which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>RESOLUTION</legis-type><official-title display="yes">Establishing a <quote>Bill of Rights</quote> to support United States law enforcement personnel nationwide in their work to protect our communities.</official-title></form><preamble><whereas><text>Whereas calls to <quote>defund</quote>, <quote>disband</quote>, <quote>dismantle</quote>, or <quote>abolish</quote> the police should be condemned and rule of law should be strictly maintained;</text></whereas><whereas><text>Whereas law enforcement officers take an oath to never betray the public trust;</text></whereas><whereas><text>Whereas in the course of investigations into officers who have allegedly exhibited misconduct, law enforcement should have certain rights to ensure a fair administration of justice, including—</text><paragraph id="H217CC8F2B2DD49098BF1889298462635"><enum>(1)</enum><text>a law enforcement officer’s inherent right to self-defense against physical threats;</text></paragraph><paragraph id="H95EE63A3DFEB46BB99FF6A74B646F6E1"><enum>(2)</enum><text>a law enforcement officer’s right to legal recourse if a civilian attempts to assault the law enforcement officer;</text></paragraph><paragraph id="HE218969D2FB140D3B5BCD63FF3F982B1"><enum>(3)</enum><text>a law enforcement officer’s right to be protected from physical harassment targeting a law enforcement officer;</text></paragraph><paragraph id="H537A5814DE234C03A2556089A3E7A1E7"><enum>(4)</enum><text>a law enforcement officer’s right to equipment necessary for personal protection;</text></paragraph><paragraph id="H491D508EF1DA403F87F1E594E6677D2A"><enum>(5)</enum><text>a law enforcement officer’s right to counsel and a union representative present at any interview conducted as part of an investigation;</text></paragraph><paragraph id="H626CC963ACE64D7797430EF2B3494907"><enum>(6)</enum><text>a law enforcement officer’s right to be informed of the nature of the investigation before any interview commences, including the name of the complainant and sufficient information to reasonably apprise the officer of the allegations;</text></paragraph><paragraph id="H1702394F40A448739B61D9995530F1F1"><enum>(7)</enum><text>during questioning in the course of an investigation a law enforcement officer’s right—</text><subparagraph id="H0035A1E390F74B90BD7638DCBFC6B90B"><enum>(A)</enum><text>to not be subjected to any offensive language;</text></subparagraph><subparagraph id="H9C3B110574544E5394E306290DF72A07"><enum>(B)</enum><text>to not be threatened with departmental, civil, or criminal charges; and</text></subparagraph><subparagraph id="HF0CF4F059D834CA2936FB6F8958521C0"><enum>(C)</enum><text>to not receive financial or promotional inducement;</text></subparagraph></paragraph><paragraph id="HB0121A389A944D6DBB90551957B69C5A"><enum>(8)</enum><text>a law enforcement officer’s right to a hearing, with notification in advance of the date, access to transcripts, other relevant documents, and evidence;</text></paragraph><paragraph id="H294D681E18174618B1B64686D3CAA351"><enum>(9)</enum><text>a law enforcement officer’s right to have the opportunity to respond to adverse accusations; and</text></paragraph><paragraph id="H8A33B8300890498FA4BE48FDFCFE386F"><enum>(10)</enum><text>a law enforcement officer’s right to not be disciplined for exercising a Fifth Amendment right to remain silent unless granted immunity that such statements will not be used against the officer in any criminal proceeding;</text></paragraph></whereas><whereas><text>Whereas in order to ensure these investigations are conducted in a manner that protects the public, respects the rights of law enforcement personnel, and is conducive to good order and discipline;</text></whereas><whereas><text>Whereas States across the country are encouraged to adopt a <quote>Bill of Rights</quote> for law enforcement personnel for protections related to investigation and prosecution arising from conduct during official performance of duties;</text></whereas><whereas><text>Whereas the law enforcement community protects our streets, acknowledges the rights of all Americans, and keeps citizens safe from harm;</text></whereas><whereas><text>Whereas law enforcement officers are recognized for their public service to all, knowing they face extremely dangerous situations while carrying out their duties; and</text></whereas><whereas><text>Whereas a healthy and collaborative relationship between law enforcement officers and the communities they serve is essential to creating mutually respectful dialogue: Now, therefore, be it</text></whereas></preamble><resolution-body style="traditional" id="HC7BF3F4EB5C7493996FFC7E6B65B702F"><section display-inline="yes-display-inline" section-type="undesignated-section" id="H8694FFE440084B6886E3218A9EE1046F"><enum/><text>That the House of Representatives—</text><paragraph id="HA617D1FFE4E34201B99BEF4180A43AEC"><enum>(1)</enum><text>recognizes all law enforcement agencies and officers for their tireless work to protect us and make our communities safer;</text></paragraph><paragraph id="HAE2E8B44EF4D4900B5DEF115F38768B7"><enum>(2)</enum><text>condemns calls to <quote>defund</quote>, <quote>disband</quote>, <quote>dismantle</quote>, or <quote>abolish</quote> the police;</text></paragraph><paragraph id="H1B3914246D5446C9ADEA95A5C194442A"><enum>(3)</enum><text>encourages dialogue between law enforcement and their respective communities to improve public safety, and engage all of society’s stakeholders; and</text></paragraph><paragraph id="H683E41F37D8545128A0914EFAA0C574D"><enum>(4)</enum><text>respects the rights of police officers to carry out their duties to protect our communities with integrity and have essential protections during the course of investigations.</text></paragraph></section></resolution-body></resolution>
