which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend section 2284 of title 28, United States Code, to establish special procedures for civil actions seeking to restrain executive branch actions. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restraining Judicial Insurrectionist Act of 2025</short-title></quote>.</text></section><section id="idac7645fdd04844ff91fc6c76a3bad077"><enum>2.</enum><header>Special procedures for civil actions seeking to restrain executive branch actions</header><text display-inline="no-display-inline">Section 2284 of title 28, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idaef8b3d3ebe54557987b73831c7491b7"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id446fa0d6b01543568554b993b20a6dbd"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote><header-in-text style="USC" level="subsection">In general</header-in-text>.—</quote> before <quote>A district court</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6233664a8be847d1b64849841dda3bbe"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>shall be convened when otherwise required</quote> and inserting the following: “shall be convened when—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAF1633B6E6114649A2A3B9778320CAC3"><paragraph commented="no" display-inline="no-display-inline" id="idac71daafab1e4a61a7ad64e0e1d55ab3"><enum>(1)</enum><text display-inline="yes-display-inline">otherwise required</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc5d5188e00794e9a894ebda55512ed43"><enum>(C)</enum><text>by striking <quote>Congress, or when an action</quote> and inserting the following: “Congress;</text><quoted-block style="OLC" display-inline="no-display-inline" id="id66252A2CC24045BBB02F20D88D365927"><paragraph commented="no" display-inline="no-display-inline" id="id62b4f02a2acf467e9301852f18591c70"><enum>(2)</enum><text>an action is commenced against any department or office of the executive branch that seeks declaratory relief, a temporary restraining order, a preliminary or permanent injunction, vacatur, a stay, or other equitable relief against an action of the executive branch or executive order of the President; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id82324dcf875c480abe4a06ec693bfa84"><enum>(3)</enum><text>an action</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfe53dc453d724da1a4f7a2e51e7b8f61"><enum>(2)</enum><text>in subsection (b), in the matter preceding paragraph (1), by striking <quote>In any action</quote> and inserting <quote><header-in-text style="USC" level="subsection">Procedures generally</header-in-text>.—Except as provided in subsection (c), in any action</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2d5a4d213f0b43258be9eb750fa5b414"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id154FD12AC8BD4032AC43036C4D6014D1"><subsection commented="no" display-inline="no-display-inline" id="idfc70411551aa4ea0a0579faec2666b94"><enum>(c)</enum><header>Procedures for actions seeking To restrain executive branch actions</header><paragraph id="id1ff6577685464ae6980ffdaa81a38b4b"><enum>(1)</enum><header>Selection of judges for a three-judge district court</header><subparagraph commented="no" display-inline="no-display-inline" id="ide8fdf418e2264df29bd236c11a697052"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Upon the filing of a request for three judges in an action described in subsection (a)(2), the judge to whom the request is made shall, unless the judge determines that three judges are not required, immediately notify the Chief Justice of the United States, who shall designate three judges at random from a list of all judges in active service regardless of circuit— </text><clause commented="no" display-inline="no-display-inline" id="id72ccd159bfde42c7a4e47a92e3e6da6a"><enum>(i)</enum><text display-inline="yes-display-inline">one of whom shall be a circuit judge in active service; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id16f0108b397e4e458e46cc76714c292b"><enum>(ii)</enum><text display-inline="yes-display-inline">not more than two of whom may be serving in the same judicial circuit.</text></clause></subparagraph><subparagraph id="id631a5868ab024a43b87801e6e18acfec"><enum>(B)</enum><header>Service by judge receiving request</header><text>The judge to whom a request described in subparagraph (A) was presented may serve as a member of the district court to hear and determine the action if—</text><clause commented="no" display-inline="no-display-inline" id="id4f553b9ccb444e99af52e3586bbac8ba"><enum>(i)</enum><text display-inline="yes-display-inline">the judge is selected to be a member at random in accordance with subparagraph (A); and </text></clause><clause commented="no" display-inline="no-display-inline" id="ida094860f4a274f52afa5cc9a44f27f8b"><enum>(ii)</enum><text display-inline="yes-display-inline">the judge is a district judge in active service.</text></clause></subparagraph></paragraph><paragraph id="id484051a8ef134b649384b14438bbe959"><enum>(2)</enum><header>Number of judges required to conduct proceedings</header><text>No temporary restraining order, stay, preliminary injunction, or other equitable relief may be granted in an action described in subsection (a)(2) unless a majority of the district court for the action orders that such relief be granted.</text></paragraph><paragraph id="idde4b5410121844449421d9738f90ac8b"><enum>(3)</enum><header>Appointments of masters</header><text>No single judge shall appoint a master, or order a reference to a magistrate judge, or hear and determine applications for preliminary or permanent relief in an action described in subsection (a)(2).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
