which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the importation, sale, manufacture, transfer, or possession of .50 caliber rifles, and for other purposes.</official-title></form><legis-body id="HA88DAB82C6AE46338B5D915C913FCE73" style="OLC"><section section-type="section-one" id="HE70112DDD2F94D23B824C39633C9C746"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Arming Cartels Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="HB0B9762FE4854F22ACAEC0CE0BADE8EE"><enum>2.</enum><header>Prohibition on rifles capable of firing .50 caliber ammunition</header><subsection commented="no" display-inline="no-display-inline" id="H2D9CBDEEBE7E4F27B534247D3A6FC764"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="HCA107254C9C04F86B2FA251219726E53"><enum>(1)</enum><text display-inline="yes-display-inline">in section 922, by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC7755556C3BF4E189A8F1097A092FC19"><subsection id="H9A581ED8D0AD4DF4BD51B3E6818437C9"><enum>(aa)</enum><header>Rifles capable of firing .50 caliber ammunition</header><paragraph commented="no" display-inline="no-display-inline" id="H083370D2ABD2480F816F3824FC401D49"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Except as provided in paragraph (2), it shall be unlawful for any person to import, sell, manufacture, transfer, or possess, in or affecting interstate or foreign commerce, a rifle capable of firing .50 caliber ammunition.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9EFF95372C5C47FF8412B10F745FC475"><enum>(2)</enum><header>Exceptions</header><subparagraph commented="no" display-inline="no-display-inline" id="H05A3B5D46282405F816D579186A49EA7"><enum>(A)</enum><header display-inline="yes-display-inline">Government use</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply to the importation for, manufacture for, sale to, transfer to, or possession by the United States, a department or agency of the United States, a State, or a department, agency, or political subdivision of a State, of a rifle capable of firing .50 caliber ammunition.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H02FFEEEA6E354CD6A73E9F4ECFDF5A50"><enum>(B)</enum><header>Grandfathered rifles</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply to the sale, transfer, or possession of any rifle otherwise lawfully possessed on or before the date of enactment of the <short-title>Stop Arming Cartels Act of 2025</short-title>.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCEC1EFC2C642414CBEED679BAE85CE8C"><enum>(2)</enum><text>in section 924(a)(1)(B), by striking <quote>or (q)</quote> and inserting <quote>(q), or (aa)</quote>.</text></paragraph></subsection><subsection id="H0C82A6C686AE48818971D7C4750EB72B"><enum>(b)</enum><header>Inclusion of certain rifles as firearms under National Firearms Act</header><paragraph commented="no" display-inline="no-display-inline" id="HBC583EA9F6954610B554086F7A0CD35A"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/5845">Section 5845(a)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>and (8) a destructive device</quote> and inserting <quote>(8) a destructive device; and (9) a rifle which is capable of firing .50 caliber ammunition and is lawfully possessed on or before the date of enactment of the <short-title>Stop Arming Cartels Act of 2025</short-title></quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF3774E43F4CA4AF7BD4681F107315A1C"><enum>(2)</enum><header>Effective date</header><subparagraph commented="no" display-inline="no-display-inline" id="H48CF2E6002174B73A4E3B828455525AB"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the amendments made by this subsection shall take effect on the date which is 12 months after the date of enactment of this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HADF4C2FCB9B24894885C4B134CE81BA1"><enum>(B)</enum><header>Registration</header><clause commented="no" display-inline="no-display-inline" id="H9C68DDF504684989BD548E6A63CDB574"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A) or any other provision of law, any person possessing a rifle which is capable of firing .50 caliber ammunition which is not registered to such person in the National Firearms Registration and Transfer Record shall register each such rifle so possessed with the Secretary in such form and manner as the Secretary may require within the 12-month period immediately following the date of enactment of this Act. No fee or tax shall be imposed with respect to any registration required under this subparagraph.</text></clause><clause commented="no" display-inline="no-display-inline" id="H6010FDA4085C4758805B27A8A4B02DEF"><enum>(ii)</enum><header>Inclusion in registry</header><text display-inline="yes-display-inline">Any registration described in clause (i) shall become a part of the National Firearms Registration and Transfer Record. No information or evidence required to be submitted or retained by a natural person to register a firearm under this subparagraph shall be used, directly or indirectly, as evidence against such person in any criminal proceeding with respect to a prior or concurrent violation of law.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBAC6A9E307E64D7BAA21262899679E93"><enum>(C)</enum><header>Definitions</header><text>In this paragraph:</text><clause commented="no" display-inline="no-display-inline" id="HC2D862B0FEC54C5DA5659223CD853B3C"><enum>(i)</enum><header display-inline="yes-display-inline">National Firearms Registration and Transfer Record</header><text>The term <term>National Firearms Registration and Transfer Record</term> means the registry established pursuant to <external-xref legal-doc="usc" parsable-cite="usc/26/5841">section 5841</external-xref> of the Internal Revenue Code of 1986.</text></clause><clause commented="no" display-inline="no-display-inline" id="H33C80C30CC9B47579786BA3A7C2BE744"><enum>(ii)</enum><header display-inline="yes-display-inline">Secretary</header><text>The term <term>Secretary</term> has the same meaning given such term under <external-xref legal-doc="usc" parsable-cite="usc/26/7701">section 7701(a)(11)(B)</external-xref> of the Internal Revenue Code of 1986.</text></clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HFE4C9999A87543C3923EB2A817810EF1"><enum>3.</enum><header>Exception to coverage under Protection of Lawful Commerce in Arms Act</header><text display-inline="no-display-inline">Section 4(5)(A) of the Protection of Lawful Commerce in Arms Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7903">15 U.S.C. 7903(5)(A)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H5987D664FE4246F580484C87BC3F920B"><enum>(1)</enum><text>in clause (v), by striking <quote>or</quote> at the end;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA6E25B3D359C43529A9B085858992DA4"><enum>(2)</enum><text>in clause (vi), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFA3C3AF354574370B10F2F91A678A245"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H464CFC561D754A35BECB9B75ECB96263"><clause id="H2AA220EF197948E2A766C6E4DA1976F3"><enum>(vii)</enum><text>an action brought against a manufacturer or seller that knowingly sells or transfers a qualified product, or attempts or conspires to do so, knowing or having reasonable cause to believe that the transaction is prohibited under section 805(c) of the Foreign Narcotics Kingpin Designation Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1904">21 U.S.C. 1904(c)</external-xref>).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="H4FC92B9DE32D47F98D26E698D517213B"><enum>4.</enum><header>Federal firearm prohibitor for significant foreign narcotics traffickers and certain other foreign persons</header><subsection commented="no" display-inline="no-display-inline" id="H74B7A74E1D724C42BDAD5D7955B01FD6"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 922(d) of title 18, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H3276D2E040F74A6FB90BB2398668DF4F"><enum>(1)</enum><text>in paragraph (10), by striking <quote>or</quote> at the end;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7CE7A23B7F484C46AF4E3900F529CCFF"><enum>(2)</enum><text>by redesignating paragraph (11) as paragraph (12);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6553EE8ECAE14F978F1BA3913C20B262"><enum>(3)</enum><text>by inserting after paragraph (10) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H473A3078C71E4A52B2313AEA0775A446"><paragraph id="H7EB14DD48EAC4A1288BC3587D50CCA2B"><enum>(11)</enum><text>is—</text><subparagraph commented="no" display-inline="no-display-inline" id="HEF41A50928774AEDBDCB2B30438D9A38"><enum>(A)</enum><text display-inline="yes-display-inline">a significant foreign narcotics trafficker publicly identified by the President in a report under subsection (b) or (h)(1) of section 804 of the Foreign Narcotics Kingpin Designation Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1903">21 U.S.C. 1903</external-xref>); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9450E000A40B40369F076262711F4FB0"><enum>(B)</enum><text display-inline="yes-display-inline">a foreign person designated by the Secretary of the Treasury under section 805(b) of the Foreign Narcotics Kingpin Designation Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1904">21 U.S.C. 1904(b)</external-xref>); or</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2BF9A7A70F3A46D19BE07A8C5EE2C749"><enum>(4)</enum><text>in paragraph (12), as so redesignated, by striking <quote>(10)</quote> and inserting <quote>(11)</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H170AA9BFAFFF4DE3BD0D349565B45733"><enum>(b)</enum><header>Conforming amendments relating to NICS</header><text>Section 103 of the Brady Handgun Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/34/40901">34 U.S.C. 40901</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H69D9BBCDBCE748DCBDEB3742BCD278AB"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(2)(D), by inserting <quote>or that transfer of a firearm or ammunition to the individual would violate subsection (d)(11) of such section 922</quote> after <quote>section 922 of title 18, United States Code,</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H258EB62307DE48D9A259D0925FB893DE"><enum>(2)</enum><text>in subsection (e)(1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="HB812A123F33140ABA8E2F3EB465BD5C1"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting <quote>or to whom transfer of a firearm would violate subsection (d)(11) of such section 922,</quote> after <quote>section 922 of title 18, United States Code or State law,</quote>;</text></subparagraph><subparagraph id="H0A96F31498A24476A984000FD85C98A3"><enum>(B)</enum><text>in subparagraph (C), by inserting <quote>or that transfer of a firearm or ammunition to the person would violate subsection (d)(11) of such section 922,</quote> after <quote>section 922 of title 18, United States Code,</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDBEBA7965B604BD4A5091A7E36D9077E"><enum>(C)</enum><text>in subparagraph (F)(iii)(I), by striking <quote>(g) or (n)</quote> and inserting <quote>(d)(11), (g), or (n)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H229F57EE0EBC42D2B2F842311752FCA3"><enum>(D)</enum><text>in subparagraph (G)(i), by striking <quote>(g) or (n)</quote> and inserting <quote>(d)(11), (g), or (n)</quote>;</text></subparagraph></paragraph><paragraph id="HB501CD2386D540FA9A87E7D7AE01441F"><enum>(3)</enum><text>in subsection (g), by inserting <quote>or that transfer of a firearm to a prospective transferee would violate subsection (d)(11) of such section 922,</quote> after <quote>section 922 of title 18, United States Code or State law,</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2E20BDB432FF462BA62E6F51CEAE74AC"><enum>(4)</enum><text>in subsection (i)(2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H5C35D29D4C7A4EB7898B871D4FE8D6E3"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>persons,</quote> and inserting <quote>persons who are</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2826FC9D27D94109B34767783AE5D4F7"><enum>(B)</enum><text>by inserting before the period at the end the following: <quote>, or to whom transfer of a firearm would violate subsection (d)(11) of such section 922</quote>.</text></subparagraph></paragraph></subsection></section><section id="H7C725DF9DB4B4C9396D1FFA1B030985D"><enum>5.</enum><header>Adding rifles to multiple firearm sales reporting requirements</header><text display-inline="no-display-inline">Section 923(g)(3)(A) of title 18, United States Code, is amended by striking <quote>pistols, or revolvers, or any combination of pistols and revolvers</quote> and inserting <quote>pistols, revolvers, or rifles, or any combination of pistols, revolvers, and rifles</quote>.</text></section></legis-body></bill>
