<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 1174</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250327">March 27, 2025</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To nullify certain regulations and notices of the Department of Housing and Urban Development, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H786E376D2BBD44EFBE3D4636CC80FD42"><section section-type="section-one" id="HF745B87E000944EBB41202EC4EDA4142"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Local Zoning Decisions Protection Act of 2025</short-title></quote>.</text></section><section id="H9D54A4A71F8E439AB83E5BDB7A346EF3"><enum>2.</enum><header>Nullification of rules and notices</header><subsection id="HFBD6A6CEBDE84BBA8C5D802A75FAF307"><enum>(a)</enum><header>Proposed rule</header><text display-inline="yes-display-inline">The proposed rule of the Department of Housing and Urban Development entitled <quote>Affirmatively Furthering Fair Housing</quote>, published in the Federal Register on February 9, 2023 (88 Fed. Reg. 8516; Docket No. FR–6250–P–01), and any successor rule that is substantially similar to such proposed rule shall have no force or effect.</text></subsection><subsection id="H29AFC37B8067416B9BBFF1DACBBE84FC"><enum>(b)</enum><header>Interim final rule</header><text>The interim final rule of the Department of Housing and Urban Development entitled <quote>Restoring Affirmatively Furthering Fair Housing Definitions and Certifications</quote>, published in the Federal Register on June 10, 2021 (86 Fed. Reg. 30779; Docket No. FR–6249–I–01), and any successor rule that is substantially similar to such interim final rule shall have no force or effect.</text></subsection><subsection id="HA1FA46F91A2144E29A5F904ECC9FFFCE"><enum>(c)</enum><header>Final rule</header><text display-inline="yes-display-inline">The final rule of the Department of Housing and Urban Development entitled <quote>Affirmatively Furthering Fair Housing</quote>, published in the Federal Register on July 16, 2015 (80 Fed. Reg. 42272; Docket No. FR–5173–F–04), and any successor rule that is substantially similar to such final rule shall have no force or effect.</text></subsection><subsection id="HFB0F4CD4F0DB419FA389B7C2C0E750B5"><enum>(d)</enum><header>Notice</header><text>The notice of the Department of Housing and Urban Development relating to the Affirmatively Furthering Fair Housing Assessment Tool, published in the Federal Register on December 31, 2015 (80 Fed. Reg. 81840; Docket No. FR–5173–N–07), and any successor notice or rule substantially similar to such notice shall have no force or effect.</text></subsection></section><section id="H4BD27ADB3F27458884FE648B8E636A22"><enum>3.</enum><header>Prohibition on use of Federal funds</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, no Federal funds may be used to design, build, maintain, utilize, or provide access to a Federal database of geospatial information on community racial disparities or disparities in access to affordable housing.</text></section><section id="HBFEA9CF1DFEE4B7D91928224CE9F3B3C"><enum>4.</enum><header>Federalism consultation and report</header><subsection id="H6E75D3CCDC5C445DAF7F6362E394CDCA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall jointly consult with State officials, local government officials, and officials of public housing agencies to develop recommendations, consistent with applicable rulings of the Supreme Court of the United States, to further the purposes and policies of the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601 et seq.</external-xref>).</text></subsection><subsection id="H78B4E46B977B453CB4283BF0D5D4C6FD"><enum>(b)</enum><header>Consultation requirements</header><text>In developing the recommendations required under subsection (a), the Secretary shall—</text><paragraph id="H93B6B3EFEB0D4600B1EAB95FA3D0037D"><enum>(1)</enum><text display-inline="yes-display-inline">provide State officials, local government officials, and officials of public housing agencies with notice and an opportunity to participate in the consultation process required under subsection (a);</text></paragraph><paragraph id="H7388DCEA69944AF9AC8847092A51ED70"><enum>(2)</enum><text display-inline="yes-display-inline">seek to consult with State officials, local government officials, and officials of public housing agencies that represent a broad cross-section of regional, economic, and geographic perspectives in the United States;</text></paragraph><paragraph id="HD6114A12278047BE9F3943F0F957DEF5"><enum>(3)</enum><text display-inline="yes-display-inline">emphasize the importance of collaboration with and among the State officials, local government officials, and officials of public housing agencies;</text></paragraph><paragraph id="H388F98ECAF3D45E99EB1FFBE1CFFF4F4"><enum>(4)</enum><text display-inline="yes-display-inline">allow for meaningful and timely input by State officials, local government officials, and officials of public housing agencies;</text></paragraph><paragraph id="H9CF4F8013D1A4FA9ACFF3402554180B9"><enum>(5)</enum><text>promote transparency in the consultation process required under subsection (a); and</text></paragraph><paragraph id="H9C50B80EBC1A4E608AD16B2A47362C4C"><enum>(6)</enum><text display-inline="yes-display-inline">explore with State officials, local government officials, and officials of public housing agencies whether Federal objectives under the Fair Housing Act can be attained by means other than through new regulations.</text></paragraph></subsection><subsection id="H09080D9AB2D44E41AAC25C6A801429AE"><enum>(c)</enum><header>Reports</header><paragraph id="H2303FDB8A86941A7A1A4206B3ED936BA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 12 months after the date of enactment of this Act, the Secretary shall publish in the Federal Register a draft report describing the recommendations developed pursuant to subsection (a).</text></paragraph><paragraph id="HCBA9496B84724BDE9B98D59F62BBBF5D"><enum>(2)</enum><header>Consensus requirement</header><text display-inline="yes-display-inline">The Secretary may include a recommendation in the draft report only if consensus has been reached with regard to the recommendation among the Secretary, the State officials, local government officials, and officials of public housing agencies consulted pursuant to subsection (a).</text></paragraph><paragraph id="HE546B91A711D42D1A780A0579C52817A"><enum>(3)</enum><header>Failure to reach consensus</header><text display-inline="yes-display-inline">If the Secretary, State officials, local government officials, and officials of public housing agencies consulted under subsection (a) fail to reach consensus on a regulatory proposal, the draft report shall identify that consensus was not reached and shall describe—</text><subparagraph id="HBBD58C8D71D4483EBB683CD9543A2AC8"><enum>(A)</enum><text>the areas and issues with regard to which consensus was reached;</text></subparagraph><subparagraph id="HD3689B14D344493DAC43D957C3BD516F"><enum>(B)</enum><text>the areas and issues of continuing disagreement that resulted in the failure to reach consensus; and</text></subparagraph><subparagraph id="HA872690489D24F3E95F1756A300D49B3"><enum>(C)</enum><text>the reasons for the continuing disagreements.</text></subparagraph></paragraph><paragraph id="HE7CCDA5040D24440AF99BED8F29B01FA"><enum>(4)</enum><header>Public review and comment period</header><text>The Secretary shall make the draft report available for public review and comment for a period of not fewer than 180 days.</text></paragraph><paragraph id="HBFC5F1322BEB4B8A909AA52CD2AAF1AA"><enum>(5)</enum><header>Final report</header><text display-inline="yes-display-inline">The Secretary shall, in consultation with the State officials, local government officials, and officials of public housing agencies, address any comments received pursuant to paragraph (4) and shall prepare a final report describing the final results of the consultation process under subsection (a).</text></paragraph></subsection><subsection id="HE7AD7C55BBDA4B959EBDDE703552AA1B"><enum>(d)</enum><header>Submission of final report</header><text>Not later than 12 months after the date of enactment of this Act, the Secretary shall make publicly available online the final report prepared pursuant to subsection (c)(5).</text></subsection><subsection id="HDEAE57ADFF9C483A8E5CA88591B92A8E"><enum>(e)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text><paragraph id="H6DCA5608476247F6963D29C94E0AB7F7"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph><paragraph id="H406CFDDE1937473D8C0D9F9B952FA316"><enum>(2)</enum><header>Local government official</header><text>The term <term>local government official</term> means an elected or professional official of a local government or an official of a regional or national organization representing local governments or officials.</text></paragraph><paragraph id="HBB81DC0C0D7E4122A7808F5965262378"><enum>(3)</enum><header>State official</header><text>The term <term>State official</term> means an elected or professional official of a State government or an official of a regional or national organization representing State governments or officials.</text></paragraph><paragraph id="H09292D9FC61A441483579A9880EF5A2D"><enum>(4)</enum><header>Public housing agency</header><text>The term <term>public housing agency</term> has the meaning given such term in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
