which was referred to the <committee-name committee-id="HRU00">Committee on Rules</committee-name></action-desc></action><legis-type>RESOLUTION</legis-type><official-title display="yes">Amending the Rules of the House of Representatives to require employees of the House to be subject to criminal background checks conducted by the United States Capitol Police, and for other purposes.</official-title></form><resolution-body style="OLC" id="H805D4F49F9C04A2695A81B0AB427EB1D"><section display-inline="no-display-inline" section-type="section-one" id="H50B3DA102077435694E12151FC24C1D5"><enum>1.</enum><header>Background checks for House employees</header><subsection id="H1FB03E4E77C4423E8C8A9810FFD34C2C"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Rule XXV of the Rules of the House of Representatives is amended by adding at the end the following new clause:</text><quoted-block style="OLC" id="HFA7D109618E64A19BBF6B08572EFDE61" display-inline="no-display-inline"><rules-clause id="H17F04067B21740C0A2E1A87F807BCFF3"><enum>9.</enum><paragraph id="H663CDB289D2842EA91BF02BBE9384573" display-inline="yes-display-inline"><enum>(a)</enum><text>During each Congress, an employee of the House shall undergo a criminal background check conducted by the United States Capitol Police—</text><subparagraph id="H3BE8161C13BE4044812A6F90047F2668" indent="up1"><enum>(1)</enum><text>in the case of an employee who is employed by an office of the House on the first day of the Congress, not later than 30 days after the first day of the Congress; and</text></subparagraph><subparagraph id="H29A4D1F0C4AC4EC9BFA10C84AD616253" indent="up1"><enum>(2)</enum><text>in the case of an employee who begins service as an employee of the House after the first day of the Congress, not later than 30 days after the employee begins service.</text></subparagraph></paragraph><paragraph id="H99604A85911F49F1A7AB03BF12D55C1E" indent="up1"><enum>(b)</enum><text>The results of a criminal background check conducted under this clause shall not be disclosed to any person other than the head of the office in which the employee is employed.</text></paragraph><paragraph id="H37C00523539D4CBFAA51F1223D80A470" indent="up1"><enum>(c)</enum><text>The Chief Administrative Officer shall enter into such agreements with the United States Capitol Police as the Chief Administrative Officer determines to be appropriate to carry out this clause.</text></paragraph></rules-clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HFE353F6CD3CE422083FC160C240A1406"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply with respect to the One Hundred Nineteenth Congress and each succeeding Congress.</text></subsection></section><section id="HBCEDA82692834A98ABD72DCFC0B72F8B"><enum>2.</enum><header>Report on payments from foreign governments</header><subsection id="HF15F91BBB3DC46FFA0E1269AA694DDE0"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Rule XXV of the Rules of the House of Representatives, as amended by section 1, is amended by adding at the end the following new clause:</text><quoted-block style="OLC" id="H1FC3A2D3A8904067AD89C0F8672DD815" display-inline="no-display-inline"><rules-clause id="H327C7C78069242D485726A9D4EB08A1E"><enum>10.</enum><paragraph id="HD6F8C60C7FB248C9BBDC68A4628F8E5A" display-inline="yes-display-inline"><enum>(a)</enum></paragraph><paragraph commented="no" display-inline="yes-display-inline" id="HD32C923753D141ABBAA5D8A1B8F5D977"><enum>(1)</enum><text display-inline="yes-display-inline">If an employee of the House received any payment from, or entered into any contract or agreement with, a government of a foreign country during the 3-year period preceding the date on which the employee begins service as an employee of the House, the employee shall file with the Clerk a report containing a description of the payment, contract, or agreement, including the identification of such government.</text><subparagraph id="HC99C761B8AAB4F2484FA396B46682A81" indent="up2"><enum>(2)</enum><text display-inline="yes-display-inline">If an employee of the House is a citizen or national of a foreign country, the employee shall file with the Clerk a statement describing the employee’s status as such a citizen or national, including the identification of the foreign country.</text></subparagraph></paragraph><paragraph id="H8BD0FDB007BE4D18804CE9023E34A0A8" indent="up1"><enum>(b)</enum><text display-inline="yes-display-inline">An individual who is required to file a report under this clause shall file the report not later than 30 days after an individual begins service as an employee of the House.</text></paragraph><paragraph id="H514BD5514D7A40319764517F858FBD57" indent="up1"><enum>(c)</enum><text>Upon receipt of a report filed under this clause, the Clerk shall post the report on the public website of the Office of the Clerk.</text></paragraph><paragraph id="H3DE8B3E7D91845FF8290D773DEA08E16" indent="up1"><enum>(d)</enum><text>In this clause, the term <term>government of a foreign country</term> has the meaning given such term in section 1(e) of the Foreign Agent Registration Act of 1938, as Amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611(e)</external-xref>).</text></paragraph></rules-clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE05DE9BF6BD144F4B1F2D5331FE6B0DE"><enum>(b)</enum><header>Requirement for current employees</header><text>An individual serving as an employee of the House of Representatives on the date of the adoption of this resolution who is required to file a report with the Clerk of the House under clause 10 of rule XXV of the Rules of the House of Representatives, as added by subsection (a), shall file the report not later than 30 days after the date of the adoption of this resolution.</text></subsection></section></resolution-body></resolution>
