which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Homeland Security to negotiate with the Government of Canada regarding an agreement for integrated cross border aerial law enforcement operations, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id4fa7fb8c-ae45-425f-a21b-02bb207c65bb" changed="not-changed"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cross Border Aerial Law Enforcement Operations Act</short-title></quote>.</text></section><section id="id772eeedc-a51f-4219-8cfd-093bc2a565fa" changed="not-changed"><enum>2.</enum><header>Integrated cross border aerial law enforcement operations program</header><subsection id="id569b7412-fdb2-4fd1-8345-e396473ae10e" changed="not-changed"><enum>(a)</enum><header>Authorization</header><text>If authorized pursuant to a bilateral agreement between the United States Government and the Government of Canada, the Secretary of Homeland Security may establish an integrated cross border aerial law enforcement program (referred to in this section as the <quote>Program</quote>) along the international border between the United States and Canada, which may be modeled off the Framework Agreement on Integrated Cross-Border Maritime Law Enforcement Operations Between the Government of the United States of America and the Government of Canada, done at Detroit May 26, 2009. </text></subsection><subsection id="id656f45d6-1f8c-4dd2-99a0-4c134a706b6c" changed="not-changed"><enum>(b)</enum><header>Program elements</header><paragraph commented="no" display-inline="no-display-inline" id="id0ba49a24-c495-4f28-a4a5-167e0f8a9309" changed="not-changed"><enum>(1)</enum><header>Participants</header><text display-inline="yes-display-inline">The Program may be staffed by approved law enforcement officers from—</text><subparagraph id="idbcb296f8-99d7-40f6-bccd-ad89d547faa3" changed="not-changed"><enum>(A)</enum><text>U.S. Customs and Border Protection;</text></subparagraph><subparagraph id="id53f89e69-1094-41d3-a1c5-279c649fd3da" changed="not-changed"><enum>(B)</enum><text>the United States Coast Guard;</text></subparagraph><subparagraph id="idc7389be1-66f0-49fd-a62c-3a781a0e6257" changed="not-changed"><enum>(C)</enum><text>Homeland Security Investigations;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id74d32f4edfa6444fb7a9a44d33136c46" changed="not-changed"><enum>(D)</enum><text display-inline="yes-display-inline">any other Federal law enforcement agency, as appropriate, designated by the Secretary of Homeland Security; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb2f7395eccc04ea4a8374f1ed2e01238" changed="not-changed"><enum>(E)</enum><text display-inline="yes-display-inline">appropriate law enforcement agencies of the Government of Canada.</text></subparagraph></paragraph><paragraph id="id3474178f-2f0c-4266-a6b4-9f77fcdad7ce" changed="not-changed"><enum>(2)</enum><header>Scope</header><text>The jurisdiction of the Program shall be limited to the territory located within 50 miles of either side of the international border between the United States and Canada unless—</text><subparagraph id="id0e2d0e78-95de-4d9a-821b-956e2930e564" changed="not-changed"><enum>(A)</enum><text>a situation within such territory requires an aircraft to leave from or return to an airport, heliport, or base of operations located outside such territory; or</text></subparagraph><subparagraph id="idb9112252-3769-4056-bc68-435b31e02502" changed="not-changed"><enum>(B)</enum><text>there are exigent circumstances relating to authorized Program activities, as defined in the underlying bilateral agreement, including an emergency on an aircraft or an emergency on the ground.</text></subparagraph></paragraph><paragraph id="idfe4ffbe8-9671-4f13-983d-4fddb4807223" changed="not-changed"><enum>(3)</enum><header>Civil rights</header><text>The Program shall ensure that the civil rights, civil liberties, and privacy of all individuals within the jurisdiction of the United States are guaranteed in accordance with Federal law. </text></paragraph><paragraph id="ide13f1db0a046489f981692e928ebb7b6" changed="not-changed"><enum>(4)</enum><header>Notification requirements</header><subparagraph commented="no" display-inline="no-display-inline" id="ide804a21709984f429d03c2be6d8108af" changed="not-changed"><enum>(A)</enum><header>Bilateral agreement</header><text display-inline="yes-display-inline">Not later than 30 days after receiving a copy of a bilateral agreement described in subsection (a), the Secretary of Homeland Security shall submit a signed copy of such agreement to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>, the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id934d4f5ed3424718a1ea010f7fa53efb" changed="not-changed"><enum>(B)</enum><header>Program elements and scope</header><text display-inline="yes-display-inline">Not later than 30 days after the implementation of the Program, the Secretary of Homeland Security shall submit a written description of the elements and scope of the Program to the congressional committees listed under subparagraph (A).</text></subparagraph></paragraph><paragraph id="id747ed79d6b224c7ca27b905ee344484d" changed="not-changed"><enum>(5)</enum><header>Privacy, civil rights, and civil liberties training</header><subparagraph commented="no" display-inline="no-display-inline" id="id91162ef9b74848cbbdfebe75866643cb" changed="not-changed"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Any agreement described in subsection (a) shall include specific provisions that—</text><clause commented="no" display-inline="no-display-inline" id="ide3aab4919516485ca40ee63517225dd7" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">are intended to protect the privacy and civil liberties of United States citizens; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id73c3ae2c9b1b48c79a961708315ef127" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">ensure that cross border aerial law enforcement operations are conducted in a manner that—</text><subclause commented="no" display-inline="no-display-inline" id="idf7deea966ff44396a828359db59675a0" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">respects individual rights; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5605236cc2db4b228262ba6811bf540a" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">complies with applicable United States laws.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6aa001b2fbd84a9eb0e102afb7bf7150" changed="not-changed"><enum>(B)</enum><header>Training</header><text display-inline="yes-display-inline">Any officer of the United States or of Canada, before participating in the Program, shall complete sufficient training to ensure they understand their responsibilities to protect the privacy, civil liberties, and civil rights of United States citizens.</text></subparagraph></paragraph></subsection><subsection id="id7653d2f3-48e9-491a-9ec5-9379b8ea2f12" changed="not-changed"><enum>(c)</enum><header>Communications</header><text>Each of the agencies referred to in subsection (b)(1) are authorized to establish necessary communication protocols for the safety of cross border aerial law enforcement operations. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id80735832-9844-4bed-b019-01c91db324f6" changed="not-changed"><enum>(d)</enum><header display-inline="yes-display-inline">Failure To finalize program report</header><text display-inline="yes-display-inline">If the Program is not established on or before the date that is 2 years after the date of the enactment of this Act, the Secretary of Homeland Security shall submit a report to the congressional committees referred to in subsection (b)(4)(A) that includes—</text><paragraph id="id861103b0-9667-4f71-a2de-eb7e18ffa53e" changed="not-changed"><enum>(1)</enum><text>a description of any unresolved issues that are preventing the establishment of the Program;</text></paragraph><paragraph id="idf0a0fd7f-cab3-41a3-bfdd-146016218559" changed="not-changed"><enum>(2)</enum><text>any actions that Congress could take to facilitate the establishment of such Program; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide1bff8b1d0434f248f8759f6ad51eef9" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">any potential concerns relating to civil rights, civil liberties, or privacy that have impacted the establishment of the Program; and</text></paragraph><paragraph id="idd313862f-79ef-4ae3-b305-32869041be50" changed="not-changed"><enum>(4)</enum><text>a recommendation regarding whether—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4f71e49e-6a70-4a3c-b1ff-ee47ce68a9a1" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary should continue trying to establish such Program; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideb4c2e7d-d568-4fce-ac96-71ad22f9c5f1" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">such Program is not needed.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idcf983bfa-20fb-4787-9d50-cf51a757d811" changed="not-changed"><enum>3.</enum><header>Unmanned aircraft system report</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Homeland Security shall submit an unclassified report, with a classified annex, if necessary, to the congressional committees referred to in section 2(b)(4)(A) that describes the use of unmanned aircraft systems (referred to in this section as <quote>UAS</quote>) along the northern international border of the United States, including—</text><paragraph id="id073a9d75-eb82-419c-af40-a8227831f467" changed="not-changed"><enum>(1)</enum><text>interagency coordination to mitigate incursions from unauthorized UAS;</text></paragraph><paragraph id="ide95407a3-2ea5-4d37-a1f4-302c588b7e5a" changed="not-changed"><enum>(2)</enum><text>any jurisdictional issues that would prevent the mitigation of unauthorized UAS;</text></paragraph><paragraph id="idad248522-2e8a-4996-9767-fd7ee7510cce" changed="not-changed"><enum>(3)</enum><text>the use of UAS by malign actors—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2da21ff3-aa54-4db9-b8ea-f17cea94efe7" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">to collect intelligence or surveil law enforcement operations;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9c1be722-727f-48e5-8a1e-c5ab144e705d" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">to move contraband, persons, or payloads across the international border; or</text></subparagraph><subparagraph id="id5690f52d-d423-4e3b-ba73-f56adceed988" changed="not-changed"><enum>(C)</enum><text>to conduct espionage;</text></subparagraph></paragraph><paragraph id="id6348b9da-3e7a-4d70-b3de-fda3d66494b0" changed="not-changed"><enum>(4)</enum><text>an assessment of the feasibility for joint, cross-border law enforcement operations involving UAS or counter-unmanned aircraft systems; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id03d2a640d4f441fe991d314539621d88" changed="not-changed"><enum>(5)</enum><text display-inline="yes-display-inline">the potential risks to civil rights, civil liberties, and privacy resulting from the Department of Homeland Security operating UAS and counter-unmanned aircraft systems along the northern border of the United States. </text></paragraph></section><section id="idb2b4b73812744905890e87531c42652b" changed="not-changed"><enum>4.</enum><header>No additional funds</header><text display-inline="no-display-inline">No additional funds are authorized to be appropriated for the purpose of carrying out this Act. </text></section></legis-body></bill>
