which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Homeland Security to enhance capabilities for outbound inspections at the southern land border, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id245631cd-3165-40a1-aaf8-9a658f3e726a" changed="not-changed"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enhancing Southbound Inspections to Combat Cartels Act</short-title></quote>.</text></section><section id="id8919aa53-74e0-48e5-bec8-877b81f5399d" changed="not-changed"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idaa4ea6a0-e9f6-4819-b806-6fcfc5907e9f" changed="not-changed"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="ide915f831-e9c3-4354-bb12-88031f6121d9" changed="not-changed"><enum>(A)</enum><text>the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name>;</text></subparagraph><subparagraph id="id7b8af0d3-6813-4016-a586-f1ccfb49f8d8" changed="not-changed"><enum>(B)</enum><text>the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>;</text></subparagraph><subparagraph id="id47677752-cfc2-4d62-930d-b2e3c2d69207" changed="not-changed"><enum>(C)</enum><text>the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>;</text></subparagraph><subparagraph id="id490f5f3c-da6c-4fcd-b04b-646423828243" changed="not-changed"><enum>(D)</enum><text>the <committee-name committee-id="">Committee on Appropriations of the House of Representatives</committee-name>;</text></subparagraph><subparagraph id="id76b067b4-1188-44b8-b5f0-9bd9394be12b" changed="not-changed"><enum>(E)</enum><text>the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>; and</text></subparagraph><subparagraph id="id9f220d18-6c67-4af7-be16-22c0867640e9" changed="not-changed"><enum>(F)</enum><text>the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>.</text></subparagraph></paragraph><paragraph id="idbd8ab6e8-bbc9-438e-9fc8-73828510763b" changed="not-changed"><enum>(2)</enum><header>Southern border</header><text>The term <term>Southern Border</term> means the international land border between the United States and Mexico.</text></paragraph></section><section id="id39ecb274-d035-48b5-aa6a-cd7cab163ecd" changed="not-changed"><enum>3.</enum><header>Additional inspection equipment and infrastructure</header><subsection commented="no" display-inline="no-display-inline" id="ida59d6ec9-4b2d-4e87-9285-202230f09891" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Imaging systems</header><text>The Commissioner of U.S. Customs and Border Protection is authorized—</text><paragraph commented="no" display-inline="no-display-inline" id="id0c310f3fd902448c9760df0d7b863081" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">to purchase up to 50 additional non-intrusive imaging systems; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id656281ba221349ad9bc09c6cb3492ec0" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">to procure additional associated supporting infrastructure.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id36f69d32e1ae4ce2a08ee9f7d187db0c" changed="not-changed"><enum>(b)</enum><header>Deployment</header><text display-inline="yes-display-inline">The systems and infrastructure purchased or otherwise procured pursuant to subsection (a) shall be deployed along the Southern Border for the primary purpose of inspecting any persons, conveyances, or modes of transportation traveling from the United States to Mexico.</text></subsection><subsection id="id392a7437-3d8d-4d0e-a923-e1c7ba6e6e5f" changed="not-changed"><enum>(c)</enum><header>Alternative equipment</header><text>The Commissioner of U.S. Customs and Border Protection is authorized to procure additional infrastructure or alternative inspection equipment that the Commissioner deems necessary for the purpose of inspecting any persons, conveyances, or modes of transportation traveling from the United States to Mexico.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idcde09aafb1674222b33a6557b15f67f2" changed="not-changed"><enum>(d)</enum><header>Sunset</header><text>Subsections (a) and (c) shall cease to have force and effect beginning on the date that is 5 years after the date of the enactment of this Act. </text></subsection></section><section commented="no" display-inline="no-display-inline" id="id079ff509-708d-48c0-802e-3e70da64fdf0" changed="not-changed"><enum>4.</enum><header display-inline="yes-display-inline">Additional Homeland Security Investigations personnel for investigations of southbound smuggling</header><subsection commented="no" display-inline="no-display-inline" id="id305bfa5c-0329-496d-8269-20ff6689348f" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">HSI special agents</header><text display-inline="yes-display-inline">The Director of U.S. Immigration and Customs Enforcement shall hire, train, and assign—</text><paragraph commented="no" display-inline="no-display-inline" id="idd7867c0dadda4692bf82d7074df0771b" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">not fewer than 100 new Homeland Security Investigations special agents to primarily assist with investigations involving the smuggling of currency and firearms from the United States to Mexico; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf35fc8fc99d5464da62f65539a5e3dc8" changed="not-changed"><enum>(2)</enum><text>not fewer than 100 new Homeland Security Investigations special agents to assist with investigations involving the smuggling of contraband, human trafficking and smuggling (including that of children), drug smuggling, and unauthorized entry into the United States from Mexico. </text></paragraph></subsection><subsection id="ideb672ddf-6788-4cab-98e7-1dba69be28a5" changed="not-changed"><enum>(b)</enum><header>Support staff</header><text>The Director is authorized to hire, train, and assign such additional support staff as may be necessary to support the functions carried out by the special agents hired pursuant to subsection (a).</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id442189e9-bb65-45e9-84d3-96960dcd6bd9" changed="not-changed"><enum>5.</enum><header display-inline="yes-display-inline">Report</header><subsection commented="no" display-inline="no-display-inline" id="idd8696776-5edd-4c73-a54e-b92e22c7bc62" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Homeland Security shall submit a report to the appropriate congressional committees that—</text><paragraph commented="no" display-inline="no-display-inline" id="id1be7aaa5-9916-4e3f-bfd4-d2733bf4b2e0" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">identifies the resources provided, including equipment, personnel, and infrastructure, and the annual budget to carry out outbound and inbound inspections, including, to the extent practicable, resources specifically used for inspections of any individuals and modes of transportation—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd7060b7e78d044c39df2d5636a2ac078" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">from the United States to Mexico or to Canada; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide88554391b454e90b8336456c69aea5b" changed="not-changed"><enum>(B)</enum><text>from Mexico or Canada into the United States;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5bd7130ea84147558c9e374bfb10dbc4" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">describes the operational cadence of all outbound and inbound inspections of individuals and conveyances traveling from the United States to Mexico or to Canada and from Mexico or Canada into the United States, described as a percentage of total encounters or as the total number of inspections conducted; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id786eb8bc-a1a7-46f6-99e9-4e37bd4fc34a" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">describes any plans that would allow for the use of alternative inspection sites near a port of entry; </text></paragraph><paragraph id="ide9acbd594097441a9199349c6356107f" changed="not-changed"><enum>(4)</enum><text>includes an estimate of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6264e82ff3f64154bb48bb90a116de9f" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the number of vehicles and conveyances that can be inspected with up to 50 additional non-intrusive imaging systems dedicated to southbound inspections; and</text></subparagraph><subparagraph id="ide6d9f5c5c2994568a838e29e99d8de77" changed="not-changed"><enum>(B)</enum><text>the number of vehicles and conveyances that can be inspected with up to 50 additional non-intrusive imaging systems that may be additionally dedicated to inbound inspections along the southwest border; and </text></subparagraph></paragraph><paragraph id="id8890e07f4c734240a905f10c928a6868" changed="not-changed"><enum>(5)</enum><text>assesses the capability of inbound inspections by authorities of the Government of Mexico, in cooperation with United States law enforcement agencies, to detect and interdict the flow of illicit weapons and currency being smuggled—</text><subparagraph commented="no" display-inline="no-display-inline" id="id14ce1f0f4d254bffa7a1bbe2bede7d86" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">from the United States to Mexico; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9429da83551748119384a5f0c5d2d52b" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">from Mexico into the United States. </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id479de955-050c-4819-b8d3-2b3a496dd694" changed="not-changed"><enum>(b)</enum><header>Classification</header><text display-inline="yes-display-inline">The report submitted pursuant to subsection (a), or any part of such report, may be classified or provided with other appropriate safeguards to prevent public dissemination. </text></subsection></section><section id="ida670b6ce-1335-4169-ac17-f9a1fc95e460" changed="not-changed"><enum>6.</enum><header>Minimum mandatory southbound inspection requirement</header><subsection commented="no" display-inline="no-display-inline" id="id424d678d-77a6-43ce-80c3-1c1add0ed5c5" changed="not-changed"><enum>(a)</enum><header>Requirement</header><text>Not later than March 30, 2027, the Secretary of Homeland Security shall ensure, to the extent practicable, that not fewer than 10 percent of all conveyances and other modes of transportation traveling from the United States to Mexico are inspected before leaving the United States.</text></subsection><subsection id="id3dc70275-92a7-46ed-930c-f37d799abbc2" changed="not-changed"><enum>(b)</enum><header>Authorized inspection activities</header><text>Inspections required under subsection (a) may include non-intrusive imaging, physical inspections by officers or canine units, or other means authorized by the Secretary of Homeland Security.</text></subsection><subsection id="idc7a3aa6c-1582-455a-87c0-976fccc23eb3" changed="not-changed"><enum>(c)</enum><header>Report on additional inspections capabilities</header><text>Not later than March 30, 2028, the Secretary of Homeland Security shall submit a report to the appropriate congressional committees that assesses the Department of Homeland Security’s timeline and resource requirements for increasing inspection rates to 15 and 20 percent, respectively, of all conveyances and modes of transportation traveling from the United States to Mexico.</text></subsection></section><section id="id4a95f5db-8ace-47ef-bfbc-f606bdca069e" changed="not-changed"><enum>7.</enum><header>Currency and firearms seizures quarterly report</header><subsection id="idb718cf27-6ee2-4930-b34f-ed0f7bdd186c" changed="not-changed"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, and every 90 days thereafter until the date that is 4 years after such date of enactment, the Commissioner for U.S. Customs and Border Protection shall submit a report to the appropriate congressional committees that describes the seizure of currency, firearms, and ammunition attempted to be trafficked out of the United States.</text></subsection><subsection id="ida6c32548-d493-40b9-8e3e-6ed7ba3d069f" changed="not-changed"><enum>(b)</enum><header>Contents</header><text>Each report submitted pursuant to subsection (a) shall include, for the most recent 90-day period for which such information is available—</text><paragraph id="id3c829b23-7bc1-4a82-88d3-ef9dcb2d582a" changed="not-changed"><enum>(1)</enum><text>the total number of currency seizures that occurred from outbound inspections at United States ports of entry;</text></paragraph><paragraph id="id50b74059-42b0-40e2-9516-db52ba26ec6f" changed="not-changed"><enum>(2)</enum><text>the total dollar amount associated with the currency seizures referred to in paragraph (1);</text></paragraph><paragraph id="ide7145d13-8f44-4f44-8239-6a762c4e0504" changed="not-changed"><enum>(3)</enum><text>the total number of firearms seized from outbound inspections at United States ports of entry;</text></paragraph><paragraph id="idb3c5843d-6f50-484f-9e45-fe80b33c6e85" changed="not-changed"><enum>(4)</enum><text>the total number of ammunition rounds seized from outbound inspections at United States ports of entry; and</text></paragraph><paragraph id="ida5cc7d83-72bd-4f9a-bd14-301cf2294586" changed="not-changed"><enum>(5)</enum><text>the total number of incidents of firearm seizures and ammunition seizures that occurred at United States ports of entry.</text></paragraph></subsection></section></legis-body></bill>
