<section commented="no" display-inline="no-display-inline" section-type="section-one" id="S1"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Opioid Overdose Data Collection Enhancement Act</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idba4ff05b58d24559adea20fb5afd146e"><enum>2.</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to expand the adoption and implementation of, and provide interoperability of, data collection tools used to track fatal and nonfatal overdoses and opioid overdose reversal medication administration in near real-time through a web-based, mobile-friendly software platform.</text></section>
<section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id54d267825bb64edd85d70788ffc82ce0"><enum>3.</enum><header display-inline="yes-display-inline">Comprehensive opioid abuse grant program</header><text display-inline="no-display-inline">Section 3021 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10701">34 U.S.C. 10701</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="ida14b2fd4f3614315a43815357bc400ee"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id084559b80be54dd19bde770f364f4f86"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (G), by striking <quote>; and</quote> at the end;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id5b432ea92ca54beba210c89a6c4eb2dc"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (H), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idf0aefc61eb32420ea1b73cd3808d5989"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id10AF79E774C54DD18561822A58E612BE"> <subparagraph commented="no" display-inline="no-display-inline" id="id0fadb39531824b85aea48639bb072f82"><enum>(I)</enum><text display-inline="yes-display-inline">an overdose data collection program described in subsection (g)(1).</text></subparagraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idff1b3e7bdcb74760865a607f8c5a117e"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id745FA640EB1B47A29C514AA2A106EF86"> <subsection commented="no" display-inline="no-display-inline" id="id9be939b3f6eb4475bc69fcf81bb5676a"><enum>(g)</enum><header display-inline="yes-display-inline">Overdose data collection program</header> <paragraph commented="no" display-inline="no-display-inline" id="id4317ebab45d747cebdf0d886e5c6c0dc"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An overdose data collection program described in this paragraph is a program under which a State, unit of local government, coalition of law enforcement agencies, or Indian tribe develops and implements a data collection tool, including mobile data mapping applications, with which the State, unit of local government, coalition of law enforcement agencies, or Indian tribe can easily and quickly track the locations of—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id5eac5bc358164e8fad5f02532daafa7f"><enum>(A)</enum><text display-inline="yes-display-inline">suspected fatal and nonfatal overdoses; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idb457fac866524f48bcb78a0f0ce19565"><enum>(B)</enum><text display-inline="yes-display-inline">the administration of opioid overdose reversal medication by first responders, including law enforcement officers, firefighters, and emergency medical service technicians.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idD56D89FCACB44BC8A5FB2160B76F56D3"><enum>(2)</enum><header display-inline="yes-display-inline">Eligibility of coalitions</header>
<subparagraph commented="no" display-inline="no-display-inline" id="idCAEA02837DA4437BB33636255AF05AC3"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding subsection (a)(1), a coalition of law enforcement agencies shall be eligible to receive a grant under subsection (a) only for the purpose of implementing an overdose data collection program described in paragraph (1) of this subsection.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id61CEA530C5C34427BA294D90A61B147A"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">A coalition of law enforcement agencies seeking a grant under subsection (a) to implement an overdose data collection program described in paragraph (1) of this subsection shall be subject to the same requirements and authorizations to which a States, units of local government, and Indian tribes are subject under this section, including the requirement to submit an application under section 3022.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id959B277987754456A6CE5D4278D5ABA8"><enum>(3)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">A State, unit of local government, coalition of law enforcement agencies, or Indian tribe implementing an overdose data collection program described in paragraph (1) shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id7da04a4a4cf24134a4ed36af3f33d239"><enum>(A)</enum><text display-inline="yes-display-inline">support the development of coordinated public safety, behavioral health, and public health responses to the data collected by the tool described in paragraph (1); </text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idf65c4eee731a49b996e4b3c88b12795b"><enum>(B)</enum><text display-inline="yes-display-inline">focus on areas in which fatal and nonfatal overdoses occur and trends of concern;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id44d5b8f75fa44333a16be43c19470972"><enum>(C)</enum><text display-inline="yes-display-inline">provide for interoperability with existing Federal, State, local, and Tribal overdose data collection tools and overdose data collection tools of coalitions of law enforcement agencies; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id1A3F0B737F0146F996E947D27CFD83D5"><enum>(D)</enum><text display-inline="yes-display-inline">make data collected through the program available to Federal, State, Tribal, and territorial governments and coalitions of law enforcement agencies.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id0B1B6C550AD140EEB422DBEC6EB93D53"><enum>(4)</enum><header display-inline="yes-display-inline">Audit; application</header><text display-inline="yes-display-inline">A State, unit of local government, coalition of law enforcement agencies, or Indian tribe seeking to use a grant received under subsection (a) for a program described in paragraph (1) of this subsection shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="idB2BEA2B0B0584BBB801BCFC75EF4A69F"><enum>(A)</enum><text display-inline="yes-display-inline">conduct an audit of available data and resources; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id00C2C62C208743DD98EB83A889182383"><enum>(B)</enum><text display-inline="yes-display-inline">in order to avoid duplication, submit the audit conducted under subparagraph (A) as a part of the application for the grant of the State, unit of local government, coalition of law enforcement agencies, or Indian tribe.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id402B018F57634692AF815D778CCFC6E8"><enum>(5)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In carrying out this subsection, the Attorney General shall consult with the heads of agencies that maintain overdose data collection tools, including the Director of the Office of National Drug Control Policy.</text></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section> </legis-body> </bill>
