<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 115</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250116">January 16, 2025</action-date><action-desc><sponsor name-id="S355">Mr. Cruz</sponsor> (for himself, <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>, <cosponsor name-id="S416">Mrs. Britt</cosponsor>, and <cosponsor name-id="S372">Mrs. Capito</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to establish a criminal penalty for unauthorized access to Department of Defense facilities.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guarding and Administering Trespass Enforcement, Controlling Restricted Areas, and Stopping High-risk Encroachment Recidivism and Sabotage Act</short-title></quote> or the <quote><short-title>GATE CRASHERS Act</short-title></quote>.</text></section><section id="idacd65ae405d148ef831b8606a89bf061"><enum>2.</enum><header>Unauthorized access to Department of Defense facilities</header><subsection id="ida4a51153a918409691a5bff27eff4bcc"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/67">Chapter 67</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idcdc1f3c1f01e42969a209845c672d8f8"><section id="id5e7e1935aa7b4d08a5928c45c94207d8"><enum>1390.</enum><header>Unauthorized access to Department of Defense facilities</header><subsection id="id029bb4fa5d5748dc9715aa55fddbe3e0"><enum>(a)</enum><header>In general</header><text>It shall be unlawful, within the jurisdiction of the United States, without authorization to go upon any property that—</text><paragraph id="id82c9e3342e7e43b98afe6fb28b2d2132"><enum>(1)</enum><text>is under the jurisdiction of the Department of Defense; and</text></paragraph><paragraph id="idb05b8b6ae69b49fb8b44a0939141eecd"><enum>(2)</enum><text>has been clearly marked as closed or restricted.</text></paragraph></subsection><subsection id="idcd6088fb78874e8782891f779174ce91"><enum>(b)</enum><header>Penalties</header><text>Any person who violates subsection (a) shall—</text><paragraph id="id285561f4474045cbbb055f5c3af3ad66"><enum>(1)</enum><text>in the case of the first offense, be fined under this title, imprisoned not more than 180 days, or both;</text></paragraph><paragraph id="idb796cceb748a41f480d0259bab251b64"><enum>(2)</enum><text>in the case of the second offense, be fined under this title, imprisoned not more than 3 years, or both; and</text></paragraph><paragraph id="idfbf92a0a2e9d4aaf90b865b446e78c1c"><enum>(3)</enum><text>in the case of the third or subsequent offense, be fined under this title, imprisoned not more than 10 years, or both.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id0a64abab1b0644c6815a0f83c8663fd6"><enum>(b)</enum><header>Table of sections amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/67">chapter 67</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0BB3C5CFE29F4309B1850B535F956944"><toc><toc-entry bold="off" level="section">1390.
