which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food Security Act of 1985 to improve delivery of technical assistance, and for other purposes.</official-title></form><legis-body><section id="id9055bde0193c4118a63460f345a7e4f4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Increased TSP Access Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id1fc27d09ce1f48ff8556391b9d292a1c"><enum>2.</enum><header>Delivery of technical assistance</header><text display-inline="no-display-inline">Section 1242 of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3842">16 U.S.C. 3842</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id89be328cc06a4465b60b5d7b13fa5d43"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id78bbfc4cef5b4671af0e9d33a6ac1859"><enum>(A)</enum><text>by redesignating paragraphs (1) and (2) as paragraphs (2) and (3), respectively; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddaaa52a6d2c14a4dad15c7ce681c50c9"><enum>(B)</enum><text>by inserting before paragraph (2) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6F07D95F0FD14385B2F3CA8305FB8519"><paragraph commented="no" display-inline="no-display-inline" id="id82bff50989df47b596fd202eff0ea35a"><enum>(1)</enum><header>Approved non-Federal certifying entity</header><text>The term <term>approved non-Federal certifying entity</term> means a non-Federal entity approved by the Secretary under subsection (e)(5)(C)(ii) to perform certifications of third-party providers under this section.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf241fc91e216431fbea990176bfeb5a1"><enum>(2)</enum><text>in subsection (b), by striking <quote>science-based, site-specific practices designed</quote> and inserting <quote>timely, science-based, and site-specific practice design and implementation assistance</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idffb1fd2d8aad41ff8822f4b8174b51b7"><enum>(3)</enum><text>in subsection (d), by inserting <quote>(including private sector entities)</quote> after <quote>non-Federal entities</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8cfb0e5410194f029dc87924e03b2c4c"><enum>(4)</enum><text>in subsection (e)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf1d2b61955ac4c298507cf4db8f35857"><enum>(A)</enum><text>in paragraph (2), by striking <quote>Food, Conservation, and Energy Act of 2008</quote> and inserting <quote><short-title>Increased TSP Access Act of 2025</short-title></quote>;</text></subparagraph><subparagraph id="idd5b1a404eb2d4ece8b637bbc01e7831a"><enum>(B)</enum><text>in paragraph (3)(A), by striking <quote>ensure</quote> and all that follows through <quote>engineering,</quote> and inserting <quote>ensure that third-party providers with expertise in the technical aspects of conservation planning, watershed planning, environmental engineering, conservation practice design, implementation, and evaluation, or other technical skills, as determined by the Secretary,</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0be7b62670bf4e4ca9970fa3fd074953"><enum>(C)</enum><text>by striking paragraphs (4) and (5) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA401E7046DC444B98938CCD8374CBDD1"><paragraph commented="no" display-inline="no-display-inline" id="HB704B6573B9E43BAB62981D038FFC594"><enum>(4)</enum><header display-inline="yes-display-inline">Certification</header><text display-inline="yes-display-inline">The Secretary shall certify a third-party provider through—</text><subparagraph commented="no" display-inline="no-display-inline" id="H07BA76589DE94672A2B9351B54CE5929"><enum>(A)</enum><text>a certification process administered by the Secretary, acting through the Chief of the Natural Resources Conservation Service; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBCE70818B1E9481E9BCC49217F58E174"><enum>(B)</enum><text>a non-Federal entity (other than a State agency) approved by the Secretary to perform the certification; or</text></subparagraph><subparagraph id="id19fd2e92f9274aefb482c9ea69506e7a"><enum>(C)</enum><text>a State agency with statutory authority to certify, administer, or license professionals in one or more fields of natural resources, agriculture, or engineering approved by the Secretary to perform the certification.</text></subparagraph></paragraph><paragraph id="idd61329659b634f85851df2f3cdc6b348"><enum>(5)</enum><header>Non-Federal certifying entity process</header><subparagraph id="id35d94b6a67e7428fa0f1282d0e663106"><enum>(A)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of the <short-title>Increased TSP Access Act of 2025</short-title>, the Secretary shall establish a process for the certification of third-party providers through approved non-Federal certifying entities, with the goal of increasing third-party provider capacity, including the certification of qualified agricultural retailers, cooperatives, professional societies, service providers, and organizations described in section 1265A(3)(B)(i).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5b55ef29c2c84d49854ae7d9ae44484f"><enum>(B)</enum><header>Eligibility of non-Federal entities</header><text>In determining the eligibility of an entity described in subparagraph (B) or (C) of paragraph (4) (referred to in this paragraph as a <term>non-Federal entity</term>) to perform certifications, the Secretary shall consider—</text><clause commented="no" display-inline="no-display-inline" id="idb02f04c1ead64c0c9205f1aa7b348730"><enum>(i)</enum><text display-inline="yes-display-inline">the ability of the non-Federal entity to assess qualifications of a third-party provider and certify third-party providers at scale;</text></clause><clause commented="no" display-inline="no-display-inline" id="id3a55e7b5fbba4003910c9f1bb516c3a5"><enum>(ii)</enum><text display-inline="yes-display-inline">the experience of the non-Federal entity in working with third-party providers and eligible participants;</text></clause><clause commented="no" display-inline="no-display-inline" id="ida9ac6dde2fe04ab8aae6ec499a669fb3"><enum>(iii)</enum><text display-inline="yes-display-inline">the expertise of the non-Federal entity in the technical and science-based aspects of conservation delivery described in paragraph (3)(A);</text></clause><clause commented="no" display-inline="no-display-inline" id="id25f895b30919460eb15aeac79ce31f3f"><enum>(iv)</enum><text display-inline="yes-display-inline">the history of the non-Federal entity in working with agricultural producers; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id8be2f80163104644ae947b4d3ef898e8"><enum>(v)</enum><text display-inline="yes-display-inline">such other qualifications as the Secretary determines to be appropriate. </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf2942fee45c8420a90f553a6be26ac6d"><enum>(C)</enum><header>Approval</header><text>Not later than 40 business days after the date on which the Secretary receives an application submitted by a non-Federal entity to perform certifications of third-party providers under this section, the Secretary shall—</text><clause commented="no" display-inline="no-display-inline" id="id214ee59a7ccc4f5ab868bfb8e6826ae9"><enum>(i)</enum><text display-inline="yes-display-inline">determine if the non-Federal entity meets the eligibility requirements established under subparagraph (B); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id5ce8511f62824cf2a0557109950671b9"><enum>(ii)</enum><text display-inline="yes-display-inline">if the Secretary makes a positive determination under clause (i), approve the non-Federal entity to perform certifications of third-party providers under this section.</text></clause></subparagraph><subparagraph id="id527f54f05ff64a7cb319493ff1323cf9" commented="no"><enum>(D)</enum><header>Timely decisions</header><text display-inline="yes-display-inline">Not later than 10 business days after the date on which the Secretary receives a notification submitted by a third-party provider that the third-party provider has been certified by an approved non-Federal certifying entity to provide technical assistance for specified practices and conservation activities, the Secretary shall—</text><clause commented="no" display-inline="no-display-inline" id="id87ab60fbae464909bf7e40ae853219fa"><enum>(i)</enum><text display-inline="yes-display-inline">review the certification; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id494a479d48184d8da869f22fd1b015fa"><enum>(ii)</enum><text display-inline="yes-display-inline">if the certification is satisfactory to the Secretary, include the name of the third-party provider on the registry of certified third-party providers maintained by the Secretary. </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4e8fb766f87e442790e5ff86b69e6ff7"><enum>(E)</enum><header>Duties of approved non-Federal certifying entities</header><text display-inline="yes-display-inline">An approved non-Federal certifying entity shall—</text><clause commented="no" display-inline="no-display-inline" id="id3a3c43d904264435a6eeb694f509f55f"><enum>(i)</enum><text display-inline="yes-display-inline">assess the ability of a third-party provider to appropriately provide technical assistance to eligible participants for specified practices and conservation activities; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7573657b735b43b7bfefea67d0373bcd"><enum>(ii)</enum><text display-inline="yes-display-inline">provide to third-party providers certified by the approved non-Federal certifying entity—</text><subclause commented="no" display-inline="no-display-inline" id="id633a27d642384e76934cf88e2939b668"><enum>(I)</enum><text display-inline="yes-display-inline">training to ensure that the third-party providers are qualified to provide the technical assistance described in clause (i); and</text></subclause><subclause id="idf91c53dd132b47a6865641a774e04222"><enum>(II)</enum><text>continuing education, as appropriate, to ensure that the third-party providers are educated in the most recent technical- and science-based aspects of conservation delivery.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id891102accce94eaf9a2e68c89bd4157a"><enum>(6)</enum><header>Streamlined certification</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of the <short-title>Increased TSP Access Act of 2025</short-title>, the Secretary shall provide a streamlined certification process for a third-party provider that has an appropriate specialty certification, including a certified crop advisor certified by the American Society of Agronomy, a professional engineer, or a holder of a technical certification approved by the Secretary.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id35e96c0d1f854e93a326973917740f40"><enum>(5)</enum><text>in subsection (f)—</text><subparagraph id="id249eb623ef3b4ea6bf252c85dc249d8a"><enum>(A)</enum><text>in paragraph (2), in the matter preceding subparagraph (A), by inserting <quote>or an approved non-Federal certifying entity</quote> after <quote>third-party provider</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id067b21632ba449f8ac856f60b68c2334"><enum>(B)</enum><text>by striking paragraph (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1DF13B62D165438A8BB2E1F15C6109F1"><paragraph commented="no" display-inline="no-display-inline" id="IDFCA13EF8E222448E96F6BE85A2B5DC9D"><enum>(3)</enum><header display-inline="yes-display-inline">Review</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Increased TSP Access Act of 2025</short-title>, and additionally thereafter at the discretion of the Secretary, the Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="IDA62EB17F389B427EA646B2FCEB134203"><enum>(A)</enum><text>review certification requirements for third-party providers;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1F96659C46C64CE0A6CBD27FCE780E61"><enum>(B)</enum><text>make any adjustments considered necessary by the Secretary to improve participation and the quality and effectiveness of conservation practices implemented and adopted with support from technical service providers; and</text></subparagraph><subparagraph id="idefafbcccc180491abcf8d95cca92db4d"><enum>(C)</enum><text>conduct outreach to and receive input from third-party providers, both that currently participate in the program under this section and those that no longer participate in the program, and entities, organizations, and associations providing or supporting consultative services to agriculture, livestock, and forest producers to assess barriers and opportunities for the use of third-party provider assistance for improved conservation program delivery.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf908af08891640df836704d926354336"><enum>(C)</enum><text>in paragraph (4)(A)(i), by inserting <quote>maintenance,</quote> after <quote>outreach,</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7dd4500d43ed4b0eb5ae90c24c9a4f0d"><enum>(D)</enum><text>by striking paragraph (5) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB93751E74CDC4CD084B35067CD94B2E0"><paragraph id="idc93b99292930400aa4b50d556b1c53c1"><enum>(5)</enum><header>Payment amounts</header><subparagraph id="id04c02d2660764e5591384e4c413a6e04"><enum>(A)</enum><header>In general</header><text>The Secretary shall establish fair and reasonable amounts of payments for technical services provided by third-party providers at rates equivalent to, but that do not exceed, technical assistance provided by the Secretary.</text></subparagraph><subparagraph id="id729233313778428883d7e2e66371be2e"><enum>(B)</enum><header>Considerations</header><text>In determining fair and reasonable payment amounts under subparagraph (A), the Secretary shall consider specialized equipment, frequency of site visits, training, travel and transportation, and such other factors as the Secretary determines to be appropriate.</text></subparagraph><subparagraph id="id076d9bec28354abc8201dcd8eea7fdaa" commented="no"><enum>(C)</enum><header>Exclusion</header><text>A payment provided under another Federal program directly to an eligible participant for technical assistance provided by a third-party provider certified under this section shall be—</text><clause commented="no" display-inline="no-display-inline" id="id7c85612577ed4d608b9e82087da39794"><enum>(i)</enum><text display-inline="yes-display-inline">excluded from cost-sharing requirements under the program under which the payment was provided; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id98ecc940d9b8423aa218736dd7c61d5c"><enum>(ii)</enum><text display-inline="yes-display-inline">equal to not more than 100 percent of the fair and reasonable payment amount for the applicable technical assistance determined under subparagraph (B).</text></clause></subparagraph></paragraph><paragraph id="id496798f1352c4b4199a49534a09805ed"><enum>(6)</enum><header>Transparency</header><text>Not later than 1 year after the date of establishment of the processes under paragraphs (5)(A) and (6) of subsection (e), and routinely thereafter, the Secretary shall provide accessible public information on—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb62f9f0c812a4225ad2d55e2f6ce0f61"><enum>(A)</enum><text display-inline="yes-display-inline">funds obligated to third-party providers through—</text><clause commented="no" display-inline="no-display-inline" id="id63871dc6052c412db890a5d44cf79699"><enum>(i)</enum><text display-inline="yes-display-inline">contracts entered into between eligible participants and individual third-party providers; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id710c5919b99748d3b378eee4f7961fda"><enum>(ii)</enum><text display-inline="yes-display-inline">agreements with public and private sector entities to secure third-party technical assistance;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9926959963d740f3969178badbb8c312"><enum>(B)</enum><text display-inline="yes-display-inline">certification results, including—</text><clause commented="no" display-inline="no-display-inline" id="ida5e05ca3074740cc84fcbdabd244d4a8"><enum>(i)</enum><text display-inline="yes-display-inline">the number of third-party providers certified by the Secretary;</text></clause><clause commented="no" display-inline="no-display-inline" id="id4bb64b470b244042bec403af7cf22830"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of approved non-Federal certifying entities;</text></clause><clause commented="no" display-inline="no-display-inline" id="id766cdc33b14d427797931da0a00f1717"><enum>(iii)</enum><text display-inline="yes-display-inline">the number of third-party providers certified through approved non-Federal certifying entities; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7046104f4e18436ea7bd9c21102bcee5"><enum>(iv)</enum><text display-inline="yes-display-inline">the number of third-party providers certified based on State agency or professional association credentialing; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id57d245ee37c84375a2b4e7516b124cce"><enum>(C)</enum><text display-inline="yes-display-inline">the estimated number of staff hours or full-time equivalents saved through work accomplished by third-party providers.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
