4d"><enum>(c)</enum><header>Certain Economic Injury Disaster Loans</header><text>Section 7 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ida0a8c21659994322b1a8c20a24158775"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating the matter appearing between paragraphs (12)(A) and (13) of subsection (a) and designated as subsection (b) (relating to deferred participation in loans) as subparagraph (B) and adjusting the margins 2 ems to the right; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide74b75f1f4a24e69bbbd648218bbc3fd"><enum>(2)</enum><text display-inline="yes-display-inline">in the second subsection (b), relating to disaster loans—</text><subparagraph id="idf10adb608d47421284878e35b1669154"><enum>(A)</enum><text>by inserting after <quote>(b)</quote> the following: <quote><header-in-text style="OLC" level="subsection">Federal disaster loans</header-in-text>.—</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id20487d64be694d33895f7277419fe60f"><enum>(B)</enum><text display-inline="yes-display-inline">by striking the second paragraph (16), relating to the statute of limitations, and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7f58e8424ae54c88a6b989f9904c1961" changed="added" reported-display-style="italic" committee-id="SSSB00"><paragraph commented="no" display-inline="no-display-inline" id="id26102cda26224bafaa8b388ed06c88f4"><enum>(17)</enum><header>Statute of Limitations</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, any criminal prosecution or civil enforcement action for a violation of, or conspiracy to violate, section 371, 641, 1001, 1028A, 1029, 1341, 1343, 1349, 1956, or 1957 of title 18, United States Code, or section 3729 or 3802 of title 31, United States Code, in which a borrower engaged in fraud with respect to a loan made under this subsection in response to COVID–19 during the covered period (as defined in section 1110(a) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009">15 U.S.C. 9009(a)</external-xref>)) shall be filed not later than 10 years after the date of the violation or conspiracy.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="idad20b9be4073467f948b432091c178ec"><enum>(d)</enum><header>Paycheck Protection Program</header><text>Section 7(a)(36) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)</external-xref>) is amended by striking subparagraph (W) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0ed48a60b42d47ff85915b9a22a08dc6" changed="added" reported-display-style="italic" committee-id="SSSB00"><subparagraph commented="no" display-inline="no-display-inline" id="ideadc3b56d7644df3afc2f4d37091f5f8"><enum>(W)</enum><header>Statute of Limitations</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, any criminal prosecution or civil enforcement action for a violation of, or conspiracy to violate, section 371, 641, 1001, 1028A, 1029, 1341, 1343, 1349, 1956, or 1957 of title 18, United States Code, or section 3729 or 3802 of title 31, United States Code, in which a borrower engaged in fraud with respect to a covered loan guaranteed under this paragraph shall be filed not later than 10 years after the offense was committed.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idfee5c9bd07594f99a3929cc093dde284"><enum>(e)</enum><header>Paycheck Protection Program Second Draw Loans</header><text>Section 7(a)(37) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(37)</external-xref>) is amended by striking subparagraph (P) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfed8c85568a84a58a48e52937a0cf36b" changed="added" reported-display-style="italic" committee-id="SSSB00"><subparagraph commented="no" display-inline="no-display-inline" id="idcab147f0dd3c407b9aefad8b150e106c"><enum>(P)</enum><header>Statute of Limitations</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, any criminal prosecution or civil enforcement action for a violation of, or conspiracy to violate, section 371, 641, 1001, 1028A, 1029, 1341, 1343, 1349, 1956, or 1957 of title 18, United States Code, or section 3729 or 3802 of title 31, United States Code, in which a borrower engaged in fraud with respect to a covered loan guaranteed under this paragraph shall be filed not later than 10 years after the offense was
