which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the United States Trade Representative to regularly monitor industrial subsidies provided by the Government of the People’s Republic of China and submit a report on the risks posed by those subsidies, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthen American Competitiveness Against Harmful Subsidies Act of 2025</short-title></quote>.</text></section><section id="idD40AB40C600B485BBF6F19926DBC4785"><enum>2.</enum><header>Monitoring by United States Trade Representative of industrial subsidies provided by Government of People’s Republic of China</header><subsection id="id533f331d2e7443229b4dd9249c35e3b3"><enum>(a)</enum><header>Monitoring</header><text>The United States Trade Representative, in coordination with the entities specified in subsection (b), shall regularly monitor—</text><paragraph id="idfe58a549d717483e8a4cf5d116ef1d1e"><enum>(1)</enum><text>industrial subsidies provided by the Government of the People’s Republic of China; and</text></paragraph><paragraph id="idc6791c166f0a4b2bb70e884d535d4e34"><enum>(2)</enum><text>plans by the Government of the People’s Republic of China to implement new industrial subsidies or expand existing industrial subsidies.</text></paragraph></subsection><subsection id="idd6a72a07dde54ce4bac5453e2dbc7dfa"><enum>(b)</enum><header>Entities specified</header><text>The entities specified in this subsection are the following:</text><paragraph id="idc3b645dd767942de98f03817767a4a41"><enum>(1)</enum><text>The Bureau of Economics and Business Affairs of the Department of State.</text></paragraph><paragraph id="id2f28d1dcea794989a0ebfabb67a05b56"><enum>(2)</enum><text>The United States and Foreign Commercial Service of the Department of Commerce (established by section 2301 of the Export Enhancement Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/15/4721">15 U.S.C. 4721</external-xref>)).</text></paragraph><paragraph id="id1b47fd0d5df14377a5b45c40170ca0c8"><enum>(3)</enum><text>The International Trade Administration of the Department of Commerce (other than the United States and Foreign Commercial Service).</text></paragraph><paragraph id="ide5b58aeeae084d9fb4a21f9d7fb0d961"><enum>(4)</enum><text>The Foreign Agricultural Service of the Department of Agriculture.</text></paragraph><paragraph id="id6bdfc5b5e7324fb2837a1c1a38fd965d"><enum>(5)</enum><text>The Small Business Administration.</text></paragraph><paragraph id="id1d7f4d23994146e989dd141539f2ef0e"><enum>(6)</enum><text>Any other department or agency of the Federal Government, as determined by the President.</text></paragraph></subsection></section><section id="id6a3a956822d74bc3b16ef8088db78433"><enum>3.</enum><header>Reporting by United States Trade Representative on risks posed by industrial subsidies provided by Government of People’s Republic of China</header><subsection id="id9d5169bc188447b395697b9a65769f3f"><enum>(a)</enum><header>Reporting</header><text>Not later than one year after the date of the enactment of this Act, and annually thereafter, the United States Trade Representative, in coordination with the entities specified in subsection (b), shall submit to the Committee on Finance of the Senate and the Committee on Ways and Means of the House of Representatives a report that—</text><paragraph id="id3d64bec42775472fbaeddb08110bca4b"><enum>(1)</enum><text>identifies current and expected industrial subsidies provided by the Government of the People’s Republic of China that pose significant risk to—</text><subparagraph id="idd298572f2b0a4dc6a170ea672767cf61"><enum>(A)</enum><text>employment in the United States, including employment in strategically critical industries; and</text></subparagraph><subparagraph id="idcfb93c958e1b4fb091c38250b5f80cbc"><enum>(B)</enum><text>manufacturing in the United States, including production of strategically critical goods; and</text></subparagraph></paragraph><paragraph id="ide22fba35cdf24cb1b77c7276a9e84636"><enum>(2)</enum><text>recommends legislative, administrative, or other actions that could mitigate the risks posed by industrial subsidies identified in paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id83edcbc4f69d438eb0fd10fcf0092dc9"><enum>(b)</enum><header>Entities specified</header><text>The entities specified in this subsection are the following:</text><paragraph commented="no" display-inline="no-display-inline" id="iddbd0002259154540a0fbc3856526f713"><enum>(1)</enum><text>The Bureau of Economics and Business Affairs of the Department of State.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id44bed837d5ec4f33b1eef11f7745823c"><enum>(2)</enum><text>The United States Agency for International Development.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd694f40cc77046148953d36d046d1e36"><enum>(3)</enum><text display-inline="yes-display-inline">The United States and Foreign Commercial Service of the Department of Commerce (established by section 2301 of the Export Enhancement Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/15/4721">15 U.S.C. 4721</external-xref>)).</text></paragraph><paragraph id="id3333a6f069b84a6abcb963cc8a7965cc"><enum>(4)</enum><text>The Industry and Analysis unit and the Enforcement and Compliance unit of the International Trade Administration of the Department of Commerce.</text></paragraph><paragraph id="id3f168533ea514e75824579c22c72b76f"><enum>(5)</enum><text>The Bureau of Industry and Security of the Department of Commerce. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id53018d810fcf4c64abee58ee7e646e2f"><enum>(6)</enum><text display-inline="yes-display-inline">The Small Business Administration.</text></paragraph><paragraph id="id833eee05967841adb3dfa075862d33b9"><enum>(7)</enum><text>The Department of Labor.</text></paragraph><paragraph id="id7c70341fe8cf4c758740fed9d10b63d2"><enum>(8)</enum><text>The Department of Transportation.</text></paragraph><paragraph id="id77b1d2d3d82d4fb4ac014f6de686c109"><enum>(9)</enum><text>The Department of Energy.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id74ef854425cc401a88b0b276d941f47a"><enum>(10)</enum><text display-inline="yes-display-inline">Any other department or agency of the Federal Government, as determined by the President.</text></paragraph></subsection><subsection id="id83b7ad1a1c5e40c7b9ab5020c642ec0e"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="ida3a52710c1104f9a967639a86c555123"><enum>(1)</enum><header>Critical infrastructure</header><text>The term <term>critical infrastructure</term> has the meaning given that term in the Critical Infrastructures Protection Act of 2001 (<external-xref legal-doc="usc" parsable-cite="usc/42/5195c">42 U.S.C. 5195c</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id69e37ca5a8b14ecfb7483a1d98b8117e"><enum>(2)</enum><header>Key technology focus areas</header><text>The term <term>key technology focus areas</term> means the key technology focus areas included in the list required under section 10387(a)(2) of the Research and Development, Competition, and Innovation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/19107">42 U.S.C. 19107(a)(2)</external-xref>). </text></paragraph><paragraph id="id23b8a93dc016435281b8748d06391e10"><enum>(3)</enum><header>Strategically critical good</header><text>The term <term>strategically critical good</term> means any raw, in process, or manufactured material (including any mineral, metal, or advanced processed material), article, commodity, supply, product, or item of supply the absence of which would have a significant effect on—</text><subparagraph id="id070aa9518823437e9b094a85cbaa2095"><enum>(A)</enum><text>the national security or economic security of the United States; and</text></subparagraph><subparagraph id="idb0615ce10eb04addbc12a7f9e50997cf"><enum>(B)</enum><text>critical infrastructure.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcb5de24e7df94c5e95146f1adf78cf30"><enum>(4)</enum><header>Strategically critical industry</header><text>The term <term>strategically critical industry</term> means an industry that is critical for the national security or economic security of the United States, considering key technology focus areas and critical infrastructure. </text></paragraph></subsection></section></legis-body></bill>
