<official-title>To amend the Clean Air Act to eliminate a waiver under that Act, to eliminate an authorization for States to use new motor vehicle emission and new motor vehicle engine emissions standards identical to standards adopted in California, and for other purposes.</official-title>

<section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop California from Advancing Regulatory Burden Act of 2025</short-title></quote> or the <quote><short-title>Stop CARB Act of 2025</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="idc6de8aca64cc47a5909a26ea08143f11"><enum>2.</enum><header>Repeal of waivers of State standards</header> <subsection commented="no" display-inline="no-display-inline" id="idcfd3d3a751e042648343e497fcc6e753"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 209 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7543">42 U.S.C. 7543</external-xref>) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="id16a9f4ed5e6349e3bbb2e7478d8c1821"><enum>(1)</enum><text>by striking subsection (b);</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="ideb0a83ed93cf439e874542a636e46100"><enum>(2)</enum><text>in subsection (c), by striking the last sentence;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id423ca4f77338431b9ce4d73a2487b7f6"><enum>(3)</enum><text>by redesignating subsections (c) and (d) as subsections (b) and (c), respectively; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id9f007a3659074241bed361a91754a94f"><enum>(4)</enum><text>by striking subsection (e) and inserting the following:</text>

<subsection id="id9AD2615FDBF645ACABF26D3794BC399F"><enum>(d)</enum><header>Prohibition on state standards for nonroad engines or vehicles</header><text>No State or any political subdivision thereof shall adopt or attempt to enforce any standard or other requirement that directly or indirectly relates to the control of emissions from nonroad engines or nonroad vehicles, including the following new nonroad engines or nonroad vehicles subject to regulation under this Act:</text> <paragraph commented="no" display-inline="no-display-inline" id="id669d11bd729948b89750c8a6917e11fa"><enum>(1)</enum><text display-inline="yes-display-inline">New engines that are used in construction equipment, construction vehicles, farm equipment, or farm vehicles.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id2cf5dad8ce9243e2923d5ba51efdb6ce"><enum>(2)</enum><text display-inline="yes-display-inline">New locomotives or new engines used in locomotives.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="id2d82d4c86f00480b9a3a738757d264b4"><enum>(b)</enum><header>Effect</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, as of the date of enactment of this Act—</text>
<paragraph commented="no" display-inline="no-display-inline" id="idbf858ec73d2849b7814c5a83e5481f66"><enum>(1)</enum><text display-inline="yes-display-inline">no waiver issued under subsection (b) of section 209 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7543">42 U.S.C. 7543</external-xref>) (as in effect on the day before the date of enactment of this Act) before the date of enactment of this Act shall have any force or effect; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id97c604ba85754b7889e5bc468d05e3be"><enum>(2)</enum><text>any application for a waiver under that subsection (as in effect on the day before the date of enactment of this Act) pending before the Administrator of the Environmental Protection Agency on the date of enactment of this Act shall be considered denied. </text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id8c14f768a3154c0d9137a0b2e1d78c79"><enum>(c)</enum><header>Conforming amendments</header>
<paragraph commented="no" display-inline="no-display-inline" id="ide27e9b01fe0a4a2dae663bf5e369bacc"><enum>(1)</enum><text>Section 202(i)(2)(A) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7521">42 U.S.C. 7521(i)(2)(A)</external-xref>) is amended, in the matter preceding clause (i), in the first sentence, by striking <quote>, taking into consideration the waiver provisions of section 209(b)</quote>.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idd5b9d698fb144d0f8eaf6e49e1bd93e5"><enum>(2)</enum><text>Section 211 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545</external-xref>) is amended—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ida55817743ce045869f4cd89249302f17"><enum>(A)</enum><text>in subsection (c)(4)—</text> <clause commented="no" display-inline="no-display-inline" id="idebac3759b263440aa59a230332f5f02a"><enum>(i)</enum><text>in subparagraph (A), in the matter preceding clause (i), by striking <quote>or (C)</quote>;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="id44ba0f8c5c8345439bd33f58824904ab"><enum>(ii)</enum><text>by striking subparagraph (B); and</text></clause> <clause id="id4721a658fcbd4b4b95c5d7dff6d2d909"><enum>(iii)</enum><text>by redesignating subparagraph (C) as subparagraph (B); </text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id77b3b5159e814591a1d99b5d0b755f1d"><enum>(B)</enum><text>in subsection (k)(1)(B)(ii), by striking <quote>(other than a refiner or importer in a State that has received a waiver under section 209(b) with respect to gasoline produced for use in that State)</quote>; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idaff250cd198f412db6a4a05c8a400484"><enum>(C)</enum><text>in subsection (o)(6)—</text>
<clause commented="no" display-inline="no-display-inline" id="idf8cdf489715e4a2292a856efdebecd26"><enum>(i)</enum><text>by striking subparagraph (E);</text></clause> <clause commented="no" display-inline="no-display-inline" id="idc86fc26bf28849e5b49bc3c17e05fa70"><enum>(ii)</enum><text>in subparagraph (F), by striking <quote>any State that has received a waiver under section 209(b) or</quote>; and</text></clause>
<clause id="id78ae709c529243909c60503a463f5334"><enum>(iii)</enum><text>by redesignating subparagraph (F) as subparagraph (E).</text></clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id56fb5db5daab4ab3986cc4f9d6a5a7c7"><enum>(3)</enum><text>Section 241(2) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7581">42 U.S.C. 7581(2)</external-xref>) is amended, in the second sentence, by striking <quote>(or any CARB</quote> and all that follows through <quote>section 243(e))</quote>.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id578bb0752d1d4e309744805db1f65df7"><enum>(4)</enum><text display-inline="yes-display-inline">Section 242(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7582">42 U.S.C. 7582(b)</external-xref>) is amended by striking <quote>except as provided in section 244 with respect to administration and enforcement, and</quote> each place it appears.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id86ba82076fed490b8c4a59b745430d18"><enum>(5)</enum><text>Section 243 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7583">42 U.S.C. 7583</external-xref>) is amended by striking subsections (e), (f), and (g).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id3cd8b0e71b444da1a38e0b88804edb34"><enum>(6)</enum><text>Section 244 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7584">42 U.S.C. 7584</external-xref>) is repealed.</text></paragraph> <paragraph commented="no" id="ida854642ad4814cfb8f9df2c4318af9fe"><enum>(7)</enum><text>Section 247(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7587">42 U.S.C. 7587(b)</external-xref>) is amended, in the second sentence, by striking <quote>section 242, 243, 244,</quote> and inserting <quote>sections 242, 243,</quote>.</text></paragraph></subsection></section>
<section id="id2c97e2f2bc6c47999683faf8ebcdefda"><enum>3.</enum><header>Repeal of authorization to use California new motor vehicle emission standards</header>
<subsection commented="no" display-inline="no-display-inline" id="idf56bd6b924be4e18a4948c64dfc54b7c"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 177 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7507">42 U.S.C. 7507</external-xref>) is repealed.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="id6251c061ddaa418091f61726e95704b2"><enum>(b)</enum><header>Conforming amendment</header><text>Section 249(e)(3) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7589">42 U.S.C. 7589(e)(3)</external-xref>) is amended by striking the second sentence.</text></subsection></section>
