<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 1100</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250325">March 25, 2025</action-date><action-desc><sponsor name-id="S348">Mr. Paul</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food and Nutrition Act to modify the definition of food under the supplemental nutrition assistance program, and for other purposes.</official-title></form><legis-body><section id="id1e21d784864a4b3baff63a0e31dd8eae" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nutritious SNAP Act of 2025</short-title></quote>.</text></section><section section-type="subsequent-section" id="idcac368bec85b43a3bb7c3a755e6b52a2"><enum>2.</enum><header>Definition of food; waiver of eligibility of certain food</header><subsection commented="no" display-inline="no-display-inline" id="idd9e538fc285f4237bc9e63bbb86cd3da"><enum>(a)</enum><header>Definition of food</header><text>Section 3(k) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012(k)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id49c90a61510b4fa1990434ef0fe0799f"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>home consumption</quote> and inserting <quote>home consumption, subject to section 11(y),</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id009ae68a622d4a1fbc75ed510143b2a5"><enum>(2)</enum><text>by inserting <quote>, any nonalcoholic beverage that is not water, cow's milk, a milk-substitute beverage (such as almond milk, soy milk, and coconut milk), or 100 percent juice, snack and dessert food items (as described in the supplemental guidance document of the Food and Nutrition Service, effective as of March 5, 2018, entitled <quote>Accessory Foods List</quote>),</quote> before <quote>tobacco</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idea69886425b64c66981557acd2550c4a"><enum>(b)</enum><header>Waiver of eligibility of certain food</header><text display-inline="yes-display-inline">Section 11 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA874FB64CC264EDEB3363E1F3168212B"><subsection commented="no" display-inline="no-display-inline" id="idc590d325b8ef4f49ab29ccd60ecd012e"><enum>(y)</enum><header>Waiver of eligibility of certain food</header><text>The Secretary shall permit a State agency, on request of the State agency, to prohibit the use of benefits to purchase food that the applicable State nutrition agency determines to be unhealthy food.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
