which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 23, United States Code, to improve transportation asset management plans, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transportation Asset Management Simplification Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id7bc6521d323f4c4f800570bf3c5df022" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Transportation asset management plans</header><text display-inline="no-display-inline">Section 119(e) of title 23, United States Code, is amended—</text><paragraph id="id81ee083102a94d2097bf81ff684a7780"><enum>(1)</enum><text>in paragraph (5)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3d6b779629954df19883eaeab968e803"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="id6d697ec92a6747bb80c955b76a67361a"><enum>(i)</enum><text>by striking <quote>each fiscal year</quote> and inserting <quote>once every 4 years, in conjunction with the recertification under paragraph (6)(B)</quote>; and</text></clause><clause id="idafe796da49ea40cc9dc68f59cf4391d0"><enum>(ii)</enum><text>by striking <quote>in that fiscal year</quote>; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbf247bf0f5ca493f98e60de48aa82e6b"><enum>(B)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1D6F348595164D699F01F05DE857CD3D"><subparagraph commented="no" display-inline="no-display-inline" id="id3759082069484664948df03afd34470a"><enum>(B)</enum><header>Application</header><clause commented="no" display-inline="no-display-inline" id="id0d6d7c26413442d48e16c08a1dd1f4ce"><enum>(i)</enum><header>Compliant States</header><text>A determination of compliance under subparagraph (A) shall apply until the next recertification date under subparagraph (A) and paragraph (6)(B). </text></clause><clause id="id4f15cc07d6414410829ab442100c8005"><enum>(ii)</enum><header>Noncompliant States</header><text display-inline="yes-display-inline">A determination of noncompliance under subparagraph (A) shall apply during the period beginning on the date of the determination and ending on the date on which the Secretary determines that the State is in compliance.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8191d50cd305498ea92fd77ca71cfbb4"><enum>(C)</enum><header>Submission</header><clause commented="no" display-inline="no-display-inline" id="idfd311aaff7914a6f96d2bd2479694095"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A State shall submit to the Secretary information to support a determination under subparagraph (A) in conjunction with a submission with respect to recertification under paragraph (6)(B). </text></clause><clause commented="no" display-inline="no-display-inline" id="id0d9126adff204c0ab3e6f8cae4392cfd"><enum>(ii)</enum><header>Requirements</header><text>For purposes of subparagraph (A) and paragraph (6)(B), a submission of a State shall—</text><subclause commented="no" display-inline="no-display-inline" id="idb54e9da6ea1d4e9c87d209dba212a889"><enum>(I) </enum><text display-inline="yes-display-inline">be considered sufficient with respect to time period if the submission is for the most recent year; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc62904b18b124604acaa6eb07b0d3196"><enum>(II)</enum><text>for applicable years other than the most recent year, include a certification by the State that asset management undertaken in those years by the State meets the requirements of this subsection. </text></subclause></clause></subparagraph><subparagraph id="idabf9b8f3dbf94182a52ec1e5bbcda8a3"><enum>(D)</enum><header>Opportunity to cure</header><clause commented="no" display-inline="no-display-inline" id="idec76f3576177445da125973ad8db5251"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">If the Secretary determines that a State is not in compliance under subparagraph (A), the Secretary shall provide to the State—</text><subclause id="id390db0ab6cb5453da7c9b013fae3f274"><enum>(I)</enum><text>a written statement of the specific actions the Secretary determines to be necessary for the State to comply under that subparagraph; and</text></subclause><subclause id="id13b9b6f5fb5341e284ab878dcc9dffd0"><enum>(II)</enum><text>a period of not less than 90 days to cure the deficiencies, during which time period all penalties and other legal impacts of a determination of noncompliance shall be stayed.</text></subclause></clause><clause id="id1ba71eecd96244efa8082f838cdaf77f"><enum>(ii)</enum><header>Extension</header><text>The Secretary, on request of the State, may extend the time period provided to cure deficiencies under clause (i)(II), including the stay of all penalties and other legal impacts of a determination of noncompliance.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id00922efabc0843d8a820bb2ec29428d1"><enum>(2)</enum><text>in paragraph (6)(C)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id71d09e70054d42b5b2acbeb7081290ed"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating clauses (i) and (ii) as subclauses (I) and (II), respectively, and indenting appropriately;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idea630584c72c4f86b1a0c71f14a5b313"><enum>(B)</enum><text>in the matter preceding subclause (I) (as so redesignated), by striking <quote>If the</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id200DD8A89B884A4C882875134EB98993"><clause commented="no" display-inline="no-display-inline" id="id7a21dbaed87342cd87c24f1a98110e45"><enum>(i)</enum><header>In general</header><text>If the</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id89981d3b3651473d85ae2e365cfc4d77"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB9FF3B2AB14748C5BDC06FA5ED77685B"><clause commented="no" display-inline="no-display-inline" id="id634e4ad85acf406886f6f8d4983a1c1b"><enum>(ii)</enum><header>Extension</header><text>The Secretary, on request of the State, may extend the time period provided to cure deficiencies under clause (i)(I), including the stay of all penalties and other legal impacts of a denial of certification.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
