Transfer of land to be held in trust for the Lovelock Paiute Tribe.</toc-entry></toc></subsection></section><section id="HAF54B535BDC04494A174B56A2EADAC88"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idfbe48ec3b57749d9aeb4e65f57644fa8"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="ideb936c947ae4424ba5f86187221dc464" commented="no"><enum>(A)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text></subparagraph><subparagraph id="idf5cb81adb4f04fd4b9bdb278e7a0f8de" commented="no"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id9fe23b9542f54305bf8761175b8d50a7"><enum>(2)</enum><header>County</header><text>The term <term>County</term> means Pershing County, Nevada.</text></paragraph><paragraph id="id4897d97996d6480484455c47d697a047"><enum>(3)</enum><header>Eligible land</header><text>The term <term>eligible land</term> means any land administered by the Director of the Bureau of Land Management—</text><subparagraph id="idd1222af838ed46a2bcd1286ac20ed493"><enum>(A)</enum><text>that is within the area identified on the Map as <quote>Checkerboard Lands Resolution Area</quote> that is designated for disposal by the Secretary through—</text><clause id="id5d8aa927a8414fcca03db0c18e5e7e57"><enum>(i)</enum><text>the Winnemucca Consolidated Resource Management Plan; or</text></clause><clause id="id202df76c3c5041479202d379d265abc1"><enum>(ii)</enum><text>any subsequent amendment or revision to the management plan that is undertaken with full public involvement;</text></clause></subparagraph><subparagraph id="id1980a80ae811476c874eee7f1e3dbe5f"><enum>(B)</enum><text>that is identified on the Map as <quote>Additional Lands Eligible for Disposal</quote>; and</text></subparagraph><subparagraph id="id64ae897ea28a455eaf277fc06cc867e4"><enum>(C)</enum><text>that is not encumbered land.</text></subparagraph></paragraph><paragraph id="ide24fd68eca2e4514930dbc0080624cb6"><enum>(4)</enum><header>Encumbered land</header><text>The term <term>encumbered land</term> means any land administered by the Director of the Bureau of Land Management within the area identified on the Map as <quote>Checkerboard Lands Resolution Area</quote> that is encumbered by mining claims, millsites, or tunnel sites.</text></paragraph><paragraph id="ida5277cc5784f48dfa14494ba770e9ad0"><enum>(5)</enum><header>Map</header><text>The term <term>Map</term> means the map entitled <quote>Pershing County Checkerboard Lands Resolution</quote> and dated July 8, 2024.</text></paragraph><paragraph id="idb447a0de1c1b46b39e77c4cf3b86d1fb"><enum>(6)</enum><header>Qualified entity</header><text>The term <term>qualified entity</term> means, with respect to a portion of encumbered land—</text><subparagraph id="idee7dbb870c7943d19e105e5be4d97709"><enum>(A)</enum><text>the owner of a mining claim, millsite, or tunnel site located on a portion of the encumbered land on the date of enactment of this Act; and</text></subparagraph><subparagraph id="id89c8e154b1b1484497e86c23f5870648"><enum>(B)</enum><text>a successor in interest of an owner described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="id85423057e41e461198bcd25ce8218e02"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="idd0dd720ad2124aecab9dda6d61d12e70"><enum>(8)</enum><header>State</header><text>The term <term>State</term> means the State of Nevada.</text></paragraph><paragraph id="id6c73a9fc53d745c79f5875d78152aab3"><enum>(9)</enum><header>Wilderness area</header><text>The term <term>wilderness area</term> means a wilderness area designated by section 201(a).</text></paragraph></section><title id="HB4B56166E1FC4DDA85E2BB393565C454"><enum>I</enum><header>Checkerboard Land Resolution</header><section id="H24BF7C0FBE694F77A567438196BD7659"><enum>101.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="H4B0133A1C3FA4C8F9209A75ADD04EE00"><enum>(1)</enum><text>since the passage of the Act of July 1, 1862 (12 Stat. 489, chapter 120) (commonly known as the <quote>Pacific Railway Act of 1862</quote>), under which railroad land grants along the Union Pacific Railroad right-of-way created a checkerboard land pattern of alternating public land and privately owned land, management of the land in the checkerboard area has been a constant source of frustration for the County government, private landholders in the County, and the Federal Government;</text></paragraph><paragraph id="HD99FF52CF9D64C15A4367649E6F21C38"><enum>(2)</enum><text>management of Federal land in the checkerboard area has been costly and difficult for the Federal land management agencies, creating a disincentive to manage the land effectively;</text></paragraph><paragraph id="H2874A7B265F6427CAF32E014B3AD8D93"><enum>(3)</enum><text>parcels of land within the checkerboard area in the County will not vary significantly in appraised value by acre due to the similarity of highest and best use in the County; and</text></paragraph><paragraph id="H15E88561668C4636BD33808E3EEB05A4"><enum>(4)</enum><text>consolidation of appropriate land within the checkerboard area through sales and exchanges for development and Federal management will—</text><subparagraph id="H4CEA2243CC2A41A3B6E71B4F4382A2D8"><enum>(A)</enum><text>help improve the tax base of the County; and</text></subparagraph><subparagraph id="H8303133FEA02475282D0F0F5F6D71161"><enum>(B)</enum><text>simplify management for the Federal Government.</text></subparagraph></paragraph></section><section id="HDA739448F8B34A0B8681157C8CC42D57"><enum>102.</enum><header>Sale or exchange of eligible land</header><subsection id="H789F0985D9ED4FCCA18AA2E09720B46A"><enum>(a)</enum><header>Authorization of conveyance</header><text>Notwithstanding sections 202, 203 (other than subsection (b) of that section), 206 (other than subsections (d) and (f) of that section), and 209 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>, 1713, 1716, 1719), as soon as practicable after the date of enactment of this Act, the Secretary, in accordance with this Act and any other applicable law and subject to valid existing rights, shall conduct sales or exchanges of the eligible land as depicted on the Map. </text></subsection><subsection id="H02AA9DF03DC947B0909862A6F76528E1"><enum>(b)</enum><header>Joint selection required</header><text>After providing public notice, the Secretary and the County shall jointly select parcels of eligible land to be offered for sale or exchange under subsection (a).</text></subsection><subsection id="H7C8FB58E0E7C4E4BA4505041A8DECC42"><enum>(c)</enum><header>Method of sale</header><text>A sale of eligible land under subsection (a) shall be—</text><paragraph id="H34633229828F469B9C82A31D71ADB72D"><enum>(1)</enum><text>consistent with subsections (d) and (f) of section 203 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1713">43 U.S.C. 1713</external-xref>);</text></paragraph><paragraph id="HDDA1A1761978499AA08FDA623B1F1CCA"><enum>(2)</enum><text>conducted through a competitive bidding process, under which adjoining landowners are offered the first option, unless the Secretary determines there are suitable and qualified buyers that are not adjoining landowners; and</text></paragraph><paragraph id="H9F29DD39048E4F89AA4038BA613F5287"><enum>(3)</enum><text>for not less than fair market value, based on an appraisal in accordance with the Uniform Standards of Professional Appraisal Practice and this Act.</text></paragraph></subsection><subsection id="H75DFB0654C3040B5AAE493B2FBA27E3F"><enum>(d)</enum><header>Land exchanges</header><paragraph id="HC6DD71A069CF41329C59107CA074BAB4"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act and subject to the joint selection requirements under subsection (b), the Secretary shall offer to exchange all eligible land under this section for private land.</text></paragraph><paragraph id="id009596aa98e548659fe8b95e53613cba"><enum>(2)</enum><header>Equal value exchange</header><subparagraph id="id5a510c4f7f3d4018b6af69140d4c1079"><enum>(A)</enum><header>In general</header><text>The value of the eligible land and private land to be exchanged under paragraph (1)—</text><clause id="idc54607a36a324083ab0a56e49b12a86f"><enum>(i)</enum><text>shall be equal; or</text></clause><clause id="id7cf17ae6ab094ba6bcb41d48b7c2ad1f"><enum>(ii)</enum><text>shall be made equal in accordance with subparagraph (B).</text></clause></subparagraph><subparagraph id="idf2e039f7c26d4ca68e9c51ce07df1092"><enum>(B)</enum><header>Equalization</header><clause id="id1c6f03ae2ce2434f8d93f8b658e5a239"><enum>(i)</enum><header>Surplus of eligible land</header><text>With respect to the eligible land and private land to be exchanged under paragraph (1), if the value of the eligible land exceeds the value of the private land, the value of the eligible land and the private land shall be equalized by—</text><subclause id="idb7bc76f815dc4a878b717c0deda83245"><enum>(I)</enum><text>the owner of the private land making a cash equalization payment to the Secretary;</text></subclause><subclause id="idbde87a5f1eec4e589eb090e1e79393b3"><enum>(II)</enum><text>adding private land to the exchange; or</text></subclause><subclause id="id9a3ad2c9e3d34bc8997d364d8c78e909"><enum>(III)</enum><text>removing eligible land from the exchange.</text></subclause></clause><clause id="idae296def143845119c1c8f889eb2408b"><enum>(ii)</enum><header>Surplus of private land</header><text>With respect to the eligible land and private land to be exchanged under paragraph (1), if the value of the private land exceeds the value of the eligible land, the value of the private land and the eligible land shall be equalized by—</text><subclause id="idfffaeb9ed7a042bf88be559e77318bf2"><enum>(I)</enum><text>the Secretary making a cash equalization payment to the owner of the private land, in accordance with section 206(b) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716(b)</external-xref>);</text></subclause><subclause id="id4b6696acca8c49b580d8e34a4b3923b9"><enum>(II)</enum><text>adding eligible land to the exchange; or</text></subclause><subclause id="id4aece3b004844226abe876754407b5cb"><enum>(III)</enum><text>removing private land from the exchange.</text></subclause></clause></subparagraph></paragraph><paragraph id="H0A7AACB23705463BB147BD85CEE81D29"><enum>(3)</enum><header>Adjacent land</header><text>To the extent practicable, the Secretary shall seek to enter into agreements with one or more owners of private land adjacent to the eligible land for the exchange of the private land for the eligible land, if the Secretary determines that the exchange would consolidate Federal land ownership and facilitate improved Federal land management.</text></paragraph><paragraph id="HF1B25FC1C8A140EEA233B9D429AFA8F7"><enum>(4)</enum><header>Priority land exchanges</header><text>In acquiring private land under this subsection, the Secretary shall give priority to the acquisition of private land in higher-value natural resource areas in the County.</text></paragraph></subsection><subsection id="H2E0B8CD73BDE497F86E8CCF91E3640DE"><enum>(e)</enum><header>Mass appraisals</header><paragraph id="H1AC3B9F616E6490FB341282A0477E454"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, and every 5 years thereafter, the Secretary shall—</text><subparagraph id="H34931A0EB68B416C87A22EEC0A54F576"><enum>(A)</enum><text>conduct a mass appraisal of eligible land to be sold or exchanged under this section;</text></subparagraph><subparagraph id="HA423EBD575844ECFBA4947CB8093BC50"><enum>(B)</enum><text>prepare an evaluation analysis for each land transaction under this section; and</text></subparagraph><subparagraph id="HB739978D1E6C48649C12BCA72295395B"><enum>(C)</enum><text>make available to the public the results of the mass appraisals conducted under subparagraph (A).</text></subparagraph></paragraph><paragraph id="HF793AEF2FA1A4F8F941F8CD4061FB213"><enum>(2)</enum><header>Use</header><text>The Secretary may use mass appraisals and evaluation analyses conducted under paragraph (1) to facilitate exchanges of eligible land for private land.</text></paragraph><paragraph id="id12d4d961e6fe4c8f90ed34f7efeb4044"><enum>(3)</enum><header>Applicable law</header><text>An appraisal under paragraph (1) shall be conducted in accordance with nationally recognized appraisal standards, including, as appropriate—</text><subparagraph id="ida71b8fe1755c4bd484202baba9346001"><enum>(A)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisitions; and</text></subparagraph><subparagraph id="idda121f00a7004b50816b8e18d8f4e1fa"><enum>(B)</enum><text>the Uniform Standards of Professional Appraisal Practice.</text></subparagraph></paragraph><paragraph id="id96ec4404a03b4f88b886df81cb05ae15"><enum>(4)</enum><header>Duration</header><text>An appraisal conducted under paragraph (1) shall remain valid for 5 years after the date on which the appraisal is approved by the Secretary.</text></paragraph></subsection><subsection id="H15575F0D4D4245468AD0B1CE892A114F"><enum>(f)</enum><header>Deadline for sale or exchange; exclusions</header><paragraph id="HA5C907DABA074ACD9C21BB1BD8BE5260"><enum>(1)</enum><header>Deadline</header><text>Not later than 90 days after the date on which the eligible land is jointly selected under subsection (b), the Secretary shall offer for sale or exchange the parcels of eligible land jointly selected under that subsection.</text></paragraph><paragraph id="H33EC03886A974F17A1E4F877858197D8"><enum>(2)</enum><header>Postponement or exclusion</header><text>The Secretary or the County may postpone, or exclude from, a sale or exchange of all or a portion of the eligible land jointly selected under subsection (b) for emergency ecological or safety reasons.</text></paragraph></subsection><subsection id="H05FB67FBE4144464B51950AF2A542A0E"><enum>(g)</enum><header>Withdrawal</header><paragraph id="H6AEAD0C39BCF49E486F78FC6D46A832F"><enum>(1)</enum><header>In general</header><text>Subject to valid existing rights and mining claims, millsites, and tunnel sites, effective on the date on which a parcel of eligible land is jointly selected under subsection (b) for sale or exchange, that parcel is withdrawn from—</text><subparagraph id="HE9D35906FD38498E850BC9DA745C634F"><enum>(A)</enum><text>all forms of entry and appropriation under the public land laws, including the mining laws;</text></subparagraph><subparagraph id="HA2D2DF7AF1C64DC3989354E8316E4D43"><enum>(B)</enum><text>location, entry, and patent under the mining laws; and</text></subparagraph><subparagraph id="H10C9FDCFB25844D0BD3C01E139B9D150"><enum>(C)</enum><text>operation of the mineral leasing and geothermal leasing laws.</text></subparagraph></paragraph><paragraph id="H65F780B178B64846A8907071CC1160EA"><enum>(2)</enum><header>Termination</header><text>The withdrawal of a parcel of eligible land under paragraph (1) shall terminate—</text><subparagraph id="H8D76C935EA804519A207CEF11F6D5584"><enum>(A)</enum><text>on the date of sale or, in the case of exchange, the conveyance of title of the parcel of eligible land under this section; or</text></subparagraph><subparagraph id="H6198853AD61F4D96B43FFDD6208548D0"><enum>(B)</enum><text>with respect to any parcel of eligible land selected for sale or exchange under subsection (b) that is not sold or exchanged, not later than 2 years after the date on which the parcel was offered for sale or exchange under this section.</text></subparagraph></paragraph></subsection><subsection id="ida9112880a8bd4b0fb505957a1da4e927"><enum>(h)</enum><header>Maps and legal descriptions</header><paragraph id="idcc1f9b82626143d7a900afd826976bcb"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall finalize maps and legal descriptions of the parcels of eligible land to be sold or exchanged under this section. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcb42abf11f5846549d83e06665ab3f38"><enum>(2)</enum><header>Availability</header><text display-inline="yes-display-inline">The maps and legal descriptions finalized under paragraph (1) shall be on file and available for public inspection in appropriate offices of the Bureau of Land Management.</text></paragraph><paragraph id="idc5c7e34b6b1842629f131ff9017cf744"><enum>(3)</enum><header>Corrections</header><text>The Secretary and the County may, by mutual agreement—</text><subparagraph id="id63e623216e784786b1d5bfc41a48bec1"><enum>(A)</enum><text>make minor boundary adjustments to the eligible land to be sold or exchanged under this section; and</text></subparagraph><subparagraph id="id10ff1060b6bf4b48bdb249da260ac985"><enum>(B)</enum><text>correct any minor errors, including clerical and typographical errors, on the Map or any maps, acreage estimates, or legal descriptions finalized under this subsection.</text></subparagraph></paragraph></subsection></section><section id="H5E8C58943EA9422BB00C238C84449338"><enum>103.</enum><header>Sale of encumbered land</header><subsection id="H0B36F157610148518AE05AAE77246929"><enum>(a)</enum><header>Authorization of conveyance</header><text>Notwithstanding sections 202, 203, 206, and 209 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>, 1713, 1716, 1719), not later than 90 days after the date of enactment of this Act and subject to valid existing rights held by third parties, the Secretary shall offer to convey to qualified entities, for fair market value, the remaining right, title, and interest of the United States, in and to the encumbered land as depicted on the Map. </text></subsection><subsection id="H01B985AFC1FD414A94A0DA84CE1AA7E6"><enum>(b)</enum><header>Costs of sales to qualified entities</header><text>As a condition of each conveyance of encumbered land under this section, the qualified entity shall pay all costs related to the conveyance of the encumbered land, including the costs of surveys and other administrative costs associated with the conveyance.</text></subsection><subsection id="HDB097F9D5574465BB87F381E74C8A970"><enum>(c)</enum><header>Offer To convey</header><paragraph id="H4B83BCDBE3154B3D8753D7BC30FACB98"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date on which the Secretary receives a fair market offer from a qualified entity for the conveyance of encumbered land, the Secretary shall accept the fair market value offer.</text></paragraph><paragraph id="HF463685418094A3BA2720AE4929D6E04"><enum>(2)</enum><header>Appraisal</header><text>Fair market value of the interest of the United States in and to encumbered land shall be determined by an appraisal conducted in accordance with the Uniform Standards of Professional Appraisal Practice.</text></paragraph></subsection><subsection id="H09C587B819CE4C38BC3C15B16CEA2CED"><enum>(d)</enum><header>Conveyance</header><text>Not later than 180 days after the date of acceptance by the Secretary of an offer from a qualified entity under subsection (c)(1) and completion of a sale for all or part of the applicable portion of encumbered land to the qualified entity, the Secretary, by delivery of an appropriate deed, patent, or other valid instrument of conveyance, shall convey to the qualified entity all remaining right, title, and interest of the United States in and to the applicable portion of the encumbered land.</text></subsection><subsection id="HDE04997D9CA0457CA636C3FB17E27048"><enum>(e)</enum><header>Merger</header><text>Subject to valid existing rights held by third parties, on delivery of the instrument of conveyance to the qualified entity under subsection (d), the prior interests in the locatable minerals and the right to use the surface for mineral purposes held by the qualified entity under a mining claim, millsite, tunnel site, or any other Federal land use authorization applicable to the encumbered land included in the instrument of conveyance, shall merge with all right, title, and interest conveyed to the qualified entity by the United States under this section to ensure that the qualified entity receives fee simple title to the purchased encumbered land.</text></subsection></section><section id="H5879041D271D4EDD92294775D46CEA13"><enum>104.</enum><header>Disposition of proceeds</header><subsection id="HA59B8E00AD6B43798A6B8032D3F1760E"><enum>(a)</enum><header>Disposition of proceeds</header><text>Of the proceeds from the sale of land under this title—</text><paragraph id="HA811531AC8F245709F3F7A50A972BF50"><enum>(1)</enum><text>5 percent shall be disbursed to the State for use in the general education program of the State;</text></paragraph><paragraph id="H1607CAB4D1FB433D8C2CE8D164331A80"><enum>(2)</enum><text>10 percent shall be disbursed to the County for use as determined through normal County budgeting procedures; and</text></paragraph><paragraph id="H1D82F58D1893419287D0233EB762C417"><enum>(3)</enum><text>the remainder shall be deposited in a special account in the Treasury of the United States, to be known as the <quote>Pershing County Special Account</quote>, which shall be available to the Secretary, in consultation with the County, for—</text><subparagraph id="H4373CC5C1B724A559C5C8B64D88B6D5E"><enum>(A)</enum><text>the acquisition of land from willing sellers (including interests in land) in the County—</text><clause id="HBDBD6E6B020B4EB7856D40CFBEA4120D"><enum>(i)</enum><text>within a wilderness area;</text></clause><clause id="H41307B4B553540B9ABE66BAD6FABFA5B"><enum>(ii)</enum><text>that protects other environmentally significant land;</text></clause><clause id="H84F0E966C55545D4B3A7364E92AF568D"><enum>(iii)</enum><text>that secures public access to Federal land for hunting, fishing, and other recreational purposes; or</text></clause><clause id="H623A37C74F0843068FBF90C807ED4C1D"><enum>(iv)</enum><text>that improves management of Federal land within the area identified as <quote>Checkerboard Lands Resolution Area</quote> on the Map; and</text></clause></subparagraph><subparagraph id="H705DACEDA5784E71AD80CCF7DD1EDA8E"><enum>(B)</enum><text>the reimbursement of costs incurred by the Secretary in preparing for the sale or exchange of land under this title.</text></subparagraph></paragraph></subsection><subsection id="H27FCEC898DF04475BBE482DABEC2712A"><enum>(b)</enum><header>Investment of special account</header><text>Any amounts deposited in the special account established under subsection (a)(3)—</text><paragraph id="HA0D999C050754C26841B06DB9FE57C76"><enum>(1)</enum><text>shall earn interest in an amount determined by the Secretary of the Treasury, based on the current average market yield on outstanding marketable obligations of the United States of comparable maturities; and</text></paragraph><paragraph id="HBC89858082D241208341359161D293D3"><enum>(2)</enum><text>may be expended by the Secretary in accordance with this section.</text></paragraph></subsection><subsection id="H76752FAC51634CCAB68C8F40C71BD12A"><enum>(c)</enum><header>Reports</header><paragraph id="HD67257FAB62C47DF97C50BE1F6C3FEF8"><enum>(1)</enum><header>In general</header><text>Not later than September 30 of the fifth fiscal year after the date of enactment of this Act, and every 5 fiscal years thereafter, the Secretary shall submit to the State, the County, and the appropriate congressional committees a report on the operation of the special account established under subsection (a)(3) for the preceding 5 fiscal years.</text></paragraph><paragraph id="H89F3001817F4458F88636C26CA34B36C"><enum>(2)</enum><header>Contents</header><text>Each report submitted under paragraph (1) shall include, for the fiscal year covered by the report—</text><subparagraph id="H5F87E3D9E17C44E4808A0289E1C24659"><enum>(A)</enum><text>a statement of the amounts deposited into the special account;</text></subparagraph><subparagraph id="H6AB6F45FC53A4096B3EC10FA9052B093"><enum>(B)</enum><text>a description of the expenditures made from the special account for the fiscal year, including the purpose of the expenditures;</text></subparagraph><subparagraph id="H99F390E89EC34D03A69CAA5919BAA42B"><enum>(C)</enum><text>recommendations for additional authorities to fulfill the purpose of the special account; and</text></subparagraph><subparagraph id="H1B30866A50224BAAB6CE56EF42CE2E8D"><enum>(D)</enum><text>a statement of the balance remaining in the special account at the end of the fiscal year.</text></subparagraph></paragraph></subsection></section></title><title id="H2D66E80983F74E7F81BA20DF16FB2054"><enum>II</enum><header>Wilderness Areas</header><section id="HF6A71338856240ACB5CA100EB24744FD"><enum>201.</enum><header>Additions to the National Wilderness Preservation System</header><subsection id="H59027010E1284293B81F4CD61CB915AA"><enum>(a)</enum><header>Additions</header><text>In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the following parcels of Federal land in the State are designated as wilderness and as components of the National Wilderness Preservation System:</text><paragraph id="H58F3101DCE4D49D18B0B5C95234B1F9E"><enum>(1)</enum><header>Cain Mountain Wilderness addition</header><text display-inline="yes-display-inline">Certain Federal land managed by the Bureau of Land Management, comprising approximately 12,339 acres, as generally depicted on the map entitled <quote>Proposed Cain Mountain Wilderness</quote> and dated July 8, 2024, which is incorporated in, and considered to be a part of, the Cain Mountain Wilderness designated by sections 2905(b)(1)(C) and 2932(a)(1) of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/263">Public Law 117–263</external-xref>; 136 Stat. 3040; 136 Stat. 3048). </text></paragraph><paragraph id="H4F1E5C7D4A2546B09414F99E66F03478"><enum>(2)</enum><header>Bluewing Wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 24,900 acres, as generally depicted on the map entitled <quote>Proposed Bluewing Wilderness</quote> and dated July 8, 2024, which shall be known as the <quote>Bluewing Wilderness</quote> . </text></paragraph><paragraph id="HC501A43CDC2F482CABB43DD985E7AB76"><enum>(3)</enum><header>Selenite Peak Wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 22,822 acres, as generally depicted on the map entitled <quote>Proposed Selenite Peak Wilderness</quote> and dated July 8, 2024, which shall be known as the <quote>Selenite Peak Wilderness</quote> . </text></paragraph><paragraph id="HD01C9868E4ED4123955292E548ADC09C"><enum>(4)</enum><header>Mount Limbo Wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 11,855 acres, as generally depicted on the map entitled <quote>Proposed Mt. Limbo Wilderness</quote> and dated July 8, 2024, which shall be known as the <quote>Mount Limbo Wilderness</quote> . </text></paragraph><paragraph id="H3EF625DCFECB4C51B0245E7A3EA97EA4"><enum>(5)</enum><header>North Sahwave Wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 13,875 acres, as generally depicted on the map entitled <quote>Proposed North Sahwave Wilderness</quote> and dated July 8, 2024, which shall be known as the <quote>North Sahwave Wilderness</quote>.</text></paragraph><paragraph id="HD0E23F3DAC954368AFF5C12E8FA0CBE1"><enum>(6)</enum><header>Grandfathers Wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 35,339 acres, as generally depicted on the map entitled <quote>Proposed Grandfathers Wilderness</quote> and dated July 8, 2024, which shall be known as the <quote>Grandfathers Wilderness</quote>.</text></paragraph><paragraph id="HFDC0F46D92534983BACC61C45220895E"><enum>(7)</enum><header>Fencemaker Wilderness</header><text>Certain Federal land managed by the Bureau of Land Management, comprising approximately 14,942 acres, as generally depicted on the map entitled <quote>Proposed Fencemaker Wilderness</quote> and dated July 8, 2024, which shall be known as the <quote>Fencemaker Wilderness</quote>.</text></paragraph></subsection><subsection id="H693934CB65C74C049DE14772660FE434"><enum>(b)</enum><header>Boundary</header><text>The boundary of any portion of a wilderness area that is bordered by a road shall be 100 feet from the centerline of the road.</text></subsection><subsection id="H1BF0DE9758784D9789B547F9A6E42F55"><enum>(c)</enum><header>Map and legal description</header><paragraph id="H64D1D0111992427BAEB2EA1E46C17D00"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall file a map and legal description of each wilderness area.</text></paragraph><paragraph id="H23BE2C80E2A5442B9C9D481F3B5F2688"><enum>(2)</enum><header>Effect</header><text>Each map and legal description prepared under paragraph (1) shall have the same force and effect as if included in this Act, except that the Secretary may correct clerical and typographical errors in the map or legal description.</text></paragraph><paragraph id="H255DF0D5ACEF4922A7562CA5A07893DB"><enum>(3)</enum><header>Availability</header><text>Each map and legal description prepared under paragraph (1) shall be on file and available for public inspection in the appropriate offices of the Bureau of Land Management.</text></paragraph><paragraph id="H6C3638375AD14631B7E27B24974A339A"><enum>(4)</enum><header>Withdrawal</header><text>Subject to valid existing rights, the wilderness areas designated by subsection (a) are withdrawn from—</text><subparagraph id="H8623C3D8A3924F6D8A00C1F7AC950CAB"><enum>(A)</enum><text>all forms of entry, appropriation, and disposal under the public land laws;</text></subparagraph><subparagraph id="H6A21747E988D436EB1688DF220FF4FCD"><enum>(B)</enum><text>location, entry, and patent under the mining laws; and</text></subparagraph><subparagraph id="H561CF439FDF84C138DF510AF8C1DB12C"><enum>(C)</enum><text>disposition under all laws relating to mineral and geothermal leasing or mineral materials.</text></subparagraph></paragraph></subsection></section><section id="HA740C97D5D734099BE7B4537521681DD"><enum>202.</enum><header>Administration</header><subsection id="H01DA79F520AC44AFBAED2814AEB4F1D6"><enum>(a)</enum><header>Management</header><text>Subject to valid existing rights, the wilderness areas shall be administered by the Secretary in accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except that with respect to the wilderness areas—</text><paragraph id="H4687165089B74ABAACDFABAAFEAE3C5A"><enum>(1)</enum><text>any reference in that Act to the effective date shall be considered to be a reference to the date of enactment of this Act; and</text></paragraph><paragraph id="HFB7B5181573A405ABA20202E15CE85E3"><enum>(2)</enum><text>any reference in that Act to the Secretary of Agriculture shall be considered to be a reference to the Secretary.</text></paragraph></subsection><subsection id="H0C1392485F2F43809C7D4A0595E3328A"><enum>(b)</enum><header>Livestock</header><text>The grazing of livestock in the wilderness areas, if established before the date of enactment of this Act, shall be allowed to continue, subject to such reasonable regulations, policies, and practices as the Secretary considers to be necessary in accordance with—</text><paragraph id="H1C91F7A29DB041B5A155A2FD8CCFEA74"><enum>(1)</enum><text>section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>); and</text></paragraph><paragraph id="HB201F956B43D48ACAAF424247E0B9B67"><enum>(2)</enum><text>the guidelines set forth in Appendix A of the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 2570 of the 101st Congress (House Report 101–405).</text></paragraph></subsection><subsection id="H6B5953AC73514A0BB0BB4E62C8F5D5CF"><enum>(c)</enum><header>Incorporation of acquired land and interests</header><text>Any land or interest in land within the boundary of a wilderness area that is acquired by the United States after the date of enactment of this Act shall be added to and administered as part of the wilderness area.</text></subsection><subsection id="H54E54895451B49DB9BB44A65C42AD099"><enum>(d)</enum><header>Adjacent management</header><paragraph id="H32AD44F9A0EE4EAE97B2D6EC9A310A56"><enum>(1)</enum><header>In general</header><text>Congress does not intend for the designation of the wilderness areas to create protective perimeters or buffer zones around the wilderness areas.</text></paragraph><paragraph id="H3DAC83062E83447AB63CABD37824B458"><enum>(2)</enum><header>Nonwilderness activities</header><text>The fact that nonwilderness activities or uses can be seen or heard from areas within a wilderness area shall not preclude the conduct of those activities or uses outside the boundary of the wilderness area.</text></paragraph></subsection><subsection id="HCB7936DF37D24D6499BD839B3C5E69F3"><enum>(e)</enum><header>Military overflights</header><text>Nothing in this title restricts or precludes—</text><paragraph id="H1DDEB0FE13754FC1BCCE3928A6229955"><enum>(1)</enum><text>low-level overflights of military aircraft over the wilderness areas, including military overflights that can be seen or heard within the wilderness areas;</text></paragraph><paragraph id="H44FBB57E21C34E9C878E2F2313CD58A7"><enum>(2)</enum><text>flight testing and evaluation; or</text></paragraph><paragraph id="HA291FF1A4BB74E5A93CA8A96F634A8AA"><enum>(3)</enum><text>the designation or creation of new units of special use airspace, or the establishment of military flight training routes, over the wilderness areas.</text></paragraph></subsection><subsection id="H4BAED6DF554748ECB1DB064D70C9711C"><enum>(f)</enum><header>Wildfire, insect, and disease management</header><text>In accordance with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>), the Secretary may take such measures in the wilderness areas as are necessary for the control of fire, insects, and diseases (including, as the Secretary determines to be appropriate, the coordination of the activities with a State or local agency).</text></subsection><subsection id="H989B75357A324C71AEBE2B3D9A729043"><enum>(g)</enum><header>Climatological data collection</header><text>In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>) and subject to such terms and conditions as the Secretary may prescribe, the Secretary may authorize the installation and maintenance of hydrologic, meteorologic, or climatological data collection devices in the wilderness areas if the Secretary determines that the facilities and access to the facilities are essential to flood warning, flood control, or water reservoir operation activities.</text></subsection><subsection id="H38504A82BAAA4457807FCAA167045636"><enum>(h)</enum><header>Water rights</header><paragraph id="H55DE47FE170B4C329CDE76330D77A4F0"><enum>(1)</enum><header>Findings</header><text>Congress finds that—</text><subparagraph id="H0F837D5A3E694E0CA9F75ED6ACA63B39"><enum>(A)</enum><text>the wilderness areas are located—</text><clause id="H21BFA93711EF487AAECBBFDDDCDF9AF4"><enum>(i)</enum><text>in the semiarid region of the Great Basin; and</text></clause><clause id="H35F2535D0A3444A7B6367F503909713A"><enum>(ii)</enum><text>at the headwaters of the streams and rivers on land with respect to which there are few, if any—</text><subclause id="H3BB5C9786A25492E8FEB2D8B8C5A5402"><enum>(I)</enum><text>actual or proposed water resource facilities located upstream; and</text></subclause><subclause id="H21065BAD8F6A49EF99B1A4922A1A04CB"><enum>(II)</enum><text>opportunities for diversion, storage, or other uses of water occurring outside the land that would adversely affect the wilderness values of the land;</text></subclause></clause></subparagraph><subparagraph id="HFCCFADF93C6042FC97DF7FCC2EF3FE6F"><enum>(B)</enum><text>the wilderness areas are generally not suitable for use or development of new water resource facilities; and</text></subparagraph><subparagraph id="HD26C77C847B94775916B824BDC272BC7"><enum>(C)</enum><text>because of the unique nature of the wilderness areas, it is possible to provide for proper management and protection of the wilderness and other values of land in ways different from those used in other laws.</text></subparagraph></paragraph><paragraph id="H5BDE0116E57A4E8FA19E9E07EA9A59B6"><enum>(2)</enum><header>Purpose</header><text>The purpose of this section is to protect the wilderness values of the wilderness areas by means other than a federally reserved water right.</text></paragraph><paragraph id="H0AF060F8CB6B42DFAB2AE4F51722C35A"><enum>(3)</enum><header>Statutory construction</header><text>Nothing in this title—</text><subparagraph id="HF7590B11221C439C88F327BF148DDB16"><enum>(A)</enum><text>constitutes an express or implied reservation by the United States of any water or water rights with respect to the wilderness areas;</text></subparagraph><subparagraph id="H50446AC15B0043CABE96F55FDCA68819"><enum>(B)</enum><text>affects any water rights in the State (including any water rights held by the United States) in existence on the date of enactment of this Act;</text></subparagraph><subparagraph id="HD4BAE33053604842B39E086768053E32"><enum>(C)</enum><text>establishes a precedent with regard to any future wilderness designations;</text></subparagraph><subparagraph id="H354F6D8309A74A138786119DF49ED627"><enum>(D)</enum><text>affects the interpretation of, or any designation made under, any other Act; or</text></subparagraph><subparagraph id="HF8DB01799DD6449F9438D7ACBF7CE86E"><enum>(E)</enum><text>limits, alters, modifies, or amends any interstate compact or equitable apportionment decree that apportions water among and between the State and other States.</text></subparagraph></paragraph><paragraph id="HBD52786140414D63B98A4050FD09BCC8"><enum>(4)</enum><header>Nevada water law</header><text>The Secretary shall follow the procedural and substantive requirements of State law in order to obtain and hold any water rights not in existence on the date of enactment of this Act with respect to the wilderness areas.</text></paragraph><paragraph id="H623D52C776C64EC1B8210ADF2E155293"><enum>(5)</enum><header>New projects</header><subparagraph id="H4AB523B0C2924FAB92D4227D880AAF95"><enum>(A)</enum><header>Definition of water resource facility</header><clause id="HA98E9FD5B8AB431B8F3998BDA4FAE62C"><enum>(i)</enum><header>In general</header><text>In this paragraph, the term <term>water resource facility</term> means irrigation and pumping facilities, reservoirs, water conservation works, aqueducts, canals, ditches, pipelines, wells, hydropower projects, transmission and other ancillary facilities, and other water diversion, storage, and carriage structures.</text></clause><clause id="H01A5A282F7074A01B9A8690771F71E73"><enum>(ii)</enum><header>Exclusion</header><text>In this paragraph, the term <term>water resource facility</term> does not include wildlife guzzlers.</text></clause></subparagraph><subparagraph id="H7CDD8F3F2D3F4F868B6FB9D4EA049876"><enum>(B)</enum><header>Restriction on new water resource facilities</header><text>Except as otherwise provided in this Act, on and after the date of enactment of this Act, neither the President nor any other officer, employee, or agent of the United States shall fund, assist, authorize, or issue a license or permit for the development of any new water resource facility within the wilderness areas.</text></subparagraph></paragraph></subsection><subsection id="HB8A382A94ED04EE1A8C3D9758F682D05"><enum>(i)</enum><header>Temporary telecommunications device</header><paragraph id="H6CDC3D1C8AD545A5BCC05F18751E8621"><enum>(1)</enum><header>In general</header><text>Nothing in this title prevents the placement of a temporary telecommunications device for law enforcement or agency administrative purposes in the Selenite Peak Wilderness in accordance with paragraph (2).</text></paragraph><paragraph id="H50CEC64CEF79420F82B11D27338A4833"><enum>(2)</enum><header>Additional requirements</header><text>Any temporary telecommunications device authorized by the Secretary under paragraph (1) shall—</text><subparagraph id="HCA721BB4721B4244A173854FC987AB40"><enum>(A)</enum><text>be carried out in accordance with—</text><clause id="HD1CD844A6F324C92B057E7204F54ED68"><enum>(i)</enum><text>the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>); and</text></clause><clause id="H70C85F3532EB451A95D1AC3951066AEC"><enum>(ii)</enum><text>all other applicable laws (including regulations);</text></clause></subparagraph><subparagraph id="H629A2DC6179C4B1581D6B90D9710B327"><enum>(B)</enum><text>to the maximum practicable, be located in such a manner as to minimize impacts on the recreational and other wilderness values of the area; and</text></subparagraph><subparagraph id="HCFB397B02D5D4B8D97037260F6B986E8"><enum>(C)</enum><text>be for a period of not longer than 7 years.</text></subparagraph></paragraph></subsection></section><section id="HC713053733E24E49A169F585CF9E48A2"><enum>203.</enum><header>Wildlife management</header><subsection id="H679A1F35648D44CAA1F8F79A725877FE"><enum>(a)</enum><header>In general</header><text>In accordance with section 4(d)(7) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(7)</external-xref>), nothing in this title affects or diminishes the jurisdiction of the State with respect to fish and wildlife management, including the regulation of hunting, fishing, and trapping, in the wilderness areas.</text></subsection><subsection id="HB83EB31D90BA46208F968E00206AB92E"><enum>(b)</enum><header>Management activities</header><text>In furtherance of the purposes and principles of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the Secretary may conduct any management activities in the wilderness areas that are necessary to maintain or restore fish and wildlife populations and the habitats to support the populations, if the activities are carried out—</text><paragraph id="HEAABD10E9E59417DAB6728D43A905C20"><enum>(1)</enum><text>consistent with relevant wilderness management plans; and</text></paragraph><paragraph id="H010379C5DAEC4B6F892A17F35CAD9CFE"><enum>(2)</enum><text>in accordance with—</text><subparagraph id="HC6AB813F680F4F0C8A3581767FF394E6"><enum>(A)</enum><text>the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>); and</text></subparagraph><subparagraph id="HDF70CFA55D154384991D0F27B2E458EA"><enum>(B)</enum><text>appropriate policies, such as those set forth in Appendix B of the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 2570 of the 101st Congress (House Report 101–405), including noxious weed treatment and the occasional and temporary use of motorized vehicles if the use, as determined by the Secretary, would promote healthy, viable, and more naturally distributed wildlife populations that would enhance wilderness values with the minimal impact necessary to reasonably accomplish those tasks.</text></subparagraph></paragraph></subsection><subsection id="H0041B2D2DD7444EDAAF3FB110258484C"><enum>(c)</enum><header>Existing activities</header><text>In accordance with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>) and in accordance with appropriate policies such as those set forth in Appendix B of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 2570 of the 101st Congress (House Report 101–405), the State may continue to use aircraft, including helicopters, to survey, capture, transplant, monitor, and provide water for wildlife populations.</text></subsection><subsection id="HDC92DE28CDCC4732924A922386F23256"><enum>(d)</enum><header>Wildlife water development projects</header><text>Subject to subsection (f), the Secretary shall authorize structures and facilities, including existing structures and facilities, for wildlife water development projects, including guzzlers, in the wilderness areas if—</text><paragraph id="H04EA6DACC8484C3DA889B0374CE1098C"><enum>(1)</enum><text>the structures and facilities will, as determined by the Secretary, enhance wilderness values by promoting healthy, viable, and more naturally distributed wildlife populations; and</text></paragraph><paragraph id="HF25516E632364673B062D1EC774D1DAF"><enum>(2)</enum><text>the visual impacts of the structures and facilities on the wilderness areas can reasonably be minimized.</text></paragraph></subsection><subsection id="H208FD198D96441E8841123A8BE93B9E0"><enum>(e)</enum><header>Hunting, fishing, and trapping</header><paragraph id="H8A9F40E5D71F4FA390D10A2CF6B6C94D"><enum>(1)</enum><header>In general</header><text>The Secretary may designate areas in which, and establish periods during which, for reasons of public safety, administration, or compliance with applicable laws, no hunting, fishing, or trapping will be permitted in the wilderness areas.</text></paragraph><paragraph id="H93DF509F0F4C4C87BABB13C2ECCFE53D"><enum>(2)</enum><header>Consultation</header><text>Except in emergencies, the Secretary shall consult with the appropriate State agency and notify the public before taking any action under paragraph (1).</text></paragraph></subsection><subsection id="H7954E479A82148568208D28DB068B771" commented="no"><enum>(f)</enum><header>Cooperative agreement</header><text>The State, including a designee of the State, may conduct wildlife management activities in the wilderness areas—</text><paragraph id="idf12e98a7b520416fb55f701e29f1b3e1" commented="no"><enum>(1)</enum><text>in accordance with the terms and conditions specified in the cooperative agreement between the Secretary and the State entitled <quote>Wildlife Management in Nevada BLM Wilderness Areas</quote> and signed September 2024, including any amendments to the cooperative agreement agreed to by the Secretary and the State; and</text></paragraph><paragraph id="H3A308151519B4691A1B4DA0BA262F4BB" commented="no"><enum>(2)</enum><text>subject to all applicable laws (including regulations).</text></paragraph></subsection></section><section id="H1C9E4146B9614DA2A78132328332630D"><enum>204.</enum><header>Release of wilderness study areas</header><subsection id="HE97328EEB55345D1879C6DEC1B91AB03"><enum>(a)</enum><header>Finding</header><text display-inline="yes-display-inline">Congress finds that, for the purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), the approximately 48,600 acres of public land in the portions of the China Mountain, Mt. Limbo, Selenite Mountains, and Tobin Range wilderness study areas that have not been designated as wilderness by subsection (a) of section 201 and the portion of the Augusta Mountains wilderness study area within the County that has not been designated as wilderness by that subsection have been adequately studied for wilderness designation.</text></subsection><subsection id="HF8A34C59E8BD488D8E4BDABE0C301DD5"><enum>(b)</enum><header>Release</header><text>The public land described in subsection (a)—</text><paragraph id="H440A6CD0EDCF42AEBA558B968BB29BB2"><enum>(1)</enum><text>is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>); and</text></paragraph><paragraph id="H276713D4C33E42F9A835D9401DE66FB1"><enum>(2)</enum><text>shall be managed in accordance with the applicable land use plans adopted under section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>).</text></paragraph></subsection></section><section id="HF3E0DC35AA2144ECA851400B8AF16686"><enum>205.</enum><header>Native American cultural and religious uses</header><subsection id="H4046790502674B5AAF8685CECC814423"><enum>(a)</enum><header>In general</header><text>Nothing in this title alters or diminishes the treaty rights of any Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)).</text></subsection><subsection id="H03A65BA9A2264251BE0CFD2E46FCA338"><enum>(b)</enum><header>Cultural uses</header><text>Nothing in this title precludes the traditional collection of pine nuts in a wilderness area for personal, noncommercial use consistent with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>). </text></subsection></section></title><title id="id4b0164b4566147699c611a92f2cef57f"><enum>III</enum><header>Tribal Trust Land</header><section id="id1e40b1ded0624130b312e869cb56db58"><enum>301.</enum><header>Transfer of land to be held in trust for the Lovelock Paiute Tribe</header><subsection id="id7af7cc6127ed462f9caaa74b369882dd"><enum>(a)</enum><header>In general</header><text>Subject to valid existing rights, all right, title, and interest of the United States in and to the land described in subsection (b) shall be—</text><paragraph id="idfe19e037a3674103a3ed64b3e0333d4a"><enum>(1)</enum><text>held in trust by the United States for the benefit of the Lovelock Paiute Tribe; and</text></paragraph><paragraph id="id43e1730523ca4194a4641148b637f55a"><enum>(2)</enum><text>part of the reservation of the Lovelock Paiute Tribe.</text></paragraph></subsection><subsection id="id17058d47c02f45a987970c5b2ace719c"><enum>(b)</enum><header>Description of land</header><text>The land referred to in subsection (a) is the approximately 10 acres of land administered by the Bureau of Land Management in the State, as depicted on the map prepared under subsection (d).</text></subsection><subsection id="id3589b00c28bf463c8a7c38f7b68d09b3"><enum>(c)</enum><header>Survey</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall complete a survey to establish the boundaries of the land taken into trust under subsection (a).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id757e54b886e246e087c7dfa306afe2f9"><enum>(d)</enum><header>Map</header><text>As soon as practicable after the date on which the Secretary completes the survey under subsection (c), the Secretary shall prepare a map that depicts the boundaries of the land established under that subsection. </text></subsection><subsection id="id7020972243a6408484d9fb6128a51640"><enum>(e)</enum><header>Gaming prohibited</header><text>The land taken into trust under subsection (a) shall not be eligible, or considered to have been taken into trust, for class II gaming or class III gaming (as those terms are defined in section 4 of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2703">25 U.S.C. 2703</external-xref>)). </text></subsection></section></title></legis-body></bill>
