which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to improve risk adjustment under Medicare Advantage.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Unreasonable Payments, Coding, Or Diagnoses for the Elderly Act</short-title></quote> or the <quote><short-title>No UPCODE Act</short-title></quote>.</text></section><section id="idB0E2332943BE49D6843C1C88E34ED647"><enum>2.</enum><header>Improving risk adjustment under Medicare Advantage</header><subsection id="idDC283A60A1B84E34A2BA21C9B77046AB"><enum>(a)</enum><header>Use of 2 years of diagnostic data</header><text>Section 1853(a)(3)(C)(iii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-23">42 U.S.C. 1395w–23(a)(3)(C)(iii)</external-xref>) is amended—</text><paragraph id="id41C626CE34134A558FC09070EE50D453"><enum>(1)</enum><text>by striking <quote><header-in-text level="clause" style="OLC">methodology</header-in-text>.—Such risk</quote> and inserting “<header-in-text level="clause" style="OLC">methodology</header-in-text>.—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDBDADEBC53334A8CA2F1EF82E9794B1A"><subclause id="idF2BEAE7DF5364B82BDEC4E0DCF07728A"><enum>(I)</enum><header>In general</header><text>Subject to subclause (II), such risk</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idBBFFED9100434087A5F9D9D75B46AEA5"><enum>(2)</enum><text>by adding at the end the following new subclauses:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2CE28C72665642DAACDD42CF44521986"><subclause id="idA65389B6A2364C578F2F2786FF28639D"><enum>(II)</enum><header>Use of health status data</header><text>For 2026 and each subsequent year, the Secretary shall use 2 years of diagnostic data (when available) under such risk adjustment methodology.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id9A5FF688F4084FEABA016042B8F60BA8"><enum>(b)</enum><header>Exclusion of diagnoses collected from chart reviews and health risk assessments</header><paragraph id="idBFA0E21E105E439AA7FF8997F23B1534"><enum>(1)</enum><header>In general</header><text>Section 1853(a)(1)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-23">42 U.S.C. 1395w–23(a)(1)(C)</external-xref>) is amended by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD15723139D50415580AEA309382C19E0"><clause id="idAF023996B8A2493D9CB66988251150CC"><enum>(iv)</enum><header>Exclusion of diagnoses collected from chart reviews and health risk assessments</header><subclause id="id7BAA67AA5E714D0FBDF1929E1EE8D167"><enum>(I)</enum><header>In general</header><text>For 2026 and each subsequent year, for purposes of establishing the payment adjustment factors and adjusting payment based on health status under clause (i), the Secretary shall not take into account a diagnosis collected from a chart review or a health risk assessment.</text></subclause><subclause commented="no" id="id27AFF1638DD5422B9CF11E4CD01F39D5"><enum>(II)</enum><header>Identification of diagnoses collected from chart reviews and health risk assessments</header><text>The Secretary shall establish procedures to provide for the identification and verification of diagnoses collected from chart reviews and health risk assessments.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id59F21E387C4D462794CCB8CD5B66FC51"><enum>(c)</enum><header>Application of coding adjustment</header><text>Section 1853(a)(1)(C)(ii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-23">42 U.S.C. 1395w–23(a)(1)(C)(ii)</external-xref>) is amended—</text><paragraph id="idB2DAF92936874078AC84943CA027E422"><enum>(1)</enum><text>in subclause (III), by striking <quote>In calculating</quote> and inserting <quote>Subject to subclause (V), in calculating</quote>; and</text></paragraph><paragraph id="idA2E9B9F3B782403FA44ED6E7EA1DCEF8"><enum>(2)</enum><text>by adding at the end the following new subclause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAE36F0BF1980438F9CD6D1D8984797F7"><subclause id="id9374B95738BD46B287DB8093ABEC1D26"><enum>(V)</enum><text>In calculating such adjustment for 2026 and each subsequent year, the Secretary shall evaluate the impact on risk scores for Medicare Advantage enrollees of differences in coding patterns between Medicare Advantage plans and providers under parts A and B and publicly report the results of such evaluation. The Secretary shall ensure that such adjustment, which may include adjustment on a plan or contract level, fully accounts for the impact of coding pattern differences not otherwise accounted for to the extent that the Secretary identifies such differences through annual evaluation.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
