<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 1055</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250313">March 13, 2025</action-date><action-desc><sponsor name-id="S381">Mr. Rounds</sponsor> (for himself and <cosponsor name-id="S385">Ms. Cortez Masto</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Indian Health Care Improvement Act to modify the notification requirement for emergency contract health services for certain beneficiaries, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Indian Health Service Emergency Claims Parity Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id27cd606bd9564625b83ff4e7f0eea605"><enum>2.</enum><header>Authorization for emergency contract health services</header><text display-inline="no-display-inline">Section 406 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1646">25 U.S.C. 1646</external-xref>) is amended—</text><paragraph id="idd90fb17f2ea14fb1bdf5237202d1276d"><enum>(1)</enum><text>by striking <quote>With respect to</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2882704FE0E643C0954280A46096BCE1"><subsection commented="no" display-inline="no-display-inline" id="id105e8e511e1a4de881ed4219ee1bdee6"><enum>(b)</enum><header>Elderly or disabled Indians</header><text>With respect to</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id747002d637a34f5cb64619e5a3fb4cbd"><enum>(2)</enum><text>by inserting before subsection (b) (as so designated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id13D5A30484AB4AFFBFAC822EBDBB0F8B"><subsection commented="no" display-inline="no-display-inline" id="id4658d308990443d783eeec88daf12adc"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (b), with respect to an Indian receiving emergency medical care or services from a non-Service provider or in a non-Service facility under the authority of this Act, the time limitation (as a condition of payment) for notifying the Service of such treatment or admission shall be 15 days.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
