<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 108</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250116">January 16, 2025</action-date><action-desc><sponsor name-id="S420">Mr. Schmitt</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To make members of the Chinese Communist Party and their family members ineligible for F or J visas, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HBFCAF37BD2674BBD99A5298C7EC3DDCD"><section section-type="section-one" id="H65875041A8B14452B62F9455FF0DA30B"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Higher Education from the Chinese Communist Party Act of 2025</short-title></quote>.</text></section><section id="H45AEB85CF6494C5B9E13B42904BD13D2"><enum>2.</enum><header>Ineligibility for certain visas of members of the Chinese Communist Party</header><subsection id="H58E538093A234360BA05C96AE14E4DB1"><enum>(a)</enum><header>Grounds for exclusion</header><text display-inline="yes-display-inline">An alien may not be accorded status or receive a visa under subparagraph (F) or (J) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) if the alien is a person who is, as of the date of enactment of this Act or at any time thereafter—</text><paragraph id="H61C938B707E2420FB0D13644C8295C6C"><enum>(1)</enum><text>any member of the Chinese Communist Party, including such a member who has served on the National Congress of the Chinese Communist Party; or</text></paragraph><paragraph id="H706426337CD84B3DBA8AB381ABE3665D"><enum>(2)</enum><text>a family member of a person described in paragraph (1).</text></paragraph></subsection><subsection id="H6541F38C6F0143088FE64D1FF231B625"><enum>(b)</enum><header>Family member</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>family member</term> means, with respect to a person, that person’s spouse, child, parent, sibling, grandchild, niece, or nephew.</text></subsection><subsection id="HD80BCFD0C7F649299151F2AACA591660"><enum>(c)</enum><header>Exception To comply with United Nations Headquarters Agreement</header><text>Subsection (a) shall not apply to an individual if admitting the individual to the United States is necessary to permit the United States to comply with the Agreement between the United Nations and the United States of America regarding the Headquarters of the United Nations, signed June 26, 1947, and entered into force November 21, 1947, and other applicable international obligations.</text></subsection><subsection id="H6CE1421B282C431B889E6EF91E6851F0"><enum>(d)</enum><header>National security waiver</header><text display-inline="yes-display-inline">The President, or a designee of the President, may waive the application of subsection (a) if the President or such designee certifies in writing to the appropriate congressional committees that such waiver is in the national security interest of the United States.</text></subsection></section></legis-body></bill>
