Severability.</toc-entry></toc></subsection></section><section id="HEC3CE348C31540089647323C425D60DF"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id1004d5e1d55a40ed95fee24e7e475686"><enum>(1)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id118ebe0f07b64ec892084d6151107352"><enum>(2)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> has the meaning given such term in section 101(a)(36) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(36)</external-xref>).</text></paragraph></section><section id="H0BEFE21650BF45F0AB1D9D898E2A53E6"><enum>3.</enum><header>Federal affirmation of assistance in the immigration law enforcement by States and political subdivisions of States</header><text display-inline="no-display-inline">Reaffirming the existing inherent authority of States, law enforcement personnel of a State, or of a political subdivision of a State, have the inherent authority of a sovereign entity to investigate, identify, apprehend, arrest, detain, or transfer to Federal custody aliens in the United States (including the transportation of such aliens across State lines to detention centers), for the purposes of assisting in the enforcement of the immigration laws of the United States in the course of carrying out routine duties. This State authority has never been displaced or preempted by Congress.</text></section><section id="H602EA70017B448649BE2CCDB92EF1626"><enum>4.</enum><header>State authorization for assistance in the enforcement of immigration laws encouraged</header><subsection id="H7A56BC962E1D4E799EDFF251B258D996"><enum>(a)</enum><header>In general</header><text>Beginning on the date that is 1 year after the date of the enactment of this Act, a State, or a political subdivision of a State, that has in effect a statute, policy, or practice that prohibits law enforcement officers of the State, or of a political subdivision of the State, from assisting or cooperating with Federal immigration law enforcement in the course of carrying out the officers’ routine law enforcement duties may not receive any of the funds that would otherwise be allocated to the State under section 241(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(i)</external-xref>).</text></subsection><subsection id="H2F0A166DBA15484D896932621BA30E10"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to require law enforcement officials from States, or from political subdivisions of States, to report or arrest victims or witnesses of a criminal offense.</text></subsection><subsection id="H23B1BD60E5814CBA9612FEE23AC95F84"><enum>(c)</enum><header>Reallocation of funds</header><text>Any funds that are not allocated to a State, or to a political subdivision of a State, due to the failure of such State, or of the political subdivision of such State, to comply with subsection (a) shall be reallocated to States, or to political subdivisions of States, that comply with such subsection.</text></subsection></section><section id="HDFD38EC0FF3A4826ABC51F4A9773080E"><enum>5.</enum><header>Listing of immigration violators in the National Crime Information Center database</header><subsection commented="no" id="HDDE252AAC2564CCC985694CF120AC393"><enum>(a)</enum><header>Provision of information to the National Crime Information Center</header><paragraph commented="no" display-inline="no-display-inline" id="id81ad30bfed4c4f4da3be21faeaf3091f"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act and periodically thereafter as updates may require, the Commissioner for U.S. Customs and Border Protection shall provide the National Crime Information Center of the Department of Justice with such information as the Commissioner may possess regarding any aliens—</text><subparagraph commented="no" display-inline="no-display-inline" id="id05abf79aead04ce2a265e292e8fdf7e1"><enum>(A)</enum><text display-inline="yes-display-inline">against whom a final order of removal has been issued;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbfbba4f44ef5481b87f42a869f529713"><enum>(B)</enum><text display-inline="yes-display-inline">who have signed a voluntary departure agreement;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd27e1a282dcb405cb40f69012c13fc4a"><enum>(C)</enum><text display-inline="yes-display-inline">who have overstayed their authorized period of stay; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id667b52fb526e4422af7a9663ce4aeaf7"><enum>(D)</enum><text display-inline="yes-display-inline">whose visas have been revoked. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id99769caa944c467ea0b0f39b52ac7d57"><enum>(2)</enum><header>Immigration violators file</header><text display-inline="yes-display-inline">The National Crime Information Center shall enter all of the information received pursuant to paragraph (1) into the Immigration Violators File regardless of whether—</text><subparagraph commented="no" id="HDF2669531BC64109B3445588615D8309"><enum>(A)</enum><text>the alien concerned received notice of a final order of removal;</text></subparagraph><subparagraph commented="no" id="H13DE8E81F55B4C79AAE45EA6E6D9C861"><enum>(B)</enum><text>the alien concerned has already been removed; or</text></subparagraph><subparagraph commented="no" id="H1459437A91264005BEC1BE34229BD157"><enum>(C)</enum><text>sufficient identifying information is available with respect to the alien concerned.</text></subparagraph></paragraph></subsection><subsection id="H4838B2DA73494588A5C2CC053DBF3E20"><enum>(b)</enum><header>Inclusion of information in the NCIC index</header><paragraph id="HB3A3DC4D139C4866BB28F713094239AE"><enum>(1)</enum><header>In general</header><text>Section 534(a) of title 28, United States Code, is amended—</text><subparagraph id="H531861DDBEC049CEA95A769C9116413B"><enum>(A)</enum><text>by redesignating paragraphs (4) and (5) as paragraphs (5) and (6), respectively; and</text></subparagraph><subparagraph id="HEC31A1C54B4343BFB7239442CC7A4C67"><enum>(B)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block style="OLC" id="H227AE49D5B6B48C18578FC9CEE98A84F"><paragraph id="HF39477B17A4A419C929126850BD1ADCE"><enum>(4)</enum><text>acquire, collect, classify, and preserve records of violations by aliens of the immigration laws of the United States, regardless of whether—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6e85ddec91de4c59b35486631a017238"><enum>(A)</enum><text display-inline="yes-display-inline">any such alien has received notice of any such violation; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4e097335aa014ed0b63434363c85557e"><enum>(B)</enum><text display-inline="yes-display-inline">sufficient identifying information is available with respect to any such alien; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf22a9e2b0ec2420ab32cb73dd86ca537"><enum>(C)</enum><text display-inline="yes-display-inline">any such alien has already been removed from the United States;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HCDB9C55C83A84059BA6C09FA14AE62BD"><enum>(2)</enum><header>Effective date</header><text>The Attorney General shall implement the amendment made by paragraph (1) not later than 6 months after the date of the enactment of this Act.</text></paragraph></subsection></section><section id="H0501A42BD61C4FA6B9CC0DD4909FB264"><enum>6.</enum><header>State and local law enforcement provision of information about apprehended aliens</header><subsection id="HE2DB508AF51342219BB6D4AE69455844"><enum>(a)</enum><header>Provision of information</header><text>In compliance with section 642(a) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1373">8 U.S.C. 1373(a)</external-xref>) and section 434 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1644">8 U.S.C. 1644</external-xref>), each State, and each political subdivision of a State, shall submit to the Secretary, in a timely manner, the information specified in subsection (b) with respect to each alien apprehended in the jurisdiction of the State, or of a political subdivision of the State, who is believed to be in violation of the immigration laws of the United States.</text></subsection><subsection id="HC12BF9D9253B4F08AE1814854CA061C9"><enum>(b)</enum><header>Information required</header><text>The information specified in this subsection is—</text><paragraph id="HE161C5C14EAB4FDF864A7B1385C7358A"><enum>(1)</enum><text>the alien’s name;</text></paragraph><paragraph id="HA41889BECFDB4946B59CB28A7F4EDAA1"><enum>(2)</enum><text>the alien’s address or place of residence;</text></paragraph><paragraph id="HF8947610019E443F9C2579D357568843"><enum>(3)</enum><text>a physical description of the alien;</text></paragraph><paragraph id="HE053DD11B74747A2ACFC5FEE3D882444"><enum>(4)</enum><text>the date, time, and location of the encounter with the alien and reason for stopping, detaining, apprehending, or arresting the alien;</text></paragraph><paragraph id="H34CEAD2F386E4B9A8326945EE64F1FEC"><enum>(5)</enum><text>if applicable—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd21bcbca1b544ec388ecb55fdf7082c9"><enum>(A)</enum><text display-inline="yes-display-inline">the alien’s driver’s license number and the State of issuance of such license;</text></subparagraph><subparagraph id="H55BBE9037772440F8DF7C18F9652A2F4"><enum>(B)</enum><text>the type of any other identification document issued to the alien, the designation number contained on the identification document, and the issuing entity for the identification document; and</text></subparagraph><subparagraph id="H6604C3A3282D44369CE80831D613FEB9"><enum>(C)</enum><text>the license plate number, make, and model of any automobile registered to, or driven by, the alien; and</text></subparagraph></paragraph><paragraph id="HFC9C39A7D1D44844B4B95EE1B5F16384"><enum>(6)</enum><text>if available or readily obtainable—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2f28247fef984f799c97845b62524978"><enum>(A)</enum><text display-inline="yes-display-inline">a photo of the alien; and</text></subparagraph><subparagraph id="HD3DC537FC6BB4159ACE533C434CCE757"><enum>(B)</enum><text>the alien’s fingerprints.</text></subparagraph></paragraph></subsection><subsection id="H4EABB62CE2F4440884803EAB8FA3AC32"><enum>(c)</enum><header>Annual report</header><text>The Secretary shall annually submit to Congress a detailed report listing the States, and the political subdivisions of States, that provided information pursuant to subsection (a) with respect to the preceding year.</text></subsection><subsection id="H8C8595990B6C4055ABAE99DB0020E574"><enum>(d)</enum><header>Reimbursement</header><text>The Secretary shall reimburse States, and political subdivisions of a State, for all reasonable costs, as determined by the Secretary, incurred by each State, and each political subdivision of a State, as a result of submitting the information required to be submitted pursuant to subsection (a).</text></subsection><subsection id="H0B6EE40333C74236851CF450F1FC1142"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to require law enforcement officials of a State, or of a political subdivision of a State, to submit to the Secretary information related to a victim of a crime or witness to a criminal offense.</text></subsection></section><section id="H83DE89A9650242AA87EEF11609A7C4D8"><enum>7.</enum><header>Financial assistance to State and local law enforcement agencies that assist in the enforcement of immigration laws</header><subsection id="H1D65DAFD57C24B4289DA639CBD506ADD"><enum>(a)</enum><header>Grants for special equipment for housing and processing certain aliens</header><text>The Secretary shall award grants to States and political subdivisions of States for the procurement of equipment, technology, facilities, and other products that facilitate and are directly related to investigating, apprehending, arresting, detaining, or transporting aliens who have violated the immigration laws of the United States, including additional administrative costs incurred to comply with the requirements under this Act.</text></subsection><subsection id="HFB4DD73788DA453886219790ABFE0EBE"><enum>(b)</enum><header>Eligibility</header><text>A State or political subdivision of a State desiring a grant under this section shall have the authority to assist, and shall have a written policy and practice of assisting, in the enforcement of the immigration laws of the United States in the course of carrying out the routine law enforcement duties of such State or political subdivision. Entities covered under this section may not have any policy or practice that prevents local law enforcement from inquiring about a suspect's immigration status.</text></subsection><subsection id="H872B26B250964E73B2DD49A00B9FCDBD"><enum>(c)</enum><header>GAO audit</header><text>Not later than 3 years after the date of the enactment of this Act, the Comptroller General of the United States shall conduct an audit of funds distributed to States and political subdivisions of a State pursuant to subsection (a).</text></subsection></section><section id="HBA7B0733814146699584746704D63B4A"><enum>8.</enum><header>Increased Federal detention space</header><subsection id="H4D1F9429135B4DF9B7402F290EA7DB74"><enum>(a)</enum><header>Construction or acquisition of detention facilities</header><paragraph id="HEE2569CE49EE4EFD9E2BBAAC0C45A356"><enum>(1)</enum><header>In general</header><text>The Secretary shall construct or acquire, in addition to existing facilities for the detention of aliens, 20 detention facilities in the United States, for aliens detained pending removal from the United States or a decision regarding such removal. Each facility shall have a sufficient number of beds necessary to effectuate the purposes of this Act.</text></paragraph><paragraph id="H39DEA8AE15F9455990A739A4A39D2F8A"><enum>(2)</enum><header>Determinations</header><text display-inline="yes-display-inline">The location of any detention facility built or acquired pursuant to this subsection shall be determined by the Assistant Director of the Custody Management Division of the Enforcement and Removal Directorate.</text></paragraph></subsection><subsection id="idA9B1BD04244B42ABBBB53EA0814374D8"><enum>(b)</enum><header>Technical and conforming amendment</header><text>Section 241(g)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(g)(1)</external-xref>) is amended by striking <quote>may expend from the appropriation <quote>Immigration and Naturalization Service—Salaries and Expenses</quote>,</quote> and inserting <quote>shall expend from the appropriation <quote>U.S. Immigration and Customs Enforcement—Operations and Support</quote>,</quote>. </text></subsection></section><section id="H710141F2AD3049CEAC6CCD5A7E2E9ED5"><enum>9.</enum><header>Federal custody of aliens unlawfully present in the United States apprehended by State or local law enforcement</header><subsection id="H70BF50ACC7644B08A2589DBB9119E16F"><enum>(a)</enum><header>State apprehension</header><paragraph id="H616A610D15F944549D504EC330356361"><enum>(1)</enum><header>In general</header><text>Chapter 4 of title II of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1221">8 U.S.C. 1221 et seq.</external-xref>) is amended by inserting after section 240C the following:</text><quoted-block style="OLC" id="H9E4AB79C5A0446D68055DCAD0F59136D"><section id="H9454E406D883468DA658416482A8D0F7"><enum>240D.</enum><header>Custody of aliens unlawfully present in the United States</header><subsection id="HFD10ED7CF66B422180618CB3D8641E0E"><enum>(a)</enum><header>Defined term</header><text>In this section, the term <term>alien who is unlawfully present in the United States</term> means an alien who—</text><paragraph id="HE5DE8396598148689E32116AB174194D"><enum>(1)</enum><text>entered the United States without inspection or at any time, manner, or place not designated by the Secretary of Homeland Security;</text></paragraph><paragraph id="H48041537DD5D4C68A45D277DBD72434C"><enum>(2)</enum><text>was admitted as a nonimmigrant and who, at the time the alien was taken into custody by the State, or a political subdivision of the State, failed—</text><subparagraph id="HCBE5DC57D5FB4AAFBAA6566CE06680AF"><enum>(A)</enum><text>to maintain the nonimmigrant status in which the alien was admitted or to which it was changed pursuant to section 248; or</text></subparagraph><subparagraph id="HC6356B4374394A7CBE313A86A22F7D84"><enum>(B)</enum><text>to comply with the conditions of any such status;</text></subparagraph></paragraph><paragraph id="H10E92AF86AE9451DBBB0EEE8CADF5291"><enum>(3)</enum><text>was admitted as an immigrant and subsequently failed to comply with the requirements of such status; or</text></paragraph><paragraph id="id713BD25800D94A4B8FF21A44906862F0" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">failed to depart the United States under a voluntary departure agreement or under a final order of removal.</text></paragraph></subsection><subsection id="id0CF85896900049F683750BCC03797CE4"><enum>(b)</enum><header>Transfer of custody by State and local officials</header><text display-inline="yes-display-inline">If a State, or a political subdivision of the State, exercising authority with respect to the apprehension or arrest of an alien who is unlawfully present in the United States, submits to the Secretary of Homeland Security a request that such alien be taken into Federal custody, the Secretary—</text><paragraph id="H562519C7C569439D95CE7F4B6DFA1B36"><enum>(1)</enum><text>not later than 48 hours after the conclusion of the State, or the political subdivision of a State, charging process or dismissal process, or if no State or political subdivision charging or dismissal process is required, not later than 48 hours after the alien is apprehended, shall take the alien into the custody of the Federal Government and incarcerate the alien; or</text></paragraph><paragraph id="HBD1E360EA26748DE9FE85DCA58151409"><enum>(2)</enum><text>shall request that the relevant State or local law enforcement agency temporarily incarcerate or transport the alien for transfer to Federal custody.</text></paragraph></subsection><subsection display-inline="no-display-inline" id="H4116E267D5E84B59B3816094524FFE80"><enum>(c)</enum><header>Policy on detention in State and local detention facilities</header><text>In carrying out section 241(g)(1), the Attorney General or the Secretary of Homeland Security shall ensure that an alien arrested pursuant to this Act is detained, pending the alien being taken for an examination under this section, in a State or local prison, jail, detention center, or other comparable facility. Such a facility is adequate for detention if—</text><paragraph id="H840635D2C02F4E9480861A43B4745185"><enum>(1)</enum><text>the facility is the most suitably located Federal, State, or local facility available for such purpose under the circumstances;</text></paragraph><paragraph id="HE835B493230A469EA1BEA64D03BE9B29"><enum>(2)</enum><text>an appropriate arrangement for such use of the facility can be made; and</text></paragraph><paragraph id="HF6E8FA6816484971B49DE8D63805B1EF"><enum>(3)</enum><text>the facility satisfies the standards for the housing, care, and security of persons held in custody of a United States marshal.</text></paragraph></subsection><subsection id="H1EDB66AF4AAF469BBC78769EE265196B"><enum>(d)</enum><header>Reimbursement</header><paragraph commented="no" display-inline="no-display-inline" id="id8d9a683b855b4261bf0b9540e0bdea56"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall reimburse States and political subdivisions of a State for all reasonable expenses, as determined by the Secretary, incurred by the State, or political subdivision as a result of the incarceration and transportation of an alien who is unlawfully present in the United States. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3a4b029d29134f1f8bc9f2420d860069"><enum>(2)</enum><header>Calculation</header><text display-inline="yes-display-inline">Compensation provided pursuant to paragraph (1) shall be equal to the sum of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id017683a06a6c4733a5cf39cff3ccdf5f"><enum>(A)</enum><text display-inline="yes-display-inline">the average cost of incarceration of a prisoner in the relevant State for the period the alien was incarcerated, as determined by the chief executive officer of a State, or of a political subdivision of a State; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7ff20c9ac44847d98ab56cea75401182"><enum>(B)</enum><text display-inline="yes-display-inline">the cost of transporting the alien from the point of apprehension to the place of detention, and to the custody transfer point if the place of detention and the place of custody are different.</text></subparagraph></paragraph></subsection><subsection id="HE6609FC9CE5448788660FBED9A7867B7"><enum>(e)</enum><header>Secure facilities</header><text>The Secretary of Homeland Security shall ensure that aliens incarcerated in Federal facilities pursuant to this section are held in facilities that provide an appropriate level of security.</text></subsection><subsection id="H38BFF347132E4AC49A5E8D6EDBD94B45"><enum>(f)</enum><header>Transfer</header><paragraph id="HFE67F143717D4BA5B99E72510551B9F9"><enum>(1)</enum><header>In general</header><text>In carrying out this section, the Secretary of Homeland Security shall establish a regular circuit and schedule for the prompt transfer of apprehended aliens from the custody of States and political subdivisions of a State to Federal custody.</text></paragraph><paragraph id="HE56D1DD57F4C47B8A5D97E8BB455F7A2"><enum>(2)</enum><header>Contracts</header><text>The Secretary of Homeland Security may enter into contracts, including appropriate private contracts, to implement this subsection.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HE5C2540D52D8419BAC92D2DFBBE9E841"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) is amended by inserting after the item relating to section 240C the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H542AAA3A1B434131BD585049AC8BC92A"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 240D. Custody of aliens unlawfully present in the United States.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H20EFFC98C30A43E4946F40F4D19EA23F"><enum>(b)</enum><header>GAO audit</header><text>Not later than 3 years after the date of the enactment of this Act, the Comptroller General of the United States shall conduct an audit of compensation to States and political subdivisions of a State for the incarceration of aliens unlawfully present in the United States under section 240D of the Immigration and Nationality Act, as added by subsection (a)(1).</text></subsection></section><section id="HB9ADD14225F74FB399940FC2C9B26E69"><enum>10.</enum><header>Training of State and local law enforcement personnel relating to the enforcement of immigration laws</header><subsection id="HADF0ABAC81254812BBC1AFB5D53E38DE"><enum>(a)</enum><header>Establishment of training manual and pocket guide</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary shall develop—</text><paragraph id="H476AD7D00A8B484D9BAFF2EF1773B230"><enum>(1)</enum><text>a manual to train law enforcement personnel of a State, or of a political subdivision of a State, on the investigation, identification, apprehension, arrest, detention, and transfer to Federal custody of aliens unlawfully present in the United States (including the transportation of such aliens across State lines to detention centers and the identification of fraudulent documents); and</text></paragraph><paragraph id="H1A7D2A81240841B2BE84F64D14B2FDC7"><enum>(2)</enum><text>an immigration enforcement pocket guide for law enforcement personnel of a State, or of a political subdivision of a State, to provide a quick reference for such personnel in the course of carrying out their duties.</text></paragraph></subsection><subsection id="H40CBD508265441A686E28C5D615CA1C3"><enum>(b)</enum><header>Availability</header><text>The training manual and pocket guide developed pursuant to subsection (a) shall be made available to all State and local law enforcement personnel.</text></subsection><subsection id="H2C43FD1B177845A28BAF3FEEE07A2D7A"><enum>(c)</enum><header>Costs</header><text>The Secretary shall be responsible for any costs incurred in developing the training manual and pocket guide pursuant to subsection (a).</text></subsection><subsection id="HB4609A8D6B4445CD8F12BE5E0B2E7F8F"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to require State or local law enforcement personnel to carry the training manual or pocket guide with them while on duty. </text></subsection><subsection id="H24FB527554D44DB49E0E674565F3A634"><enum>(e)</enum><header>Training flexibility</header><paragraph id="HA1FB61A31D2B4443BD69C5388F4650AF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall make training of State and local law enforcement officers available through as many means as possible, including through—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb3305aa176a842f9a27dd9f7fc11805b"><enum>(A)</enum><text display-inline="yes-display-inline">residential training at the Center for Domestic Preparedness of the Federal Emergency Management Agency;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id67598375e3b841298e660f8e3939c88f"><enum>(B)</enum><text display-inline="yes-display-inline">onsite training held at State or local police agencies or facilities;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd0a784cca3c545858088a0184dbd108d"><enum>(C)</enum><text display-inline="yes-display-inline">online training courses by computer, teleconferencing, and videotape; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3dfd24a5bc024d96be2c9378bd170b5f"><enum>(D)</enum><text display-inline="yes-display-inline">training courses made available on DVD. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd44f0aed2bd14ef78cde0c6448fd1398"><enum>(2)</enum><header>E–learning</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Secretary shall ensure that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idcf95095bdfc4482dadc28df1b97a5f73"><enum>(A)</enum><text display-inline="yes-display-inline">an e-learning portal is made available through the Federal Law Enforcement Training Center's Distributed Learning Program to train State and local law enforcement officers through a secure, encrypted distributed learning system; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idebee11caaf4a4bd983a30da2911ee3a3"><enum>(B)</enum><text display-inline="yes-display-inline">the system described in subparagraph (A) is scalable and survivable and has all its servers based in the United States.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida8514d04908841b2b611e1ceb06db21f"><enum>(3)</enum><header>Priority</header><text display-inline="yes-display-inline">In carrying out this section, priority funding shall be given for existing web-based immigration enforcement training systems.</text></paragraph><paragraph id="H8BBB2865FF0E48C298AA2D456CC54BD9"><enum>(4)</enum><header>Federal personnel training</header><text>The training of State and local law enforcement personnel under this section shall not displace the training of Federal personnel.</text></paragraph><paragraph id="HC983BA297D244C9998F3679DF0150E5C"><enum>(5)</enum><header>Savings provision</header><text>Nothing in this Act or in any other provision of law may be construed as making any immigration-related training a requirement for, or prerequisite to, any State or local law enforcement officer assisting in the enforcement of Federal immigration laws in the normal course of carrying out the law enforcement duties of such officers.</text></paragraph></subsection></section><section id="H99CAC838BF5E4B6A922C4309DC94B39F"><enum>11.</enum><header>Immunity</header><subsection id="H088CD97E8C7E49C19D041E150CAA72AE"><enum>(a)</enum><header>Personal immunity</header><text>A law enforcement officer of a State or local law enforcement agency who is acting within the scope of the officer’s official duties shall be immune, to the same extent as a Federal law enforcement officer, from personal liability arising out of the performance of any duty described in this Act.</text></subsection><subsection id="HEB07C003791E449FBBDEBB221BFC180A"><enum>(b)</enum><header>Agency immunity</header><text>A State or local law enforcement agency shall be immune from any claim for money damages based on Federal, State, or local civil rights law for an incident arising out of the enforcement of any Federal immigration law, except to the extent a law enforcement officer of such agency committed a violation of Federal, State, or local criminal law in the course of enforcing such immigration law.</text></subsection></section><section id="H1DF5FF544B2741D89CFC9EF9BCB32957"><enum>12.</enum><header>Institutional Removal Program</header><subsection id="H12A3F4A79C3548948E632C0BBEB60DF9"><enum>(a)</enum><header>Continuation and expansion</header><paragraph id="HEF8DF7932BD64B7996605595641C9761"><enum>(1)</enum><header>In general</header><text>The Secretary shall continue to operate and implement the program known as the Institutional Removal Program, which—</text><subparagraph id="HD38E2F8438C8464D8F641F24F56689EB"><enum>(A)</enum><text>identifies removable criminal aliens in Federal and State correctional facilities;</text></subparagraph><subparagraph id="H9E01BB3A22FA4C58AE1FBCC2F6A30DDB"><enum>(B)</enum><text>ensures such aliens are not released into the community; and</text></subparagraph><subparagraph id="HB56CEBBF7DE84EBD9F22207BAAADE403"><enum>(C)</enum><text>removes such aliens from the United States after the completion of their respective sentences.</text></subparagraph></paragraph><paragraph id="HB833453F5878449F9C9576E3654D1124"><enum>(2)</enum><header>Expansion</header><text>The Institutional Removal Program shall be extended to all States. Any State that receives Federal funds for the incarceration of criminal aliens shall—</text><subparagraph id="HC70189C6F8FD4B7E96FE6DCDB3DCEC4C"><enum>(A)</enum><text>cooperate with officials of the Institutional Removal Program;</text></subparagraph><subparagraph id="HD5C2B11ED30247778DE599BB88DE1836"><enum>(B)</enum><text>expeditiously and systematically identify all criminal aliens in its prison and jail populations; and</text></subparagraph><subparagraph id="HF7E14160A9A14AD9A20A489B1270410A"><enum>(C)</enum><text>promptly convey such information to officials of the Institutional Removal Program as a condition of receiving such Federal funds.</text></subparagraph></paragraph></subsection><subsection id="H5E3F91F2FEEE409EA7F8C95283CB8A7A"><enum>(b)</enum><header>Authorization for detention after completion of State or local prison sentence</header><text>Law enforcement officers of a State, or of a political subdivision of a State, may—</text><paragraph id="H282CC0E87A3B4F51A4EFA439D4287A0C"><enum>(1)</enum><text>hold a criminal alien for a period of up to 14 days after the alien has completed the alien’s State prison sentence in order to effectuate the transfer of the alien to Federal custody when the alien is removable or not lawfully present in the United States; or</text></paragraph><paragraph id="H06B34171F991484F80C2F7CA7D983CB2"><enum>(2)</enum><text>issue a detainer that would allow aliens who have served a State prison sentence to be detained by the State prison until personnel from U.S. Immigration and Customs Enforcement can take such alien into custody.</text></paragraph></subsection><subsection id="HF4E1C255C7CF476AB88FCCDA5EC89ABF"><enum>(c)</enum><header>Technology usage</header><text>Technology, such as video conferencing, shall be used to the maximum extent practicable to make the Institutional Removal Program available in remote locations. Mobile access to Federal databases of aliens, such as IDENT, and live scan technology shall be used, to the maximum extent practicable, to make such resources available to State and local law enforcement agencies in remote locations.</text></subsection></section><section id="HB0AEBD33D9414B8A98EC99B4F29352B5"><enum>13.</enum><header>Authorization of appropriations</header><subsection commented="no" display-inline="no-display-inline" id="id2460cbf37b3e4fb4bb888632a3652451"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Department of Homeland Security, for fiscal year 2025, and for each subsequent fiscal year, such sums as may be necessary to carry out this Act. </text></subsection><subsection commented="no" id="H014AB5E25C1A4BC3B36D653F38A39988"><enum>(b)</enum><header>State Criminal Alien Assistance Program</header><text display-inline="yes-display-inline">Section 241(i)(5) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(i)(5)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2ECC317E77CF4BE8B2902D02C2496947"><paragraph commented="no" id="H5C46B3DBA0C34A079DC947BDAD5324FD"><enum>(5)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this subsection such sums as may be necessary for fiscal year 2025 and for each subsequent fiscal year.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H65981BC868264260AE37CECC761D263B"><enum>14.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or of any amendment made by this Act, or the application of such provision or amendment to any person or circumstance, is held to be invalid, the remainder of the provisions of this Act and of the amendments made by this Act, and the application of any such provision or amendment to other persons not similarly situated or to other circumstances, shall not be affected. </text></section></legis-body></bill>
